<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3957</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Infrastructure Investment and Jobs Act to make certain activities eligible for grants from the Abandoned Mine Reclamation Fund, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Treatment for the Restoration of Ecosystems from Abandoned Mines Act</short-title></quote> or the <quote><short-title>STREAM Act</short-title></quote>.</text></section><section id="id102e50b074be43cf990f34a387096004" section-type="subsequent-section" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Long-term abandoned mine land reclamation</header><text display-inline="no-display-inline">Section 40701(c) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1231a">30 U.S.C. 1231a(c)</external-xref>) is amended—</text><paragraph id="id26E7611D189B43C88B4EB1EFF8728982" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Grants under</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3889FB6ADDF846A29E6FBB92ADDB3A22"><paragraph id="id7C9DA405F19A4A8892FA31A8BEF3CD10" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), grants under</text></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph id="id0B699F6EDB814DC8A3763A155091EDD3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id42A0C592CECF4375A1CA7E24A5A0BE5A"><paragraph id="idB7AC67525083466FA5506A2A86144B3E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Long-term abandoned mine land reclamation</header><subparagraph id="idC6BF2BAFAEEE4CF086497AA2829C7B1F" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not more than 30 percent of the total amount of a grant made annually under subsection (b)(1) may be retained by the recipient of the grant if those amounts are deposited into a long-term abandoned mine land reclamation fund established under State law, from which amounts (together with all interest earned on the amounts) are expended by the State or Indian Tribe, as applicable, for— </text><clause id="id4704A8FE5B0A446D92CF23368CE345C2" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the abatement of the causes and the treatment of the effects of acid mine drainage resulting from coal mining practices, including for the costs of building, operating, maintaining, and rehabilitating acid mine drainage treatment systems;</text></clause><clause id="id20b651db5bd04074bbf22bd48a91320f" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the prevention, abatement, and control of subsidence; or</text></clause><clause id="id5a30a77cdd32402bb8dfcb7bfe494ac4" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the prevention, abatement, and control of coal mine fires.</text></clause></subparagraph><subparagraph id="idd097cabd056a4f65808c99bd88c348f1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Reporting requirements</header><text display-inline="yes-display-inline">Each recipient of a grant under subsection (b)(1) that deposits grant amounts into a long-term abandoned mine land reclamation fund under subparagraph (A) shall—</text><clause id="id651C44EA7B6B4D2F974021E295C6BFA3" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">offer amendments to the inventory maintained under section 403(c) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1233">30 U.S.C. 1233(c)</external-xref>) to reflect the use of the amounts for—</text><subclause id="id9EF0813572C640D6B1364D639FDC0BC3" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">acid mine drainage abatement and treatment; </text></subclause><subclause id="id38df8dcf0e6d429490d5cece3a4cd249" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">subsidence prevention, abatement, and control; and</text></subclause><subclause id="id5f63a9f244b34a679da669aa786f455a" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">coal mine fire prevention, abatement, and control; and </text></subclause></clause><clause id="id9FFB7ABBA0A140458BD13695EE674532" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">include in the annual grant report of the recipient information on the status and balance of amounts in the long-term abandoned mine land reclamation fund. </text></clause></subparagraph><subparagraph id="id8A4BCC2C9A654955A19CC6D015AAF140" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">Amounts retained under subparagraph (A) shall not be subject to—</text><clause id="id6DE3E9B13D3F4207B5C21D68E30EFB87" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">subsection (d)(4)(B);
