<section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Intergovernmental Cooperation and Reducing Duplication Act of 2022</short-title></quote>.</text></section> <section id="id369d99d95f904e1b971ed297d3825cd7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="id86791b7167114eb9ae2d7bba350e9c29"><enum>(1)</enum><text>It remains the policy of the United States Government to rely on the private sector enterprise system to provide services reasonably and quickly through ordinary business channels.</text></paragraph> <paragraph id="id923e3c3c77c34a46a2a1d86c8f01087e"><enum>(2)</enum><text>However, over the past half century, the substantial investment in unique, scalable, purposeful, and well-functioning government products and services, including those reliant on the private sector for support, has grown substantially and contributed to the successful delivery of important benefits, services, and programs to taxpayers while reducing waste, fraud, and abuse.</text></paragraph>
<paragraph id="idd7ff2ba8744649689363212fcd7c24f3"><enum>(3)</enum><text>While the United States remains, as it always shall, a Federal system, when Congress makes sustained and significant investments in inherently governmental functions, Congress must seek to ensure that arbitrary restrictions are not in place that encourage other instances of waste, fraud, and abuse by allowing government agencies at all levels to create bespoke, independent systems, studies, and development projects in an independent and uncoordinated manner.</text></paragraph> <paragraph id="id4d19eca584fa4f408df47054546d945a"><enum>(4)</enum><text>In respecting the leadership and ingenuity of the private sector, Congress must not allow agencies at various levels of government to operate in completely independent silos, especially when Federal benefits and programs are being administered at the State, local, territorial, and Tribal levels, which, in doing so, requires far greater taxpayer resources to be spent developing and maintaining systems, programs, projects, and other services that can be better delivered and managed cooperatively between jurisdictions.</text></paragraph>
<paragraph id="id98ae92dedf6c47b2bc002113c1ea7bc7"><enum>(5)</enum><text>State, local, territorial, and Tribal entities should have the option, without being coerced or required, to adopt and use important information, infrastructure, capabilities, and services from the Federal Government if such offerings are made to benefit taxpayers and the constituents served by those offerings.</text></paragraph></section> <section id="id8171D885319C40988BD0F4305B58DCE4"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="idF7DB0D9522DB45E99754C234F163F397"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph> <paragraph id="id365B3986617C41419505476F4455AB58"><enum>(2)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term in section 102 of title 31, United States Code.</text></paragraph>
<paragraph id="idba5088e219a343a09d07d65dee08b143"><enum>(3)</enum><header>Territorial government</header><text>The term <term>territorial government</term> has the meaning given the term in section 5 of PROMESA (<external-xref legal-doc="usc" parsable-cite="usc/48/2104">48 U.S.C. 2104</external-xref>).</text></paragraph> <paragraph id="id38f71415d3ed4873b1d9e00891091aaf"><enum>(4)</enum><header>Tribal government</header><text>The term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of enactment of this paragraph pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>). </text></paragraph></section>
<section id="idC6F9FB28BE774D21BAF43C7B20ED1D49" commented="no"><enum>4.</enum><header>Specialized or technical services</header><text display-inline="no-display-inline">Section 6505 of title 31, United States Code, is amended— </text> <paragraph id="id93489780D4D849528D39FB888B6D7E04"><enum>(1)</enum><text>in subsection (a)—</text>
<subparagraph id="id37865263ce264befba40daf1ac246651"><enum>(A)</enum><text>by inserting <quote>information technology products and platforms,</quote> after <quote>documents,</quote>;</text></subparagraph> <subparagraph id="id78C4177895634B21B09ACD2508896A80"><enum>(B)</enum><text>by inserting <quote>or supporting</quote> after <quote>similar</quote>; and</text></subparagraph>
<subparagraph id="id4265F155282B4161A2042A04EA164B31"><enum>(C)</enum><text>by striking the second sentence;</text></subparagraph></paragraph> <paragraph id="idb3ecd3274fc34a6793b4810ad2854bbd"><enum>(2)</enum><text>in subsection (b)—</text>
<subparagraph id="id90031693599a4d9aa742a242fd9af5e5"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>State or local</quote> and inserting <quote>State, local, territorial, or Tribal</quote>;</text></subparagraph> <subparagraph id="idbfe38e8e8ed54cbcb7d3b90b27d0e52b"><enum>(B)</enum><text>by striking paragraph (1) and inserting the following:</text>

<paragraph id="idFD9418F8B6804728889EAE4359DB4D63"><enum>(1)</enum><text>a request is made by a representative of the State, local, territorial or Tribal government; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="id1ac7041589a742c393b2b5278c44ba18"><enum>(C)</enum><text>in paragraph (2), by striking <quote>State or local</quote> and inserting <quote>State, local, territorial, or Tribal</quote>; </text></subparagraph></paragraph>
<paragraph id="idEE0579361842412B9C3C141CE5581946"><enum>(3)</enum><text>by redesignating subsection (d) as subsection (f);</text></paragraph> <paragraph id="idA0955DCCF21848299A89F8D4440F67D1"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text>

<subsection id="idffe59c07dc0b40738940481ff47bb074"><enum>(d)</enum><text>When providing services prescribed by the President under this section to a State, local, territorial, or Tribal government, the head of an executive agency shall take all available necessary and appropriate steps to increase cooperation and reduce administrative burden between the State, local, territorial, or Tribal government requesting the service and the executive agency.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="idAAAC1A72B6A544C4B3213C5D52E0DEC1"><enum>(5)</enum><text>by adding at the end the following:</text>

<subsection id="id6872495999E64EE3A66726C7177C8B69"><enum>(g)</enum><text>In this section—</text> <paragraph id="id19C860E484A24E1CA079D1EBBB21796E"><enum>(1)</enum><text>the term <term>territorial government</term> has the meaning given the term in section 5 of PROMESA (<external-xref legal-doc="usc" parsable-cite="usc/48/2104">48 U.S.C. 2104</external-xref>); and</text></paragraph>
<paragraph id="idABFA02C18FC748C680A42235EDB0EC5B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of enactment of this paragraph pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="id21702f652486495b9f9e2b2d69769494"><enum>5.</enum><header>Strategic plan</header> <subsection id="id831a874d14484b6fabf21c9285b44704"><enum>(a)</enum><header>In general</header><text>Not later than 150 days after the date of enactment of this Act, the Director, in coordination with the Director of the Office of Intergovernmental Affairs, shall publish a strategic plan to improve cooperation between and support greater harmonization, effectiveness, and the reduction of burdens and costs between the Federal Government and State, local, territorial, and Tribal governments.</text></subsection>
<subsection id="id6363dd48135f4bbe9ca4fb3cd0df233c"><enum>(b)</enum><header>Contents</header><text>The plan required under subsection (a)—</text> <paragraph id="id5d3cb54b49f04490b2a0cf520582cc20"><enum>(1)</enum><text>shall include coordination with and input from State, local, territorial, and Tribal governments and other relevant stakeholders; </text></paragraph>
<paragraph id="id442fb871bb0946b6b08e1a97dbd3b2bd"><enum>(2)</enum><text>shall include, at a minimum, actions and activities the Federal Government shall take to strengthen and improve the delivery of Federal services, benefits, and programs administered by State and local governments, including specific actions to increase harmonization between the Federal Government and State, local, territorial, and Tribal governments through increased availability and use of specialized or technical services provided by executive agencies pursuant to section 6505 of title 31, United States Code, as amended by section 4 of this Act; and</text></paragraph> <paragraph id="id988D03AD79AD49FA82A843ED967F9E8A"><enum>(3)</enum><text>may include additional elements, data, plans, and actions, and may be updated from time to time, as the Director and the Director of the Office of Intergovernmental Affairs determine necessary.</text></paragraph></subsection></section>
<section id="id7b50bbd6b57148ed89e7833398692bc3"><enum>6.</enum><header>Office of Management and Budget guidance</header>
<subsection id="id2e2e7f93288946568909457fc6f0e068"><enum>(a)</enum><header>Guidance required by the director</header>
<paragraph id="id9ae9241cf8304cc3a0841237e02dfc21"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Director shall issue guidance implementing section 6505 of title 31, United States Code, as amended by section 4 of this Act.</text></paragraph> <paragraph id="id61f4d6d0af5442bf95428ab38a48c6cf"><enum>(2)</enum><header>Contents</header><text>The guidance issued under paragraph (1)—</text>
<subparagraph id="id64d93e392d7f453f910d366c5d28bbef"><enum>(A)</enum><text>may not preclude any executive agency offering specialized services pursuant to section 6505 of title 31, United States Code, as amended by section 4 of this Act, from utilizing employees or hiring employees to support the development and offering of specialized or technical services identified by the executive agency under such section 6505;</text></subparagraph> <subparagraph id="id36592d3110c042dfb6c5f2c93d3782a6"><enum>(B)</enum><text>shall set requirements for executive agencies to routinely identify, scope, and, where approved, provide specialized or technical services to State, local, territorial, and Tribal governments;</text></subparagraph>
<subparagraph id="id7d5507d2090e46bdbd3093dbdfbcd89d"><enum>(C)</enum><text>shall ensure that executive agencies are not unreasonably restricted from offering specialized or technical services to State, local, territorial, and Tribal governments, especially when doing so would improve the efficiency, effectiveness, and successful delivery of Federal programs or benefits to United States citizens; and</text></subparagraph> <subparagraph id="id6b26cde9a756403ba1e723d83fff1929"><enum>(D)</enum><text>shall include any other measures identified by the Director to implement section 6505 of title 31, United States Code, as amended by section 4 of this Act.</text></subparagraph></paragraph></subsection>
<subsection id="id1ef9497882454ba884efde10052cf89d"><enum>(b)</enum><header>Rescission of current guidance by the director</header><text>Upon issuance of the guidance required by subsection (a), the Director shall rescind Office of Management and Budget Circular A–97, dated August 29, 1969. </text></subsection></section> <section id="ida97b9091223848aaac86b49ec52364dc"><enum>7.</enum><header>Report</header> <subsection id="id2ee7db6638264eddacf4c582b40083be"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, and every year thereafter, the Director, in coordination with the Director of the Office of Intergovernmental Affairs, shall submit to the Committee on Homeland Security and Government Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report on actions and activities taken by executive agencies pursuant to section 6505 of title 31, United States Code, as amended by section 4 of this Act.</text></subsection>
<subsection id="id91e84c0d22ad40769664dc32524a4dbf"><enum>(b)</enum><header>Contents</header><text>The report required under subsection (a) shall include—</text> <paragraph id="id64bc5a00109c46d48d998c551086243d"><enum>(1)</enum><text>a detailed list of the types of specialized or technical services provided by each executive agency under section 6505 of title 31, United States Code, as amended by section 4 of this Act, including the costs of each service provided to each State, local, territorial, and Tribal government;</text></paragraph>
<paragraph id="id56b603dfc5d543c18c18907f9ee4aae8"><enum>(2)</enum><text>measures of State, local, territorial, and Tribal government satisfaction, including an assessment of any such measures, with the specialized or technical services provided by executive agencies under such section 6505, including any cost savings to taxpayers;</text></paragraph> <paragraph id="ide2c2d1337cf8458e96d71b6c3aee8024"><enum>(3)</enum><text>in coordination with State, local, territorial, and Tribal governments, recommendations for the continued improvement of cooperation between the Federal Government and State, local, territorial, and Tribal governments, including legislative recommendations where appropriate, to reduce unnecessary duplication and costs, improve service delivery, and strengthen accountability and oversight of Federal programs, services, and benefits primarily delivered by State, local, territorial, or Tribal governments; and</text></paragraph>
<paragraph id="id4eadac8923c446ada5263888124bbbb5"><enum>(4)</enum><text>other information, assessments, and matters that the Director and the Director of the Office of Intergovernmental Affairs may determine necessary.</text></paragraph></subsection> <subsection id="idfb7ac54a1dd849d0bbb1bd4149e5bf09"><enum>(c)</enum><header>Format</header><text>The report required under subsection (a) may be published in a machine readable format on a website chosen by the Director. </text></subsection></section>
<section id="id0db79603ccd84c31ad53c2c5802cf6eb"><enum>8.</enum><header>Authorities of the Administrator of General Services</header>
<subsection id="id7a3668e561f344a5b1bfe4b4da6c1c5e"><enum>(a)</enum><header>In general</header><text>Subchapter III of chapter III of subtitle I of title 40, United States Code, is amended by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="idFC90C52E6E8E445BA0A9A586DAE9524E"> <section id="id9650d9fc692a4adbb002372c1fa84464" section-type="section-one"><enum>324.</enum><header>Support for State, local, territorial, and Tribal governments</header> <subsection id="iddc1468ba48194240882dec3fb7e45187"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="id3177d5e19d7c41ab99bdd481360b7911"><enum>(1)</enum><text>the term <term>local government</term> and <term>State</term> have the meanings given those terms in section 6501 of title 31;</text></paragraph> <paragraph id="id3E525185A7B740128E12AE28D533D96D"><enum>(2)</enum><text>the term <term>territorial government</term> has the meaning given the term in section 5 of PROMESA (<external-xref legal-doc="usc" parsable-cite="usc/48/2104">48 U.S.C. 2104</external-xref>); and</text></paragraph>
<paragraph id="idED06C76F40E143C7830584683E3C3547" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>the term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of enactment of this paragraph pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph></subsection> <subsection id="id9347afa54dd7461ca9f21d322511e261"><enum>(b)</enum><header>Authority To provide services to State, local, territorial, and Tribal governments</header><text>In addition to any authorities provided to the Administrator in this title or any other title of the United States Code, the Administrator may provide specialized or technical services described in section 6505 of title 31 on a reimbursable or non-reimbursable basis to a State, local, territorial, or Tribal government.</text></subsection>
<subsection id="idf10b74bd70a347a9998d2809ef3d72bb"><enum>(c)</enum><header>Use of funds</header><text>The Administrator is authorized to use monies deposited into or otherwise made available to funds authorized under this chapter to provide the services described in subsection (b).</text></subsection> <subsection id="idBF5294856B42485EA04FCA925451E0B8"><enum>(d)</enum><header>Use of authority</header><text>The authorities provided under this section shall be in addition to any other authorities provided to the Administrator by law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id8BF18E7AA70C4E3EADAB4358AFD9EF59"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for title 40, United States Code, is amended by inserting after the item relating to section 323 the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id9984E7D22D8C4D8A8C6A5586AA9AAD05"> <toc> <toc-entry bold="off" level="section">324.
