<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 398</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210223">February 23, 2021</action-date><action-desc><sponsor name-id="S389">Mr. Kennedy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Homeland Security Act of 2002 to clarify that utility line technicians qualify as emergency response providers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="idB84B38A59F4F48ECB40A6776A5A0644B" commented="no" display-inline="no-display-inline" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Linemen Legacy Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idD5DAB3481A0A43CCB1916DA204EAD813"><enum>2.</enum><header>Emergency response providers</header><text display-inline="no-display-inline">Section 2(6) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101(6)</external-xref>) is amended—</text><paragraph id="idFD3566D08CE14A80A9DBA24A9A780DB7"><enum>(1)</enum><text>by striking <quote>includes Federal</quote> and inserting “includes—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFF8DF4B3B28F4C49A1265581746D01A3"><subparagraph id="id85D1AE02FA2443F78105457E8FD69AB1"><enum>(A)</enum><text>Federal</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id53B60CBCC7974098A5C063A9524762B3"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idC449B25E116E442980CF3DAA39328F55"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id41FFE6A5678C4CDCB2D3C857B1E5D2B1"><subparagraph id="idAB7417513B3B4F16B57016670374A8AA"><enum>(B)</enum><text>utility line technicians responding to a major disaster or an emergency declared by the President under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
