<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 394</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210223">February 23, 2021</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> (for himself, <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>, <cosponsor name-id="S359">Mr. Heinrich</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S057">Mr. Leahy</cosponsor>, <cosponsor name-id="S229">Mrs. Murray</cosponsor>, <cosponsor name-id="S364">Mr. Murphy</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S309">Mr. Casey</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S331">Mrs. Gillibrand</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S306">Mr. Menendez</cosponsor>, and <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Election Campaign Act of 1971 to require reporting to the Federal Election Commission and the Federal Bureau of Investigation of offers by foreign nationals to make prohibited contributions, donations, expenditures, or disbursements, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title; findings</header><subsection id="id8DD29B9B76C84843BD2AB5945E7773D2"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Duty To Report Act</short-title></quote>.</text></subsection><subsection id="id5E3C82100A10494C8B451F336717C3DD"><enum>(b)</enum><header>Findings</header><text>Congress makes the following findings:</text><paragraph id="id4070f3b571834977967aae1928671603"><enum>(1)</enum><text>Political contributions and express-advocacy expenditures are an integral aspect of the process by which Americans elect officials to Federal, State, and local government offices.</text></paragraph><paragraph id="id095007ec3db845ec83873f1f6acd3b6f"><enum>(2)</enum><text>It is fundamental to the definition of a national political community that foreign citizens do not have a constitutional right to participate in, and thus may be excluded from, activities of democratic self-governance.</text></paragraph><paragraph id="idf9227e5b11cc4e9884de962596fc5ca7"><enum>(3)</enum><text>The United States has a compelling interest in limiting the participation of foreign citizens in activities of democratic self-government, and in thereby preventing foreign influence over the United States political process.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a88ac65764f40dd8448fd2d37f97d6d"><enum>(4)</enum><text>Foreign donations and expenditures have a corrupting influence on the campaign process and limiting the activities of foreign citizens in our elections is necessary to preserve the basic conception of a political community and democratic self-governance.</text></paragraph></subsection></section><section id="idABE304697DB3407D933D027CE0B89084"><enum>2.</enum><header>Reporting to
			 the FEC</header><subsection id="idAB35FD8D7DEE4E52B2EE4E8D6C1F4517"><enum>(a)</enum><header>Reporting offers of prohibited contributions, donations, expenditures, or disbursements by foreign
 nationals</header><text display-inline="yes-display-inline">Section 304 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD954957A0A1941538D5072A5D34D3FB6"><subsection id="id2E0E9AE7A3324F1381EBF7B3782CA2D8"><enum>(j)</enum><header>Disclosure of offers of prohibited contributions, donations, expenditures, or disbursements by
 foreign nationals</header><text>If a political committee, an agent of the committee, or in the case of an authorized committee of a candidate for Federal office, a candidate, receives an offer (orally, in writing, or otherwise) of a prohibited contribution, donation, expenditure, or disbursement (as defined in section 3(c) of the <short-title>Duty To Report Act</short-title>), the committee shall, within 24 hours of receiving the offer, report to the Commission—</text><paragraph id="id878be02365f943f48c5ad3c6dd2fad86"><enum>(1)</enum><text>to the extent known, the name, address, and nationality of the foreign national (as defined in section 319(b)) making the offer; and</text></paragraph><paragraph id="id7b6b5b44a6e54ee58788200c488d1571"><enum>(2)</enum><text>the amount and type of contribution, donation, expenditure, or disbursement offered.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id936CC6C8B5F74CE89CFF61E842B53B07"><enum>(b)</enum><header>Reporting meetings with foreign governments or their agents</header><text>Section 304 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104</external-xref>), as amended by subsection (a), is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id858ADD0C1DD046889BF813452B69217D"><subsection id="id9763DAC507DD4A738E00DDFDBAD98FB9"><enum>(k)</enum><header>Disclosure of meetings with foreign governments or their agents</header><paragraph id="idD51EC570E3394C22A1D7FD77D6DA2261"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), if a political committee, an agent of the committee, or in the case of an authorized committee of a candidate for Federal office, a candidate, meets with a foreign government or an agent of a foreign principal, as defined in section 1 of the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref>), the committee shall, within 24 hours of meeting, report to the Commission—</text><subparagraph id="id0E7C0A11AE3548C7B706A8803E68DE8E"><enum>(A)</enum><text>to the extent known, the identity of each individual at the meeting and the foreign government involved; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7DDF867F72474FEBA88678DBDB7CBB82"><enum>(B)</enum><text>the purpose of the meeting.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id742429BA5E7C4D1A974A8463C4105712"><enum>(2)</enum><header>Exception for meetings in official capacity</header><text>Paragraph (1) shall not apply with respect to a meeting with a foreign government or an agent of a foreign principal by an elected official or as an employee of an elected official in their official capacity as such an official or employee.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id4C7A9012BF1741CBBF7B72DAC759F108"><enum>(c)</enum><header>Promulgation of regulations</header><text>Not later than one year after the date of enactment of this Act, the Federal Election Commission shall promulgate regulations providing additional indicators beyond the pertinent facts described in section 110.20(a)(5) of title 11, Code of Federal Regulations (as in effect on the date of enactment of this Act) that may lead a reasonable person to conclude that there is a substantial probability that the source of the funds solicited, accepted, or received is a foreign national, as defined in section 319(b) of the Federal Election Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(b)</external-xref>), or to inquire whether the source of the funds solicited, accepted, or received is a foreign national, as so defined. Regulations promulgated under the proceeding sentence shall also provide guidance to political committees and campaigns to not engage in racial or ethnic profiling in making such a conclusion or inquiry.</text></subsection></section><section id="H29DADE53483D45F597579BE71E228400"><enum>3.</enum><header>Reporting offers of prohibited contributions, donations, expenditures, or disbursements by foreign
			 nationals to
 the FBI</header><subsection id="idB18E1755EDFC4493926C848C8B751C7D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If a political committee or an applicable individual (as defined in subsection (c)) receives an offer (orally, in writing, or otherwise) of a prohibited contribution, donation, expenditure, or disbursement, the committee or applicable individual shall, within 24 hours of receiving the offer, report to the Federal Bureau of Investigation—</text><paragraph id="idB63A323D044A444F904433CA59A2A18F"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent known, the name, address, and nationality of the foreign national making the offer; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD26B8373ACB64599B5BE818D3353F562"><enum>(2)</enum><text>the amount and type of contribution, donation, expenditure, or disbursement offered.</text></paragraph></subsection><subsection id="id10f952351ccd46749219c920fab4466d"><enum>(b)</enum><header>Offense</header><paragraph id="idb88d8896f50e42ccae43307cbf87b1ea"><enum>(1)</enum><header>In general</header><text>It shall be unlawful to knowingly and willfully fail to comply with subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b21ea7574784f6ca972ac6fdac4eaa1"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined under title 18, United States Code, imprisoned not more than 2 years, or both.</text></paragraph></subsection><subsection id="H21FB74E7F86944C59E150308C12D4367"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id7E561CEC2C994746A112CC38B9BE9946"><enum>(1)</enum><header>Applicable individual</header><subparagraph id="id38BF2F042BC346CD9572AB5906CC5372"><enum>(A)</enum><header>In general</header><text>The term <term>applicable individual</term> means—</text><clause id="id207F70E381544D83AF0139DBD69641FB"><enum>(i)</enum><text>an agent of a political committee;</text></clause><clause id="id65CB1A03158B477B9ABAE9AD55CD3F1A"><enum>(ii)</enum><text>a candidate;</text></clause><clause commented="no" id="id54362063FE5C4157ACB61E167C78953D"><enum>(iii)</enum><text>an individual who is an immediate family member of a candidate; or</text></clause><clause commented="no" id="id7F8422B24E064EBAA8CED76750959909"><enum>(iv)</enum><text>any individual affiliated with a campaign of a candidate.</text></clause></subparagraph><subparagraph commented="no" id="idF0B2690E993C422485A8A12DBD821889"><enum>(B)</enum><header>Immediate family member; individual affiliated with a campaign</header><text>For purposes of subparagraph (A)—</text><clause commented="no" id="idE5168ADEB30649B88917F5E10FD8BDD8"><enum>(i)</enum><text>the term <term>immediate family member</term> means, with respect to a candidate, a parent, parent in law, spouse, adult child, or sibling; and</text></clause><clause commented="no" id="id9CD7889DF04F4392A4A3FA46F38E1A4A"><enum>(ii)</enum><text>the term <term>individual affiliated with a campaign</term> means, with respect to a candidate, an employee of any organization legally authorized under Federal, State, or local law to support the candidate's campaign for nomination for, or election to, any Federal, State, or local public office, as well as any independent contractor of such an organization and any individual who performs services for the organization on an unpaid basis (including an intern or volunteer).</text></clause></subparagraph></paragraph><paragraph id="H725574FA6CD549E48A1AA23977BE2DAB"><enum>(2)</enum><header>Foreign national</header><text>The term <term>foreign national</term> has the meaning given that term in section 319(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(b)</external-xref>).</text></paragraph><paragraph id="id4442391479D84CBE9E89EB4E58D3AF8A"><enum>(3)</enum><header>Knowingly</header><text>The term <term>knowingly</term> has the meaning given that term in section 110.20(a)(4) of title 11, Code of Federal Regulations (or any successor regulations).</text></paragraph><paragraph id="id33F8BA5A19DD4F11AB5097AAB217188E"><enum>(4)</enum><header>Prohibited contribution, donation, expenditure, or disbursement</header><subparagraph id="id525DCC2866094EC8B62053115C1539B1"><enum>(A)</enum><header>In general</header><text>The term <term>prohibited contribution, donation, expenditure, or disbursement</term> means a contribution, donation, expenditure, or disbursement prohibited under section 319(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(a)</external-xref>).</text></subparagraph><subparagraph id="id2D668AEE0C2F4E74B2ABB46084CBB8A0"><enum>(B)</enum><header>Clarification</header><text>Such term includes, with respect to a candidate or election, any information—</text><clause id="idECBDE865207A4DB09852B29427F26308"><enum>(i)</enum><text>regarding any of the other candidates for election for that office;</text></clause><clause id="idC8859AC15997467B82BCF46EFFCC5CCF"><enum>(ii)</enum><text>that is not in the public domain; and</text></clause><clause id="idF8BC3C6A6FEF4ED6A19B01DB70A60DF6"><enum>(iii)</enum><text>which could be used to the advantage of the campaign of the candidate.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id589E5E6B7875457CB6B0002B0BC481BD"><enum>(5)</enum><header>Other terms</header><text>Any term used in this section which is defined in section 301 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref>) and which is not otherwise defined in this section shall have the meaning given such term under such section 301.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idD445AE88BD90440993499675C044229C"><enum>4.</enum><header display-inline="yes-display-inline">Clarification regarding use of information reported</header><text display-inline="no-display-inline">Information reported under subsection (j) or (k) of section 304 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104</external-xref>), as added by section 2, or under section 3(a), may not be used to enforce the provisions under chapter 4 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1221">8 U.S.C. 1221</external-xref> et seq.) relating to the removal of undocumented aliens.</text></section></legis-body></bill>
