which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Administrator of the Environmental Protection Agency to establish a grant program to improve the effectiveness of education and outreach on <quote>Do Not Flush</quote> labeling, and to require the Federal Trade Commission, in consultation with the Administrator, to issue regulations requiring certain products to have <quote>Do Not Flush</quote> labeling, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF8C61400D9B54D979D74B6C5BE9138A0"><section section-type="section-one" id="H901F7B87AA5F48D5AA61CE6ABB995C56"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wastewater Infrastructure Pollution Prevention and Environmental Safety Act</short-title></quote> or the <quote><short-title>WIPPES Act</short-title></quote>. </text></section><section id="idD8BFCCAD88024FDF9D685669F13C183B"><enum>2.</enum><header>Consumer education and outreach grant program</header><subsection id="id086DAA7AD7994CDDA50F2B5A07C774CF"><enum>(a)</enum><header>In general</header><text>The Administrator of the Environmental Protection Agency (referred to in this section as the <term>Administrator</term>) shall establish a program (referred to in this section as the <term>grant program</term>) to award competitive grants to eligible entities to improve the effectiveness of residential and community education and outreach on <quote>Do Not Flush</quote> labels.</text></subsection><subsection id="id2DC4D86D4C004A04AFF417809E51DD15"><enum>(b)</enum><header>Criteria</header><text>The Administrator shall award grants under the grant program for projects that, by using one or more eligible activities described in subsection (d), inform and educate the public about—</text><paragraph id="id531c59a119d446f2bad0901c07536995"><enum>(1)</enum><text>the <quote>Do Not Flush</quote> label printing on covered products;</text></paragraph><paragraph id="id404cfaea255749c5b66f8b25abdf029e"><enum>(2)</enum><text>the types of covered products with the <quote>Do Not Flush</quote> label;</text></paragraph><paragraph id="id652CF02FD08445B0BEC0CF8C73A807F0"><enum>(3)</enum><text>the purpose for the <quote>Do Not Flush</quote> labeling requirement and the adverse impacts to water collection and wastewater treatment infrastructure of the improper disposal of covered products; and</text></paragraph><paragraph id="id817F17148D93494CAFBD6B7E72F30A11"><enum>(4)</enum><text>proper disposal methods for covered products.</text></paragraph></subsection><subsection id="id1AAB913E2F154EFA8AFBECCDC59EAD66"><enum>(c)</enum><header>Eligible entities</header><paragraph id="id4A6D22E3D4C5481196D108C56A9448B7"><enum>(1)</enum><header>In general</header><text>An entity that is eligible to receive a grant under the grant program is—</text><subparagraph id="id854089D5EC9D40289B5B0F6D19FC6B5F"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="id4A062010FE124CAE972C7AE65AB2556F"><enum>(B)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="idFF861A92871A406F8EC0D4CA40F22C85"><enum>(C)</enum><text>a Tribal government;</text></subparagraph><subparagraph id="idEF169432E8E341118F577A8F3502BF5C"><enum>(D)</enum><text>a nonprofit organization; or</text></subparagraph><subparagraph id="idA4B0681263134B058F63ABC0BD66ABE1"><enum>(E)</enum><text>a public-private partnership.</text></subparagraph></paragraph><paragraph id="id5D5485D817C74B648BB5C2C26AB253AA"><enum>(2)</enum><header>Coordination of activities</header><text>Two or more entities described in paragraph (1) may receive a grant under the grant program to coordinate the provision of information to ratepayers and businesses within shared or combined service areas.</text></paragraph></subsection><subsection id="idB293D7540B4049AC99B92928935403C2"><enum>(d)</enum><header>Eligible activities</header><text>An eligible entity that receives a grant under the grant program may use the grant funds for activities including—</text><paragraph id="id4e80b472edca443c8cda5b5c78776bfd"><enum>(1)</enum><text>public service announcements;</text></paragraph><paragraph id="id0603efc3c430400fba48f65757f08dd6"><enum>(2)</enum><text>a door-to-door education and outreach campaign;</text></paragraph><paragraph id="id6b8b65711875482997027d7c27d43111"><enum>(3)</enum><text>social media and digital outreach;</text></paragraph><paragraph id="iddceb9f14aa414aa9a6a35405c9cae69c"><enum>(4)</enum><text>an advertising campaign on <quote>Do Not Flush</quote> label awareness;</text></paragraph><paragraph id="id9d5a1cc6d5394aabb791e63085105f24"><enum>(5)</enum><text>the development and dissemination of—</text><subparagraph id="id1B58E414B3E34EAB97D019528672DFF2"><enum>(A)</enum><text>a toolkit for a municipal and publicly owned treatment works;</text></subparagraph><subparagraph id="id17BE06571775490DAFA5D0504C7FD894"><enum>(B)</enum><text>notices advertising the presence of the label notice on covered products;</text></subparagraph><subparagraph id="id873807400B3E47BDB2996F73647D95FD"><enum>(C)</enum><text>covered products that carry the <quote>Do Not Flush</quote> label;</text></subparagraph><subparagraph id="id028744557A26426E87331D493172C7E0"><enum>(D)</enum><text>notices describing the intended effects of the label notice on consumer behavior with respect to the disposal of covered products;</text></subparagraph><subparagraph id="id771E7A96BD334384BDDB811BAA92AF0D"><enum>(E)</enum><text>notices describing the adverse impacts that covered products have on sewer and wastewater infrastructure when improperly disposed; and</text></subparagraph><subparagraph id="idE16CC11F0C0E42D8B53A22477ACAF405"><enum>(F)</enum><text>other materials for education and outreach to promote the proper disposal of covered products; and</text></subparagraph></paragraph><paragraph id="ide9e7e3ab694d45aca8ba9d6949ea8655"><enum>(6)</enum><text>other activities that the Administrator determines are appropriate to carry out the purposes of this section.</text></paragraph></subsection><subsection id="id57DD1D30F1E24DFCA6D0250DB719385A"><enum>(e)</enum><header>Prohibition on use of funds</header><text>No funds may be awarded under the grant program for a public outreach campaign that promotes or advocates any wipes product that is not a covered product or falsely depicts a covered product as not a covered product.</text></subsection><subsection id="id1FEFFECA3EDF4A0FB6BAF856E8AD3C01"><enum>(f)</enum><header>Authorization</header><text>There is authorized to be appropriated to the Administrator $5,000,000 for each of fiscal years 2023 through 2027 to carry out this section.</text></subsection></section><section id="HC3AC1918D5634746AF5E85F3F0D9FA94"><enum>3.</enum><header><quote>Do Not Flush</quote> labeling</header><subsection id="HEB90BEADA292490BB6A3C35E68433523"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this section, the Federal Trade Commission, in consultation with the Administrator of the Environmental Protection Agency, shall issue regulations under section 553 of title 5, United States Code, requiring covered entities to label covered products clearly and conspicuously with <quote>Do Not Flush</quote> label notices and symbols in accordance with this section.</text></subsection><subsection id="HAB463390B08245F0825FD26939056ABC"><enum>(b)</enum><header>Requirements</header><paragraph id="HADF21D067A3B49BBB07F273E9D6E1560"><enum>(1)</enum><header>Cylindrical packaging</header><text>In issuing regulations under subsection (a), the Commission shall require a covered product sold in cylindrical or near-cylindrical packaging, and intended to dispense individual wipes, to have—</text><subparagraph id="H7D8F9CDA1CA5442F8B83C673E84EDCFA"><enum>(A)</enum><text>the symbol and label notice on the principal display panel in a location reasonably visible to the user each time a wipe is dispensed; or</text></subparagraph><subparagraph id="H42C627346ECB4086B2129EEE7A882568"><enum>(B)</enum><text>the symbol on the principal display panel and the label notice, or a combination of the label notice and symbol, on a flip lid in a manner that covers at least 8 percent of the surface area of the flip lid.</text></subparagraph></paragraph><paragraph id="HAF6155D6ABFF4919967D06267D865032"><enum>(2)</enum><header>Flexible film packaging</header><text>In issuing regulations under subsection (a), the Commission shall require a covered product sold in flexible film packaging, and intended to dispense individual wipes, to have—</text><subparagraph id="HA0F14F30FDD74D0E92BB0203E2CD44AD"><enum>(A)</enum><text>the symbol on the principal display panel and, if the principal display panel is not on the dispensing side of the packaging, on the dispensing side panel; and</text></subparagraph><subparagraph id="H5FE1BC5C44F043F18CC8F188B3FAF7F5"><enum>(B)</enum><text>the label notice on either the principal display panel or the dispensing side panel, in a prominent location reasonably visible to the user each time a wipe is dispensed.</text></subparagraph></paragraph><paragraph id="H9AFAA3EACFBB4FF19242B0F06F53D38D"><enum>(3)</enum><header>Rigid packaging</header><text>In issuing regulations under subsection (a), the Commission shall require a covered product sold in a refillable tub or other rigid packaging that may be reused by a customer, and intended to dispense individual wipes, to have the symbol and label notice on the principal display panel in a prominent location reasonably visible to the user each time a wipe is dispensed.</text></paragraph><paragraph id="HCD99B632BBAF4E339F77526F747155E8"><enum>(4)</enum><header>Packaging not intended to dispense individual wipes</header><text>In issuing regulations under subsection (a), the Commission shall require a covered product sold in packaging that is not intended to dispense individual wipes to have the symbol and label notice on the principal display panel in a prominent location reasonably visible to the user of the covered product.</text></paragraph><paragraph id="HAA6512C32ACB4C6EB85CDFAE08A5D9CF"><enum>(5)</enum><header>Bulk packaging</header><subparagraph id="H549713E6AA4642E28D6EBF3464E7A137"><enum>(A)</enum><header>In general</header><text>In issuing regulations under subsection (a), the Commission shall require a covered product sold in bulk at retail to have labeling in compliance with such regulations on both the outer packaging visible at retail and the individual packaging contained within the outer packaging.</text></subparagraph><subparagraph id="HC9B210C2355D413F8C9A34CE036F49F1"><enum>(B)</enum><header>Exemption</header><text>The Commission shall exempt from the requirements under subparagraph (A) the following:</text><clause id="H723A9E5066E44F289C9BC608D5EE660A"><enum>(i)</enum><text>Individually packaged covered products that are contained within outer packaging, are not intended to dispense individual wipes, and have no retail labeling.</text></clause><clause id="H90D37F0B546C4CF984AAC3146BF89859"><enum>(ii)</enum><text>Outer packaging that does not obscure the symbol and label notice on individually packaged covered products contained within.</text></clause></subparagraph></paragraph><paragraph id="H5392B34D082B4DE78C8012E0C72F3FD1"><enum>(6)</enum><header>Packaging of combined products</header><subparagraph id="H5D0D761A78A7459CBA9BA8F494567A5D"><enum>(A)</enum><header>Outer packaging</header><text>In issuing regulations under subsection (a), the Commission shall exempt the outer packaging of a combined product from the requirements of such regulations. </text></subparagraph><subparagraph id="H6B2925B516704B28B33D26E3D2A6AED8"><enum>(B)</enum><header>Packages less than 3 by 3 inches</header><text>In issuing regulations under subsection (a), the Commission shall provide that, with respect to a covered product in packaging smaller than 3 inches by 3 inches (such as an individually packaged wipe in tear-top packaging) and sold as part of a combined product, if a symbol and label notice are placed in a prominent location reasonably visible to the user of the covered product, such covered product is considered to be labeled clearly and conspicuously in accordance with such regulations.</text></subparagraph></paragraph></subsection><subsection id="HEB2F660C3F1740B4AF1832D1E0E9EBC8"><enum>(c)</enum><header>Reasonable visibility of symbol and label notice</header><paragraph id="HB0FC65CD8B514CB2BB2B95EA73E682D1"><enum>(1)</enum><header>In general</header><text>In requiring the symbol and label notice under this section, the Commission shall require that—</text><subparagraph id="H02A607BA273B45929ED990115CB836C2"><enum>(A)</enum><text>packaging seams or folds or other packaging design elements do not obscure the symbol or label notice;</text></subparagraph><subparagraph id="HD4FBF12143CC4950BDFB7F0A1B866986"><enum>(B)</enum><text>the symbol and label notice are each equal in size to at least 2 percent of the surface area of the principal display panel; and</text></subparagraph><subparagraph id="H33042FE981D64FC3824304802B00F889"><enum>(C)</enum><text>the symbol and label notice have high contrast with the immediate background of the packaging so that such symbol and label notice may be seen and read by an ordinary individual under customary conditions of purchase and use.</text></subparagraph></paragraph><paragraph id="H8FC5B7A59582457AA7CEE7271C8AC9E0"><enum>(2)</enum><header>Proximity of symbol and label notice</header><text>In requiring the symbol and label notice under this section, the Commission may allow a symbol and label notice on a principal display panel to be placed adjacently or on separate areas of the principal display panel.</text></paragraph><paragraph id="HFA8C2A33176248B380ABE4A5D2A177DC"><enum>(3)</enum><header>Exception</header><text>Paragraph (1)(C) does not apply to an embossed symbol or label notice on the flip lid of a covered product sold in cylindrical or near-cylindrical packaging.</text></paragraph></subsection><subsection id="H93926740F8874785915E5551496A3BEC"><enum>(d)</enum><header>Additional words or phrases</header><text>In issuing regulations under subsection (a), the Commission shall allow additional words or phrases on a covered product that describe consequences associated with flushing or disposing of such covered product, if such words or phrases are consistent with the purposes of this section.</text></subsection><subsection id="H6A212C603D1C42448FD0835271D6196B"><enum>(e)</enum><header>Representations of flushability</header><text>In issuing regulations under subsection (a), the Commission shall prohibit, with respect to a covered product, the representation or marketing of flushable attributes, performance, or efficacy benefits.</text></subsection><subsection id="HFDAA8FBF4C8F4DF78FFC2D991634C3D1"><enum>(f)</enum><header>Compliance with other requirements</header><paragraph commented="no" id="HD684CE2691A7479C8AD3E8FCD1118750"><enum>(1)</enum><header>FIFRA requirements</header><subparagraph id="H072039A1E4164774A8D9DD231022B7E9"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, the Commission and the Administrator of the Environmental Protection Agency, acting jointly, shall issue regulations that, with respect to a covered product that contains a pesticide required to be registered under the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>), include the following:</text><clause commented="no" id="H46EB26DB619E42A8B01086658566BCD9"><enum>(i)</enum><text>Instructions describing how such a covered product may comply with the requirements of such Act and the regulations issued under subsection (a).</text></clause><clause commented="no" id="H34CC4C3928BB499A8E1D7EE149CC8F73"><enum>(ii)</enum><text>A requirement that, not later than 90 days after the date on which regulations are issued under this subparagraph, a covered entity shall submit for approval by the Administrator of the Environmental Protection Agency a product label compliant with such instructions.</text></clause></subparagraph><subparagraph id="HA78CEA19D5244555879F8B373ADFFB61"><enum>(B)</enum><header>Enforcement</header><text>For purposes of subsection (h), a violation of a regulation issued under subparagraph (A) shall be treated as a violation of a regulation issued under subsection (a). </text></subparagraph></paragraph><paragraph id="H72A4102A73FB46C29562E7C6AA72A699"><enum>(2)</enum><header>Type size exception</header><text display-inline="yes-display-inline">If the label notice type size otherwise required by the regulations issued under subsection (a) for a covered product would conflict with a labeling requirement under the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>) or the Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1261">15 U.S.C. 1261 et seq.</external-xref>), the Commission may, in issuing such regulations, provide for a label notice type size requirement for the covered product under this section that—</text><subparagraph id="H8842EDDA62E54198B55975CAEBC3BA52"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a covered product required to display a warning pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act regarding a pesticide in such covered product, requires a type size for the label notice under this paragraph that is equal to or greater than the type size required for the <quote>keep out of reach of children</quote> statement under such Act; and</text></subparagraph><subparagraph commented="no" id="H577606C78B7A4AE98124541A326AA36D"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a covered product required to contain first aid instructions pursuant to the Federal Hazardous Substances Act, requires a type size for the label notice under this paragraph that is equal to or greater than the type size required for such first aid instructions. </text></subparagraph></paragraph></subsection><subsection id="H9DE8CEB927684430BD8B506E54C02183"><enum>(g)</enum><header>Applicability</header><text>The Commission shall provide that the regulations issued under subsection (a) apply with respect to covered products manufactured on or after the date that is 90 days after the date on which such regulations are issued.</text></subsection><subsection id="H64510B99813E40AAA695B343DC095F4D"><enum>(h)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H737F883E4E3D4764A610BE591FAFF633"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of a regulation promulgated under subsection (a) shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></paragraph><paragraph id="HC1E0267158EF4E76947BAD40E7E4BB81"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), the Commission shall enforce the regulations promulgated under subsection (a) in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section, and any person who violates such a regulation shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph><paragraph id="H5C4EC9053A4E4B95B7D85C96ED96A09C"><enum>(3)</enum><header>Penalty amounts</header><text display-inline="yes-display-inline">Notwithstanding section 5 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45</external-xref>), any civil penalties imposed under such section with respect to a violation of a regulation promulgated under subsection (a) of this section shall be in accordance with the following:</text><subparagraph id="HC52DAF3FA94946D9849A7F809B563F55"><enum>(A)</enum><text>A fine of not more than $2,500 for each day that a violation occurs.</text></subparagraph><subparagraph id="HBB58DDA32AFC4F90ABC141E2E320E674"><enum>(B)</enum><text>In no event may the total amount of fines imposed for a single violation exceed $100,000.</text></subparagraph></paragraph></subsection><subsection id="ida3205a9c67a04988a9c54b48fa8b64d7"><enum>(i)</enum><header>Preemption of State laws</header><text>No State or political subdivision of a State may directly or indirectly establish or continue in effect under any authority restrictions with respect to the <quote>Do Not Flush</quote> labeling of covered products that are not identical to the restrictions under this section.</text></subsection><subsection id="id4055CB4B97E946A9A06623283A6F9A7D"><enum>(j)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="HCFF12E4B881640ED812B148536362E69"><enum>(1)</enum><header>Combined product</header><text>The term <term>combined product</term> means two or more products sold in shared retail packaging, of which—</text><subparagraph id="HE150D6BB15514BEF99A97EE56A1928D0"><enum>(A)</enum><text>at least one of the products is a covered product; and</text></subparagraph><subparagraph id="H120B85D71CBB4E9EBE16411AA2A3C842"><enum>(B)</enum><text>at least one of the products is another consumer product intended to be used in combination with such covered product.</text></subparagraph></paragraph><paragraph id="H007D7089358F4F7CA43FAAE32B0C4996"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission. </text></paragraph><paragraph id="H51C9A16AF3C34626B04A80DB2043906A"><enum>(3)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a manufacturer, wholesaler, supplier, or retailer that is responsible for the labeling or retail packaging of a covered product that is sold or offered for sale in the United States.</text></paragraph><paragraph id="H9B48F5D280264BB48590E58CF235DE10"><enum>(4)</enum><header>Covered product</header><subparagraph id="H19A822BF8F8349FA89110FD793029E90"><enum>(A)</enum><header>In general</header><text>The term <term>covered product</term> means a premoistened, nonwoven disposable wipe sold or offered for retail sale—</text><clause id="HB7A56D5466A6456B965BAA6907392D5F"><enum>(i)</enum><text>that is marketed as a baby wipe or diapering wipe; or</text></clause><clause id="HA7784BB6DECA485FB424D6421AD93FEB"><enum>(ii)</enum><text>that is a household or personal care wipe (including wipes described in subparagraph (B)) that—</text><subclause id="HF307D2AE253346FAADCFAA06FB10423A"><enum>(I)</enum><text>is composed entirely, or in part, of petrochemical-derived fibers; and</text></subclause><subclause id="H00EAF84454B141089419956AFEDA3E06"><enum>(II)</enum><text>has significant potential to be flushed.</text></subclause></clause></subparagraph><subparagraph id="HDD5D69A367064121A89C46CB626379EF"><enum>(B)</enum><header>Inclusions</header><text>The wipes described in this subparagraph are—</text><clause id="H606E62425E884FD9BB308D984D4BAC93"><enum>(i)</enum><text>antibacterial wipes and disinfecting wipes;</text></clause><clause id="H186477F79E984637A4BD43DEA1AA2F53"><enum>(ii)</enum><text>wipes intended for general purpose cleaning or bathroom cleaning, including toilet cleaning and hard surface cleaning; and</text></clause><clause id="H0B61A04EF1AD401A9E0A85D79CBB2482"><enum>(iii)</enum><text>wipes intended for personal care use on the body, including hand sanitizing, makeup removal, feminine hygiene, adult hygiene (including incontinence hygiene), and body cleansing.</text></clause></subparagraph></paragraph><paragraph id="H11A1CAE85545469A95750124F18B6E2C"><enum>(5)</enum><header>High contrast</header><text>The term <term>high contrast</term> means, with respect to the symbol or label notice, that such symbol or label notice—</text><subparagraph id="H45CEE9EBE21A4883A1C2012C5001EEE8"><enum>(A)</enum><text>is either light on a solid dark background or dark on a solid light background; or</text></subparagraph><subparagraph id="HF74B0D8EF8B3495D81552E0F2B6B0091"><enum>(B)</enum><text>in the case of a flexible film package in which a rectangular prism or near-rectangular prism stack of wipes is housed within the film, the surface area of which is measured by multiplying the length by the width of the side of the package when the flexible packaging film is pressed flat against the stack of wipes on all sides of the stack.</text></subparagraph></paragraph><paragraph id="HB842F484170C4870AAB621495DB59189" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header>Symbol</header><text>The term <term>symbol</term> means the <quote>Do Not Flush</quote> symbol, as depicted in the Guidelines for Assessing the Flushability of Disposable Nonwoven Products (Edition 4; May 2018) published by the Association of the Nonwoven Fabrics Industry (INDA) and the European Disposables And Nonwovens Association (EDANA), or an otherwise identical symbol depicting an individual of another gender. </text></paragraph></subsection></section></legis-body></bill>
