which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To collect information regarding water access needs across the United States, to provide grants for decentralized drinking water systems, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water, Sanitation, and Hygiene Sector Development Act of 2022</short-title></quote> or the <quote><short-title>WASH Sector Development Act of 2022</short-title></quote>.</text></section><section id="idEAA2B6FF36E84372AC35D52AF7B09897"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idA5988A8C06E74A77BA51B90E933549F6"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idE15A21B0B235497F86D84D36767B4AD1"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) in the list published most recently as of the date of enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="id5414792D25244B35AFD02C0739B8ADED"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="idC60FB22E627040EBA9680BFADA78C8A6"><enum>(A)</enum><text>each of the 50 States;</text></subparagraph><subparagraph id="id8D921C8847F54DEF818E8CE4A127A1FA"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="idFAC804D9803B4612A193C7DBD16F87EE"><enum>(C)</enum><text>any territory of the United States.</text></subparagraph></paragraph><paragraph id="id7D64251E8876484DBC53D83089319D91"><enum>(4)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of an Indian Tribe.</text></paragraph></section><section id="id5922A31595F44A1588A976E5F3E85B03"><enum>3.</enum><header>Water and Sanitation Needs Working Group</header><subsection id="idE25EC47998504D7AA9806010888590DF"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall establish a working group, to be known as the <quote>Water and Sanitation Needs Working Group</quote> (referred to in this section as the <quote>Working Group</quote>)—</text><paragraph id="idC756FA51FFC641CE966618A70457F6B5"><enum>(1)</enum><text>to work with a Federal agency or independently to carry out a survey that will measure, as accurately as possible, the number and approximate geographic distribution of households in the United States that do not have access to drinking water infrastructure or a means for the safe collection and disposal of wastewater; and</text></paragraph><paragraph id="id9A8F42C5B5AB418CAE97AEE81E130548"><enum>(2)</enum><text>on the basis of the results of the survey carried out under paragraph (1), to prepare a report for Congress that estimates the cost of capital improvements that would be needed to ensure that all households in the United States have access to reliable drinking water and adequate sanitation, subject to the conditions that—</text><subparagraph id="id5F5281070C924574B39159CD0ECC5BC9"><enum>(A)</enum><text>to the extent practicable, the cost estimate prepared under this paragraph shall take into consideration the cost of project proposals that may be submitted by individuals, the research community, nonprofit organizations with experience in the water and sanitation sectors, and Federal, State, local, or Tribal government agencies consistent with guidance provided by the Working Group; and</text></subparagraph><subparagraph id="id971FA68A73CA47B2AC49B4415733D6BC"><enum>(B)</enum><text>the Working Group will not be required to collect or report personally identifiable information, but can maintain information with respect to drinking water and sanitation needs based on ZIP Code or another appropriate geographic breakdown.</text></subparagraph></paragraph></subsection><subsection id="id76A208B8A22F462BBFFACB832BDF6A6B"><enum>(b)</enum><header>Chairperson; membership</header><paragraph id="id2A1CF0DFB68E46B2805D05BFA7A04FCC"><enum>(1)</enum><header>Chairperson</header><text>The Administrator shall serve as the chairperson of the Working Group.</text></paragraph><paragraph id="id0F17D446A17A4A36A4421A83D5C541D0"><enum>(2)</enum><header>Membership</header><text>In addition to the Administrator, the Working Group shall comprise senior representatives from such Federal agencies as the Administrator determines to be appropriate, including—</text><subparagraph id="id3A7BDEF45A9D42959157528CF8656C86"><enum>(A)</enum><text>the Department of the Interior, including the Bureau of Indian Affairs;</text></subparagraph><subparagraph id="id21AA4BC447DA4D68AD294ECB8504565A"><enum>(B)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph id="id4EDD871A1AB9471486E9C8086FC11188"><enum>(C)</enum><text>the Census Bureau;</text></subparagraph><subparagraph id="id44677133476C4BA0B0832BCDDF103B5B"><enum>(D)</enum><text>the Department of Health and Human Services, including the Indian Health Service; and</text></subparagraph><subparagraph id="idD2FABEF7D19344F0AD4D72670A6140AE"><enum>(E)</enum><text>the Department of Housing and Urban Development.</text></subparagraph></paragraph></subsection><subsection id="id443420AB2AFE4172878E53F9F097EB20"><enum>(c)</enum><header>Duties</header><text>The Working Group shall—</text><paragraph id="idC85D768E3CF346B286C9B38170E4FC50"><enum>(1)</enum><text>leverage the expertise of industry, the research community, nongovernmental organizations, and utilities, including through the incorporation of information that could be collected by utilities, circuit riders, and technical assistance providers;</text></paragraph><paragraph id="id334B6DD0AB4B40DA95D99773B7054B27"><enum>(2)</enum><text>consult, on a regular basis, with States, units of local government, Indian tribes, and relevant Federal agencies not included in the membership of the Working Group; and</text></paragraph><paragraph id="id1A614FF47D324D57885FFD0A2A7F1128"><enum>(3)</enum><text>in carrying out subsection (a)—</text><subparagraph id="idFBB10B89BDB945F1A75CF0D3F5893FFA"><enum>(A)</enum><text>seek to determine whether the decennial census or another existing survey of the Federal Government presents an efficient opportunity for collecting the information described in paragraph (1) of that subsection;</text></subparagraph><subparagraph id="idD54FEB901F72407E8589927599F05374"><enum>(B)</enum><text>seek to coordinate Federal programs and policies to support the collection and use of the information described in that subsection;</text></subparagraph><subparagraph id="id91E93B619DC34DDBBD6E3CCD86635288"><enum>(C)</enum><text>develop a methodology for creating the cost estimate required under paragraph (2) of that subsection; and</text></subparagraph><subparagraph id="id9BC16F06E75C43119ED80E4278C6ED2D"><enum>(D)</enum><text>oversee the collection of—</text><clause id="idD981A1618E784F4288C99FD898CD6C90"><enum>(i)</enum><text>the information described in paragraph (1) of that subsection; and</text></clause><clause id="id5904BD826A7B41F6A960115AFEBC67B7"><enum>(ii)</enum><text>the information necessary to create the cost estimate required under paragraph (2) of that subsection.</text></clause></subparagraph></paragraph></subsection><subsection id="id74412496A7874783A2BE0F1D7B5EFD7C"><enum>(d)</enum><header>Report on water and sanitation needs</header><text>Not less frequently than once every 2 years, the Administrator shall submit to Congress a report that describes the activities and findings of the Working Group, including—</text><paragraph id="id17703B20BD334FDA816B0764E10A1552"><enum>(1)</enum><text>an explanation of the methodology used by the Working Group to determine drinking water and sanitation needs;</text></paragraph><paragraph id="id4899313DE62E4648833A8EBD5651024A"><enum>(2)</enum><text>an estimate of the amount of funds necessary to provide all households with access to reliable drinking water and adequate sanitation; and</text></paragraph><paragraph id="idFC14BC46E9894BB1AEFFA12C43C63D2A"><enum>(3)</enum><text>a breakdown by State and, if possible, congressional district of—</text><subparagraph id="idEC53C4F76405467FBFB583821C91E132"><enum>(A)</enum><text>drinking water and sanitation needs; and</text></subparagraph><subparagraph id="idAD04D6D5178040A79BB1350CCBD3C673"><enum>(B)</enum><text>the amount of funding required to address those needs.</text></subparagraph></paragraph></subsection><subsection id="idD0E210285E434D87BC14E36475A2A49E"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator and other necessary Federal agencies to collect the information and prepare the reports required under this section—</text><paragraph id="idEA4532867DA341CAA56310E319FEAD38"><enum>(1)</enum><text>for each of fiscal years 2023 through 2027, $10,000,000; and</text></paragraph><paragraph id="id27A2E7F52FAA4B089910F38DE88E8246"><enum>(2)</enum><text>for fiscal year 2028 and each fiscal year thereafter, such sums as may be necessary.</text></paragraph></subsection></section><section id="id3EA27A365CA1424E950319E4779F1586"><enum>4.</enum><header>Grants for construction and refurbishment of individual household or community decentralized drinking water systems for individuals with low or moderate income</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id340B3CABB7134C17B654A1276147483F"><section id="idC1F78ABC72CF46B8BFB2FB0E4547C197"><enum>1459H.</enum><header>Grants for construction and refurbishment of individual household or community decentralized drinking water systems for individuals with low or moderate income</header><subsection id="idceb03110802347bd85a5fb99be14701c"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9EEDEAB59BC24F49B3B1769F6CDE96A6"><enum>(1)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means a member of a low-income or moderate-income household, the members of which have a combined income (for the most recent 12-month period for which information is available) equal to not more than 80 percent of the median nonmetropolitan household income for the State, Indian land, or territory in which the household is located, according to the most recent information collected by the Census Bureau.</text></paragraph><paragraph id="id80B3819B5DD34FD6B9381CC9B9233CF8"><enum>(2)</enum><header>Indian land</header><text>The term <term>Indian land</term> includes—</text><subparagraph id="idfdc827a9705c41ad88f93700b40b5986"><enum>(A)</enum><text>Indian country (as defined in section 1151 of title 18, United States Code);</text></subparagraph><subparagraph id="id576b0ca1be0642f9a969d5379d4c02a3"><enum>(B)</enum><text>any land in Alaska owned, pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), by an Indian tribe that is a Native village (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)) or by a Village Corporation (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)) that is associated with an Indian tribe;</text></subparagraph><subparagraph id="ideac2c3e0b4f9405cbf206eb5a0828ec5"><enum>(C)</enum><text>any land on which the seat of a Tribal government (as defined in section 2 of the <short-title>WASH Sector Development Act of 2022</short-title>) is located; and</text></subparagraph><subparagraph id="id01ebbb9e4f6c4097ba901c8356a1fb94" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>any land that is part of a Tribal designated statistical area associated with an Indian tribe, or an Alaska Native village statistical area associated with an Indian tribe, as defined by the Census Bureau for the purposes of the most recent decennial census.</text></subparagraph></paragraph></subsection><subsection id="id3b380df191414adbb3d1c9286ed5bcf9"><enum>(b)</enum><header>Grant program</header><paragraph id="ide8bf17dc37714d738d4244cd250533c2"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Administrator shall establish a program under which the Administrator shall provide grants to private nonprofit organizations for the purpose of improving general welfare by providing assistance to eligible individuals—</text><subparagraph id="id0003f5a619034e899f1004af7e69b821"><enum>(A)</enum><text>for the construction, repair, or replacement of an individual household decentralized drinking water system; </text></subparagraph><subparagraph id="id51d477e0ee97444db95018deead754b5"><enum>(B)</enum><text>for the installation of a larger decentralized drinking water system that is designed to provide treatment or drinking water for 2 or more households in which eligible individuals reside, if—</text><clause id="id28f05d46497246e781010d616075493a"><enum>(i)</enum><text>site conditions at the households are unsuitable for the installation of an individually owned decentralized drinking water system;</text></clause><clause id="idec0c290ff69d4c6ab40526ac2233ddab"><enum>(ii)</enum><text>multiple examples of unsuitable site conditions exist in close geographic proximity to each other; and</text></clause><clause id="id35fb8e04e7d94beb8c82c874e9f115f7"><enum>(iii)</enum><text>a larger decentralized drinking water system could be cost-effectively installed; or</text></clause></subparagraph><subparagraph id="id361B1B12638943D8B79237184A2A9355"><enum>(C)</enum><text>for the creation and support of an on-site maintenance entity or user association with the ability to collect fees to provide for the ongoing operation, maintenance, and replacement of an installed decentralized drinking water system.</text></subparagraph></paragraph><paragraph id="id99736fb651af4ae888f82c2bb55fd28f"><enum>(2)</enum><header>Application</header><text>To be eligible to receive a grant under this subsection, a private nonprofit organization shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator determines to be appropriate.</text></paragraph><paragraph id="id55870b0b98e44895bbdc04e406c03bc1"><enum>(3)</enum><header>Priority</header><text>In awarding grants under this subsection, the Administrator shall give priority to applicants that—</text><subparagraph id="id800bc126ec5c458f94647734b3a9b64f"><enum>(A)</enum><text>have demonstrated expertise in working with local communities to implement infrastructure projects, such as experience promoting the safe and effective use of household decentralized drinking water systems;</text></subparagraph><subparagraph id="id930CE989791F48CD88D0563C44FC5750"><enum>(B)</enum><text>propose to serve individuals or communities lacking—</text><clause id="idF0002EFB345E4E2EA36432FAACEBB6AA"><enum>(i)</enum><text>a safe drinking water system; and</text></clause><clause id="id1A9E7E15796F4EE693B39D464FC257A4"><enum>(ii)</enum><text>a feasible connection to a reliable public water system; and</text></clause></subparagraph><subparagraph id="id834b29963ecf4f1a998340d01d624c62"><enum>(C)</enum><text>demonstrate that the decentralized drinking water infrastructure to be constructed, repaired, or replaced using amounts from a grant under this subsection will be operated, maintained, and replaced by the individuals or communities that will use the infrastructure, which may be demonstrated through—</text><clause id="iddd9d0e29c83144b6b438d8bf76fce56c"><enum>(i)</enum><text>a study demonstrating the ability of the individual or community to pay for that operation, maintenance, and replacement; or</text></clause><clause id="idff5da9b06b75410ca81cdf055b175065"><enum>(ii)</enum><text>the creation of an on-site maintenance entity or user association with the ability to collect fees to provide for ongoing operation, maintenance, and replacement.</text></clause></subparagraph></paragraph><paragraph id="id5f366ac75c3e4963918717fa152224e1"><enum>(4)</enum><header>Administrative expenses</header><text>A private nonprofit organization may use amounts provided under this subsection to pay the administrative expenses associated with the provision of the services described in paragraph (1), as the Administrator determines to be appropriate.</text></paragraph></subsection><subsection id="id4be0abf751694565a1609a9832311d26"><enum>(c)</enum><header>Grants</header><paragraph id="id9283167d1fb1438d9e29ae391212d450"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a private nonprofit organization shall use a grant provided under subsection (b) for the services described in paragraph (1) of that subsection.</text></paragraph><paragraph id="ida8b63dc883c74cdb8a4da63724236eaf"><enum>(2)</enum><header>Application</header><text>To be eligible to receive the services described in subsection (b)(1), an eligible individual shall submit to the private nonprofit organization serving the area in which the individual or community household decentralized drinking water system of the eligible individuals is, or is proposed to be, located an application at such time, in such manner, and containing such information as the private nonprofit organization determines to be appropriate.</text></paragraph><paragraph id="id23e687e0ca6e475e81becf70f1a845f5"><enum>(3)</enum><header>Priority</header><text>In awarding grants under this subsection, a private nonprofit organization shall give priority to any eligible individual who does not have—</text><subparagraph id="id93BC4F189F324558984B1E56325B29AA"><enum>(A)</enum><text>access to a drinking water system; and</text></subparagraph><subparagraph id="idF3A5C5AEC41C4CD290EAA79CBA1E70B2"><enum>(B)</enum><text>a feasible connection to a reliable public water system.</text></subparagraph></paragraph></subsection><subsection id="idc126784c7b124cc59c62aa8b99f3cf16"><enum>(d)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this section, the Administrator shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the recipients of grants under the program under this section and the results of the program under this section.</text></subsection><subsection id="id86d5137ad1b140b48a206838f41ea121"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="ida99643ad959a42138520c141b4ab6879"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator to carry out this section $50,000,000 for each of fiscal years 2023 through 2027.</text></paragraph><paragraph id="id83f53027d7334a319735a9930790eb95"><enum>(2)</enum><header>Limitation on use of funds</header><text>Of the amounts made available for grants under paragraph (1), not more than 2 percent may be used to pay the administrative costs of the Administrator.</text></paragraph><paragraph id="id6C5C2F5BBCA141E3A56D8C09C552BBF7"><enum>(3)</enum><header>Indian land</header><text>Of the amounts made available under paragraph (1), the Administrator shall use not less than 5 percent to make grants to private nonprofit organizations that serve eligible individuals that reside on Indian land.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
