which was read twice and referred to the <committee-name committee-id="SSSB00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20220525">May 25, 2022</action-date><action-desc>Reported by <sponsor name-id="S308">Mr. Cardin</sponsor>, with amendments</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To improve certain programs of the Small Business Administration to better assist small business customers in accessing broadband technology, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" changed="not-changed" id="id1d1d7842-0aa3-4e75-be9f-1132f74704c5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Broadband and Emerging Information Technology Enhancement Act of 2022</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" changed="not-changed" id="id5f30f0e9-d5bb-4208-8b62-f1df2bd69489"><enum>2.</enum><header>Broadband and emerging information technology coordinator</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text><paragraph id="id1e0ccb28-280a-4ae4-88f5-5dae112fc8ef" changed="not-changed"><enum>(1)</enum><text>by redesignating section 49 (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) as section 50; and</text></paragraph><paragraph id="idb7320ce3-ba9f-4c09-be9e-de6908f348e6" changed="not-changed"><enum>(2)</enum><text>by inserting after section 48 (<external-xref legal-doc="usc" parsable-cite="usc/15/657u">15 U.S.C. 657u</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" changed="not-changed" id="id3f8d2281-05f9-47e8-a297-a433e9694609"><section id="ida451542f-1065-46c4-9a5a-03c541313333" changed="not-changed"><enum>49.</enum><header>Broadband and emerging information technology</header><subsection id="id7e87e47c-9914-492c-97ae-1a81f1be983d" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idf8018670-4b52-4bfb-b823-995b3a8ed2da" changed="not-changed"><enum>(1)</enum><text>the term <term>Associate Administrator</term> means the Associate Administrator for the Office of Investment and Innovation; </text></paragraph><paragraph changed="not-changed" id="idF64951A7E8764080BE18649A5CF51C53"><enum>(2)</enum><text>the term <term>broadband</term> means—</text><subparagraph id="idce758f7c3c6e4ac9b3087871be594de0"><enum>(A)</enum><text>high-speed wired broadband internet; and</text></subparagraph><subparagraph id="id1c756f337555466fb2352abab1ecdac5"><enum>(B)</enum><text>high-speed wireless internet; </text></subparagraph></paragraph><paragraph id="id45648ac9-e224-4f7c-b37f-2f6f613b75db" changed="not-changed"><enum>(3)</enum><text>the term <term>broadband and emerging information technology coordinator</term> means the employee designated to carry out the broadband and emerging information technology coordination responsibilities of the Administration under subsection (b)(1); and</text></paragraph><paragraph id="id7969c925c9684e7a8aa1d043c96705b9"><enum>(4)</enum><text>the term <term>emerging information technology</term> includes—</text><subparagraph id="id90653b4a691b4ee4bbb410c18012fe06"><enum>(A)</enum><text>data science technologies such as artificial intelligence and machine learning;</text></subparagraph><subparagraph id="id5121ff4e65394a519e70d931cdf042bc"><enum>(B)</enum><text>Internet of Things;</text></subparagraph><subparagraph id="ide3712a32a12c4be99a36a30a2a4cea4b"><enum>(C)</enum><text>distributed ledger technologies such as blockchain;</text></subparagraph><subparagraph id="idf2b51f3d92244862ae5fde321dfaf13b"><enum>(D)</enum><text>cloud computing and software as a system technologies;</text></subparagraph><subparagraph id="id862d6462bc2f471e8b0632f52c232341"><enum>(E)</enum><text>computer numerical control technologies such as 3D printing; and</text></subparagraph><subparagraph id="id38a0f40e0ec3413ab96f4ede5d6363ba"><enum>(F)</enum><text>robotics and automation.</text></subparagraph></paragraph></subsection><subsection id="idef3c34ff-244f-4148-9fd2-e04ba3dfce5b" changed="not-changed"><enum>(b)</enum><header>Assignment of coordinator</header><paragraph id="id0e9a8d75-7d3e-453d-835c-ee54d89f026a" changed="not-changed"><enum>(1)</enum><header>Assignment of coordinator</header><text>The Associate Administrator shall designate a senior employee of the Office of Investment and Innovation to serve as the broadband and emerging information technology coordinator, who—</text><subparagraph id="idee78c860-66b9-46d2-a688-8b172a4d91ce" changed="not-changed"><enum>(A)</enum><text>shall report to the Associate Administrator;</text></subparagraph><subparagraph id="id511d7626-31d7-4bdb-aeb4-84aa8dc1e7d7" changed="not-changed"><enum>(B)</enum><text>shall work in coordination with—</text><clause id="id1f831991-1ed2-4334-8f4e-02b6b1d21aab" changed="not-changed"><enum>(i)</enum><text>the chief information officer, the chief technology officer, and the head of the Office of Technology of the Administration; and</text></clause><clause id="ide9d3789a-10a7-4348-be3f-fdbf3e916a47" changed="not-changed"><enum>(ii)</enum><text>any other Associate Administrator of the Administration determined appropriate by the Associate Administrator;</text></clause></subparagraph><subparagraph id="idf9614604-c3f7-4a1e-a105-61165fd2f64c" changed="not-changed"><enum>(C)</enum><text>has experience developing and implementing telecommunications policy in the private sector or government; and</text></subparagraph><subparagraph id="idabe4c5b8-5626-4e01-92f1-9c1f2bc71a46" changed="not-changed"><enum>(D)</enum><text>has demonstrated significant experience in the area of broadband or emerging information technology.</text></subparagraph></paragraph><paragraph id="id45213f77-f39b-4bf2-9b64-dc478ccfa87f" changed="not-changed"><enum>(2)</enum><header>Responsibilities of coordinator</header><text>The broadband and emerging information technology coordinator shall—</text><subparagraph id="id4b2e505d-dbc8-4760-bef0-48dad8d6d8a6" changed="not-changed"><enum>(A)</enum><text>coordinate programs of the Administration that assist small business concerns in adopting, making innovations in, and using broadband and other emerging information technologies;</text></subparagraph><subparagraph id="idb165ab04-d189-45e2-8a60-a7e11bed98c5" changed="not-changed"><enum>(B)</enum><text>serve as the primary liaison of the Administration to other Federal agencies involved in broadband and emerging information technology policy, including the Department of Commerce, the Department of Agriculture, the Department of the Treasury, and the Federal Communications Commission;</text></subparagraph><subparagraph id="id1a814ebf-0195-40b0-9535-e35ae18c850b" changed="not-changed"><enum>(C)</enum><text>identify best practices relating to broadband and emerging information technology that may benefit small business concerns; and</text></subparagraph><subparagraph id="id6c0ef7ab-6dcf-414a-aac3-703faf54a812" changed="not-changed"><enum>(D)</enum><text>identify and catalog tools and training available through the resource partners of the Administration that assist small business concerns in adopting, making innovations in, and using broadband and emerging information technologies.</text></subparagraph></paragraph><paragraph id="id99f57d81-5007-42a7-98c3-e179b146d2d3" changed="not-changed"><enum>(3)</enum><header>Travel</header><text>Not more than 20 percent of the hours of service by the broadband and emerging information technology coordinator during any fiscal year shall consist of travel outside the United States to perform official duties.</text></paragraph></subsection><subsection id="id37407018-e011-42bb-9a88-fd7134099ca1" changed="not-changed"><enum>(c)</enum><header>Broadband and emerging information technology training</header><text><added-phrase reported-display-style="italic">The Associate Administrator shall provide to employees of the Administration training that—</added-phrase></text><paragraph id="idBEB4344207E44B6C8D5EA2F77002F44B" changed="added" reported-display-style="italic"><enum>(1)</enum><text>familiarizes employees of the Administration with broadband and other emerging information technologies;</text></paragraph><paragraph id="id9B9856C0A1BA4AA3A65D1F612F667650" changed="added" reported-display-style="italic"><enum>(2)</enum><text>includes—</text><subparagraph id="idD936E506694541CA9928D98CD507E127"><enum>(A)</enum><text>instruction on counseling small business concerns regarding adopting, making innovations in, and using broadband and other emerging information technologies; and</text></subparagraph><subparagraph id="id4154BD600AA041E293A8BD7F5C1F15C3"><enum>(B)</enum><text>information on programs of the Federal Government that provide assistance to small business concerns relating to broadband and emerging information technologies; and</text></subparagraph></paragraph><paragraph id="idBA376D51539A4D15B12583801B906D9D" changed="added" reported-display-style="italic"><enum>(3)</enum><text>to maximum extent practicable, uses the tools and training cataloged and identified under subsection (b)(2)(D).</text></paragraph><paragraph id="id6cb8f427-9e8a-47e7-9b17-16ee980ff04c" changed="deleted" reported-display-style="strikethrough"><enum>(1)</enum><header>Training</header><text>The Associate Administrator shall provide to employees of the Administration training that—</text><subparagraph id="idb65eadfb-08e4-426d-a7e3-0c21caf554ca"><enum>(A)</enum><text>familiarizes employees of the Administration with broadband and other emerging information technologies;</text></subparagraph><subparagraph id="id2e20da2c-f596-4925-b54a-4b842d62b5fd"><enum>(B)</enum><text>includes—</text><clause id="id04a5f4b2-9301-434d-a2d9-0b3e6d94d066"><enum>(i)</enum><text>instruction on counseling small business concerns regarding adopting, making innovations in, and using broadband and other emerging information technologies; and</text></clause><clause id="idb8d720fa-beb2-4469-b99c-9bd7e4c07c56"><enum>(ii)</enum><text>information on programs of the Federal Government that provide assistance to small business concerns relating to broadband and emerging information technologies; and</text></clause></subparagraph><subparagraph id="id4cca922b-1c1e-42b9-a30c-18321fe86a8e"><enum>(C)</enum><text>to maximum extent practicable, uses the tools and training cataloged and identified under subsection (b)(2)(D).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1db3193-178e-452e-9e95-496006d52529" changed="deleted" reported-display-style="strikethrough"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this subsection.</text></paragraph></subsection><subsection id="idf9e07616-b021-4811-9ae6-60c8cfc1c9e4" changed="not-changed"><enum>(d)</enum><header>Reports</header><paragraph id="id3206a32f-dc29-4cef-b31a-08d5db1f024f" changed="not-changed"><enum>(1)</enum><header>Biennial report on activities</header><text>Not later than 2 years after the date on which the Associate Administrator makes the first designation of an employee under subsection (b), and every 2 years thereafter, the broadband and emerging information technology coordinator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report regarding the programs and activities of the Administration relating to broadband and other emerging information technologies.</text></paragraph><paragraph id="id1efe30b6-9789-4377-9f0a-71b166eff42c" changed="not-changed"><enum>(2)</enum><header>Impact of broadband availability, speed, and price and emerging information technology deployment on small businesses</header><subparagraph id="id9e6879bf-3825-4aa4-810d-ea3814e48cdb" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Subject to appropriations, the Chief Counsel for Advocacy shall conduct a study evaluating the impact of—</text><clause changed="not-changed" id="id9A3F497CA4964F8BA6EFBD079F952B13"><enum>(i)</enum><text>broadband availability, speed, and price on small business concerns; and</text></clause><clause changed="not-changed" id="idB21D44336A6C46EAAFD662316C469CA5"><enum>(ii)</enum><text>emerging information technology deployment on small business concerns.</text></clause></subparagraph><subparagraph id="ida4e0a8bf-f168-4f73-9112-eb3232cd81a2" changed="not-changed"><enum>(B)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of the <short-title>Small Business Broadband and Emerging Information Technology Enhancement Act of 2022</short-title>, the Chief Counsel for Advocacy shall submit to the Committee on Commerce, Science, and Transportation and the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Energy and Commerce and the Committee on Small Business of the House of Representatives a report on the results of the study under subparagraph (A), including—</text><clause id="idd6abfafa-fe69-4cc2-9bcf-0ccedb958d48" changed="not-changed"><enum>(i)</enum><text>a survey of broadband speeds available to small business concerns;</text></clause><clause id="idc456151e-1036-44b6-8901-ca826e2f2162" changed="not-changed"><enum>(ii)</enum><text>a survey of the cost of broadband speeds available to small business concerns;</text></clause><clause id="id240cf58a-b54e-49bb-8e09-c67274ce0e30" changed="not-changed"><enum>(iii)</enum><text>a survey of the type of broadband technology used by small business concerns;</text></clause><clause id="id934a0af8d68d4e098bdd02341ddb9a69"><enum>(iv)</enum><text>a survey of the types of emerging information technologies used by small business concerns; and</text></clause><clause id="id346baa6d-c260-4ba1-9e1a-547d8fb19fcb" changed="not-changed"><enum>(v)</enum><text>any policy recommendations that may improve the access of small business concerns to comparable broadband services or emerging information technologies at comparable rates in all regions of the United States.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section changed="not-changed" id="id2d93229e-4c06-4eee-a349-9536f84194e3"><enum>3.</enum><header>Entrepreneurial development</header><text display-inline="no-display-inline">Section 21(c)(3)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)(3)(B)</external-xref>) is amended—</text><paragraph id="id0e5fb4a0-f320-45a9-a2a6-103bddf9ad2d" changed="not-changed"><enum>(1)</enum><text>in the matter preceding clause (i), by inserting <quote>accessing broadband and other emerging information technology,</quote> after <quote>technology transfer,</quote>;</text></paragraph><paragraph id="id099521dd-f90d-4292-b268-e3868372a733" changed="not-changed"><enum>(2)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id3ead059a-cef3-4726-924b-9d5430295592" changed="not-changed"><enum>(3)</enum><text>in clause (iii), by adding <quote>and</quote> at the end; and</text></paragraph><paragraph id="id910bed0a-1fe4-41d4-9482-b90c77f5492c" changed="not-changed"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" changed="not-changed" id="id45027aad-215b-482f-ba36-52f0138010ac"><clause id="ida1bbddf6-a041-4725-b64b-00f30b128836" indent="up1" changed="not-changed"><enum>(iv)</enum><text>increasing the competitiveness and productivity of small business concerns by assisting entrepreneurs in accessing broadband and other emerging information technology;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement><action-date date="20220525">May 25, 2022</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
