technical assistance for service providers</header><subsection id="idCBECEA12E79C4FF494AFEBB760942E40" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 111(c)(1) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20708">34 U.S.C. 20708(c)(1)</external-xref>) is amended by inserting <quote>, which may include programs to build law enforcement capacity to identify and respond to human trafficking that are funded through the Office of Community Oriented Policing Services of the Department of Justice, such as the Interdiction for the Protection of Children Program</quote> before the semicolon.</text></subsection><subsection id="idc0af67f359ee453681a26bb6094cd60b" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 107(c)(4)(A) of the Victims of Trafficking and Violence Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(c)(4)(A)</external-xref>) is amended by inserting <quote>in order to fulfill the purposes described in section 111 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20708">34 U.S.C. 20708</external-xref>)</quote> before the period at the end. </text></subsection></section><section id="id23E834F46A3A4275BCEE35A730C8D341" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Technical and clarifying update to civil remedy</header><text display-inline="no-display-inline">Section 1595(a) of title 18, United States Code, is amended by inserting <quote>or attempts or conspires to benefit,</quote> after <quote>whoever knowingly benefits,</quote>.</text></section><section id="id0ecde5144afb40408eae0a947607cfbc" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Ensuring protection and confidentiality for survivors of human trafficking</header><text display-inline="no-display-inline">The Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF42176F5FA43495EA912E091BF18F8ED"><section id="id781a018ac2a34c50b2fc341a8c48940e" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>114.</enum><header display-inline="yes-display-inline">Ensuring protection and confidentiality for survivors of human trafficking</header><subsection id="idA3E80513C4654856A68447B5D715EBD3" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section— </text><paragraph id="id4B0DED31A31D493688839423E72F79D1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>covered grant</term> means a grant from the Attorney General or the Secretary of Health and Human Services under section 106(b), 107(b), or 107(f); and</text></paragraph><paragraph id="idCEB2BB8BF674420CA57B74E414388E69" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered recipient</term> means a grantee or subgrantee receiving funds under a covered grant.</text></paragraph></subsection><subsection id="idd879ad2792544f138a6b03aa8314e543" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Grant conditions</header><text display-inline="yes-display-inline">Covered grants and covered recipients shall be subject, at the election of the Attorney General or the Secretary of Health and Human Services, as applicable, to—</text><paragraph commented="no" display-inline="no-display-inline" id="id315514d2c4ad49b8b7f4f63c0741c58c"><enum>(1)</enum><text display-inline="yes-display-inline">the conditions under section 40002(b)(2) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(b)(2)</external-xref>) that apply with respect to grants under such Act and grantees and subgrantees for such grants; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45cd20fc5cba4f7fbd172ccbff17a8f9"><enum>(2)</enum><text display-inline="yes-display-inline">the conditions under section 306(c)(5) of the Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10406">42 U.S.C. 10406(c)(5)</external-xref>) that apply with respect to grants under such Act and grantees and subgrantees for such grants.</text></paragraph></subsection><subsection id="id649179337bac46c78ad7c3e3c57755e8" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Department of Justice-sponsored research</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit a covered recipient from sharing personally identifying information with researchers seeking the information for the purposes of conducting research—</text><paragraph id="id1fdf958806b0476790ce758ead5be4d2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">that is funded by the Department of Justice;</text></paragraph><paragraph id="id2a12b3068b974a66aa5bfc9530896f16" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">for which protections are in place in accordance with the requirements under part 22 of title 28, Code of Federal Regulations, or any successor thereto, and section 812(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10231">34 U.S.C. 10231(a)</external-xref>); and</text></paragraph><paragraph id="id3bcde627d477479fb2dac00519febab9" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">for which a current privacy certificate is on file documenting how the researchers intend to fulfill the obligations under such part 22.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="id00A1ABC9267447798DB2D229023834F7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Grants for State improvements</header><subsection id="id68609DDB96E2441E9DD7A84F8F805BF1" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Enhancing the ability of State, local, and Tribal child welfare agencies to identify and respond to children who are, or are at risk of being, victims of trafficking</header><paragraph id="idF85E3A61820E40BA94846EC4EC5DE304" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title II of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20701">34 U.S.C. 20701 et seq.</external-xref>) is amended by inserting after section 204 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFB13DD4D31594B7F848206044729A256"><section commented="no" display-inline="no-display-inline" id="IDF3609288506B40E2862474F7F05C311F" section-type="subsequent-section"><enum>204A.</enum><header display-inline="yes-display-inline">Enhancing the ability of State, local, and Tribal child welfare agencies to identify and respond to children who are, or are at risk of being, victims of trafficking</header><subsection commented="no" display-inline="no-display-inline" id="id5e5e3639-61bd-4f0d-a6df-485e3998d822"><enum>(a)</enum><header display-inline="yes-display-inline">Grants To enhance child welfare services</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services may make grants to eligible States to develop, improve, or expand programs that assist State, local, or Tribal child welfare agencies with identifying and responding to— </text><paragraph commented="no" display-inline="no-display-inline" id="id19A598FB22C64066AF4CE4C39531ED5C"><enum>(1)</enum><text display-inline="yes-display-inline">children considered victims of <quote>child abuse and neglect</quote> and of <quote>sexual abuse</quote> under the application of section 111(b)(1) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106g">42 U.S.C. 5106g(b)(1)</external-xref>) because of being identified as being a victim or at risk of being a victim of a severe form of trafficking in persons; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idD0E082C3DFC242D1B09C79C4DAB05F18"><enum>(2)</enum><text display-inline="yes-display-inline">children over whom such agencies have responsibility for placement, care, or supervision and for whom there is reasonable cause to believe are, or are at risk of being a victim of 1 or more severe forms of trafficking in persons. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="id465DA2AFC5FE43C1AE01CB16A3A1C136"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph display-inline="no-display-inline" commented="no" id="idEF0AE065D22647C886A62F26657FEFE8"><enum>(1)</enum><header display-inline="yes-display-inline">Child</header><text display-inline="yes-display-inline">The term <term>child</term> means an individual who has not attained 18 years of age or such older age as the State has elected under section 475(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/675">42 U.S.C. 675(8)</external-xref>). At the option of an eligible State, such term may include an individual who has not attained 26 years of age. </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id5916C3DA09BE44E2BB1E70EC1207D37B"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible State</header><text display-inline="yes-display-inline">The term <term>eligible State</term> means a State that has not received more than 3 grants under this section and meets 1 or more of the following criteria:</text><subparagraph display-inline="no-display-inline" commented="no" id="id9D47702F133549D6B48FD925EAE1A6D4"><enum>(A)</enum><header display-inline="yes-display-inline">Elimination of third party control requirement</header><text display-inline="yes-display-inline">The State has eliminated or will eliminate any requirement relating to identification of a controlling third party who causes a child to engage in a commercial sex act in order for the child to be considered a victim of trafficking or a victim of 1 or more severe forms of trafficking in persons for purposes of accessing child welfare services and care.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id26AF90A996424832BC851D6C93A290E7"><enum>(B)</enum><header display-inline="yes-display-inline">Application of standard for human trafficking</header><text display-inline="yes-display-inline">The State considers a child to be a victim of trafficking if the individual is a victim of a severe form of trafficking in persons, as described in subparagraph (A) of section 103(11) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(11)</external-xref>).</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idE92F4AF74BCD44AFB92BEA112A15160F"><enum>(C)</enum><header display-inline="yes-display-inline">Development and implementation of State child welfare plan protocols</header><text display-inline="yes-display-inline">The State agency responsible for administering the State plan for foster care and adoption assistance under part E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>) has developed and is implementing or will develop and implement protocols that meet the following reporting requirements:</text><clause id="ide62796366cfe46df86f5b02c4a303ee3" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">The requirement to report immediately, and in no case later than 24 hours after receiving, information on children who have been identified as being a victim of a severe form of trafficking in persons to law enforcement authorities under paragraph (34)(A) of section 471(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/671">42 U.S.C. 671(a)</external-xref>).</text></clause><clause id="id3c1e85459a834c7b9b6c43428efbd82c" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">The requirement to report immediately, and in no case later than 24 hours after receiving, information on missing or abducted children to law enforcement authorities, including children classified as <quote>runaways</quote>, for entry into the National Crime Information Center (NCIC) database of the Federal Bureau of Investigation, and to the National Center for Missing and Exploited Children, under paragraph (35)(B) of such section. </text></clause><clause id="id316ab1fbed4a4eb7872d07f1f070f2d5" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">The requirement to report to the Secretary of Health and Human Services the total number of children who are victims of child human trafficking under paragraph (34)(B) of such section. </text></clause></subparagraph><subparagraph id="id77bedc2f7a0d439e9e32459d461a6f1f" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Trafficking-specific protocol</header><text display-inline="yes-display-inline">The State has developed and implemented or will develop and implement a specialized protocol for responding to a child who is, or is at risk of being, a trafficking victim to ensure the response focuses on the child’s specific safety needs as a victim of trafficking, and that includes the development and use of an alternative mechanism for investigating and responding to cases of child human trafficking in which the alleged offender is not the child’s parent or caregiver without utilizing existing processes for investigating and responding to other forms of child abuse or neglect that require the filing of an abuse or neglect petition. </text></subparagraph></paragraph><paragraph id="idCA9980DA3DBD4EFEBDB8195C75D2C3F4" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Indian tribe; tribal organization</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> and <term>tribal organization</term> have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id8D1E648DC79641B7889A0E7564704707"><enum>(4)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands. Such term includes an Indian tribe, tribal organization, or tribal consortium with a plan approved under section 479B of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/679c">42 U.S.C. 679c</external-xref>), or which is receiving funding to provide foster care under part E of title IV of such Act pursuant to a cooperative agreement or contract with a State.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph><paragraph id="idEBFBBDD17B9F47A1A27E1F26E67C654A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/164">Public Law 109–164</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101</external-xref> note) is amended by inserting after the item relating to section 204 the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id9DE9AC450D1144718A0DBB1DF82A3548"><toc><toc-entry level="section" bold="off">204A. Enhancing the ability of State, local, and Tribal child welfare agencies to identify and respond to children who are, or are at risk of being, victims of trafficking.</toc-entry></toc><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id88A7C26247A949A595EC3831CDF8E921" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Section 113(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7110">22 U.S.C. 7110(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A423C4DB15A41579DD64DC9D675C04F"><paragraph commented="no" display-inline="no-display-inline" id="ID71322B79064E4790B13B1BB526B386A3"><enum>(3)</enum><header display-inline="yes-display-inline">Grants for State improvements</header><text display-inline="yes-display-inline">To carry out the purposes of section 204A of the Trafficking Victims Protection Reauthorization Act of 2005, there are authorized to be appropriated $4,000,000 to the Secretary of Health and Human Services for each of fiscal years 2022 through 2027.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id606a36a6dd84480eb5748a627c68ab49" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Sense of Congress regarding health care professionals and trafficking prevention</header><text display-inline="yes-display-inline">It is the sense of Congress that health care and social service licensing boards and professional membership associations should facilitate access to trafficking-specific training guided by the Department of Health and Human Service’s Core Competencies for Human Trafficking Response in Health Care and Behavioral Health Systems on— </text><paragraph id="idc9eddb728b6c49e38f0b2be21b40066a" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the scope and signs of human trafficking and child sexual abuse that present in the applicable health care, behavioral health, or social services settings;</text></paragraph><paragraph id="id1464bba445ba4c5f9c7ad94f4bf1e1a5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">how to interact with potential victims of trafficking (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) and with survivors of human trafficking, using an age-appropriate, gender-responsive, culturally and linguistically appropriate, and trauma-informed approach; and</text></paragraph><paragraph id="id9f8d5127274f4f65b5cb58cb42d69e51" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the manner in which to respond to victims and potential victims of trafficking or child sexual exploitation and abuse.</text></paragraph></subsection></section><section id="idd22eb25caa2c40ccaed63f7e4a590245" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Additional reauthorization</header><subsection id="id7A184BB0D9024259A1F493B8B6D7750C" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Airport personnel training To identify and report human trafficking victims</header><text display-inline="yes-display-inline">Section 303 of the Frederick Douglass Trafficking Victims Prevention and Protection Reauthorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/425">Public Law 115–425</external-xref>; and</text></paragraph><paragraph id="id9E7E1E13ADBA4F06B7C38B71F8DA43AF" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">increase the number of Federal prosecutions of cybercrimes against individuals.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id81a4abee8f9a4a01bb5a40335c866ed1"><enum>(b)</enum><header display-inline="yes-display-inline">Reporting on cybercrime taxonomy</header><text display-inline="yes-display-inline">Section 3(c) of the Better Cybercrime Metrics Act (<external-xref legal-doc="usc" parsable-cite="usc/34/30109">34 U.S.C. 30109</external-xref> note) is amended, in the matter preceding paragraph (1), by inserting <quote>, which shall include the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives,</quote> after <quote>committees of Congress</quote>.</text></subsection></section></subtitle><subtitle id="idf6f7314023c240fe88bacd4b377e71c6" commented="no" level-type="subsequent"><enum>B</enum><header display-inline="yes-display-inline">Prioritizing online threat enforcement</header><section id="id44A5B01A798E449D829046511F0F0809" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>321.</enum><header display-inline="yes-display-inline">Improved investigative and forensic resources for enforcement of laws related to cybercrimes against individuals</header><text display-inline="no-display-inline">Subject to the availability of appropriations to carry out this section, the Attorney General, in consultation with the Director of the Federal Bureau of Investigation and the Secretary of Homeland Security, including the Executive Associate Director of Homeland Security Investigations, shall, with respect to cybercrimes against individuals— </text><paragraph id="id502c319edf174fb99bba45005bb1a796" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that there are not fewer than 10 additional operational agents of the Federal Bureau of Investigation designated to support the Criminal Division of the Department of Justice in the investigation and coordination of cybercrimes against individuals;</text></paragraph><paragraph id="id99c74e9f055745729ecc7f181a55140c" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that each office of a United States Attorney designates at least 1 Assistant United States Attorney as responsible for investigating and prosecuting cybercrimes against individuals; and</text></paragraph><paragraph id="id60773a12177d4a59a75d27520fe13a28" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">ensure the implementation of a regular and comprehensive training program—</text><subparagraph id="id266654ef4e184a079fe92bc4ada2689b" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the purpose of which is to train agents of the Federal Bureau of Investigation in the investigation and prosecution of such crimes and the enforcement of laws related to cybercrimes against individuals; and</text></subparagraph><subparagraph id="id9505eb27fdb648b7a717bded201959bd" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">that includes relevant forensic training related to investigating and prosecuting cybercrimes against individuals.</text></subparagraph></paragraph></section><section id="id6ba4170713ff4c7d981e729ac3b9ea20" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>322.</enum><header display-inline="yes-display-inline">Report</header><subsection id="id7ed2c532e9354e89bb10998fbb0fa892" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the National Academy of Sciences submits the report required under section 3(c) of the Better Cybercrime Metrics Act (<external-xref legal-doc="usc" parsable-cite="usc/34/30109">34 U.S.C. 30109</external-xref> note), and once each year thereafter, the Director of the Office for Victims of Crime shall submit a report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives that addresses, to the extent data are available, the nature, extent, and amount of funding under the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101 et seq.</external-xref>) for victims of cybercrimes against individuals.</text></subsection><subsection id="id9db6d09706284794b3e644b0c0863f87" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report required under subsection (a) shall include—</text><paragraph id="id6acbd853d2864b4391971c2cf61f4d22" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">an analysis of victims’ assistance, victims’ compensation, and discretionary grants under which victims of cybercrimes against individuals received assistance; 116 Stat. 2256).</text></paragraph></subsection><subsection id="id28b23c953f4e44f0ad039990a32bb130" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Clarification with respect to continuing registration</header><text display-inline="yes-display-inline">Section 240(b) of William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/22/212b">22 U.S.C. 212b(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd00193d5fc8643b2993c2910effff86f"><paragraph id="id87da496c41b54ffa80fd3c2f8085461a" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Clarification with respect to continuing registration</header><text display-inline="yes-display-inline">An individual may not be issued or reissued a passport without a unique identifier solely because the individual has moved or otherwise resides outside the United States.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section id="id8BC5A307B7C04CEF9992A289756F3074" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>324.</enum><header display-inline="yes-display-inline">Training and technical assistance for States</header><text display-inline="no-display-inline">The Attorney General, in consultation with the Secretary of Homeland Security, the Director of the United States Secret Service, the Executive Associate Director of Homeland Security Investigations, and nongovernmental and survivor stakeholders, shall create, compile, evaluate, and disseminate materials and information, and provide the necessary training and technical assistance, to assist States and units of local government in—</text><paragraph id="idd141d956a432422f963b348f9142fa6f" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">investigating, prosecuting, pursuing, preventing, understanding, and mitigating the impact of—</text><subparagraph id="id1a55112de4d4491ca667f4b82da4043e" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">physical, sexual, and psychological abuse of cybercrime victims, including victims of human trafficking that is facilitated by interactive computer services;</text></subparagraph><subparagraph id="idd5d2996d844c424b84039c02c12f438f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">exploitation of cybercrime victims; and</text></subparagraph><subparagraph id="idbdaba71940684e6a8c8b14be82e9420c" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">deprioritization of cybercrime; and</text></subparagraph></paragraph><paragraph id="id16d8e2a4b32d43089a5f5a52986fa6f0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">assessing, addressing, and mitigating the physical and psychological trauma to victims of cybercrime. </text></paragraph></section></subtitle></title><title id="id94AB69C39A784E059A6CDC46588AD326" style="OLC" commented="no" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Other Federal improvements relating to human trafficking</header><section id="idBB12CC2DEE4D408BBB812D8DF9D33314" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Cybercrime</header><text display-inline="no-display-inline">Subject to the availability of appropriations, and in accordance with the comparable level of the General Schedule, the Attorney General and the Secretary of Homeland Security shall provide incentive pay, in an amount that is not more than 25 percent of the basic pay of the individual, to an individual appointed to a position in the Department of Justice (including the Federal Bureau of Investigation) or the Department of Homeland Security (including positions in Homeland Security Investigations), respectively, requiring significant cyber skills, including to aid in— </text><paragraph id="id2E523C42FD9643CDB84A46CEB5B9631E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the protection of trafficking victims; </text></paragraph><paragraph id="id5019DFEBE99C4205B8DCFADB59B43305" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the prevention of trafficking in persons; or </text></paragraph><paragraph id="id3CA05B5829A44E7EA18568E0A76A9F21" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the prosecution of technology-facilitated crimes against children by buyers or traffickers in persons.</text></paragraph></section><section id="id4EBB19C264484296A54934D02C877A1E" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Elimination of barriers</header><subsection id="id206950ff0e214c12be54054eafdfeba6" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Minors</header><text display-inline="yes-display-inline">A Federal agency may not require a survivor of human trafficking who is less than 18 years of age or a homeless youth to obtain the consent or signature of the parent or guardian of the survivor or homeless youth to receive a copy of a Government-issued identity card issued to the survivor or homeless youth.</text></subsection><subsection id="idf26543fe9a894262948802efd33d2348" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Fees</header><text display-inline="yes-display-inline">A Federal agency may not charge a survivor of human trafficking or a homeless youth a fee to obtain a copy of a Government-issued identity card issued to the survivor or homeless youth. </text></subsection></section><section id="id5e64a1fa752d4c73bcf8ccce00264d51" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>403.</enum><header display-inline="yes-display-inline">Tip organizations</header><text display-inline="no-display-inline">Section 524(c)(1) of title 28, United States Code, is amended—</text><paragraph id="ida641bca1c1564389bbe160fbbba5778c" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id208b8ef97fcb4ffe92c4c140fbdd26e3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (I), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="idcaebc7840b6d485daa5355f00bcbc1d8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idde48aefc06e04775a77d062d831f152e"><subparagraph id="id30902ec44d2e4106a1f1cf6d61e1076a" indent="up1" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">at the discretion of the Attorney General, payments to reimburse operating expenses and program costs incurred by crime-tip organizations that— </text><clause id="idBD194759B5E34DE3B2B5870EA7BADAA7" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">annually waive their qualification for— </text><subclause id="id2531EC679EBB4C11A24DAC13AF2B8926" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">awards for information leading to forfeiture under subparagraph (C); and</text></subclause><subclause id="id1AB860B86033444DB28C545D9AFA05DF" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">receiving payment from equitably shared forfeiture funds; and </text></subclause></clause><clause id="idD650AEBCAA4F4B7EAA9602EF33E36BD5" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">offer rewards for information about violations of Federal criminal laws prohibiting human trafficking.</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="id895254ec113c4cbb9261b5da8a509156" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>404.</enum><header display-inline="yes-display-inline">Data collection</header><text display-inline="no-display-inline">Section 105(d)(7) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>) is amended—</text><paragraph id="id29C42A11522440BCA9C872371DA223C6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (Q)—</text><subparagraph id="id4C3ED225D6BA4DFBA49BCC82393EF8E8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (vii), by adding <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="id1F9BA971CF3841A291297FA631843D4C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (viii), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="idA0BFE6667E394F428129663436750F0A" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text display-inline="yes-display-inline">disaggregated data regarding— </text><clause id="idDEEA912F0CCF40E8920945D381730B20" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the number of victims trafficked by third parties and by family members;</text></clause><clause id="id6d96ab58d6fe42fa9cc2270fd506924b" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">victims trafficked by victim age; and</text></clause><clause id="iddc11a5693c094f04b3ff44fa1801e417" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">victims trafficked by the type of trafficking.</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section><section id="id3106952a26d94ce0ae6f6d9b34eb792f" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>405.</enum><header display-inline="yes-display-inline">Cumulative biennial report on data collection and statistics</header><text display-inline="no-display-inline">Not later than 280 days after the date of enactment of this Act, and every 2 years thereafter, the Attorney General and the Secretary of Health and Human Services shall each submit to the Committee on the Judiciary and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on the Judiciary and the Committee on Energy and Commerce of the House of Representatives the status of the required data collection and reporting requirements of the Attorney General and the Secretary, respectively, related to trafficking, which shall include the status of—</text><paragraph id="idf03e7c36cb434c358b933cec9d118729" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the study required under section 201(a)(1)(B)(ii) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20701">34 U.S.C. 20701(a)(1)(B)(ii)</external-xref>); </text></paragraph><paragraph id="idf90bac0e5b9541f1a62b1e6b50579147" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the State reports required under section 237(b) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/34/41309">34 U.S.C. 41309(b)</external-xref>) to be included in the Uniform Crime Reporting Program and the National Incident-Based Reporting System;
