<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3988</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220404" legis-day="20220331">April 4 (legislative day, March 31), 2022</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S347">Mr. Moran</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To codify and authorize the Federal Communications Commission’s establishment of a council to make recommendations on ways to increase the security, reliability, and interoperability of communications networks, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Communications Security, Reliability, and Interoperability Council Act</short-title></quote>.</text></section><section id="id481110DE8B384C32A02674F41470E4AF"><enum>2.</enum><header>Council on Communications Security, Reliability, and Interoperability</header><subsection id="id86B8515F21EF47388112B4ED89CAD54B"><enum>(a)</enum><header>Codification and establishment</header><paragraph id="id418AA51AF6374F399357BA24F8F789B9"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Commission shall establish a council to advise the Commission on issues including the security, reliability, and interoperability of communications networks. </text></paragraph><paragraph id="idD5C1C16AE0EC4FC2AD1E34D6C0B8855C"><enum>(2)</enum><header>Existing advisory committee</header><text>Any Federal advisory committee of the Commission that is operating on the date of enactment of this Act under a charter filed in accordance with <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /9">section 9(c)</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.) for the purpose of addressing the issues described in paragraph (1) of this subsection shall satisfy the requirement under that paragraph if, not later than 90 days after that date, the membership of the Federal advisory committee is modified, as necessary, to comply with subsection (b) of this section. </text></paragraph></subsection><subsection id="id9CD13ED9907D48BE9F19F56E1DA2B0DC"><enum>(b)</enum><header>Membership</header><paragraph id="id074ED4339F364CC999DA56C737D1FE69"><enum>(1)</enum><header>Appointment</header><text>The members of the Council shall be appointed by the Chair.</text></paragraph><paragraph id="idBF4CCA32A45444C285E534B118445EF4"><enum>(2)</enum><header>Composition</header><text>The Chair shall appoint as members of the Council the following:</text><subparagraph id="idEF47A245C8384F5FBE079A6A89B19679"><enum>(A)</enum><text>Representatives of companies or relevant trade associations in the communications industry with facilities in the United States, except entities that are determined by the Chair to be not trusted, including, at minimum—</text><clause id="id337B640B1E814E78A753F6439B1E3301"><enum>(i)</enum><text>1 representative of a national wireless provider;</text></clause><clause id="id7B78A1BBFF3A4022BA06B49C40442F24"><enum>(ii)</enum><text>1 representative of a national wireline provider; </text></clause><clause id="idA866F94258544F4B9F307616A7EA395A"><enum>(iii)</enum><text>1 representative of a national cable provider;</text></clause><clause id="idC7AD7C76854F4E588C218C317F280C03"><enum>(iv)</enum><text>1 representative of a national satellite provider; and</text></clause><clause id="idEF5C05A05A214B65A2A840D6845F7525"><enum>(v)</enum><text>1 representative of an equipment manufacturer.</text></clause></subparagraph><subparagraph id="idC638B2FCDBE949FCB9CF3AFCFD0DA46A"><enum>(B)</enum><text>Representatives of government, including, at minimum—</text><clause id="idEE1D439448FF42938E71FB2171E8F7AB"><enum>(i)</enum><text>1 representative of the Federal Government, including not less than 1 representative of the Department of Homeland Security; and</text></clause><clause id="idC7F767860636464FA3484CB020425962"><enum>(ii)</enum><text>1 representative of a State government, local government, or Tribal government, including not less than 1 representative from each type of government, if feasible.</text></clause></subparagraph><subparagraph id="idC03B8C4D71234A1FBBBA90EB7C877D07"><enum>(C)</enum><text>Representatives of public interest organizations or academic institutions, except public interest organizations or academic institutions that are determined by the Chair to be not trusted, provided that not more than <fraction>1/3</fraction> of the membership of the Council be from public interest organizations or academic institutions.</text></subparagraph></paragraph><paragraph id="id4BC69323BB5A4241A4B323A53D1B7FE4"><enum>(3)</enum><header>Knowledge and experience</header><text>Each member of the Council shall have knowledge and experience relevant to the purpose and goals of the Council.</text></paragraph><paragraph id="idF13B03C49D394EBCBE4C5BAA55A5D039"><enum>(4)</enum><header>Terms</header><subparagraph id="idEECD52EC5FE1452EA3390B430767CC2C"><enum>(A)</enum><header>In general</header><text>Each member of the Council shall be appointed for a term of 2 years, except as provided in subparagraph (B).</text></subparagraph><subparagraph id="id119EE9C8259A4F7AB925BC77FB820FDE"><enum>(B)</enum><header>Vacancies</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term for which the member's predecessor was appointed shall be appointed only for the remainder of that term. A member may serve after the expiration of that member's term until a successor has taken office.</text></subparagraph></paragraph></subsection><subsection id="id9A54432765F540B9A469D828F4DEB37F"><enum>(c)</enum><header>Consultation</header><text>The Chair may consult with the Secretary of Homeland Security as the Chair determines appropriate to enable coordination on matters pertaining to the Council.</text></subsection><subsection id="idB95E6414688B4E40AB257A67D28E9D1E"><enum>(d)</enum><header>Duration</header><text>Section 14(a)(2) of the Federal Advisory Committee Act (5 U.S.C. App.) (relating to the termination of advisory committees) shall not apply to the Council.</text></subsection><subsection id="id83C1C5CAA3AA47868C6738B87A00B25D"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id8AD8BF32E4D14BC9B512CAF11AC3ADAE"><enum>(1)</enum><header>Chair</header><text>The term <term>Chair</term> means the Chairman of the Commission.</text></paragraph><paragraph id="idCD2204FB6E2E46638DAEB7B894E51121"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="idA654390B368A410BB8D6D2EBF47458A5"><enum>(3)</enum><header>Council</header><text>The term <term>Council</term> means the council established under subsection (a).</text></paragraph><paragraph id="id8FA562F13C05442781A0A5A1517DBFBE"><enum>(4)</enum><header>Not trusted</header><text>The term <term>not trusted</term> means, with respect to an entity, that—</text><subparagraph id="id88A911142B87425A8C91D743ADCF33A6"><enum>(A)</enum><text>the Chair has made a public determination that such entity is owned by, controlled by, or subject to the influence of a foreign adversary; or</text></subparagraph><subparagraph id="id42163625B87F44F8AEC5C44ACE638CC3"><enum>(B)</enum><text>the Chair determines that such entity poses a threat to the national security of the United States, using solely the criteria described in paragraphs (1) through (4) of section 2(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1601">47 U.S.C. 1601(c)</external-xref>), as appropriate.</text></subparagraph></paragraph><paragraph id="id8A3CCD8C415C45FABC459895938793D4"><enum>(5)</enum><header>State</header><text>The term <term>State</term> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
