<official-title>To amend the Small Business Act relating to small business concerns owned and controlled by women, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Women in Small Business Act</short-title></quote>.</text></section> <section id="id17602392CF4540A181DE1A95039AE266"><enum>2.</enum><header>Treatment of funding by small business investment companies</header><text display-inline="no-display-inline">Section 8 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637</external-xref>) is amended—</text>
<paragraph id="idD2D36D7D30354116AA4C2EF8A80D208B"><enum>(1)</enum><text>in subsection (a)(21)(E), by inserting <quote>, and except as provided under subsection (m)(9),</quote> after <quote>law,</quote>; and</text></paragraph> <paragraph id="id5316DDF1C14448AE911F748B5E5A7BC7"><enum>(2)</enum><text>in subsection (m), by adding at the end the following:</text>

<paragraph id="id8D79624FB2A244B086B198F74FB0102E"><enum>(9)</enum><header>Treatment of funding by small business investment companies</header>
<subparagraph id="id8A36B63C08E84ED685811BC3F5FF783B"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <term>covered small business concern</term> means a small business concern—</text> <clause id="id7A0B6F05A2BA4534A2C26FC1BDC7794A"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="id603CCC5A72604E48946FAEEB9C86B991"><enum>(I)</enum><text>owned and controlled by women; or</text></subclause>
<subclause id="id79DD939C2946433B97F0CC7B30C64BD2" indent="up1"><enum>(II)</enum><text>owned and controlled by women described in paragraph (2)(A) and certified under paragraph (2)(E); and</text></subclause></clause> <clause id="id9A3B0BD6E5464A9E8F416A8FAA5B8E1F"><enum>(ii)</enum><text>that receives funding from a small business investment company licensed under title III of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681 et seq.</external-xref>).</text></clause></subparagraph>
<subparagraph id="idFE795690E87E49408A0ABDE534C201EB"><enum>(B)</enum><header>Retained certification</header><text>Any covered small business concern shall retain certification as a covered small business concern under this subsection for a period of not more than 7 years if, during that period, ownership interests in the covered small business concern that are held by a small business investment company licensed under title III of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681 et seq.</external-xref>) would reduce the percentage required under section 3(n) or paragraph (2)(A) of this subsection, as applicable, to less than 51 percent.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="idCF41D9A611B64D96963860D42EFA61EE"><enum>3.</enum><header>Required training and reporting on Governmentwide goals</header><text display-inline="no-display-inline">Section 15(g)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(g)(2)</external-xref>) is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id0DB4C943189C4E11B95E11D2198B6D1C">
<subparagraph id="idA91D64AD2F3F46FBB30F3066FEAA59A8" indent="up1"><enum>(G)</enum><header>Required training</header>
<clause id="id3E10361ABFF845E7BD36F917989F733A"><enum>(i)</enum><header>In general</header><text>Notwithstanding the goals established under this subsection for each Federal agency, the Administration, in consultation with the National Women's Business Council established under section 405 of the Women’s Business Ownership Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/7105">15 U.S.C. 7105</external-xref>), shall provide training to employees with responsibility for procurement or acquisition at any Federal agency that awards less than 5 percent of prime contracts and subcontracts to small business concerns owned and controlled by women in a fiscal year. </text></clause> <clause id="id454D0AC50D2A4EB296CE500DF40DD7A6"><enum>(ii)</enum><header>Guidance</header><text>The Administration shall issue publicly available guidance for each Federal agency identified in a report submitted under clause (iii) to meet the 5 percent goal described in clause (iii)(I).</text></clause>
<clause id="id93E3049DE86C4651B7D510F27E7D8CDD"><enum>(iii)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administration shall submit to Congress—</text> <subclause id="id84B2C129C4BA4BBBB32A6AAD84AF524F"><enum>(I)</enum><text>a list of each Federal agency that awarded less than 5 percent of the prime contracts and subcontracts of the Federal agency to small business concerns owned and controlled by women in the fiscal year covered by the report;</text></subclause>
<subclause id="id53A948DF9B85456B953571A2C8A9C1DA"><enum>(II)</enum><text>the number of training sessions provided under clause (i) to each Federal agency described in subclause (I);</text></subclause> <subclause id="id534196CD124C4B9F83990595F2377234"><enum>(III)</enum><text>an overview of the content of each training session described in subclause (II); and</text></subclause>
<subclause id="id24FAF05644BF4157BF41A87CCE6FF9FA"><enum>(IV)</enum><text>the result of each training session described in subclause (II), including whether additional contracting opportunities were provided to small business concerns owned and controlled by women and the 5 percent threshold described in clause (i) was met by the Federal agency.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="idB703BEA440D947F89919B1A7E4F43FD1"><enum>4.</enum><header>Interagency report</header> <subsection id="id9F5E82F09C5044F691B12728FA01F9C6"><enum>(a)</enum><header>Definition</header><text>In this section—</text>
<paragraph id="id94397CCA4CBD4900ACFAB96FA1592655"><enum>(1)</enum><text>the term <term>covered agency</term> means—</text> <subparagraph id="id3D5742F934854073860F493028243426"><enum>(A)</enum><text>the Department of Commerce;</text></subparagraph>
<subparagraph id="id25B10C0A90B6452398961C834417C51E"><enum>(B)</enum><text>the Small Business Administration;</text></subparagraph> <subparagraph id="idDD2499859BFF4D018719C4D437974D34"><enum>(C)</enum><text>the Department of Agriculture; and</text></subparagraph>
<subparagraph id="id155E499C0F8144829DDD11AED9680C10"><enum>(D)</enum><text>the Department of the Treasury;</text></subparagraph></paragraph> <paragraph id="idA873E212DF6E4420B153CB4051C06E00"><enum>(2)</enum><text>the term <term>covered small business concern</term> means—</text>
<subparagraph id="idDAEED4882AF2409AB9D0D231D0D00A61"><enum>(A)</enum><text>a small business concern owned and controlled by women; and</text></subparagraph> <subparagraph id="id56EBB89ECD6D4D7B9451624332CE0501"><enum>(B)</enum><text>a small business concern owned and controlled by women described in and certified under subparagraphs (A) and (E), respectively, of section 8(m)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(m)(2)</external-xref>); and</text></subparagraph></paragraph>
<paragraph id="idD95F4EE9F53A43DAA0B48EB43DF626FA"><enum>(3)</enum><text>the term <term>small business concern owned and controlled by women</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></subsection> <subsection id="id7E07C222A9E847D8904883407000B93A"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Commerce, in consultation with the Administrator of the Small Business Administration, the Secretary of Agriculture, and the Secretary of the Treasury, shall submit to Congress an interagency report that—</text>
<paragraph id="ida87c7e5018a74283b661aa1f68a53150"><enum>(1)</enum><text>identifies the leading economic barriers for small business concerns owned and controlled by women, particularly for industries underrepresented by small business concerns owned and controlled by women;</text></paragraph> <paragraph id="idb0f7ecee78674efea3e760685395c765"><enum>(2)</enum><text>includes a detailed description of the impact of inflation and supply chain disruptions on small business concerns owned and controlled by women during the 3-year period preceding the report;</text></paragraph>
<paragraph id="idf1de0f5935a34531b229539e3023213d"><enum>(3)</enum><text>makes recommendations to improve access to capital for small business concerns owned and controlled by women; and</text></paragraph> <paragraph id="id344c388201db4370ad142b67ca859a63"><enum>(4)</enum><text>in consultation with the Office of Small Business and Disadvantaged Business Utilization of each covered agency, identifies Federal contract opportunities for covered small business concerns.</text></paragraph></subsection></section>
