which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a comprehensive United States strategy to address the national security threat posed by the People’s Republic of China’s control of nearly <fraction>2/3</fraction> of the global supply of critical minerals, and for other purposes.</official-title></form><legis-body><section id="id5008496CF3174BA6B17443F1AA529CBE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quad Critical Minerals Partnership Act</short-title></quote>.</text></section><section id="ida36f50a2a7a641f4842ca75dcec2ca5c"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id24eccecda2404134b9c7022e1b83aecc"><enum>(1)</enum><text>The People’s Republic of China is the global leader in mining, refining, and component manufacturing of critical minerals, producing approximately 85 percent of the world’s supply between 2011 and 2017.</text></paragraph><paragraph id="id363cf02a1a7448c982516dfe955efe89"><enum>(2)</enum><text>In 2019, the United States imported an estimated 80 percent of its critical minerals from the People’s Republic of China.</text></paragraph><paragraph id="id02bc351f80c441c993187c04a1bb0f7a"><enum>(3)</enum><text>On March 26, 2014, the World Trade Organization ruled that the People’s Republic of China’s export restraints on critical minerals violated its obligations under its protocol of accession to the World Trade Organization, thereby harming United States manufacturers and workers.</text></paragraph><paragraph id="id36194ac6d72f432ca275ccfbca37948d"><enum>(4)</enum><text>The Chinese Communist Party has threatened to leverage the People’s Republic of China’s dominant position in the critical minerals market to <quote>strike back</quote> at the United States.</text></paragraph><paragraph id="id30525cc4b5a94e89a485fe56c4b85552"><enum>(5)</enum><text>The Quadrilateral Security Dialogue is a strategic security dialogue comprised of the United States, Australia, Japan, and India that facilitates multilateral cooperation in areas of shared interest to advance a free and open Indo-Pacific region.</text></paragraph><paragraph id="id4c2cd7118fdb4355b7c2040f03a7797a"><enum>(6)</enum><text>The Quadrilateral Security Dialogue is an effective partnership for reliable multilateral financing, development, and distribution of goods for global consumption, as evidenced by the Quad Vaccine Partnership announced on March 12, 2021.</text></paragraph></section><section id="id99d57a0096be4a9785abc789b1564369"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id86faf325dd3f4d0ca5d387311f7bc063"><enum>(1)</enum><text>the People’s Republic of China’s dominant share of the global critical minerals market is a threat to the economic stability, well-being, and competitiveness of key industries in the United States;</text></paragraph><paragraph id="id131483631c4a410bb7aec953b68fdce3"><enum>(2)</enum><text>the United States should reduce reliance on the People’s Republic of China for critical minerals through—</text><subparagraph id="id94419f09e8fa4247a2f674057b060521"><enum>(A)</enum><text>strategic investments in development projects, production technologies, and refining facilities in the United States; or</text></subparagraph><subparagraph id="id8dfb8bb730134826831d146eb64ea28e"><enum>(B)</enum><text>in partnership with strategic allies of the United States that are reliable trading partners, including members of the Quadrilateral Security Dialogue;</text></subparagraph></paragraph><paragraph id="idf1d307d75e0b4c54b2583d3559e3c6f6"><enum>(3)</enum><text>the United States International Development Finance Corporation should collaborate with its counterpart entities in Japan, Australia, and India to finance a more reliable and secure supply chain of critical minerals; and</text></paragraph><paragraph id="id28a1fb9fc67b4582bf61c4f8f45bbb51"><enum>(4)</enum><text>the United States Trade Representative should initiate multilateral talks among the countries of the Quadrilateral Security Dialogue to promote shared investment and development of critical minerals.</text></paragraph></section><section id="id0b2dfd45033a47c1b219623e2b257570"><enum>4.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="id7F86E433664348C187940C59EB942CC6"><enum>(1)</enum><text display-inline="yes-display-inline">to pursue a more reliable and secure supply chain of critical minerals;</text></paragraph><paragraph id="idEC4E6EAF0BCE4CB38D0034EF3AD23495"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce reliance on the People’s Republic of China for critical minerals; and</text></paragraph><paragraph id="id65685032FA8946738A442D83FE995767"><enum>(3)</enum><text display-inline="yes-display-inline">to partner, consult, and coordinate with the governments of the countries in the Quadrilateral Security Dialogue in a concerted effort to make significant strategic investments in development projects, production technologies, and refining facilities for critical minerals.</text></paragraph></section><section id="id6E0AC5885542478AA093ED624A45D752"><enum>5.</enum><header>Comprehensive strategy</header><subsection id="id11d2994ec6ee415ca39aac9ec78b900a"><enum>(a)</enum><header>In general</header><text>The President shall establish a comprehensive strategy to address the national security threat posed by the People’s Republic of China’s control of nearly <fraction>2/3</fraction> of the global supply of critical minerals by developing a more reliable and secure supply chain of critical minerals.</text></subsection><subsection id="idA18A9B8A8D8545D8BBE0AC648FDF2FAE"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall include efforts to develop a more reliable and secure supply chain of critical minerals, including the following:</text><paragraph id="id98C154CEFBE5468386AC18B5D44A590A"><enum>(1)</enum><text>Plans to partner, consult, and coordinate with the governments of the other countries in the Quadrilateral Security Dialogue in a concerted effort to make significant strategic investments in development projects, production technologies, and refining facilities.</text></paragraph><paragraph id="idA4DBAB52F683402188E1081C73DC9F89"><enum>(2)</enum><text>A strategy to leverage the partnership of the United States International Development Finance Corporation and its counterpart entities in those countries. </text></paragraph><paragraph id="id08f872b53dee4431af2bc2b8e3e8e657"><enum>(3)</enum><text>A strategy to decrease trade barriers for the development, production, refinement, and shipment of critical minerals among those countries.</text></paragraph></subsection><subsection id="id96d65de24f6842dca53911b16e6cbb68"><enum>(c)</enum><header>Report required</header><paragraph id="id6D6ACDADCE9743A58D6DD884E3A80CA9"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report on the strategy required by subsection (a). </text></paragraph><paragraph id="id4c0ebd2f4ec948cda2126bb496b8376a"><enum>(2)</enum><header>Elements</header><text>The report required in paragraph (1) shall include—</text><subparagraph id="ida03efbab15e94a698724108ca311c502"><enum>(A)</enum><text>a description of the extent of the engagement of the United States International Development Finance Corporation with the governments of the other countries of the Quadrilateral Security Dialogue to promote shared investment and development of critical minerals; and</text></subparagraph><subparagraph id="idc092f17b49664d65924c11fadfe99649"><enum>(B)</enum><text>a description of the work of the United States Trade Representative to engage with the government of those countries to decrease trade barriers for the development, production, refinement, and transportation of critical minerals.</text></subparagraph></paragraph></subsection><subsection id="id6f6a1f6e12a04ca18d18afb04862d8e5"><enum>(d)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="id04281d85bec74ec78824e947366ee271"><enum>(1)</enum><text>the Committee on Finance, the Committee on Foreign Relations, and the Committee on Energy and Natural Resources of the Senate; and</text></paragraph><paragraph id="id034ac830020e4512b90723cb62048a78"><enum>(2)</enum><text>the Committee on Ways and Means, the Committee on Foreign Affairs, and the Committee on Energy and Commerce of the House of Representatives.</text></paragraph></subsection></section><section id="iddfe136b0466041928c003ed871480b06"><enum>6.</enum><header>Prioritization of support by United States International Development Finance Corporation</header><text display-inline="no-display-inline">The United States International Development Finance Corporation shall prioritize providing support under title II of the Better Utilization of Investments Leading to Development Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/22/9621">22 U.S.C. 9621 et seq.</external-xref>) for development projects, production technologies, and refining facilities for critical minerals that the Corporation determines will—</text><paragraph id="idda637e8592464cadac51ccccc2073c92"><enum>(1)</enum><text>contribute to the development of a more reliable and secure supply chain of critical minerals;</text></paragraph><paragraph id="ideb0edebcf0f5433f956f4057311efb42"><enum>(2)</enum><text>reduce reliance on the People’s Republic of China for critical minerals; and</text></paragraph><paragraph id="id533dc7254be24e5e84e417f9a735a6f7"><enum>(3)</enum><text>facilitate cooperation with the governments of the other countries in the Quadrilateral Security Dialogue in a concerted effort to make significant strategic investments in development projects, production technologies, and refining facilities for critical minerals.</text></paragraph></section><section id="id23eaa9e0122443e7b8a14d13323bd5e0"><enum>7.</enum><header>Initiation of multilateral discussions by United States Trade Representative</header><text display-inline="no-display-inline">The United States Trade Representative shall initiate multilateral discussions with the governments of the other countries in the Quadrilateral Security Dialogue for the purpose of—</text><paragraph id="idca0f21e2440040bea96892259670fd48"><enum>(1)</enum><text>developing a more reliable and secure supply chain of critical minerals;</text></paragraph><paragraph id="id59d4d2ab0c274d22b77fd26376a82438"><enum>(2)</enum><text>reducing reliance on the People’s Republic of China for critical minerals; and</text></paragraph><paragraph id="id754a9b8bd25a4728b2655323fe427a32" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>facilitating cooperation with those governments in a concerted effort to make significant strategic investments in development projects, production technologies, and refining facilities for critical minerals. </text></paragraph></section><section id="idCEF910CFB0BB44A0B676D0D28C2E0A84"><enum>8.</enum><header>Definition of critical mineral</header><text display-inline="no-display-inline">In this Act, the term <term>critical mineral</term> has the meaning given that term in section 7002(a) of the Energy Act of 2020 (division Z of <external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>). </text></section></legis-body></bill>
