which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Land Between the Lakes Protection Act of 1998 to clarify the administration of the Land Between the Lakes National Recreation Area, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HACCF8C40FD05487890DABB0656204475"><section section-type="section-one" id="H94C7AEA123DC4183A0CE6C37F809ECAB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Land Between the Lakes Recreation and Heritage Act</short-title></quote> or the <quote><short-title>LBL Recreation and Heritage Act</short-title></quote>. </text></section><section id="H4EEC99CE305841609922E8B0F7C0A30E"><enum>2.</enum><header>Administration of the Land Between the Lakes National Recreation Area</header><subsection id="HE16441A7E70C4144B7140F80661C74CF"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 502 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>) is amended—</text><paragraph id="H5076B49DA8AD42D69EDF391185B0FCBA"><enum>(1)</enum><text>in paragraph (5)(B)—</text><subparagraph id="HD86530A540BB4E0EA3EA93A6517AA47F"><enum>(A)</enum><text>in clause (viii), by striking <quote>and</quote> after the semicolon at the end;</text></subparagraph><subparagraph id="H18520BAB2C7F407FA55D350210C901C7"><enum>(B)</enum><text>in clause (ix), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HCC60122E85A449E4923C5667C845060C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD1C272758BBE42E197BAB6A67D873D73"><clause id="H501763C940594165BD2D29BBD5C79846"><enum>(x)</enum><text display-inline="yes-display-inline">division A of subtitle III of title 54, United States Code (formerly known as the <quote>National Historic Preservation Act</quote>).</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9ACBBBD0174E4DC4B55302DCE50B7D98"><enum>(2)</enum><text>by redesignating paragraphs (11) through (15) as paragraphs (12) through (16), respectively; and</text></paragraph><paragraph id="HC50EA23A46B642E496563A31FC790D98"><enum>(3)</enum><text>by inserting after paragraph (10) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H7F740755B6FB4F4A91055F33D463044D"><paragraph commented="no" id="H657CC2546ABE46A3BCA398214B9C4FDB"><enum>(11)</enum><header>Qualified resident or relative</header><text display-inline="yes-display-inline">The term <term>qualified resident or relative</term> means—</text><subparagraph commented="no" id="H6A2E50456AA24E2E88503252DE8E4C6D"><enum>(A)</enum><text>a former resident of the area within the Recreation Area or the spouse of a former resident of that area; or</text></subparagraph><subparagraph commented="no" id="HB2320858B7D94EF9B29ED2950465D15A"><enum>(B)</enum><text>a widow, widower, or lineal descendant of an individual buried in a cemetery located in the Recreation Area.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H413E1E23D65846C8B786BABD24E9EE0F"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 511(b) of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–11(b)) is amended by striking paragraph (3) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H7C002FB290124FB5A1D718E89731B221"><paragraph id="H30A4D659499D45C4A07FBF5ED4B58C7E"><enum>(3)</enum><header>Status of unit</header><text display-inline="yes-display-inline">The Secretary shall administer the Recreation Area as a separate unit of the National Forest System.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H77E0E7C62024436BB1462418197EFB41"><enum>(c)</enum><header>Advisory board</header><text display-inline="yes-display-inline">Section 522 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–22) is amended—</text><paragraph id="HBC1E9C9ED895487F91C1601E45C068B2"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H852677B527EE4576B352A37C4613E3CF"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>17</quote> and inserting <quote>13</quote>; </text></subparagraph><subparagraph id="H55B1DD9483C342C6AA63229FF4099A13"><enum>(B)</enum><text>by striking paragraphs (4) and (5);</text></subparagraph><subparagraph id="H0EFD2F2EE9B244358D9C5B4B23964D90"><enum>(C)</enum><text>in paragraph (3), by adding <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph id="HC29C656E73EC470F86F7AA0824B0F87D"><enum>(D)</enum><text>by redesignating paragraph (6) as paragraph (4);</text></subparagraph></paragraph><paragraph id="HB2F4A771256443088E4A846251986007"><enum>(2)</enum><text>in subsection (c), by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD03BC18EBEDA4132A532807642C51ACB"><paragraph id="H8EEC1343ED32491B9C4D5426667E9FB5"><enum>(2)</enum><header>Nonconsecutive terms</header><text display-inline="yes-display-inline">Members of the Advisory Board may serve multiple terms, but may not serve consecutive terms. </text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HA223FE94376B471885AE65E290A97402"><enum>(3)</enum><text>in subsection (f)—</text><subparagraph id="HD9B46BE822374FCEBD847AF61C12A6B3"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>may advise</quote> and inserting <quote>shall advise and partner with</quote>;</text></subparagraph><subparagraph id="HE2F2EBE3303A49EBB8CFD6270D5788A9"><enum>(B)</enum><text>in paragraph (1), by striking <quote>and</quote> after the semicolon at the end;</text></subparagraph><subparagraph id="H533EED0D01644B6CB6257B6BDBE6269A"><enum>(C)</enum><text>in paragraph (2), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H420CC7F0F0454A8795CC22539BEDA043"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H1403B3413F40433E988EF95359B3DAE5"><paragraph id="HDA24ACF18A244EE6978394D644DABD46"><enum>(3)</enum><text display-inline="yes-display-inline">developing an annual work plan for recreation and environment education areas in the Recreation Area, including the heritage program, with the nonappropriated amounts in the Land Between the Lakes Management Fund;</text></paragraph><paragraph id="HDF247B51F75C4EE08980331ACD448B78"><enum>(4)</enum><text>developing an annual forest management and harvest plan for the Recreation Area; and</text></paragraph><paragraph id="H3013844D095549FD8B4651785C41D0C9"><enum>(5)</enum><text>the balance and status of the Land Between the Lakes Management Fund.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAF25626F80734B458FD85BD45EE3AA54"><enum>(4)</enum><text>in subsection (g)—</text><subparagraph id="H50F282DF41044CA9A16D182F16DD06DF"><enum>(A)</enum><text>in paragraph (1), by striking <quote>biannually</quote> and inserting <quote>twice each year</quote>;</text></subparagraph><subparagraph id="HCCF59307E5794F3BA65CE33590682AC5"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>, on a public website of the Department of Agriculture,</quote> before <quote>and by</quote>; and</text></subparagraph><subparagraph id="H31ADDD5005AE4A7E800E1D79BFECA932"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H397FADC6FE19485B8B506CBC6C1BFB71"><paragraph id="H9AD8112951694F948D841697D97C0F33"><enum>(4)</enum><header>Minutes</header><text display-inline="yes-display-inline">The chairperson of the Advisory Board shall publish the minutes of each meeting of the Advisory Board on a public website of the Department of Agriculture.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H72813F7F194A4FA1BAE00EE556CF692F"><enum>(d)</enum><header>Fees</header><text>Section 523(a) of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–23(a)) is amended by striking <quote>may charge reasonable fees</quote> and inserting <quote>shall charge reasonable fees, as determined by the Advisory Board,</quote>.</text></subsection><subsection id="H7D68C9A0DA2C4653817F2D30DAE5174D"><enum>(e)</enum><header>Disposition of receipts</header><text>Section 524 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–24) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H18308D92EC4D4DB483BDB82310938986"><subsection id="H0E497577510940538CB9892A2F901CC8"><enum>(b)</enum><header>Use</header><text display-inline="yes-display-inline">Amounts in the Land Between the Lakes Management Fund—</text><paragraph id="H4651F345666C4E4BADBC3B7C8A2435E6"><enum>(1)</enum><text display-inline="yes-display-inline">shall be available to the Secretary until expended, without further appropriation, to perform new work or deferred maintenance in the Recreation Area; and</text></paragraph><paragraph id="H8B80CA36ADBF46F1BC63614BD1EA102F"><enum>(2)</enum><text>shall not be available for the payment of salaries or other expenses.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H5335EC473C2B42D68CDBE07F61344036"><enum>(f)</enum><header>Cooperative authorities and gifts</header><text>Section 526 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–26) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H91EDD865C4974D10B9D4C5E956E94852"><subsection commented="no" id="H9F4DE108AD69468BAC90A423D505B610"><enum>(c)</enum><header>Memoranda of understanding</header><text display-inline="yes-display-inline">The Secretary is encouraged, for purposes of carrying out this Act—</text><paragraph commented="no" id="HDC4063192778471A886DF74D6D1AE5D6"><enum>(1)</enum><text>to enter into memoranda of understanding with State or local government entities, including law enforcement, as appropriate, to clarify jurisdictional matters, such as road management, policing, and other functions that are typically performed by the entity on non-Federal land; and</text></paragraph><paragraph commented="no" id="H6D2F827532BF4BCC8745ED22A04A648B"><enum>(2)</enum><text>to make available on a public website of the Department of Agriculture any memoranda of understanding entered into under paragraph (1). </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEFF0A658DBDC439BA8E1DBF63DDE8E11"><enum>(g)</enum><header>Cemeteries</header><text display-inline="yes-display-inline">Section 528 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–28) is amended—</text><paragraph id="HAEB8C0AD446B4A799F82674CF9FD8D6A"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H4B6BF1CB44174FFE95701379E5B51CA7"><subsection id="HD3C07B1B591546278132266546209537"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDCC3EF935BD64AF1913FBD55DB35C5CB"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HF7A2144C0A2F46A3940BE291E8FFAEBD"><subsection id="H262628AE36C14710862769B11E05A19C"><enum>(b)</enum><header>Land for plots for qualified residents or relatives</header><paragraph id="H64D5EB4A5B2C439FB1E3B7C640AFF40D"><enum>(1)</enum><header>Requests</header><text>The Secretary, on request from a qualified resident or relative or a cemetery association, shall grant additional land for the expansion of existing cemeteries within the Recreation Area to allow for the burial of qualified residents or relatives. </text></paragraph><paragraph id="H1CA2447474B746079B6114EC93560CFF"><enum>(2)</enum><header>Expenses</header><text display-inline="yes-display-inline">Any expenses required to move border fences or markers due to an expansion under paragraph (1) shall be the responsibility of the person making the request under that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H02A484969B76461D8C3975CAD37CF562"><enum>(h)</enum><header>Resource management</header><text>Section 529 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–29) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H69F210400C1E40258EE12EC398C0784D"><subsection id="H961126BAEE3840BCB7EB3BA6FA9B37DE"><enum>(c)</enum><header>Historical resources</header><paragraph id="HEB5D7F7A31C84140A5F12A6A25AEBBC2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall identify and manage the historical resources of the Recreation Area—</text><subparagraph id="HCD68E62523A14EB5AB9BB4281D6B57F7"><enum>(A)</enum><text display-inline="yes-display-inline">in accordance with the requirements of division A of subtitle III of title 54, United States Code (formerly known as the <quote>National Historic Preservation Act</quote>); and</text></subparagraph><subparagraph id="H7F4CE254FE144D97AEAEF6429174B76F"><enum>(B)</enum><text display-inline="yes-display-inline">in coordination with qualified residents or relatives.</text></subparagraph></paragraph><paragraph id="HAFFCAF4275B7474B8AA98330C4A0DB87"><enum>(2)</enum><header>Consideration</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="H667DDD8E9C824F5A83BBE5379A090AA8"><enum>(A)</enum><text>give consideration to requests by qualified residents or relatives to use and maintain traditional sites, buildings, cemeteries, and other areas of cultural importance in the Recreation Area; and</text></subparagraph><subparagraph id="HF6D4B42A45A84C7D8C29505803A8137B"><enum>(B)</enum><text>work cooperatively with qualified residents or relatives in the management of the historical resources of the Recreation Area.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H58AE095DA0FA434086A8828C42957724"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 551 of the Land Between the Lakes Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/16/460lll">16 U.S.C.460<italic>lll</italic></external-xref>–61) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H267762EDA207414590BE94A16C4D5F32"><subsection commented="no" id="HFD307AB0EA474682AC2D6E7D75150822"><enum>(d)</enum><header>Minimum expenditure</header><text display-inline="yes-display-inline">Subject to the availability of appropriations under subsection (a), the Secretary shall make available not less than $8,000,000 each fiscal year for the purposes of administering the Recreation Area (not including salaries and expenses).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
