which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require applicable Federal agencies to take action on applications for Federal energy authorizations, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Furthering Resource Exploration and Empowering American Energy Act</short-title></quote> or the <quote><short-title>FREE American Energy Act</short-title></quote>.</text></section><section id="idED48D463103145D6A4FF060D902CDD95"><enum>2.</enum><header>Federal energy authorizations</header><subsection id="id947165A59DFC47F2B1E197CC75E26A15"><enum>(a)</enum><header>Definition of Federal energy authorization</header><text>In this section, the term <term>Federal energy authorization</term> means a permit, waiver, license, or other authorization required from a Federal agency relating to—</text><paragraph id="id357440fee96b485bbbfe1f67b38d8684"><enum>(1)</enum><text>a natural gas transmission project;</text></paragraph><paragraph id="id7cbe628c39a94db795b8780caa3d0d8d"><enum>(2)</enum><text>a natural gas interstate project;</text></paragraph><paragraph id="id553848ab45e24a039d542f624cf10498"><enum>(3)</enum><text>the exportation of natural gas;</text></paragraph><paragraph id="id437a1f83b4b44de1b2dd3db876954a26"><enum>(4)</enum><text>oil and gas lease sales;</text></paragraph><paragraph id="id5ee6150cb80c4317ae6fb45115ccd8b6"><enum>(5)</enum><text>onshore and offshore oil and gas drilling exploration; or</text></paragraph><paragraph id="idb21b09d15b054b4d9ecfe99b442e4ef5"><enum>(6)</enum><text>alternative energy production, including—</text><subparagraph id="idaf3bfa63826642f79fc8ec238c6eaa27"><enum>(A)</enum><text>geothermal production;</text></subparagraph><subparagraph id="idff430b238d8c4c17a7fafd41b01711a0"><enum>(B)</enum><text>solar production;</text></subparagraph><subparagraph id="id8e744e8bb87e4d7c868189918ac81630"><enum>(C)</enum><text>wind production; and</text></subparagraph><subparagraph id="id0b65befa9dd649a38d839fcf5dd7fd80"><enum>(D)</enum><text>mineral production.</text></subparagraph></paragraph></subsection><subsection id="id12F7E2BCC07C401192F43C8E65B622F8"><enum>(b)</enum><header>Agency action</header><paragraph id="id77C25ADCCAA6497A9F572372BCC95D6B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President, acting through the Director of the Office of Management and Budget, shall require each applicable Federal agency to, not later than 60 days after the date of enactment of this Act, review and approve or deny each application for a Federal energy authorization that is pending with the Federal agency on the date of enactment of this Act.</text></paragraph><paragraph id="id62E05EE4C1014EF8992E81FE5F4DE447"><enum>(2)</enum><header>Subsequent applications</header><text>The President, acting through the Director of the Office of Management and Budget, shall require each applicable Federal agency to, not later than 60 days after the date on which the Federal agency receives an application for a Federal energy authorization, review and approve or deny the application.</text></paragraph></subsection><subsection id="idCC35D5B9D0154417892322EF79B5A230"><enum>(c)</enum><header>Denial</header><text>If a Federal agency denies an application for a Federal energy authorization under paragraph (1) or (2) of subsection (b), not later than 5 days after the date of the denial, the Federal agency shall submit to Congress a detailed explanation of the reasons for the denial.</text></subsection><subsection id="id4D2567392C8944F68BC7BBE29FB30F04"><enum>(d)</enum><header>Extension</header><text>On request by the head of a Federal agency, the President, acting through the Director of the Office of Management and Budget, may grant an extension of the deadline under paragraph (1) or (2) of subsection (b) of not more than 30 days, on the condition that the head of the Federal agency submits to Congress an explanation of the reasons why the extension is necessary. </text></subsection></section><section id="id8797449a014949d0b4a2ea2f987b1c1d"><enum>3.</enum><header>FERC authorizations</header><subsection id="idEA7C34D5F35945CEA41413A30134091E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id8DF1445CDBA3443C8EFA629021200961"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph id="id5CE1FDB646564CA58D3C6C80417A878D"><enum>(2)</enum><header>FERC authorization</header><text>The term <term>FERC authorization</term> means a permit, waiver, license, or other authorization required from the Commission relating to—</text><subparagraph id="idaed07b0410014501afeb4721a3b64122"><enum>(A)</enum><text>transportation of oil by pipeline in interstate commerce;</text></subparagraph><subparagraph id="ide5267b4ef2604028bce4c96bc64d554a"><enum>(B)</enum><text>construction of new interstate natural gas pipelines or natural gas storage projects;</text></subparagraph><subparagraph id="id3527b50502874b0aa7614e40967b7378"><enum>(C)</enum><text>liquefied natural gas terminal projects; or</text></subparagraph><subparagraph id="id3f53dff5e66a495b88f593b24ac4d4bb" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>projects relating to hydropower. </text></subparagraph></paragraph></subsection><subsection id="idB9AE7ACFD8724779883AD0B1D4189EB3"><enum>(b)</enum><header>FERC action</header><paragraph id="idD41939D07C0B4D30B16C3E6FAFD07823"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Commission shall review and approve or deny each application for a FERC authorization that is pending on the date of enactment of this Act.</text></paragraph><paragraph id="id1D118DF71833435F949063E55D2A5407"><enum>(2)</enum><header>Subsequent applications</header><text>Not later than 60 days after the date on which the Commission receives an application for a FERC authorization, the Commission shall review and approve or deny the application.</text></paragraph></subsection><subsection id="id2850A203BDE94D439EFCD963F632E721"><enum>(c)</enum><header>Denial</header><text>If the Commission denies an application for a FERC authorization under paragraph (1) or (2) of subsection (b), not later than 5 days after the date of the denial, the Commission shall submit to Congress a detailed explanation of the reasons for the denial. </text></subsection><subsection id="idac7c36f5c6cb400ca80d6fe654672034"><enum>(d)</enum><header>Extension</header><paragraph id="idDB83BD2892B64042B8DEFF4BAC231100"><enum>(1)</enum><header>In general</header><text>The Commission may submit to Congress a request for an extension of the deadline under paragraph (1) or (2) of subsection (b) of not more than 30 days, which shall include an explanation of the reasons why the extension is necessary. </text></paragraph><paragraph id="idE4F041180FB14F518B51A5F82D90A9AF"><enum>(2)</enum><header>Congressional approval</header><text>A request for an extension under paragraph (1) may only be approved by an Act of Congress.</text></paragraph></subsection></section><section id="idfc3887efd92a48089e2963efae08d6aa"><enum>4.</enum><header>Rescission of Executive order</header><text display-inline="no-display-inline">Executive Order 13990 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to protecting public health and the environment and restoring science to tackle the climate crisis) is rescinded and shall have no force or effect. </text></section><section id="idA1FB2517EF6A41CA92FBB71EE8EFA19F"><enum>5.</enum><header>Construction, connection, operation, and maintenance of oil or natural gas pipelines or electric transmission facilities</header><subsection id="idC588D09D8A4C4DE9A910F61043636A71"><enum>(a)</enum><header>In general</header><text>No Presidential permit (or similar permit) required under Executive Order 13337 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; 69 Fed. Reg. 25299 (April 30, 2004)), Executive Order 11423 (<external-xref legal-doc="usc" parsable-cite="usc/3/301">3 U.S.C. 301</external-xref> note; 33 Fed. Reg. 11741 (August 16, 1968)), section 301 of title 3, United States Code, Executive Order 12038 (43 Fed. Reg. 3674 (January 26, 1978)), Executive Order 10485 (18 Fed. Reg. 5397 (September 9, 1953)), or any other Executive order shall be necessary for the construction, connection, operation, or maintenance of an oil or natural gas pipeline or electric transmission facility or any cross-border segment thereof.</text></subsection><subsection id="id60335EA5819A4DCFB8CFBD497A00482B"><enum>(b)</enum><header>Congressional authority</header><text>The construction, connection, operation, or maintenance of an oil or natural gas pipeline or electric transmission facility, or any cross-border segment thereof, may be approved by an Act of Congress.</text></subsection></section><section id="id84903F84AC5544F9A514E1689A77829B"><enum>6.</enum><header>Energy production permits on Federal land</header><subsection id="idD0E3541E7D7B44359DBD51ECAA16C140"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idB41BCA9305C340C6BA3B76DF6F06695A"><enum>(1)</enum><header>Agency; rule making</header><text>The terms <term>agency</term> and <term>rule making</term> have the meanings given the terms in section 551 of title 5, United States Code. </text></paragraph><paragraph id="idFDC69826477743A8A85DFA09AB06789D"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)). </text></paragraph></subsection><subsection id="idA3FDBAABA25E47C5BB8A342904F02146"><enum>(b)</enum><header>Delegation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the President, acting through the Director of the Office of Management and Budget, shall initiate a rule making to develop an interagency process under which any authority or requirement of an agency to issue a permit or other required authorization necessary to identify, develop, extract, and transport oil or natural gas on Federal land shall be delegated to the State within the borders of which the Federal land is located, on written request of the State to assume such authority.</text></subsection></section><section id="id9DC047C9FCC5407EB60987C77B6747ED"><enum>7.</enum><header>Codification of NEPA implementing regulations reform rule</header><text display-inline="no-display-inline">The final rule of the Council on Environmental Quality entitled <quote>Update to the Regulations Implementing the Procedural Provisions of the National Environmental Policy Act</quote> (85 Fed. Reg. 43304 (July 16, 2020)) is enacted into law. </text></section><section id="id7ce765f3b6684bc28b58ff907b26c0bc"><enum>8.</enum><header>Navigable waters protection rule</header><text display-inline="no-display-inline">The final rule of the Corps of Engineers and the Environmental Protection Agency entitled <quote>The Navigable Waters Protection Rule: Definition of <quote>Waters of the United States</quote></quote> (85 Fed. Reg. 22250 (April 21, 2020)) is enacted into law. </text></section><section id="id83DA9A0077AB434B95858EE5B0F560B0"><enum>9.</enum><header>Termination of credit for new qualified plug-in electric drive motor vehicles</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/30D">Section 30D</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id46E17991B1B94CDCAA601057EF68C037"><subsection id="idD08AD027D32649B9A6780ACE7D7602EB"><enum>(h)</enum><header>Termination</header><text>This section shall not apply with respect to any vehicle acquired after December 31, 2022.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
