which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that the Secretary of the Interior may not enter into certain conservation easements with a term of more than 50 years, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H26D1B62FF13847B8BD1296FD0E96C812"><section section-type="section-one" id="HF56B8AFA83584E089697A48938F98BAB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Landowner Easement Rights Act</short-title></quote>.</text></section><section id="HA42B981AB7F44832A5985ECA11455F06"><enum>2.</enum><header>Limitation on conservation easement terms</header><text display-inline="no-display-inline">After the date of the enactment of this Act, the Secretary may not enter into a conservation easement with a term of more than 50 years.</text></section><section id="HC974011EB2FF46599E8E630238C0CB0E"><enum>3.</enum><header>Renegotiation of conservation easements</header><text display-inline="no-display-inline">At the request of an owner of land that is subject to an eligible conservation easement, the Secretary shall—</text><paragraph id="H9C2409D19EAB4A87A2C9C07CD895DC79"><enum>(1)</enum><text display-inline="yes-display-inline">not later the 6 months after the Secretary receives the request from the landowner, provide to the landowner—</text><subparagraph id="H0ABE7C3D955D4970A90EDD662012C500"><enum>(A)</enum><text>a detailed map of the easement; and</text></subparagraph><subparagraph id="HB19D8E67C94A46AF9F215ECC354C4EC8"><enum>(B)</enum><text display-inline="yes-display-inline">notice of the current fair market value of the easement as determined by the Secretary; and</text></subparagraph></paragraph><paragraph id="H348193F7578F465AA721D746DEBA4FA8"><enum>(2)</enum><text display-inline="yes-display-inline">renegotiate the terms of the eligible conservation easement, including—</text><subparagraph id="H84540DB02BD14D53B2721BA42F773576"><enum>(A)</enum><text>a term not longer than 50 years; and</text></subparagraph><subparagraph commented="no" id="H7797561893364EB7BB0CB4DE619A955C"><enum>(B)</enum><text>payment by the Secretary to the landowner in an amount equal to the fair market value of the easement, as determined by the Secretary under paragraph (1)(B), minus the amount paid by the Secretary for the eligible conservation easement being renegotiated (adjusted for inflation); or</text></subparagraph></paragraph><paragraph id="H29110429AE274D0D8CDCBA9C375029E0"><enum>(3)</enum><text display-inline="yes-display-inline">allow the landowner to buy back the eligible conservation easement or a portion of the eligible conservation easement at fair market value, as determined by the Secretary.</text></paragraph></section><section id="H946A2E8C671C4D1FB6DD4DB2019E88C0"><enum>4.</enum><header>Notice to landowners</header><text display-inline="no-display-inline">The Secretary shall notify the owner of the land subject to that conservation easement of the owner’s right to submit a request under section 3—</text><paragraph id="HA96B56AB95A24D29960966B305EAD5A4"><enum>(1)</enum><text>not later than 3 months before the conservation easement becomes an eligible conservation easement described in section 5(2)(A); and</text></paragraph><paragraph id="H14ED1F3D75204EA1BBDA3B68D213DEC8"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 1 year before the conservation easement becomes an eligible conservation easement described in section 5(2)(B).</text></paragraph></section><section id="H6208E29B9DD34D0E9588106AB5193ED6"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2A46DD1780E44E02AB8E3437B8104401"><enum>(1)</enum><header>Conservation easement</header><text display-inline="yes-display-inline">The term <term>conservation easement</term>—</text><subparagraph id="H60D1B1313D9D4DF18275C2A3089ECD54"><enum>(A)</enum><text>means a voluntary, legal agreement between a landowner and the Secretary that limits use of the land in order to protect its conservation values; and</text></subparagraph><subparagraph id="HAF358BFF2C2748088E03701C0E8545B9"><enum>(B)</enum><text>does not include agreements—</text><clause id="H2B1571D3567648FB8D73DC133EFD6868"><enum>(i)</enum><text>with Indian Tribes; or</text></clause><clause id="HCF898CA8750E47338C86743ACCB43FBF"><enum>(ii)</enum><text>related to utilities.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H5832EF62A8A64739B03C16B1E6540BFB"><enum>(2)</enum><header>Eligible conservation easement</header><text display-inline="yes-display-inline">The term <term>eligible conservation easement</term> means a conservation easement that—</text><subparagraph commented="no" id="H3DE21B962A0D4DCE844279040300B136"><enum>(A)</enum><text>has been in effect for longer than 50 years; or</text></subparagraph><subparagraph commented="no" id="H454AC5F4747942538F451134CC605301"><enum>(B)</enum><text display-inline="yes-display-inline">was put into effect before 1977 without the creation of an official corresponding map. </text></subparagraph></paragraph><paragraph id="HA2C72B9A69914023AA7245CD8AA247CD"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></section></legis-body></bill>
