which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to establish a funding program for supporting EMS organizations, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EMS Staffing and Support Act</short-title></quote>.</text></section><section id="idF6E64CBC30FC4AB1AA79B9F29F3C75E2"><enum>2.</enum><header>EMS organization funding</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id39178CAB76C046EB9F1B35A3F0EA359A"><section id="id764977EE81D841258A2060600D66236D"><enum>399V–7.<?LEXA-Enum 399V–7.?></enum><header>EMS organization funding</header><subsection id="id2B3012CAB4E1403CB43EFD4569AF5D81"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="id0CFCEFD6E77B4859BA91BF88EE2BD164"><enum>(1)</enum><header>Indian Tribe; Tribal organization</header><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given such terms in section 4 of the Indian Self-Determination and Education Assistance Act.</text></paragraph><paragraph id="id30D14FC5D9944DEB830D0F73ECBD8251"><enum>(2)</enum><header>EMS organization</header><text>The term <term>EMS organization</term> means a public or private entity that provides medical transport and emergency medical services. </text></paragraph><paragraph id="id0414D03E4231404D8AFAF8216DAAFB14" commented="no"><enum>(3)</enum><header>Emergency medical services</header><text>The term <term>emergency medical services</term> has the meaning given such term in section 330J(e).</text></paragraph><paragraph id="id9DEABB036998498D8076829953CA6E5F"><enum>(4)</enum><header>Qualified applicant</header><text>The term <term>qualified applicant</term> means—</text><subparagraph id="idFD6AE478786A46D7A5947AE410D0B9F9"><enum>(A)</enum><text>an EMS organization, other than an EMS organization that operates for profit; </text></subparagraph><subparagraph id="id608837C0C7964A0AA1B737215BC8FE92"><enum>(B)</enum><text>a State, Indian Tribe, Tribal organization, county, or municipality; or</text></subparagraph><subparagraph id="id44168B6320B14E50A7827362CCD7130B"><enum>(C)</enum><text>any other nonprofit organization that represents the interests of EMS organizations. </text></subparagraph></paragraph><paragraph id="id4B717B0E43B84394BC011698B39DD7C1" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, American Samoa, Guam, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States.</text></paragraph></subsection><subsection id="idF4CEC6520E044E7A9C07C94BF1058AEC"><enum>(b)</enum><header>Competitive grants</header><paragraph id="id9374951D0183453681E4EEF36B253FF2"><enum>(1)</enum><header>In general</header><text>Beginning in fiscal year 2023, the Secretary, acting through the Administrator of the Health Resources and Services Administration, shall award grants on a competitive basis to qualified applicants to carry out activities described in subsection (d) in order to support EMS organizations in the United States. </text></paragraph><paragraph id="id2A4D8BC8591D45D589BAFD598BB174AC"><enum>(2)</enum><header>Applications</header><subparagraph id="id167F19F7BD494B449D3C055A552D6064"><enum>(A)</enum><header>In general</header><text>A qualified applicant seeking a grant under this subsection shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require, including—</text><clause id="id04A7B614A6D348CD8B089332F0A9680C"><enum>(i)</enum><text>a description of the financial need of the qualified applicant (or each qualified applicant in the case of a joint application described in subparagraph (B)); and</text></clause><clause id="id34DB93F2EDDC469299D742382CE59494"><enum>(ii)</enum><text>an analysis of the costs and benefits, with respect to improving medical transport and emergency medical services, of the activities to be carried out through the grant. </text></clause></subparagraph><subparagraph id="id5340099636EE48B8AA43E6DD56089FE9"><enum>(B)</enum><header>Joint applications</header><text>A qualified applicant may submit a joint application with 1 or more other qualified applicants under this subsection.</text></subparagraph><subparagraph id="idFC60459F442F4579813F27FE6215747B"><enum>(C)</enum><header>Peer review of grant applications</header><clause id="id7262FEA1564D49DFA9213D02F85C2521"><enum>(i)</enum><header>In general</header><text>The Secretary, after consultation with national emergency medical services organizations, shall appoint emergency medical service personnel to conduct peer reviews of applications received under this subsection.</text></clause><clause id="id8CC7E1ED777E44CF8E6156259769EF1C"><enum>(ii)</enum><header>Applicability of Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to activities carried out under this subparagraph.</text></clause></subparagraph><subparagraph id="id808534FBDD0B4C158FD73B7ED0A532AC"><enum>(D)</enum><header>Prioritization of grant awards</header><text>In awarding grants under this subsection, the Secretary shall consider each of the following:</text><clause id="idead2ad30327441ec92c40537a3dfc3ed"><enum>(i)</enum><text>The findings and recommendations of the peer reviews carried out under subparagraph (C).</text></clause><clause id="idc545260897a34cceaae4f238c02c890f"><enum>(ii)</enum><text>The degree to which an award will improve the coverage, response times, and ability of EMS organizations to provide medical transport and emergency medical services.</text></clause><clause id="idf6b7cc98aed0418c99129406a44eda98"><enum>(iii)</enum><text>The extent of the need of an applicant for a grant under this subsection and the need to protect the United States as a whole. </text></clause></subparagraph></paragraph></subsection><subsection id="idBCCD07762E0344B98B022D1B70BECE30"><enum>(c)</enum><header>Contracts or compacts with Indian Tribes and Tribal organizations</header><paragraph id="id454DB4560443402194A4B11B4A94C5AD"><enum>(1)</enum><header>In general</header><text>Beginning in fiscal year 2023, the Secretary, acting through the Administrator of the Health Resources and Services Administration, shall award funding through contracts or compacts pursuant to the Indian Self-Determination and Education Assistance Act, distributed on a fair and equitable formula as developed through consultation with Indian Tribes and Tribal organizations, to Indian Tribes and Tribal organizations to carry out activities described in subsection (d) in order to support EMS organizations in Tribal communities. </text></paragraph><paragraph id="idDFA40768374D4C3DBE633E2896CA4248"><enum>(2)</enum><header>Applications</header><text>An Indian Tribe or Tribal organization seeking funding under this subsection shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary requires through consultation with Indian Tribes and Tribal organizations. </text></paragraph></subsection><subsection id="idF3A6938C51BC41758C428C7690151374"><enum>(d)</enum><header>Activities</header><paragraph id="idF49E2068473042D2836E8015E09D7133"><enum>(1)</enum><header>In general</header><text>Grants or other funding awarded under this section may be used to support EMS organizations through any of the following:</text><subparagraph id="id1AA54A28DA144E4EB03F418E4CC08863"><enum>(A)</enum><text>Hiring EMS organization personnel.</text></subparagraph><subparagraph id="idC0945C4C97644127BFFFD03ECC350D89"><enum>(B)</enum><text>Recruiting and retaining volunteer EMS organization personnel.</text></subparagraph><subparagraph id="id17798E52DCEC4AF7A6F692D7FB018D6C"><enum>(C)</enum><text>Providing training or reimbursing personnel for training.</text></subparagraph><subparagraph id="idf716ee7584394ed691a9b244c4dcdf3f"><enum>(D)</enum><text>Conducting courses and implementing apprenticeship programs that qualify graduates to serve in an EMS organization in accordance with State and local requirements. </text></subparagraph><subparagraph id="id79952626C8C4473D9FE3C367BCBD24DD"><enum>(E)</enum><text>Purchasing necessary equipment.</text></subparagraph><subparagraph id="id0A05907754A349A0A68C103EE6A14FE4"><enum>(F)</enum><text>Purchasing medicine and medical supplies.</text></subparagraph><subparagraph id="idbef3149e97b1490eaf861016cd07be58"><enum>(G)</enum><text>Purchasing EMS vehicles.</text></subparagraph><subparagraph id="id0d8c00de85924f90b7073f2d7548ca5e"><enum>(H)</enum><text>Wellness and fitness programs for EMS organization personnel.</text></subparagraph><subparagraph id="iddc53528487514941b70919dc1dc7fc6a"><enum>(I)</enum><text>Modifying facilities.</text></subparagraph><subparagraph id="id258480091e2e4673a3904dca9696c724"><enum>(J)</enum><text>Improving regional coordination among EMS organizations.</text></subparagraph><subparagraph id="idE64B0B297BD74353A9B578CC06557172"><enum>(K)</enum><text>Establishing or supporting community paramedicine or mobile integrated health care initiatives.</text></subparagraph><subparagraph id="idefc384ed91574b8883fe22baa9045af2"><enum>(L)</enum><text>Any other activity the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="id599B0F52768F4840BCB968882A62EE0E"><enum>(2)</enum><header>Limitation</header><text>No funds awarded under this section may be made available to an EMS organization that operates for profit or to otherwise support efforts to establish or provide emergency medical services, or medical transport, for profit.</text></paragraph></subsection><subsection id="idD11BA3912BF346E29BC41AA61FEA6936"><enum>(e)</enum><header>Amount</header><text>Each grant awarded under subsection (b), or funding through a contract or compact under subsection (c), shall be in an amount not to exceed $1,000,000.</text></subsection><subsection id="idFF2534F4DF1048DFAC5D3EE29D770F0E"><enum>(f)</enum><header>Appropriations</header><paragraph id="idC943B7362ED142CE900C6AAB4060E6F8"><enum>(1)</enum><header>Awards</header><subparagraph id="idAB297524165D4D8299D57046CA9C7718"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated, and there is appropriated, to the Secretary to award grants, and funding through contracts or compacts, under this section—</text><clause id="id69CF7426BE264D2185C0586960733996"><enum>(i)</enum><text>for fiscal year 2023, $500,000,000; and</text></clause><clause id="id6F1FCC877BFC45B9964BE4502DA28A99"><enum>(ii)</enum><text>for each fiscal year thereafter, the amount authorized under this subparagraph for the preceding fiscal year increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) for the most recent 12-month period for which applicable data is available.</text></clause></subparagraph><subparagraph id="idF35FBCEA7B60419EA0D0A0960EE26E9E"><enum>(B)</enum><header>Contracts and compacts</header><text>Of the amount appropriated under subparagraph (A) for each fiscal year, not less than 5 percent shall be set aside to carry out subsection (c).</text></subparagraph></paragraph><paragraph id="id81079793BE99488EAA176F9B2E7136BD"><enum>(2)</enum><header>Technical assistance</header><text>There is authorized to be appropriated, and there is appropriated, to the Secretary to provide technical assistance to entities completing and submitting applications under this section—</text><subparagraph id="id5056EBD79C8F4CBB8592C333904C1C50"><enum>(A)</enum><text>for fiscal year 2023, $10,000,000; and</text></subparagraph><subparagraph id="idA3EED96D21DF49BFACFAD69857F8F990"><enum>(B)</enum><text>for each fiscal year thereafter, the amount authorized under this paragraph for the preceding fiscal year increased by the percentage increase in the consumer price index for all urban consumers (all items; United States city average) for the most recent 12-month period for which applicable data is available.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="iddd49546cc5cd444da1bf2270c134a6a1"><enum>3.</enum><header>Reports</header><subsection id="id9a6c64fe240c4a55ba03f08c3328e588"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Administrator of the Centers for Medicare &amp; Medicaid Services, the Administrator of the Health Resources and Services Administration, the Assistant Secretary for Preparedness and Response, and EMS stakeholders, shall submit to Congress a report detailing the challenges, disparities, and inadequacies in providing Federal, State, and private (including commercial insurers) reimbursement for medical transport and emergency medical services and providing recommendations for improvement with respect to providing such reimbursement.</text></subsection><subsection id="id49221dd3e7674a9ba22b2fb2121251f2"><enum>(b)</enum><header>Rural EMS organizations</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Administrator of the Centers for Medicare &amp; Medicaid Services, the Administrator of the Health Resources and Services Administration, the Assistant Secretary for Preparedness and Response, and EMS stakeholders, shall submit to Congress a report on the challenges specific to rural EMS organizations, including with respect to Federal, State, and private (including private insurers) reimbursement rates and policies, and develop an action plan to address those challenges through grants and other administrative action.</text></subsection></section></legis-body></bill>
