Multidisciplinary teams.</toc-entry></toc></section><section id="idD122025CCCD949F6B4C60E82865BD03A"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id8749db4f63364057bbc939ad3fda25e2"><enum>(1)</enum><header>Computer</header><text>The term <term>computer</term> includes a computer network and any interactive electronic device.</text></paragraph><paragraph id="id0687d81ca9bd44e48b7a48c4f1ce7c36"><enum>(2)</enum><header>Cybercrime against individuals</header><text>The term <term>cybercrime against individuals</term> means a Federal, State, or local criminal offense that involves the use of a computer to cause personal harm to an individual, such as the use of a computer to harass, threaten, stalk, extort, coerce, cause fear, intimidate, without consent distribute intimate images of, or violate the privacy of, an individual, except that—</text><subparagraph id="ida5842d3540dc4539a834f336f22d7361"><enum>(A)</enum><text>use of a computer need not be an element of the offense; and</text></subparagraph><subparagraph id="idb041ee9b6066408ab1ab24abb1391b30"><enum>(B)</enum><text>the term does not include the use of a computer to cause harm to a commercial entity, government agency, or non-natural person.</text></subparagraph></paragraph><paragraph id="id4ee6c3bb550f45d38e3274b5d909ae91"><enum>(3)</enum><header>Homeless youth</header><text>The term <term>homeless youth</term> has the meaning given the term <term>homeless children and youths</term> in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>).</text></paragraph><paragraph id="iddf81c2a313d14e0ea555b8b70c6e63aa"><enum>(4)</enum><header>Labor trafficking</header><text>The term <term>labor trafficking</term> has the meaning given that term in section 106(b)(2)(A) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7104">22 U.S.C. 7104(b)(2)(A)</external-xref>).</text></paragraph><paragraph id="id4611fac039cb48599fcb30d1d742903d"><enum>(5)</enum><header>Sex trafficking</header><text>The term <term>sex trafficking</term> has the meaning given that term in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph><paragraph id="id58f89caea4984c2bb54e97847f7be500"><enum>(6)</enum><header>Survivor of human trafficking</header><text>The term <term>survivor of human trafficking</term> means a survivor of human trafficking as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph></section><title id="id5812F5A946AD4222BAEAE6757443692F" style="OLC"><enum>I</enum><header>Grants relating to human trafficking prevention and assistance for victims of human trafficking</header><section id="id85dbdd72ee22430aad0e18e112ab963e"><enum>101.</enum><header>Human trafficking prevention education grants</header><subsection id="id1f118c96615e461987b125d76524d3df"><enum>(a)</enum><header>In general</header><text>Section 106(b)(2) of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7104">22 U.S.C. 7104(b)(2)</external-xref>) is amended—</text><paragraph id="idcefd727411794cfd9da747d88ac7ee62"><enum>(1)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text style="OLC" level="paragraph">Frederick Douglass human trafficking prevention education grants</header-in-text></quote>;</text></paragraph><paragraph id="id6259F5FFDDAA49AF852C058908C1D645"><enum>(2)</enum><text>in subparagraph (A)—</text><subparagraph id="id02E9E0EEDBD84314ABB392354AE1A6B3"><enum>(A)</enum><text>in clause (iii), by striking <quote>103(9)(B)</quote> and inserting <quote>103(11)(B)</quote>; and</text></subparagraph><subparagraph id="id0E55C08354024F87A49C227E7FB5340C"><enum>(B)</enum><text>in clause (v), by striking <quote>103(9)(A)</quote> and inserting <quote>103(12)</quote>;</text></subparagraph></paragraph><paragraph id="id782d5953f7a74d219ad71912c65071d5"><enum>(3)</enum><text>in subparagraph (B)—</text><subparagraph id="idf187b32edd4f4b92931f58c2753a3fd7"><enum>(A)</enum><text>in the matter preceding clause (i), by inserting <quote>, under a program to be known as <quote>Frederick Douglass Human Trafficking Prevention Education Grants</quote>,</quote> after <quote>may award grants</quote>; and</text></subparagraph><subparagraph id="id193059a5d4874fc3b0eef1a581e011d8"><enum>(B)</enum><text>in clause (ii), by inserting <quote>, linguistically accessible, and culturally responsive</quote> after <quote>age-appropriate</quote>;</text></subparagraph></paragraph><paragraph id="id0b64ca37333b45f98283d3db58d792b9"><enum>(4)</enum><text>in subparagraph (C), by amending the subparagraph heading to read as follows: <quote><header-in-text style="OLC" level="subparagraph">Program requirements for frederick douglass human trafficking prevention education grants</header-in-text></quote>; and</text></paragraph><paragraph id="ida3fc91a13fac4ab7b07636bf340e69b0"><enum>(5)</enum><text>by striking subparagraph (D) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id91861974c4d04182ba32b9171724980d"><subparagraph id="id97ffba87b197444eace54f358ebb5410"><enum>(D)</enum><header>Priority</header><text>In awarding Frederick Douglass Human Trafficking Prevention Education Grants under this paragraph, the Secretary of Health and Human Services shall give priority to local educational agencies that—</text><clause id="idD204755718B2468D9D80FB47C5A97C97"><enum>(i)</enum><text>serve a high-intensity child sex or labor trafficking area;</text></clause><clause id="id394cea86f3744896b6d584f725f15fcb"><enum>(ii)</enum><text>partner with nonprofit organizations specializing in human trafficking prevention education, law enforcement, and technology or social media companies to assist in training efforts to protect children from sexual exploitation and abuse, including grooming, child sex or labor trafficking, child sexual abuse materials, and human trafficking transmitted through technology;</text></clause><clause id="ideadfc2dbe2974b68b49dbc5c366c4ff1"><enum>(iii)</enum><text>consult with the Secretary of Education, the Secretary of Housing and Urban Development, the Secretary of Labor, the Secretary of Health and Human Services, and the Attorney General, as appropriate, to identify the geographic areas in the United States with the highest prevalence of populations that are at high risk for being trafficked, including children who are members of a racial or ethnic minority, homeless youth, foster youth, youth involved in the child welfare system, and children and youth who have run away from home or are in an out-of-home placement; or</text></clause><clause id="id2adb326919334228b9fe9c8d13a85dfb"><enum>(iv)</enum><text>consult with the Secretary of Education, the Secretary of Housing and Urban Development, the Secretary of Labor, the Secretary of Health and Human Services, and the Attorney General, as appropriate, to identify the geographic areas in the United States with the highest levels of child sex trafficking and child labor trafficking.</text></clause></subparagraph><subparagraph id="idd99d8a961afc4d4fa51bca44d0771a89"><enum>(E)</enum><header>Criteria for selection</header><text>Grantees under this paragraph should be selected based on their demonstrated ability—</text><clause id="id2c3a087dba8641ac925cc779cc3d543a"><enum>(i)</enum><text>to engage stakeholders, including survivors of human trafficking, and Federal, State, Tribal, and local partners, to develop programs described in subparagraph (B);</text></clause><clause id="idda638957f8834f35924dad8436b7fd5a"><enum>(ii)</enum><text>to train the trainers, parents or guardians, elementary and secondary school students, teachers, and other school personnel, particularly specialized instructional support personnel, such as a scientifically validated brief screening tool to quickly detect and serve trafficking survivors in a linguistically accessible, culturally responsive, age-appropriate and trauma-informed fashion; and </text></clause><clause id="id062172a7b75044ac817ceaebb3f954f1"><enum>(iii)</enum><text>to create a scalable, repeatable program that uses proven and tested best practices by researchers and employs appropriate technological tools and methodologies, including linguistically accessible, culturally responsive, age appropriate and trauma-informed approach and measurement and training curricula adapted for trainers, guardians, educators, and elementary and secondary school students, to prevent child sexual exploitation and abuse, including grooming, child labor trafficking, the creation or distribution of child sexual abuse materials, and trafficking transmitted through technology.</text></clause></subparagraph><subparagraph id="id4ca4db8729b34e599e90575c14e11c56"><enum>(F)</enum><header>Data collection</header><text>The Secretary of Health and Human Services and the Secretary of Labor shall consult with the Secretary of Education to determine the appropriate demographics of the recipients or of students at risk of being trafficked or exploited, to be collected and reported with respect to grants awarded under this paragraph.</text></subparagraph><subparagraph id="id10e76dd6b4d34379b26988b6de782bb2"><enum>(G)</enum><header>Report</header><text>Not later than 18 months after the date of the enactment of this Act, and annually thereafter, the Secretary of Health and Human Services shall submit a report to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="">Committee on Education and Labor of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that identifies—</text><clause id="iddc7a79ca5ecb45fcb8b05407e700e3a7"><enum>(i)</enum><text>the total number of entities that received a Frederick Douglass Human Trafficking Prevention Education Grant during the preceding year;</text></clause><clause id="idcefa81c9ad014449b3fe22b7825a4c74" commented="no"><enum>(ii)</enum><text>the total number of partnerships or consultants that included survivors, nonprofit organizations specialized in human trafficking prevention education, law enforcement, or technology or social media companies;</text></clause><clause id="id8c7171292bfa45758f3629a8ee9dbee2"><enum>(iii)</enum><text>the total number of elementary and secondary schools that established and implemented proper protocols and procedures through programs developed using grants received under this paragraph;</text></clause><clause id="id6f452e6c20ba4d1e9b975c0581eb199b"><enum>(iv)</enum><text>the total number and geographic distribution of trainers, guardians, students, teachers, and other school personnel trained assisted through grants received under this paragraph;</text></clause><clause id="ideabe1141e98e4f7eadad90f3fd18799a"><enum>(v)</enum><text>the results of pre-training and post-training surveys to gauge trainees’ increased understanding of—</text><subclause id="idD6EA5357FBEB46868921B35220F59351"><enum>(I)</enum><text>the scope and signs of child trafficking and child sexual exploitation and abuse; </text></subclause><subclause id="idB44C959AD5A34161A76DCB48CA9ACF51"><enum>(II)</enum><text>how to interact with potential victims and survivors of child trafficking and child sexual exploitation and abuse using age-appropriate, culturally and linguistically responsive, and trauma-informed approaches; and</text></subclause><subclause id="idD50E2DA7ECC4421E97D06729BFA131E4"><enum>(III)</enum><text>the manner in which to respond to potential child trafficking and child sexual exploitation and abuse;</text></subclause></clause><clause id="id104b568b85244e01bea469b6bc96cf9d"><enum>(vi)</enum><text>the number of potential victims and survivors of child trafficking and child sexual exploitation and abuse identified and served by grantees under this paragraph, excluding any individually identifiable information about such children, in full compliance with all applicable privacy laws and regulations;</text></clause><clause id="id74673538608c48a7be62e49564fea15e"><enum>(vii)</enum><text>the number of students in elementary or secondary school identified by grantees under this paragraph as being at risk of being trafficked or sexually exploited and abused, excluding any individually identifiable information about such students;</text></clause><clause id="id58479f36d02f4428b598bdce277e6003"><enum>(viii)</enum><text>the demographic characteristics of child trafficking survivors and victims, sexually exploited and abused children, and students at risk of being trafficked or sexually exploited and abused described in clauses (vi) and (vii), excluding any individually identifiable information about such children, in full compliance with the standards established by the Department of Education National Center for Education Statistics with respect to at-risk students; and</text></clause><clause id="ide066827a61ee43e0ab9415ee6207338c"><enum>(ix)</enum><text>any service gaps and best practices identified by grantees under this paragraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc0af67f359ee453681a26bb6094cd60b" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment</header><text>Section 107(c)(4)(A) of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(c)(4)(A)</external-xref>) is amended by inserting <quote>in order to fulfill the purposes described in section 111 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20708">34 U.S.C. 20708</external-xref>)</quote> before the period at the end.</text></subsection></section><section id="id6676d70c40f84c1c835af8dddc013f9e"><enum>102.</enum><header>Protecting children abroad</header><text display-inline="no-display-inline">Section 240(c)(1) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/22/212b">22 U.S.C. 212b(c)(1)</external-xref>) is amended to read as follows:</text><quoted-block id="idB3CB0DEBD22C492BA8D7177D53C200A6" display-inline="no-display-inline" style="OLC"><paragraph id="idb6f48520b08a421e9664bf7f2346796c"><enum>(1)</enum><text>the term <term>covered sex offender</term> means an individual who—</text><subparagraph id="id7ae3d57333de41549a3058208e9b3945"><enum>(A)</enum><text>is required to register, based on an offense against a minor, under section 113 of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20913">34 U.S.C. 20913</external-xref>); or </text></subparagraph><subparagraph id="iddc5637f4913840b6b5f82924bce960e7"><enum>(B)</enum><text>resides outside the United States, or applies for or seeks to renew a passport outside the United States, and would be required to register, based on an offense against a minor, under section 113 of the Sex Offender Registration and Notification Act, if the individual returned to the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id0ecde5144afb40408eae0a947607cfbc"><enum>103.</enum><header>Ensuring protection and confidentiality for human trafficking survivors</header><subsection id="idd879ad2792544f138a6b03aa8314e543"><enum>(a)</enum><header>In general</header><text>In order to ensure the safety of human trafficking survivors and their families—</text><paragraph id="id504a7ad499a940b690eca25175935ec8"><enum>(1)</enum><text>a grantee or subgrantee receiving Federal funds under a grant shall protect the confidentiality and privacy of survivors of human trafficking receiving services from the grantee or subgrantee; and</text></paragraph><paragraph id="id797f0d3983854ec2964689d2dc15af5a"><enum>(2)</enum><text>each entity applying to receive Federal funds in the form of a grant shall submit, in conjunction with the application for the grant, a privacy policy for human trafficking survivors and their families that is in accordance with the requirements under this section.</text></paragraph></subsection><subsection id="id51eae9749f2048fa985e004604a46a9a"><enum>(b)</enum><header>Nondisclosure</header><text>Subject to subsections (c), (d), and (e), a grantee or subgrantee shall agree, as a condition of receiving Federal funds, to not—</text><paragraph id="id9676a2912aae41d1b80edaa3b7482193"><enum>(1)</enum><text>disclose, reveal, or release any personally identifying information or individual information collected in connection with services requested, used, or denied through a program of the grantee or subgrantee, regardless of whether the information has been encoded, encrypted, hashed, or otherwise protected; or</text></paragraph><paragraph id="id9576e69d8e6b4ee6b5149642b7d18cb6"><enum>(2)</enum><text>disclose, reveal, or release individual client information regarding an individual who requested, used, or was denied services through a program of the grantee or subgrantee without the informed, written, and reasonably time-limited consent of the individual about whom information is sought, whether in connection with the program for which the Federal funds were received or another Federal, State, Tribal, or territorial grant program.</text></paragraph></subsection><subsection id="id58779c1b438847608218f20f1af3adc5"><enum>(c)</enum><header>Exceptions relating to minors</header><paragraph id="idb9fd91661e174d07b14b643ac7408433"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (b)(2)—</text><subparagraph id="id8dc6e8eb2989462d993e16c17c2be44a"><enum>(A)</enum><text>the informed, written, and reasonably time-limited consent described in such subsection— </text><clause id="idA75D8D3E81394CCFA0D36263C4726EC4"><enum>(i)</enum><text>in the case of an unemancipated minor shall be obtained from both the minor and a parent or guardian; and</text></clause><clause id="id89A36FE799F34746BBF9D5252069C634"><enum>(ii)</enum><text>in the case of person with a legal incapacity, shall be obtained from both the person and a court-appointed guardian; and</text></clause></subparagraph><subparagraph id="id122982d3f8b14332b2938231d4aad740"><enum>(B)</enum><text>such consent may not be given by the alleged or convicted trafficker of the minor or person with a legal incapacity, or the alleged or convicted trafficker of a parent or legal guardian of the minor or person with a legal incapacity.</text></subparagraph></paragraph><paragraph id="id69eaef2d70a24858935329b3b8284c21"><enum>(2)</enum><header>Waiver of parental consent</header><text>Notwithstanding the prohibition under subsection (b)(2), if a minor or a person with a legally incapacity is permitted by law to receive services without the consent of a parent or guardian, the minor or person may consent to the disclosure, revealing, or release of information without obtaining additional consent in accordance with paragraph (1) of this subsection.</text></paragraph></subsection><subsection id="id643a29fe0c6248f692fd7e06c58b7f1a"><enum>(d)</enum><header>Compelled release</header><text>If a grantee or subgrantee is compelled by a statutory or court mandate to disclose, reveal, or release information described in subsection (b), the grantee or subgrantee shall—</text><paragraph id="id93667ef5ad5c4b289881c7d54838a88a"><enum>(1)</enum><text>make reasonable attempts to provide notice to survivors affected by the disclosure, revealing, or release of the information; and </text></paragraph><paragraph id="id2AFF5D117854413BBA331DC9A097F976"><enum>(2)</enum><text>take steps necessary to protect the privacy and safety of the persons affected by the disclosure, revealing, or release of the information.</text></paragraph></subsection><subsection id="id3647b7a1ccd94f4280a83e5a325adf4c"><enum>(e)</enum><header>Information sharing</header><paragraph id="id5071878ca097474baef891b2e6119799"><enum>(1)</enum><header>In general</header><text>A grantee or subgrantee may share—</text><subparagraph id="id2cd24a92d5284cdbaa87a3f692fee778"><enum>(A)</enum><text>nonpersonally identifying data in the aggregate regarding services to clients of the grantee or subgrantee and nonpersonally identifying demographic information, in order to identify underserved populations and comply with Federal, State, Tribal, or territorial reporting, evaluation, or data collection requirements;</text></subparagraph><subparagraph id="idd8625fea30f141568f4d2992942794a7"><enum>(B)</enum><text>court-generated information and law enforcement-generated information contained in secure, governmental registries for protection order enforcement purposes; </text></subparagraph><subparagraph id="idb27a2c0bc6f043f4a4232cc59829059a"><enum>(C)</enum><text>law enforcement-generated and prosecution-generated information necessary for law enforcement and prosecution purposes; and</text></subparagraph><subparagraph id="idBFE077642A944DE1B9AF07D83E7895EA"><enum>(D)</enum><text>information necessary for the functioning of a multidisciplinary team.</text></subparagraph></paragraph><paragraph id="id945d572feb924150a7084b7e064e15c8"><enum>(2)</enum><header>Prohibition</header><text>Under no circumstances may a grantee or subgrantee—</text><subparagraph id="id3b1d31159d3e4846bb48a436e5114d67"><enum>(A)</enum><text>require a human trafficking survivor to provide consent to disclose, reveal, or release his or her personally identifying information as a condition of eligibility for the services provided by the grantee or subgrantee; or</text></subparagraph><subparagraph id="id5f082b789fe7486686ac8c444b1961ce"><enum>(B)</enum><text>share any personally identifying information of a human trafficking survivor in order to comply with Federal, State, Tribal, or territorial reporting, evaluation, or data collection requirements, whether in connection with the program for which the Federal funds were received or another Federal, State, Tribal, or territorial grant program.</text></subparagraph></paragraph></subsection><subsection id="id8b4404d3e5024feea533d95eac5a8993"><enum>(f)</enum><header>Statutorily mandated reports of human trafficking, exploitation, abuse or neglect</header><text>Nothing in this section shall be construed to prohibit a grantee or subgrantee from reporting suspected human trafficking, exploitation, abuse or neglect, as those terms are defined under, and as such reporting is specifically mandated by, Federal, State, local, or Tribal laws.</text></subsection></section><section id="id63f35cbabb764c2f81f1ab739150d95d"><enum>104.</enum><header>Temporary waivers</header><subsection id="idf1b2cdfdd7244dde8a69fbe9a556f224"><enum>(a)</enum><header>Waiver of match requirements</header><text>The non-Federal match requirements set forth in subsection (g) of section 202 of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20702">34 U.S.C. 20702</external-xref>) shall not apply to grants under such section during fiscal year 2023.</text></subsection><subsection id="id5e19ced744a2416680c80306a1d7b97f" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Waiver of Federal share limitations</header><text>The Federal share limitations set forth in subsections (b)(2)(C) and (f)(3)(B) of section 107 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>) shall not apply to grants under subsections (b)(2) and (f)(3) of such section during fiscal year 2023. </text></subsection></section><section id="id00A1ABC9267447798DB2D229023834F7"><enum>105.</enum><header>Grants for State improvements</header><subsection id="id68609DDB96E2441E9DD7A84F8F805BF1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title II of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20701">34 U.S.C. 20701 et seq.</external-xref>) is amended by inserting after section 204 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFB13DD4D31594B7F848206044729A256"><section commented="no" display-inline="no-display-inline" id="IDF3609288506B40E2862474F7F05C311F" section-type="subsequent-section"><enum>204A.</enum><header display-inline="yes-display-inline">Enhancing the ability of State, local, and tribal child welfare agencies to identify and respond to children who are, or are at risk of being, victims of trafficking</header><subsection commented="no" display-inline="no-display-inline" id="id5e5e3639-61bd-4f0d-a6df-485e3998d822"><enum>(a)</enum><header display-inline="yes-display-inline">Grants To enhance child welfare services</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services may make grants to eligible States to develop, improve, or expand programs that assist State, local, or Tribal child welfare agencies with identifying and responding to—</text><paragraph commented="no" display-inline="no-display-inline" id="id19A598FB22C64066AF4CE4C39531ED5C"><enum>(1)</enum><text display-inline="yes-display-inline">children considered victims of <quote>child abuse and neglect</quote> and of <quote>sexual abuse</quote> under the application of section 111(b)(1) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106g">42 U.S.C. 5106g(b)(1)</external-xref>) because of being identified as being a victim or at risk of being a victim of sex trafficking; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idD0E082C3DFC242D1B09C79C4DAB05F18"><enum>(2)</enum><text>children over whom such agencies have responsibility for placement, care, or supervision and for whom there is reasonable cause to believe are, or are at risk of being a victim of 1 or more severe forms of trafficking in persons. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id465DA2AFC5FE43C1AE01CB16A3A1C136"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph display-inline="no-display-inline" commented="no" id="idEF0AE065D22647C886A62F26657FEFE8"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means an individual who has not attained 18 years of age or such older age as the State has elected under section 475(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(8)</external-xref>). At the option of an eligible State, such term may include an individual who has not attained 26 years of age. </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id5916C3DA09BE44E2BB1E70EC1207D37B"><enum>(2)</enum><header>Eligible State</header><text>The term <term>eligible State</term> means a State that meets 1 or more of the following criteria:</text><subparagraph display-inline="no-display-inline" commented="no" id="id9D47702F133549D6B48FD925EAE1A6D4"><enum>(A)</enum><header>Elimination of third party control requirement</header><text>The State has eliminated any requirement relating to identification of a controlling third party who causes a child to engage in a commercial sex act in order for the child to be considered a victim of 1 or more severe forms of trafficking in persons, or a victim of trafficking, for purposes of accessing child welfare services and care.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id26AF90A996424832BC851D6C93A290E7"><enum>(B)</enum><header>Application of standard for human trafficking</header><text>The State considers a child to be a victim of trafficking if the individual is a victim of a severe form of trafficking in persons as described in subparagraph (A) of section 103(11) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(11)</external-xref>).</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idE92F4AF74BCD44AFB92BEA112A15160F"><enum>(C)</enum><header>Development and implementation of State child welfare plan protocols</header><text>The State agency responsible for administering the State plan for foster care and adoption assistance under part E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>) has developed and is implementing protocols that meet the following reporting requirements:</text><clause id="ide62796366cfe46df86f5b02c4a303ee3"><enum>(i)</enum><text>The requirement to report immediately, and in no case later than 24 hours after receiving, information on children or youth who have been identified as being a victim of sex trafficking to law enforcement authorities under paragraph (34)(A) of section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>).</text></clause><clause id="id3c1e85459a834c7b9b6c43428efbd82c"><enum>(ii)</enum><text>The requirement to report immediately, and in no case later than 24 hours after receiving, information on missing or abducted children or youth to law enforcement authorities, including children or youth classified as <quote>runaways</quote>, for entry into the National Crime Information Center (NCIC) database of the Federal Bureau of Investigation, and to the National Center for Missing and Exploited Children, under paragraph (35)(B) of such section. </text></clause><clause id="id316ab1fbed4a4eb7872d07f1f070f2d5"><enum>(iii)</enum><text>The requirement to report to the Secretary of Health and Human Services the total number of children and youth who are victims of sex trafficking under paragraph (34)(B) of such section. </text></clause></subparagraph><subparagraph id="id77bedc2f7a0d439e9e32459d461a6f1f"><enum>(D)</enum><header>Trafficking-specific protocol</header><text>The State has developed and implemented a specialized protocol for responding when victims of trafficking are exploited by a third party trafficker to ensure the response focuses on the child’s specific safety needs as a victim of trafficking, and that includes the development and use of an alternative mechanism for investigating and responding to cases of child sex trafficking in which the alleged offender is not the child’s parent or caregiver without utilizing existing processes for investigating and responding to other forms of child abuse or neglect or requiring the filing of an abuse or neglect petition. </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id8D1E648DC79641B7889A0E7564704707"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands. Such term includes an Indian tribe, tribal organization, or tribal consortium with a plan approved under section 479B of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679c">42 U.S.C. 679c</external-xref>), or which is receiving funding to provide foster care under part E of title IV of such Act pursuant to a cooperative agreement or contract with a State.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id3F883405233D48EAB447665D6AACAB75"><enum>(4)</enum><header>Other terms</header><text>The terms <term>commercial sex act</term>, <term>severe forms of trafficking in persons</term>, <term>sex trafficking</term>, <term>victim of a severe form of trafficking</term>, and <term>victim of trafficking</term> have the meanings given those terms in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id88A7C26247A949A595EC3831CDF8E921"><enum>(b)</enum><header>Funding</header><text>Section 113(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7110">22 U.S.C. 7110(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A423C4DB15A41579DD64DC9D675C04F"><paragraph commented="no" display-inline="no-display-inline" id="ID71322B79064E4790B13B1BB526B386A3"><enum>(3)</enum><header display-inline="yes-display-inline">Grants for State improvements</header><text display-inline="yes-display-inline">To carry out the purposes of section 204A of the Trafficking Victims Protection Reauthorization Act of 2005, there are authorized to be appropriated $8,000,000 to the Secretary of Health and Human Services for each of fiscal years 2022 through 2027.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id606a36a6dd84480eb5748a627c68ab49"><enum>(c)</enum><header>Sense of congress regarding health care professionals and social service providers</header><text>It is the sense of Congress that State and local licensing boards throughout the United States should facilitate access for health care and behavioral health care practitioners and social service providers, as a condition of receiving new or renewal licensure, to training guided by the Department of Health and Human Service’s Core Competencies for Human Trafficking Response in Health Care and Behavioral Health Systems on— </text><paragraph id="idc9eddb728b6c49e38f0b2be21b40066a"><enum>(1)</enum><text>the scope and signs of human trafficking and child sexual exploitation and abuse that present in the applicable health care, behavioral health, or social services settings;</text></paragraph><paragraph id="id1464bba445ba4c5f9c7ad94f4bf1e1a5"><enum>(2)</enum><text>how to interact with potential victims of trafficking (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) and with trafficking survivors, using an age-appropriate, gender-responsive, culturally and linguistically appropriate, and trauma-informed approach; and</text></paragraph><paragraph id="id9f8d5127274f4f65b5cb58cb42d69e51"><enum>(3)</enum><text>the manner in which to respond to potential victims and to survivors of human trafficking (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) or child sexual exploitation and abuse. </text></paragraph></subsection></section><section id="idd22eb25caa2c40ccaed63f7e4a590245"><enum>106.</enum><header>Additional reauthorization</header><subsection id="id7A184BB0D9024259A1F493B8B6D7750C"><enum>(a)</enum><header>Airport personnel training To identify and report human trafficking victims</header><text>Section 303 of the Frederick Douglass Trafficking Victims Prevention and Protection Reauthorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/425">Public Law 115–425</external-xref>; 132 Stat. 5488) is amended by striking <quote>2018 through 2021</quote> and inserting <quote>2021 through 2027</quote>. </text></subsection><subsection id="idf60679e6bb5f4806977d1f291ca045c5"><enum>(b)</enum><header>HERO corps hiring</header><text>Section 890A(g)(2) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/473">6 U.S.C. 473(g)(2)</external-xref>) is amended by striking <quote>2019 through 2022</quote> and inserting <quote>2022 through 2027</quote>. </text></subsection><subsection id="id28129dfa187d41a685560193304d9f88"><enum>(c)</enum><header>Reauthorizing the special assessment and ensuring full funding for the domestic trafficking victims’ fund</header><text>Section 3014 of title 18, United States Code, is amended—</text><paragraph id="id9100472da132476fb79c25f4767b23ef"><enum>(1)</enum><text>in subsection (a), in the matter preceding paragraph (1), by striking <quote>and ending on September 11, 2022</quote>; or</quote>; and</text></paragraph><paragraph id="idE5E123E36AB74A43B2D76CAA72B4F449"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (19) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id81DE705597CF4B078748C67272CCF68E"><paragraph id="idEB96222715234106A6FA5E09CF0ADCD5" indent="up1"><enum>(20)</enum><text>for injury to an individual by the debtor relating to a violation of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18, including injury caused by an instance in which the debtor knowingly benefitted financially, or by receiving anything of value, from participation in a venture that the debtor knew or should have known engaged in an act in violation of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H39AB5F69E5CF485FB9D809DE888826FE"><enum>III</enum><header>Cyber harassment prevention</header><subtitle id="HA6FC6895776D4E26B11F93C94071FE75"><enum>A</enum><header>Cybercrime statistics</header><section id="H1D3EDFCD267C4DD9B588CBD7560EA726"><enum>311.</enum><header>National strategy, classification, and reporting on cybercrime</header><subsection id="H0F79B39E71004FF2B37F4F7E5DDF9EDF"><enum>(a)</enum><header>National strategy</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Secretary of Homeland Security, shall develop a national strategy to—</text><paragraph id="idE7EC3A9657F04B85AB0014A3F48A5BED"><enum>(1)</enum><text display-inline="yes-display-inline">reduce the incidence of cybercrimes against individuals;</text></paragraph><paragraph id="id11865B799CA444D28528FF0402C18696"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate investigations of cybercrimes against individuals by Federal law enforcement agencies; and</text></paragraph><paragraph id="id9E7E1E13ADBA4F06B7C38B71F8DA43AF"><enum>(3)</enum><text display-inline="yes-display-inline">increase the number of Federal prosecutions of cybercrimes against individuals.</text></paragraph></subsection><subsection id="H68D0FD322E934B02A77BB62671B133F1"><enum>(b)</enum><header>Classification of cybercrimes against individuals for purposes of crime reports</header><text display-inline="yes-display-inline">In accordance with the authority of the Attorney General under section 534 of title 28, United States Code, the Director of the Federal Bureau of Investigation shall—</text><paragraph id="HAEAAE069F9E44104B213A5F18CCD14B6"><enum>(1)</enum><text display-inline="yes-display-inline">design and create within the Uniform Crime Reports a category for offenses that constitute cybercrimes against individuals;</text></paragraph><paragraph id="HF176B159EE51404ABA145BF5287D8DA4"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent feasible, within the category established under paragraph (1), establish subcategories for each type of cybercrime against individuals that is an offense under Federal or State law;</text></paragraph><paragraph id="H536D10D6AFF740088370814103213317"><enum>(3)</enum><text display-inline="yes-display-inline">classify the category established under paragraph (1) as a Part I crime in the Uniform Crime Reports; and</text></paragraph><paragraph id="HF21B798B727441AC88D9EBB6AFA4C429"><enum>(4)</enum><text display-inline="yes-display-inline">classify each type of cybercrime against individuals that is an offense under Federal or State law as a Group A offense for the purpose of the National Incident-Based Reporting System.</text></paragraph></subsection><subsection id="HEDB36174F2B64F2DAAF1F2EC5DCC78E4"><enum>(c)</enum><header>Annual summary</header><text display-inline="yes-display-inline">The Attorney General shall publish an annual summary of the information reported in the Uniform Crime Reports and the National Incident-Based Reporting System relating to cybercrimes against individuals.</text></subsection></section></subtitle><subtitle id="idf6f7314023c240fe88bacd4b377e71c6"><enum>B</enum><header>Prioritizing online threat enforcement</header><section id="id44A5B01A798E449D829046511F0F0809"><enum>321.</enum><header>Improved investigative and forensic resources for enforcement of laws related to cybercrimes against individuals</header><text display-inline="no-display-inline">Subject to the availability of appropriations to carry out this section, the Attorney General, in consultation with the Director of the Federal Bureau of Investigation and the Secretary of Homeland Security, including the Executive Associate Director of Homeland Security Investigations, shall, with respect to cybercrimes against individuals— </text><paragraph id="id502c319edf174fb99bba45005bb1a796"><enum>(1)</enum><text>ensure that there are not less than 10 additional operational agents of the Federal Bureau of Investigation designated to support the Criminal Division of the Department of Justice in the investigation and coordination of cybercrimes against individuals;</text></paragraph><paragraph id="id99c74e9f055745729ecc7f181a55140c"><enum>(2)</enum><text>ensure that each office of a United States Attorney designates at least 1 Assistant United States Attorney as responsible for investigating and prosecuting cybercrimes against individuals; and</text></paragraph><paragraph id="id60773a12177d4a59a75d27520fe13a28"><enum>(3)</enum><text>ensure the implementation of a regular and comprehensive training program—</text><subparagraph id="id266654ef4e184a079fe92bc4ada2689b"><enum>(A)</enum><text>the purpose of which is to train agents of the Federal Bureau of Investigation in the investigation and prosecution of such crimes and the enforcement of laws related to cybercrimes against individuals; and</text></subparagraph><subparagraph id="id9505eb27fdb648b7a717bded201959bd"><enum>(B)</enum><text>that includes relevant forensic training related to investigating and prosecuting cybercrimes against individuals.</text></subparagraph></paragraph></section><section id="id6ba4170713ff4c7d981e729ac3b9ea20"><enum>322.</enum><header>Report</header><subsection id="id7ed2c532e9354e89bb10998fbb0fa892"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date on which the collection of statistical data under section 311 begins and once each year thereafter, the Director of the Office for Victims of Crime shall submit a report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives that addresses, to the extent data are available, the nature, extent, and amount of funding under the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101 et seq.</external-xref>) for victims of cybercrimes against individuals.</text></subsection><subsection id="id9db6d09706284794b3e644b0c0863f87"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall include—</text><paragraph id="id6acbd853d2864b4391971c2cf61f4d22"><enum>(1)</enum><text>an analysis of victims' assistance, victims' compensation, and discretionary grants under which victims of cybercrimes against individuals received assistance;</text></paragraph><paragraph id="id7240dcb51d7644a08987e81c5ac32626"><enum>(2)</enum><text>recommendations for improving services for victims of cybercrimes against individuals; and</text></paragraph><paragraph id="idab5176ead4d5437cb50551ef6ad0524d"><enum>(3)</enum><text>efforts by the Department of Justice to conduct outreach to State and local law enforcement agencies on the process for collaborating with the Federal Government for the purpose of investigating and prosecuting interstate and international cybercrime cases.</text></paragraph></subsection></section><section id="id8BC5A307B7C04CEF9992A289756F3074"><enum>323.</enum><header>Training and technical assistance for States</header><text display-inline="no-display-inline">The Attorney General, in consultation with the Secretary of Homeland Security, the Director of the United States Secret Service, and nongovernmental and survivor stakeholders, shall create, compile, evaluate, and disseminate materials and information, and provide the necessary training and technical assistance, to assist States and units of local government in—</text><paragraph id="idd141d956a432422f963b348f9142fa6f"><enum>(1)</enum><text>investigating, prosecuting, pursuing, preventing, understanding, and mitigating the impact of—</text><subparagraph id="id1a55112de4d4491ca667f4b82da4043e"><enum>(A)</enum><text>physical, sexual, and psychological abuse of cybercrime victims, including victims of human trafficking that is facilitated by interactive computer services;</text></subparagraph><subparagraph id="idd5d2996d844c424b84039c02c12f438f"><enum>(B)</enum><text>exploitation of cybercrime victims; and</text></subparagraph><subparagraph id="idbdaba71940684e6a8c8b14be82e9420c"><enum>(C)</enum><text>neglect of cybercrime; and</text></subparagraph></paragraph><paragraph id="id16d8e2a4b32d43089a5f5a52986fa6f0"><enum>(2)</enum><text>assessing, addressing, and mitigating the physical and psychological trauma to victims of cybercrime. </text></paragraph></section></subtitle></title><title id="id94AB69C39A784E059A6CDC46588AD326" style="OLC"><enum>IV</enum><header>Other Federal improvements relating to human trafficking</header><section id="id0aef5cd7598748379fd0e6643f2e2a4c"><enum>401.</enum><header>Youthful offenders</header><subsection id="HD8156E4B94F94C4F9BE3E6A7EE40F718"><enum>(a)</enum><header>Sentencing juvenile victim offenders who have been trafficked, abused, or assaulted</header><paragraph id="HFA3BB2188D194575BA9A7DC897176F79"><enum>(1)</enum><header>Sentencing juvenile victim offenders</header><subparagraph id="H9B30EFD30E2747B9B8FEC0D6F9EABFB4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3553 of title 18, United States Code, is amended— </text><clause id="id4E969BE4C1CD4D8C93085FDA98051BE2"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating subsection (g) as subsection (i); and</text></clause><clause id="id7F94C36F00AA4B80A18CA62E987B6A84"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting after subsection (f) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H851D93DD7B6D4F1795C58FE4659A420C"><subsection id="HC935DE19E7C946F889748ACF333CE998"><enum>(g)</enum><header>Sentencing juvenile victim offenders</header><paragraph id="H58D38BE2D911483CAC54DFBF7C7F9286"><enum>(1)</enum><header>Statutory minimums</header><text>In the case of a juvenile victim offender, the court shall have the authority to impose a sentence that is below a level established by statute as a minimum sentence in recognition of the potential effect of trauma on the offender’s conduct, if the effect of trauma on the offender’s conduct is established by clear and convincing evidence.</text></paragraph><paragraph id="H98990942170A4FCD96553A128B3A7143"><enum>(2)</enum><header>Suspension of sentence</header><subparagraph id="id657761B01B6C42B581E1071600F59F8E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), in the case of a juvenile offender, the court shall have the authority to suspend any portion of an imposed sentence.</text></subparagraph><subparagraph id="id3642fc2d82414f248e09c1e1a4c2a435"><enum>(B)</enum><header>Limitation</header><text>For an offense for which the minimum sentence under the statute is not less than 10 years, the court may not suspend the sentence imposed on a juvenile victim offender to be less than 3 years.</text></subparagraph></paragraph><paragraph id="id298ce32adfba46c49dcb0da5909fbb62"><enum>(3)</enum><header>Detention</header><text>A court may order that a juvenile victim offender serve a sentence in a juvenile facility if— </text><subparagraph id="id260A1058E0564B77B53A5F310B6114EA"><enum>(A)</enum><text>the court imposes a sentence below the level established by statute as a minimum sentence under paragraph (1) or suspends in whole or in part the sentence imposed under paragraph (2); and</text></subparagraph><subparagraph id="id02012D99159444B7878A14E153BD7E9F"><enum>(B)</enum><text>the period of imprisonment imposed or that is not suspended ends not later than the 21st birthday of the juvenile victim offender. </text></subparagraph></paragraph><paragraph id="id7853f1cd29d94abfaba149fe1d2d1217"><enum>(4)</enum><header>Juvenile victim offender defined</header><text>In this subsection, the term <term>juvenile victim offender</term> means an individual who—</text><subparagraph id="H5556F474850A4936BD30F0A1931BC0F8"><enum>(A)</enum><text>has not attained the age of 18 years; and</text></subparagraph><subparagraph id="H912DCDAC496549F3985722FE4CEEF696"><enum>(B)</enum><text display-inline="yes-display-inline">has been convicted of a violent offense against a person who the court finds, by clear and convincing evidence, engaged in conduct against such individual, not earlier than 1 year before such violent offense, that is an offense under section 1591 or an offense under chapter 71, 109A, 110, or 117.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HDB05692AA1C147719AB0C23DE50BFC15"><enum>(B)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by subparagraph (A) shall apply to a conviction entered on or after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="H2D39F7C7B56548CA9D3F1FDEE6B4625D"><enum>(2)</enum><header>Directive to sentencing commission</header><text>Pursuant to its authority under section 994(p) of title 28, United States Code, and in accordance with this subsection, the United States Sentencing Commission shall review its guidelines and its policy statements with respect to juvenile victim offenders (as defined in subsection (g) of section 3553 of title 18, United States Code, as added by paragraph (1)) to ensure that the guidelines and policy statements are consistent with the amendments made by paragraph (1).</text></paragraph></subsection><subsection id="HF48185560B7E42F2BAF3ACFF7B3C0A73"><enum>(b)</enum><header>Sentencing juvenile offenders</header><paragraph id="HD44985A1FAEF43DAACD77ACB74CBE6B8"><enum>(1)</enum><header>Sentencing juvenile offenders</header><subparagraph id="HE511F459C15F4BF79663C82802D89E82"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3553 of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States Code, is amended—</text><clause id="H65AA154790134F7B96CB4B74335F92D0"><enum>(i)</enum><text>in subsection (a)—</text><subclause id="H35A941178E834C9289881946DF4B0E8F"><enum>(I)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></subclause><subclause id="H64476FDE7A8643EDAFD83FFF29F950CF"><enum>(II)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></subclause><subclause id="H8AED8DFE1F834E018731CE11450C11BC"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC011A3FCD73E4CC0A3F9E9BB70D71F2B"><paragraph id="HBB71F0C3107E42A9B73338603339A736"><enum>(8)</enum><text display-inline="yes-display-inline">in the case of a juvenile (as such term is defined in section 5031), the diminished culpability of juveniles compared to that of adults.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="H4D836B80BC4649D4A7A65C409E07A7A1"><enum>(ii)</enum><text>by inserting after subsection (g), as added by subsection (b), the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H30EC637046DE4693BA3C1998ADFCF651"><subsection id="HBF7BBCD69ACD42538A83F9C4C392F81B"><enum>(h)</enum><header>Limitation on statutory minimum for juvenile offenders</header><text display-inline="yes-display-inline">In the case of a juvenile (as such term is defined in section 5031), the court shall have the authority to impose a sentence that is 35 percent below a level established by statute as a minimum sentence so as to reflect the juvenile’s age and prospect for rehabilitation. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HABFFD0C667E54358952EC0E54F40643F"><enum>(B)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by subparagraph (A) shall apply to a conviction entered on or after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="HED4535B05A0E4FF4BC609D68FD502859"><enum>(2)</enum><header>Directive to sentencing commission</header><text>Pursuant to its authority under section 994(p) of title 28, United States Code, and in accordance with this subsection, the United States Sentencing Commission shall review its guidelines and its policy statements with respect to juveniles (as defined in section 5031 of title 18, United States Code) to ensure that the guidelines and policy statements are consistent with the amendments made by paragraph (1).</text></paragraph></subsection><subsection id="H41DA5F9EA739486D9A42A424EDADAA54"><enum>(c)</enum><header>Parole for juveniles</header><paragraph id="H2CE13EF66326422590BB374D93CFA56B"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/403">Chapter 403</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/5032">section 5032</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H05E329AC85154C0CA0A2000579A3C368"><section id="H3FCB0B837F7642258A0F4205F43F4886"><enum>5032A.</enum><header>Modification of an imposed term of imprisonment for violations of law committed prior to age 18</header><subsection id="H4D98F94F517B4B369CECD130D72B4C29"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, a court may reduce a term of imprisonment imposed upon a defendant convicted as an adult for an offense committed and completed before the defendant attained 18 years of age if—</text><paragraph id="H20E9D930A7B542D08F35E80DB185E9C3"><enum>(1)</enum><text>the defendant has served not less than 20 years in custody for the offense; and</text></paragraph><paragraph id="H52C9BF718EB5490CA26B1FB7F0C249B5"><enum>(2)</enum><text>the court finds, after considering the factors and information set forth in subsection (c), that the defendant is not a danger to the safety of any person or the community and that the interests of justice warrant a sentence modification.</text></paragraph></subsection><subsection id="H062309D304AE41E1B1313671121EB6DE"><enum>(b)</enum><header>Supervised release</header><text>Any defendant whose sentence is reduced pursuant to subsection (a) shall be ordered to serve a period of supervised release of not less than 5 years following release from imprisonment. The conditions of supervised release and any modification or revocation of the term of supervised release shall be in accordance with section 3583.</text></subsection><subsection id="HFA98C29F901A4C1996F83BDF08F08A9A"><enum>(c)</enum><header>Factors and information To be considered in determining whether To modify a term of imprisonment</header><text>The court, in determining whether to reduce a term of imprisonment pursuant to subsection (a), shall consider—</text><paragraph id="H5D012F5AD17A43A28D2FC4006EF29C7F"><enum>(1)</enum><text>the factors described in section 3553(a), including the nature of the offense and the history and characteristics of the defendant;</text></paragraph><paragraph id="HA1184EFDE9C143C78906F2BB109C1F58"><enum>(2)</enum><text>the age of the defendant at the time of the offense;</text></paragraph><paragraph id="HEAB1D807CCE2423AB0D19ECEF2E79C97"><enum>(3)</enum><text>a report and recommendation of the Bureau of Prisons, including information on whether the defendant has substantially complied with the rules of each institution in which the defendant has been confined and whether the defendant has completed any educational, vocational, or other prison program, where available;</text></paragraph><paragraph id="HED1044F9AB9C494FBB6D36666D2BC0EC"><enum>(4)</enum><text>a report and recommendation of the United States attorney for any district in which an offense for which the defendant is imprisoned was prosecuted;</text></paragraph><paragraph id="H0445241C302D4861A30939579AA1FC6B"><enum>(5)</enum><text>whether the defendant has demonstrated maturity, rehabilitation, and a fitness to reenter society sufficient to justify a sentence reduction;</text></paragraph><paragraph id="HF659F4E4D28F41D2A4A7438C3D8E4AFB"><enum>(6)</enum><text>any statement, which may be presented orally or otherwise, by any victim of an offense for which the defendant is imprisoned or by a family member of the victim if the victim is deceased;</text></paragraph><paragraph id="H4183643DD50D477C8278BE55FA6FB9FC"><enum>(7)</enum><text>any report from a physical, mental, or psychiatric examination of the defendant conducted by a licensed health care professional;</text></paragraph><paragraph id="H75B8E44C17854FE490A63A2A467925BB"><enum>(8)</enum><text>the family and community circumstances of the defendant at the time of the offense, including any history of abuse, trauma, or involvement in the child welfare system;</text></paragraph><paragraph id="H33B838F916404DDCAEDBE690930AEA0B"><enum>(9)</enum><text>the extent of the role of the defendant in the offense and whether, and to what extent, an adult was involved in the offense;</text></paragraph><paragraph id="idcb8e0c49126e492db623767bb96bcd30"><enum>(10)</enum><text>any statement, which may be presented orally or in writing, by a prosecutor or law enforcement officer who was involved in the original investigation or criminal proceeding for which the defendant is incarcerated; </text></paragraph><paragraph id="HFBE73AE6798444A3911422ABD8C175C2"><enum>(11)</enum><text>the diminished culpability of juveniles as compared to that of adults, and the hallmark features of youth, including immaturity, impetuosity, and failure to appreciate risks and consequences, which counsel against sentencing juveniles to the otherwise applicable term of imprisonment; and</text></paragraph><paragraph id="H3AEB8E62BE354CBD8FE7AB6F7E7BD2E0"><enum>(12)</enum><text>any other information the court determines relevant to the decision of the court.</text></paragraph></subsection><subsection id="H462E2A7E6E9647E19FE3F06216B5FF5D"><enum>(d)</enum><header>Limitation on applications pursuant to this section</header><paragraph id="H326D01DF183D4BE2ADD7BB6294DD4AB7"><enum>(1)</enum><header>Second application</header><text>Not earlier than 5 years after the date on which an order entered by a court on an initial application under this section becomes final, a court shall entertain a second application by the same defendant under this section.</text></paragraph><paragraph id="HA1458F9950844054965286122C220188"><enum>(2)</enum><header>Final application</header><text>Not earlier than 5 years after the date on which an order entered by a court on a second application under paragraph (1) becomes final, a court shall entertain a final application by the same defendant under this section.</text></paragraph><paragraph id="HE53CD746276F4409B6C3F6252C1FB539"><enum>(3)</enum><header>Prohibition</header><text>A court may not entertain an application filed after an application filed under paragraph (2) by the same defendant.</text></paragraph></subsection><subsection id="H2E3F765E58504538856D19B366FABEF3"><enum>(e)</enum><header>Procedures</header><paragraph id="H97BBF7B768274C438FCC77F2FC5FEAA0"><enum>(1)</enum><header>Notice</header><text>The Bureau of Prisons shall provide written notice of this section to—</text><subparagraph id="H3CFB036FE3E1411FA261D809B287F2ED"><enum>(A)</enum><text>any defendant who has served not less than 19 years in prison for an offense committed and completed before the defendant attained 18 years of age for which the defendant was convicted as an adult; and</text></subparagraph><subparagraph id="H2B8B173FC86C43DC83562340A7F04172"><enum>(B)</enum><text>the sentencing court, the United States attorney, and the Federal Public Defender or Executive Director of the Community Defender Organization for the judicial district in which the sentence described in subparagraph (A) was imposed.</text></subparagraph></paragraph><paragraph id="id873f288970eb42c082bdf8f186a75283"><enum>(2)</enum><header>Crime victims rights</header><subparagraph id="id04a31e984b0a4c009b8ae1b0b1036518"><enum>(A)</enum><header>Notice</header><text>Upon receiving notice under paragraph (1), the United States attorney shall provide any notifications required under section 3771.</text></subparagraph><subparagraph id="id0adb30a2a6624afa93fc978ff36546c2"><enum>(B)</enum><header>Victim services</header><text>Victims notified under subparagraph (A) shall be provided the same treatment and services provided by the Department of Justice to victims in similar criminal proceedings, and shall be given notice of the availability of such treatment and services when contacted under this section.</text></subparagraph></paragraph><paragraph id="H9749231F4EDF4974B8E125CAB912634E"><enum>(3)</enum><header>Application</header><subparagraph id="HB8428D9945EA4164B9C97214B1C9DA6A"><enum>(A)</enum><header>In general</header><text>An application for a sentence reduction under this section shall be filed as a motion to reduce the sentence of the defendant and may include affidavits or other written material.</text></subparagraph><subparagraph id="H9E561D00EAB3427B87D30495E667083B"><enum>(B)</enum><header>Requirement</header><text>A motion to reduce a sentence under this section shall be filed with the sentencing court and a copy shall be served on the United States attorney for the judicial district in which the sentence was imposed.</text></subparagraph></paragraph><paragraph id="H54FCDB52A72C4738BAB4F859A3035F0B"><enum>(4)</enum><header>Expanding the record; hearing</header><subparagraph id="H462F0A53A49E40B9A92789CD45431667"><enum>(A)</enum><header>Expanding the record</header><text>After the filing of a motion to reduce a sentence under this section, the court may direct the parties to expand the record by submitting additional written materials relating to the motion.</text></subparagraph><subparagraph id="H1FA5393EE66344B584F5F65C84EFF13E"><enum>(B)</enum><header>Hearing</header><clause id="H780FEEDCCC554027A7C026D1158C3E03"><enum>(i)</enum><header>In general</header><text>The court shall conduct a hearing on the motion, at which the defendant and counsel for the defendant shall be given the opportunity to be heard.</text></clause><clause id="H42CB25044937400FA731893EECE9DA51"><enum>(ii)</enum><header>Evidence</header><text>In a hearing under this section, the court may allow parties to present evidence.</text></clause><clause id="HD7303D651CBF452D83CCB4FE58D53779"><enum>(iii)</enum><header>Defendant’s presence</header><text>At a hearing under this section, the defendant shall be present unless the defendant waives the right to be present. The requirement under this clause may be satisfied by the defendant appearing by video teleconference.</text></clause><clause id="H6C434417F5614CD39B00E9684D3E7800"><enum>(iv)</enum><header>Counsel</header><text>A defendant who is unable to obtain counsel is entitled to have counsel appointed to represent the defendant for proceedings under this section, including any appeal, unless the defendant waives the right to counsel.</text></clause><clause id="HCACD72D041E044719B79AD581BC87BCB"><enum>(v)</enum><header>Findings</header><text>The court shall state in open court, and file in writing, the reasons for granting or denying a motion under this section.</text></clause></subparagraph><subparagraph id="HC1D5B5E221DA4F71B6ED9C99C2AF4340"><enum>(C)</enum><header>Appeal</header><text>The Government or the defendant may file a notice of appeal in the district court for review of a final order under this section. The time limit for filing such appeal shall be governed by rule 4(a) of the Federal Rules of Appellate Procedure.</text></subparagraph></paragraph></subsection><subsection id="H623DA80B81D64B719B983BD809A0BBF9"><enum>(f)</enum><header>Educational and rehabilitative programs</header><text>A defendant who is convicted and sentenced as an adult for an offense committed and completed before the defendant attained 18 years of age may not be deprived of any educational, training, or rehabilitative program that is otherwise available to the general prison population.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HA4FE7DEFFB994434AEBD05E0795245C6"><enum>(2)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/403">chapter 403</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/5032">section 5032</external-xref> the following:</text><quoted-block style="OLC" id="HD0541944E5D74E709C2B56D5E00C2A7C"><toc><toc-entry level="section">5032A. Modification of an imposed term of imprisonment for violations of law committed prior to age 18.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H7F8AE113A56F44EFB3D8C013572B98A8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Applicability</header><text>The amendments made by this subsection shall apply to any conviction entered before, on, or after the date of enactment of this Act.</text></paragraph></subsection></section><section id="idfc0e38d27ab345018ff34be5dab0a0cd"><enum>402.</enum><header>Prevention research</header><subsection id="idD24C51998DE14B1B90CE5D817E705948"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), acting through the Director of the Centers for Disease Control and Prevention and in coordination with the Department of Justice, the Department of Homeland Security, the Department of Housing and Urban Development, the Department of Labor, and the Department of State, including the Office to Monitor and Combat Trafficking in Persons of the Department of State, shall develop a research agenda on primary prevention of human trafficking in the United States, in accordance with Federal law. Such research agenda shall include research to support effective screening tools and primary prevention programs, including education and prevention campaigns.</text></subsection><subsection id="id8588BB6AF658443D8425D1113A434691"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the research agenda under subsection (a), the Secretary shall consult with a panel of service providers, university researchers, advocates, human trafficking prevention education experts, survivors of human trafficking, and community and faith-based organizations.</text></subsection><subsection id="idA053A7B093FF4353AE7ED910D81568A5"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report that includes—</text><paragraph id="id86f07cde1825445ebc40e5552abdc9a0"><enum>(1)</enum><text>a list of members of the panel under subsection (b) and the organization or institute each such member represents, if any;</text></paragraph><paragraph id="id131f9c6b2f2149f4a4732085beece825"><enum>(2)</enum><text>a description of the research agenda developed under subsection (a) and the plan to implement that agenda; </text></paragraph><paragraph id="id7bc7aa660f1b469b9ee28660a29a394c"><enum>(3)</enum><text>recommendations for congressional priorities to assist the Secretary in carrying out the agenda developed under subsection (a), including by effectively advancing knowledge about trafficking in persons in the United States and providing the means by which to prevent or reduce both sex and labor trafficking; and </text></paragraph><paragraph id="idbd6ee7670f254acf9688b6d358aa01a6"><enum>(4)</enum><text>recommendations for supporting State and local practitioners. </text></paragraph></subsection></section><section id="id63FCBDE046084EE48631F16E373AC45C"><enum>403.</enum><header>Reduction of barriers to obtain identity documents for trafficking survivors</header><subsection id="idF57D85C5DD2640599586E196B1BD619F"><enum>(a)</enum><header>Alternative identity documents accepted</header><text>A survivor of human trafficking or a homeless youth may provide to a Federal agency any of the following documents in lieu of a birth certificate or passport to prove identity, age, and residency of the survivor:</text><paragraph id="idf5c1eafa926149acb0ffbcfced4ba663"><enum>(1)</enum><text>A school-issued document, including a school ID, school record, or transcript.</text></paragraph><paragraph id="id551c7f89d09b4c45b6e7463e044b2fb0"><enum>(2)</enum><text>A W–2 or a 1099 tax form.</text></paragraph><paragraph id="id50b37123b0054603bccd9ea5330003bb"><enum>(3)</enum><text>A State or Federal court document.</text></paragraph><paragraph id="ida452659a08fe495ea52899ee4429a0d4"><enum>(4)</enum><text>A medical insurance policy identification card or medical record.</text></paragraph><paragraph id="id4eef3e0eb7564113a179651f4486f39c"><enum>(5)</enum><text>A United States military ID or United States military dependent ID.</text></paragraph><paragraph id="id19c2381b31504b63bd3df00680b09a70"><enum>(6)</enum><text>An employee ID or other employee record.</text></paragraph><paragraph id="idef98cd1a84ce4103b45cbd410528b263"><enum>(7)</enum><text>A vehicle registration or title.</text></paragraph><paragraph id="idb944b1b6f1394fd9b8dd2ad594af2bb7"><enum>(8)</enum><text>A Certificate of Degree of Indian Blood.</text></paragraph><paragraph id="id8c4f102f889f469d8b4b496ffd30aa4c"><enum>(9)</enum><text> A State or local government ID.</text></paragraph><paragraph id="ideb7e0f0c5e3d4250b4286e18ff47aae4"><enum>(10)</enum><text>A doctor or hospital bill.</text></paragraph><paragraph id="id926ecd90ba174d39903a83d1881fc8b6"><enum>(11)</enum><text>A utility bill.</text></paragraph><paragraph id="idffab64528cbb48cfae290cd3edf0264a"><enum>(12)</enum><text>A consular ID card.</text></paragraph><paragraph id="idd5cb11bb781d4f38b5e1b37a8a109db0"><enum>(13)</enum><text>A paycheck or paycheck stub.</text></paragraph></subsection><subsection id="id9c053104fe1449c6afbcdf4d5e8477a7"><enum>(b)</enum><header>Minors</header><text>A survivor of human trafficking who is a minor or a homeless youth shall not be required to obtain the consent or signature of the parent or guardian of the minor to receive from a Federal agency a copy of the government-issued identity card issued to the minor.</text></subsection><subsection id="ida42940feb11e47cc862125cc6d0d38a7"><enum>(c)</enum><header>Fees</header><text>Federal agencies shall not charge a survivor of human trafficking or a homeless youth a fee to obtain a copy of a government-issued identity card.</text></subsection><subsection id="id187e28ff3acb40cc8f39e8408e8cf119"><enum>(d)</enum><header>Technical assistance and grants</header><text display-inline="yes-display-inline">The Department of Justice is authorized to provide technical assistance and grants to States to encourage the States to remove existing barriers and support human trafficking survivors and homeless youth with access to personal identification documents by—</text><paragraph id="idc0d0fe58babc4584b154b42f10ea30e1"><enum>(1)</enum><text>accepting from a survivor of human trafficking or a homeless youth to prove identity, age, and residency in lieu of a birth certificate or passport, a <quote>statement of identity, residency, and date of birth</quote> from—</text><subparagraph id="id85e2bb4284364510ae5283298ae25933"><enum>(A)</enum><text>the head, or the designee of the head, of a human trafficking service provider funded by the Department of Justice or the Department of Health and Human Services;</text></subparagraph><subparagraph id="id84A2FD03F87B432F87E8A4530A75A157"><enum>(B)</enum><text>a social worker, attorney, or other direct service worker at a human trafficking service provider funded by the Department of Justice or the Department of Health and Human Services;</text></subparagraph><subparagraph id="id310edd6115134d4ea7303e6040a8be63"><enum>(C)</enum><text>a liaison described in section 722(g)(1)(J)(ii) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11432">42 U.S.C. 11432(g)(1)(J)(ii)</external-xref>);</text></subparagraph><subparagraph id="id8715c20ddda14bdaab0ad5d39968e7c3"><enum>(D)</enum><text>the head, or the designee of the head, of a shelter funded by the Department of Housing and Urban Development;</text></subparagraph><subparagraph id="idee0e0d64866e48719f0370a102377dfd"><enum>(E)</enum><text>the head, or the designee of the head, of a shelter funded by the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/34/11201">34 U.S.C. 11201 et seq.</external-xref>);</text></subparagraph><subparagraph id="id9c186121f9494ef8abc7f9e8a1f65cb6"><enum>(F)</enum><text>a local, State, Federal, or Tribal law enforcement officer; or</text></subparagraph><subparagraph id="ida5decb355c084abbb19f8a0e36b52fc4"><enum>(G)</enum><text>a local, State, Federal, or Tribal government official with responsibility for issuing personal identification documents;</text></subparagraph></paragraph><paragraph id="idb338fe338fe449ee975e008519524865"><enum>(2)</enum><text>removing any requirement that a survivor of human trafficking who is a minor or a homeless youth be required to obtain the consent or signature of the parent or guardian of the minor to receive from a Federal agency a certification or a copy of the birth record, government ID, or drivers' license of the minor; or</text></paragraph><paragraph id="idc6d34a8da2ad44f9b543aac24fed9582" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>preventing a survivor of human trafficking or homeless youth from being charged a fee for copies of the birth record, government-issued identity card, or drivers’ license of the survivor of human trafficking. </text></paragraph></subsection></section><section id="idBB12CC2DEE4D408BBB812D8DF9D33314"><enum>404.</enum><header>Cybercrime</header><text display-inline="no-display-inline">Subject to the availability of appropriations, the Attorney General and the Secretary of Homeland Security shall provide incentive pay, in an amount that is not more than 25 percent of the basic pay of the individual, to an individual appointed to a position in the Department of Justice or the Department of Homeland Security (including positions in Homeland Security Investigations), respectively, requiring significant cyber skills to aid in the protection of trafficking victims, prevention of trafficking in persons, or prosecution of buyers of and traffickers in persons, in accordance with the comparable level of the General Schedule.</text></section><section id="idb8a0ee805c47415e9fa7da3dee3d8e0e"><enum>405.</enum><header>Office of Counter-Trafficking</header><subsection id="id25A601B3F77A43EE8A474FE469F3AF1E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102 of title 49, United States Code, is amended—</text><paragraph id="id31552DCDFC944BF2BDCD5BC0D2A3E2E7"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (h) as subsection (i); and</text></paragraph><paragraph id="id8A152770B5204FB69D184594203ED127"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id20D17540EC5344F1A201FBC350B4D8BE"><subsection id="idDFF13BC90BD44DC0BDD889509B2E1F69"><enum>(h)</enum><header>Office of Counter-Trafficking</header><paragraph id="idC5EF75489AC242439DA0120B54303DE5"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established, in the Department, the Office of Counter-Trafficking (referred to in this subsection as the <quote>Office</quote>), which shall plan, coordinate, and implement department-wide counter-trafficking initiatives, including efforts to combat sex and labor trafficking.</text></paragraph><paragraph id="idEB3595C88BD74D55A25F1196EE6C0540"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The Office shall—</text><subparagraph id="idaf83efa3fbec4169813b319d9e13d79f"><enum>(A)</enum><text>collaborate with other entities of the Department to articulate the vision and priorities for anti-trafficking efforts, including grants;</text></subparagraph><subparagraph id="id42cf2671569147f397c43e377cb32c79"><enum>(B)</enum><text>expand the Transportation Leaders Against Human Trafficking initiative;</text></subparagraph><subparagraph id="id50f3242931184075b80a839f96807ebe"><enum>(C)</enum><text>facilitate stronger public-private partnerships to combat human trafficking;</text></subparagraph><subparagraph id="idaf25fbb6667f41208f08bab9d8882ea7"><enum>(D)</enum><text>develop and implement interagency counter-trafficking projects, including by coordinating with the Department of Justice, the Department of Health and Human Services, and the Department of Homeland Security;</text></subparagraph><subparagraph id="idd3a1a05c916c43fab3ed7fa7db460f9a"><enum>(E)</enum><text>create and oversee an online portal to permit transportation stakeholders to track data on measurable counter-trafficking initiatives; and</text></subparagraph><subparagraph id="id193c2c4b6a34419481607fa590d368f5"><enum>(F)</enum><text>coordinate with the Department of State to establish transportation-based counter-trafficking programs across North America and around the world.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id52404aa43fc34b7ba1441525b5be75dd" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Office of Counter-Trafficking of the Department of Transportation $1,000,000 for each of the fiscal years 2023 through 2027, which shall be used—</text><paragraph id="ide9c307a174f944c59d112b9cc580fa28"><enum>(1)</enum><text>to educate and train transportation personnel on how to identify and stop human trafficking;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id91A81716F23341BEA34F270AFA266495"><enum>(2)</enum><text display-inline="yes-display-inline">to raise awareness among transportation personnel and the traveling public on recognizing and reporting human trafficking;</text></paragraph><paragraph id="id3fd3b3c8c05947ae998065aa017294a0"><enum>(3)</enum><text>to conduct research or collect data on trafficking within the transportation sector; and</text></paragraph><paragraph id="idD886061FED064C9791BA4BEDE9673AFD" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">to provide grants to State, tribal, and local governments, United States territories, transit agencies, port authorities, metropolitan planning organizations, political subdivisions of a State or local government, a collaboration among any such entities, and qualified nonprofit organizations, for the purposes of developing and supporting human trafficking prevention programs. </text></paragraph></subsection></section><section id="id5e64a1fa752d4c73bcf8ccce00264d51"><enum>406.</enum><header>Tip organizations</header><text display-inline="no-display-inline">Section 524(c)(1) of title 28, United States Code, is amended—</text><paragraph id="ida641bca1c1564389bbe160fbbba5778c"><enum>(1)</enum><text>in subparagraph (H), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id208b8ef97fcb4ffe92c4c140fbdd26e3"><enum>(2)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idcaebc7840b6d485daa5355f00bcbc1d8"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idde48aefc06e04775a77d062d831f152e"><subparagraph id="id30902ec44d2e4106a1f1cf6d61e1076a" indent="up1"><enum>(J)</enum><text>at the discretion of the Attorney General, payments to reimburse operating expenses and program costs incurred by crime-tip organizations that— </text><clause id="idBD194759B5E34DE3B2B5870EA7BADAA7"><enum>(i)</enum><text>annually waive their qualification for— </text><subclause id="id2531EC679EBB4C11A24DAC13AF2B8926"><enum>(I)</enum><text>awards for information leading to forfeiture under subparagraph (C); and</text></subclause><subclause id="id1AB860B86033444DB28C545D9AFA05DF"><enum>(II)</enum><text>receiving payment from equitably shared forfeiture funds; and </text></subclause></clause><clause id="idD650AEBCAA4F4B7EAA9602EF33E36BD5"><enum>(ii)</enum><text>offer rewards for information about violations of Federal criminal laws prohibiting human trafficking.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id895254ec113c4cbb9261b5da8a509156"><enum>407.</enum><header>Data collection</header><subsection id="idBB75FA4F602943BFAC0836015A185925"><enum>(a)</enum><header>Disaggregated data</header><text>The Department of Justice shall collect and submit to Congress— </text><paragraph id="idB1714A0517FA41D3AE773DC4009D22EB"><enum>(1)</enum><text>disaggregated data regarding the number of victims trafficked by third parties and by family members; </text></paragraph><paragraph id="idEFC0F4E72C324A6EB65E012E1C03F714"><enum>(2)</enum><text>disaggregated data regarding victims trafficked by victim age; and</text></paragraph><paragraph id="id47D4833C9B1940549C49CE7F15852FB4"><enum>(3)</enum><text>disaggregated data regarding victims trafficked by the type of trafficking (labor, sex, labor and sex, or unknown).</text></paragraph></subsection><subsection id="idC6C939C8FD154BA1871C3D30C36C096A"><enum>(b)</enum><header>Continued presence data</header><paragraph id="id600052C10C74409AA4230645D49103DB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The data described in paragraph (2), disaggregated by type of trafficking (labor, sex, labor and sex, or unknown)—</text><subparagraph id="idE6626184AFE246A2AC155A5A189F99FA"><enum>(A)</enum><text display-inline="yes-display-inline">shall be included in the report required under section 105(d)(7) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>); </text></subparagraph><subparagraph id="id6EAF8D3115E340C1A5F6FD1C61700DE7"><enum>(B)</enum><text display-inline="yes-display-inline">should be included in reports from any Federal, State, Tribal, or local agency that receives Federal counter trafficking in persons funding; and</text></subparagraph><subparagraph id="id16BE3031519F41A09858A06999E7B88D"><enum>(C)</enum><text>for data included under subparagraph (A) or (B), shall include demographic characteristics of the victim of trafficking, including age, sex, race, ethnicity, and national origin. </text></subparagraph></paragraph><paragraph id="id117B7171EA124089BF0F727DF498061A"><enum>(2)</enum><header>Data described</header><text>The data described in this paragraph are the following:</text><subparagraph id="id0c4ca657d204431bb1a840b8ac48bb8c"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idAD181D423A66444BA862A8AD56E30347"><enum>(i)</enum><text>The number of requests for continued presence that were received from, or on behalf of, potential trafficking victims.</text></clause><clause id="id359DC7C36FE541C7AC88074B80403C0C" indent="up1"><enum>(ii)</enum><text>For each request referred to in clause (i), whether the request was filed or was not filed. </text></clause><clause indent="up1" id="id0B563F2A9FA54EFFB939D64F359A9776"><enum>(iii)</enum><text>For each request that was filed, whether the request was approved or denied.</text></clause></subparagraph><subparagraph id="id0596a8cefa8e4bcbb817cead933ae232"><enum>(B)</enum><text>In each applicable case—</text><clause id="id2EE90E64CF564D718C0A134F6A817E32"><enum>(i)</enum><text>the month and year when the continued presence request was filed;</text></clause><clause id="id318317efd6334d899666759c187ed6e3"><enum>(ii)</enum><text>if the continued presence request was not filed, the reasons for such failure to file; and</text></clause><clause id="id57c64da78c524ed2870817256119bd9f"><enum>(iii)</enum><text>if the continued presence request was denied, the reasons for such denial.</text></clause></subparagraph><subparagraph id="id77f952d427b64c3992609ffcdac47d8b"><enum>(C)</enum><text>For each potential human trafficking case described in subparagraph (A)—</text><clause id="idDA653EAB689F4D60A0B3A1EB84340697"><enum>(i)</enum><text>whether or not an investigation was initiated into the case; and </text></clause><clause id="id958C1BD97D554C3A82D8953350377034"><enum>(ii)</enum><text>if an investigation was not initiated, the reasons for such failure to investigate.</text></clause></subparagraph><subparagraph id="id3bda9b6ce30a4d6a9b99ecab8ebfa9f3"><enum>(D)</enum><text>The number of requests for T visa certifications that were received from, or on behalf of, potential trafficking victims and the outcomes of such requests, indicating whether or not a T visa certification was provided.</text></subparagraph><subparagraph id="ideeacf4bb219441b795f6d1da76f89c15"><enum>(E)</enum><text>In each applicable case—</text><clause id="id67BD1C74914F4111912F3AE986A10DEA"><enum>(i)</enum><text>the month and year when the T visa certification request for approval was submitted; and</text></clause><clause id="idB0D9838F9DE54B0581BC52396677231D"><enum>(ii)</enum><text>if such request was denied, the reasons for such denial.</text></clause></subparagraph><subparagraph id="id2724d01d65cc46ebb194fc8a2e0e8616" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>Whether an investigation was initiated into each potential human trafficking case described in subparagraph (D). </text></subparagraph></paragraph></subsection></section><section id="id3106952a26d94ce0ae6f6d9b34eb792f"><enum>408.</enum><header>Cumulative biennial report on data collection and statistics</header><text display-inline="no-display-inline">Not later than 280 days after the date of enactment of this Act, and every 2 years thereafter, the Attorney General and the Secretary of Health and Human Services shall each submit to the Committee on the Judiciary and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on the Judiciary and the Committee on Energy and Commerce of the House of Representatives the status of the required data collection and reporting requirements of the Attorney General and the Secretary, respectively, related to trafficking, which shall include the status of—</text><paragraph id="idf03e7c36cb434c358b933cec9d118729"><enum>(1)</enum><text>the study required under section 201(a)(1)(B)(ii) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20701">34 U.S.C. 20701(a)(1)(B)(ii)</external-xref>); </text></paragraph><paragraph id="idf90bac0e5b9541f1a62b1e6b50579147"><enum>(2)</enum><text>the State reports required under section 237(b) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/41309">34 U.S.C. 41309(b)</external-xref>) to be included in the Uniform Crime Reporting Program and the National Incident-Based Reporting System; </text></paragraph><paragraph id="id05ceb7baf88c422fa6e3b1fd30ecd210"><enum>(3)</enum><text>the report required under section 237(c)(1)(A) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/457">Public Law 110–457</external-xref>; 122 Stat. 5084);</text></paragraph><paragraph id="id0D94A800273B4E73A691788EC743A56C"><enum>(4)</enum><text>the report required under section 237(c)(1)(B) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 id="idc5442a755ea046f8bb569d14969376a3"><enum>409.</enum><header>Forced labor requirements</header><subsection id="id3be7d309e4a247b89f6ddcb83ab4ea1a"><enum>(a)</enum><header>Department of Justice</header><paragraph id="idDB6598FBAA6D4673BEFAFA48492CFB92"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Attorney General shall establish a team of not less than 10 agents within the Civil Rights Unit of the Federal Bureau of Investigation to be assigned to exclusively investigate labor trafficking.</text></paragraph><paragraph id="idE42A87EAB90C40C7AC5291C183333B39"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out paragraph (1) $2,000,000 for each of fiscal years 2022 to 2027, to remain available until expended.</text></paragraph></subsection><subsection id="id39291b53bb4546829a7782dad6ce8504"><enum>(b)</enum><header>Department of Homeland Security</header><paragraph id="id9E23966BCAF74275B5FE2B1E3E40CCA8"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Homeland Security shall establish a team of not less than 10 agents within the Center for Countering Human Trafficking of the Department of Homeland Security to be assigned to exclusively investigate labor trafficking.</text></paragraph><paragraph id="idBE8A62F06D13415C8BFF9ABAAC9EAB24"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out paragraph (1) $2,000,000 for each of fiscal years 2022 to 2027, to remain available until expended. </text></paragraph></subsection></section><section id="idf163006d3c84457a81d5012a8b16f39a"><enum>410.</enum><header>Homeland Security VAP</header><text display-inline="no-display-inline">Section 442 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/252">6 U.S.C. 252</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcb90f887a3f2418584a7433f5da19b21"><subsection id="id108c7efdc51b47409c8dd4cf72aaeb75"><enum>(d)</enum><header>Homeland security investigations victim assistance program</header><paragraph id="id02564bb859f8498a951d3cd0a533dd89"><enum>(1)</enum><header>In general</header><text>There is established within Homeland Security Investigations of U.S. Immigration and Customs Enforcement a Victim Assistance Program.</text></paragraph><paragraph id="id351547e4f7004babbee55388198316ab"><enum>(2)</enum><header>Functions</header><text>The Victim Assistance Program established under paragraph (1) shall—</text><subparagraph id="id13a857f28aaa4bd2ba7ed0acbe417a3c"><enum>(A)</enum><text>provide oversight, guidance, training, travel, equipment, and coordination to victim assistance personnel nationwide;</text></subparagraph><subparagraph id="id94694f39c27b48e3a66da6f94c10339a"><enum>(B)</enum><text>locate, at a minimum— </text><clause id="id3BC14CFA06984A64A08BA65F7963FF4E"><enum>(i)</enum><text>a forensic interview specialist and a victim assistance specialist in each office of the Special Agent in Charge of Homeland Security Investigations; </text></clause><clause id="idF960FC0191B84162A4F2FABE57911E9D"><enum>(ii)</enum><text>a victim assistance specialist in each office of Homeland Security Investigations participating in a human trafficking task force; </text></clause><clause id="id5BC51DCC1FB745F581287EC4839B4DDC"><enum>(iii)</enum><text>a victim assistance specialist in each regional attaché office of Homeland Security Investigations; and </text></clause><clause id="id8FBD3201DC674D1BB063DB8A8BB4B402"><enum>(iv)</enum><text>a victim assistance specialist in each office of Homeland Security Investigations participating in a child sexual exploitation task force; and</text></clause></subparagraph><subparagraph id="idf1a227bc2913457c8e028bda89abceb9"><enum>(C)</enum><text>provide training on such topics as victims’ rights, victim-related policies, roles of forensic interviewers and victim assistance specialists, and the victim-centered approach.</text></subparagraph></paragraph><paragraph id="id1E1590DA1EB349CBA97FD48C982E6B66"><enum>(3)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $25,000,000 for each of fiscal years 2022 through 2027.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idE77814A822BF42C4BD29FD8E1CD3D773"><enum>411.</enum><header>Multidisciplinary teams</header><subsection id="ide2e0a785275d4540bfe1a151bd051982"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/33">Chapter 33</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id7fdf31bf58cf40768120b5a7959a3c54"><section id="id7946c9049e1141c3b2f7a73569f35f74" section-type="subsequent-section"><enum>540D.</enum><header>Multidisciplinary teams</header><subsection id="ideb721cf988e9400aaa96f066faaf6ea0"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>child sexual abuse investigation</term> includes an investigation of child sexual abuse material. </text></subsection><subsection id="id23E32CBE539740D7BCD817DF442E4326"><enum>(b)</enum><header>Multidisciplinary teams required</header><paragraph id="id50a704dc469a418ca1d060f25f30b443"><enum>(1)</enum><header>In general</header><text>The Director of the Federal Bureau of Investigation (referred to in this section as the <quote>Director</quote>) shall establish and maintain, except as provided in paragraph (2), multidisciplinary teams on child sexual abuse and sex and labor trafficking investigations for the purposes specified in subsection (c). </text></paragraph><paragraph id="idd5ea3f3f05834a379b95be209a99e57c"><enum>(2)</enum><header>Child advocacy centers</header><text>The Director—</text><subparagraph id="idf21ac5a5d5904183b064ab3e0d48ed3c"><enum>(A)</enum><text>may work with local child advocacy centers to provide appropriate multidisciplinary investigations of child sexual abuse and other investigations; and</text></subparagraph><subparagraph id="id5cdbf48b2b554f3d848ee548fedc0ce0"><enum>(B)</enum><text>shall allow, facilitate, and encourage multidisciplinary teams to collaborate with appropriate child advocacy centers with regard to availability, provision, and use of services to and by such victims and families.</text></subparagraph></paragraph><paragraph id="id1beda588b06445099ae97dabc6449ea6"><enum>(3)</enum><header>Memoranda of understanding</header><text>The Director shall seek to enter into a memorandum of understanding with a national reputable accrediting organization for children's advocacy centers under which—</text><subparagraph id="idb50270fd4f424d6e98e3be9f9aa0b038"><enum>(A)</enum><text>the children’s advocacy services of the national organization are made available to all field offices of the Federal Bureau of Investigation in the continental United States; and</text></subparagraph><subparagraph id="id3d4581d539144399a0da463d224b9c35"><enum>(B)</enum><text>special agents and other employees of the Federal Bureau of Investigation are made aware of the existence of such memoranda and its purposes.</text></subparagraph></paragraph></subsection><subsection id="idee992ee16a694b97a3de135e766d7397"><enum>(c)</enum><header>Purposes</header><text>The purposes of each multidisciplinary team maintained under subsection (b) shall be as follows:</text><paragraph id="id09df0594fe7a4289a8bef429c79bad1a"><enum>(1)</enum><text>To provide for the sharing of information among such team and other appropriate personnel regarding the progress of investigations into and resolutions of incidents of child sexual abuse and sex and labor trafficking reported to or otherwise investigated by the Federal Bureau of Investigation. </text></paragraph><paragraph id="id5cc4158e63264ef1aa85358c1e7ac0ab"><enum>(2)</enum><text>To provide for and enhance collaborative efforts among such team and other appropriate personnel regarding investigations into the abuse.</text></paragraph><paragraph id="ideb75869afa144f07afcf6ad612afa260"><enum>(3)</enum><text>To enhance the social services available to victims in connection with such incidents, including through the enhancement of cooperation among specialists and other personnel providing such services in connection with such incidents.</text></paragraph><paragraph id="id0852b86677404d4b911f537e9266167d"><enum>(4)</enum><text>To carry out other duties regarding the response to child sexual abuse investigations.</text></paragraph></subsection><subsection id="id8f3283e6b6954d95a1ca438bbb3cd2f3"><enum>(d)</enum><header>Personnel</header><paragraph id="id67f70ef7ef684ec085752b2d2e460512"><enum>(1)</enum><header>In general</header><text>Each multidisciplinary team maintained under subsection (b) shall be composed of the following:</text><subparagraph id="id230c98ea1e7549d1ace0447bdbab29bf"><enum>(A)</enum><text>Appropriate investigative personnel.</text></subparagraph><subparagraph id="idf032d3d002bf4886b57f8dd8789a5d72"><enum>(B)</enum><text>Appropriate mental health professionals.</text></subparagraph><subparagraph id="idc82c0a7d9c7245debe6aa0dec7b2ddba"><enum>(C)</enum><text>Appropriate medical personnel.</text></subparagraph><subparagraph id="idb72e872f4f95486e86380977f80a5e5f"><enum>(D)</enum><text>Family advocacy case workers.</text></subparagraph><subparagraph id="id53cff0d6cc884cc3bf0b4d13131bfd8f"><enum>(E)</enum><text>Child advocacy center personnel.</text></subparagraph><subparagraph id="id410458ABACFB4DBA85CC3971B5901C66"><enum>(F)</enum><text>Appropriate prosecutors.</text></subparagraph></paragraph><paragraph id="id18be344d3d1f4697b93aadb842db14cd"><enum>(2)</enum><header>Expertise and training</header><subparagraph id="idee4a11437d4649f3a3e1f22ab7ee1b9f"><enum>(A)</enum><header>In general</header><text>Any individual assigned to a multidisciplinary team shall possess such expertise, and shall undertake such training as is required to maintain such expertise, in order to ensure that members of the team remain appropriately qualified to carry out the purposes of the team under this section.</text></subparagraph><subparagraph id="id2648552f24344d35953c54a6fd0ab897"><enum>(B)</enum><header>Requirement</header><text>The training and expertise required under subparagraph (A) shall include training and expertise on special victims’ crimes, including child sexual abuse.</text></subparagraph></paragraph></subsection><subsection id="id21814c20b08b4a1ba47106cefaaab3b5"><enum>(e)</enum><header>Sharing of information</header><paragraph id="id90DC184809D04DC4B587A495E28E20DB"><enum>(1)</enum><header>Access to information</header><text>Personnel of child advocacy centers who are assigned to work on an investigation under this section shall be granted access to the case information necessary to perform their role conducting forensic interviews, providing mental health treatment, medical care, and victim advocacy for Federal Bureau of Investigation cases. </text></paragraph><paragraph id="id99AA4A6C316F4AEC988E0A629E51BDCC"><enum>(2)</enum><header>Sharing information with FBI</header><text>Child advocacy centers shall provide the Federal Bureau of Investigation with forensic interview recordings and documentation, medical reports, and other case information on Federal Bureau of Investigation-related cases. </text></paragraph><paragraph id="id08dec4381d6d40a4a84c6ace984f2636" commented="no"><enum>(3)</enum><header>Security clearances</header><subparagraph commented="no" id="id4CD18301881846CCB9EA1B2239D22847"><enum>(A)</enum><header>In general</header><text>The Federal Bureau of Investigation shall provide security clearances to not more than 20 individuals who are personnel of child advocacy centers for purposes of case review by multidisciplinary teams.</text></subparagraph><subparagraph commented="no" id="idA01BC1459A054F6983A349B591EE8A71"><enum>(B)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated such sums as are necessary to carry out subparagraph (A). </text></subparagraph></paragraph></subsection><subsection id="id9927fb07bc45460cb183849eaca2a083"><enum>(f)</enum><header>Use of teams</header><text>Multidisciplinary teams required under this section shall be made available for minor and adolescent reporting of child sexual abuse, as well as adult reporting of child sexual abuse.</text></subsection><subsection id="idcb34f711ce70428a9eb2b7e27707de82"><enum>(g)</enum><header>Case review by multidisciplinary team</header><text>Child sexual abuse investigations shall be regularly reviewed by a multidisciplinary team under this section at regularly scheduled times to—</text><paragraph id="id2476B73EAA30487B9F3405E0601DC6AA"><enum>(1)</enum><text>share information about case progress; </text></paragraph><paragraph id="id7A8D02820D144DE495CB0AF5A32F5B6F"><enum>(2)</enum><text>address any investigative or prosecutorial barriers; and</text></paragraph><paragraph id="idE487D8CAE9DD42CCA63CA35089295A1B"><enum>(3)</enum><text>ensure that victims receive support and needed treatment.</text></paragraph></subsection><subsection id="idF8605C8F83414D0A83A98D284E653B19"><enum>(h)</enum><header>Availability of victim advocates</header><text>The Director shall make victim advocates available to all reporting victims.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idcc5fa9c7c9594d50acd84a640daed49b"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/33">chapter 33</external-xref> of title 28, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/28/540C">section 540C</external-xref> the following:</text><quoted-block style="USC"
