which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Federal Energy Regulatory Commission to promulgate regulations on regional and interregional transmission planning, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Connecting Hard-to-reach Areas with Renewably Generated Energy Act of 2022</short-title></quote> or the <quote><short-title>CHARGE Act of 2022</short-title></quote>.</text></section><section id="id8054ca9a6f144441b570dbaa6364c100"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id608dcc1a4c6349f89ae83b660c433ff8"><enum>(1)</enum><text>current transmission planning is fractured across many jurisdictions, prioritizes incumbent entities and highly localized transmission, and fails to identify cost-effective solutions for 21st century needs;</text></paragraph><paragraph id="idc48e86fbc6c04fbda1696fc47af13d9a"><enum>(2)</enum><text>the historical structure, regulations, and incentives of the electric power system lead to under-planning and under-investment in the regional and interregional transmission lines that are needed for a reliable and resilient grid;</text></paragraph><paragraph id="id23266653d4d449f9bf77ef45fdba364d"><enum>(3)</enum><text>much of the existing transmission infrastructure of the United States is in need of significant upgrade or replacement;</text></paragraph><paragraph id="idf71c73f8c21e47eea0ca0144fd54472f"><enum>(4)</enum><text>the energy sector of the United States is at a critical juncture, with a rapidly changing power generation mix and new public policy mandates;</text></paragraph><paragraph id="idf958f2c2427142c2b0c1bda50f3c6e48"><enum>(5)</enum><text>it is imperative to proactively plan for electricity transmission in the future, including by taking into account long-term changes to demand and load growth;</text></paragraph><paragraph id="id0901aa65b77443b5a94087cc46e877d7"><enum>(6)</enum><text>renewable energy resources must be incorporated into the grid efficiently in order to meet State and Federal decarbonization goals;</text></paragraph><paragraph id="idd49d2c8cb0f9467b94b87d7ba34ce621"><enum>(7)</enum><text>the public desires, and has a right to, electricity data that is transparent, organized, and accessible;</text></paragraph><paragraph id="id1542B1D715344B9AB73E418F69EF8CF6"><enum>(8)</enum><text>having reliable and diverse sources of electricity generation is a foundational need for the entire economy;</text></paragraph><paragraph id="id57eb72746c3f473c930ba2fcc089137b"><enum>(9)</enum><text>climate change has increased the frequency and intensity of severe weather events that affect the grid;</text></paragraph><paragraph id="idB546665BD622478280806D9B6CCDCE89"><enum>(10)</enum><text>it is in the national interest to implement policies that provide effective electric infrastructure to save consumers money, avoid preventable damage, ensure energy reliability, and save lives;</text></paragraph><paragraph id="idb924b06d83c7407eafd767dc14524b0f"><enum>(11)</enum><text>the Federal Government has a responsibility to combat rising transmission costs and ensure customers receive just and reasonable rates for electricity; and</text></paragraph><paragraph id="idf7980f57bef5410aa7d950acf726e15c"><enum>(12)</enum><text>industry experience, scientific studies, and modern examples of reformed electricity transmission provide confidence that new public policies and regulatory guidance will achieve more efficient and beneficial planning than the status quo.</text></paragraph></section><section id="id364f86baca7648b9b8e828f3f4dd4a3b"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id1f9b6cb099944f2abab1814de39f7fe4"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph id="id3e2546cf827042c2abaaf58a28c70969"><enum>(2)</enum><header>Independent System Operator</header><text>The term <term>Independent System Operator</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="id44AEE5C23F2245489BD76779CADE3694"><enum>(3)</enum><header>Interconnection customer</header><text>The term <term>interconnection customer</term> means an individual or entity that has submitted to the owner or operator of a transmission facility or transmission system a request to interconnect a generation project or energy storage project that is subject to the jurisdiction of the Commission.</text></paragraph><paragraph id="id75ce76bef6754dc69124ad3918e15168"><enum>(4)</enum><header>Interregional transmission planning process</header><text>The term <term>interregional transmission planning process</term> means a joint process by transmission providers in 2 or more adjacent transmission planning regions to evaluate electric energy transmission needs.</text></paragraph><paragraph id="iddbaa40fbf77d4b129c86b88d1269d4bd"><enum>(5)</enum><header>Load-serving entity</header><text>The term <term>load-serving entity</term> has the meaning given the term in section 217(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824q">16 U.S.C. 824q(a)</external-xref>).</text></paragraph><paragraph id="id54de5932cf514d0fab993ad5e6b69a64"><enum>(6)</enum><header>Pricing node</header><text>The term <term>pricing node</term> means a specific electrical bus location on the grid where an injection or withdrawal of power is modeled. </text></paragraph><paragraph id="id45eb2fe955c341ebb835183f8a9b6d9f"><enum>(7)</enum><header>Regional Transmission Organization</header><text>The term <term>Regional Transmission Organization</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>). </text></paragraph><paragraph id="id8831573B74E84C7EB047120386E7C513"><enum>(8)</enum><header>Transmission facility</header><text>The term <term>transmission facility</term> means a facility that is used for the transmission of electric energy in interstate commerce.</text></paragraph><paragraph id="id3b102de1f0604a12abdf6c0b79834833"><enum>(9)</enum><header>Transmission planning region</header><text>The term <term>transmission planning region</term> means a region for which electric energy transmission planning is appropriate, as determined by the Commission, such as a region established pursuant to the guidance in the final rule of the Commission entitled <quote>Transmission Planning and Cost Allocation by Transmission Owning and Operating Public Utilities</quote> (76 Fed. Reg. 49842 (August 11, 2011)).</text></paragraph><paragraph id="idefc11ffceaa2441cb25c1f7cafc57021"><enum>(10)</enum><header>Transmission provider</header><text>The term <term>transmission provider</term> means a public utility (as defined in section 201(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824(e)</external-xref>)) that owns, operates, or controls 1 or more transmission facilities.</text></paragraph></section><section id="id54602168a77540ebac1821c9be4d1a50"><enum>4.</enum><header>Transmission planning and cost allocation</header><subsection id="id9df0651c8e3d485f9ff59379f74c2fe5"><enum>(a)</enum><header>Rulemaking</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall promulgate a final rule that establishes transmission planning processes and cost-allocation processes that—</text><paragraph id="id2477CEF73B564C75A35454519F766E31"><enum>(1)</enum><text>ensure that transmission providers—</text><subparagraph id="id15a24a9c502243928abba9fd314bad72"><enum>(A)</enum><text>engage in formalized interregional transmission planning processes and interconnection-wide transmission planning processes, in conjunction with transmission planning processes within transmission planning regions;</text></subparagraph><subparagraph id="ida35dbfe2f5dd457f90e541f3ca3a7576"><enum>(B)</enum><text>harmonize interregional transmission planning processes and interconnection-wide transmission planning processes with other transmission planning regions, such as by using a joint model on a consistent timeline with a unified set of minimum requirements regarding needs, input assumptions, and benefit metrics;</text></subparagraph><subparagraph id="id53126eaf98774f94812d9a1762197082"><enum>(C)</enum><text>include as part of planning and cost-allocation processes the use of grid-enhancing transmission technologies and nontransmission alternatives that increase delivery of power over transmission networks, including, at a minimum—</text><clause id="id495ed66285ca456382c9432acdf0c668"><enum>(i)</enum><text>dynamic line ratings;</text></clause><clause id="idd51e10cf0a0741cc933689bd265a0bce"><enum>(ii)</enum><text>topology optimization;</text></clause><clause id="id5081ef7bb18343b29b0fedc020526f1a"><enum>(iii)</enum><text>power flow control;</text></clause><clause id="id90273ad9c91e402f8a2e240263a930b7"><enum>(iv)</enum><text>advanced conductors; and</text></clause><clause id="idacbaf063c68a40678e5ca8374233e3ea"><enum>(v)</enum><text>storage-as-transmission;</text></clause></subparagraph><subparagraph id="idbbce5372abb54e5492a315482d269a67"><enum>(D)</enum><text>conduct interregional and interconnection-wide planning regularly and not less frequently than once every 3 years;</text></subparagraph><subparagraph id="id1D3991BF60C34D8B951EF42E9194CCE8"><enum>(E)</enum><text>conduct system-wide planning based on a range of possible future load and generation scenarios; and</text></subparagraph><subparagraph id="idF6FFA9CEAB804B5EAA72639FE2BAE36A"><enum>(F)</enum><text>are required to incorporate in a transmission planning process the full scope of benefits of transmission investment, including, at a minimum—</text><clause id="idd366665aeb58439aa6bd06a9de768728"><enum>(i)</enum><text>reduced costs of electric energy to customers, including reduced costs associated with lower quantities of necessary capacity, ancillary services, and reserve margins;</text></clause><clause id="id5347e0db96ee4166aee4a482d1246748"><enum>(ii)</enum><text>access to resources in neighboring transmission planning regions;</text></clause><clause id="id1e4016fc1b4d48d395b5f4ac5cfdde7f"><enum>(iii)</enum><text>the transmission of renewable energy or the ability of renewable energy to connect to the grid;</text></clause><clause id="id73853da6198e4bbc8188a355682d3f7f"><enum>(iv)</enum><text>improvements in reliability, resilience, and flexibility of the grid, including, at a minimum—</text><subclause id="id7FA2FA2DEC26427AA78423825A4C33FE"><enum>(I)</enum><text>reduced loss of load probability; </text></subclause><subclause id="id37C07D1E63464B91BE6875E42B154975"><enum>(II)</enum><text>increased resource diversity; </text></subclause><subclause id="idBC95F6DB729F45CC8DC86235F7A8CBC1"><enum>(III)</enum><text>increased climate hardening; and </text></subclause><subclause id="id67906C31BC9641589A98B9560C80178E"><enum>(IV)</enum><text>increased ability to maintain functionality during regionally appropriate weather conditions and severe weather scenarios;</text></subclause></clause><clause id="ide8a3b3ef5ce244c7b8180f4936ce635c"><enum>(v)</enum><text>leveraging resources across climatological patterns or time zones to account for resource availability and weather patterns;</text></clause><clause id="id9489515d4abb4b72a3af5ff78addf48b"><enum>(vi)</enum><text>avoidance, to the maximum extent practicable, of sensitive environmental areas and cultural heritage sites;</text></clause><clause id="id7C5CAF7BA3BF41AE91D6022AFFEF08C3"><enum>(vii)</enum><text>reasonable and economical use of existing rights-of-way;</text></clause><clause id="id3f056345ebb04918a99b8f8448f3732e"><enum>(viii)</enum><text>market facilitation benefits, including, at a minimum, increased competitiveness, liquidity, and integrity of broader geographic markets;</text></clause><clause id="id723ed7e236b045c1b4bf172c7d681c1e"><enum>(ix)</enum><text>avoided costs and deferred cost savings, including reduced generation costs and reduced future transmission investment costs;</text></clause><clause id="idAAF37D9B8C914EA4918806441A7AA225"><enum>(x)</enum><text>the integration of grid-enhancing technologies;</text></clause><clause id="idce431636091c425bbeacc48ca373a8da"><enum>(xi)</enum><text>meeting local, State, and Federal policy goals, including goals established in decarbonization, climate, and clean energy laws (including regulations);</text></clause><clause id="id4AED08E27C8C48AB8D7D2E3465EC4BC8"><enum>(xii)</enum><text>protections to maintain just and reasonable rates for customers; and</text></clause><clause id="idD6E7123A81E24BE6AAF2E0A8432D8A43"><enum>(xiii)</enum><text>any other production costs savings or other economic benefits from proposed transmission projects;</text></clause></subparagraph></paragraph><paragraph id="idfdd32a1bedb54e9c96e857a81c6b56a5" commented="no"><enum>(2)</enum><text>require that regional and interregional cost-allocation methodologies allocate costs on the basis of the multiple benefits described in clauses (i) through (xiii) of paragraph (1)(F); </text></paragraph><paragraph id="id8caac8e37ec24256a26f5c7f609c9c1f" commented="no"><enum>(3)</enum><text>incorporate a 10- to 20-year future resource mix for each load-serving entity and State, which may require a load-serving entity to make publicly available the resource plans of the load-serving entity if, in the determination of the Commission, those plans are not adequately described in publicly stated plans in Securities and Exchange Commission filings, State agency filings, and power purchase contracts;</text></paragraph><paragraph id="id7d7cf3a66f734cacbfd5bc9ecda7a595" commented="no"><enum>(4)</enum><text>prioritize interregional cost-benefit considerations over regional cost-benefit considerations;</text></paragraph><paragraph commented="no" id="idD9EDA86EC635455298C41192EDC14D80"><enum>(5)</enum><text>require transmission providers to maximize the use of portfolio-based cost allocations;</text></paragraph><paragraph commented="no" id="id84AF60B8BC71426BAE2BDCC638ADAAE7"><enum>(6)</enum><text>in cases in which costs and benefits are difficult to quantify, may allocate transmission investment costs among transmission system customers in proportion to—</text><subparagraph commented="no" id="id8CBE326250F948D3B94A9BF21AD0E21B"><enum>(A)</enum><text>in the case of regional projects, the share of electricity of each customer in the region; or</text></subparagraph><subparagraph commented="no" id="idA686DA4A2E1A4C1DB704B2C98620F984"><enum>(B)</enum><text>in the case of interregional projects, the share of electricity of each customer in each applicable region; and</text></subparagraph></paragraph><paragraph commented="no" id="id24AC2AEC29D54700ABF7A28008E88082"><enum>(7)</enum><text>to the extent practicable, prevent transmission providers from using cost-allocation methodologies that—</text><subparagraph commented="no" id="idB10586CBFAA143958A591EF5D6AF0FF2"><enum>(A)</enum><text>discourage distributed generation, energy efficiency, demand response, or storage if more economic than transmission;</text></subparagraph><subparagraph commented="no" id="id320BD6722D054B5AA7E1C272DDFDF1BC"><enum>(B)</enum><text>are constrained by consideration only of benefits that are easy to allocate; or</text></subparagraph><subparagraph commented="no" id="idED797F81E4424D6B8E6D6C20C2F51181"><enum>(C)</enum><text>undermine previous cost-allocation agreements for projects already in operation.</text></subparagraph></paragraph></subsection><subsection id="id291693cff9ae4e4fab7c3d5dd79702ee"><enum>(b)</enum><header>Technical conference</header><paragraph id="idbf7c1a3a55104668b16c5b4ba74be778"><enum>(1)</enum><header>In general</header><text>As part of the rulemaking process under subsection (a), the Commission may convene a technical conference to consider implementation details, as the Commission determines to be appropriate.</text></paragraph><paragraph id="idd9e22f03083f471ab6cbb0b9f7fc7b50"><enum>(2)</enum><header>Participation</header><subparagraph id="ida15e09dedb984f19bea16d8c579f7a9a"><enum>(A)</enum><header>Leadership</header><text>A technical conference convened under paragraph (1) may be led by the members of the Commission.</text></subparagraph><subparagraph id="idd84892a0cf564beab39d5db2d200c525"><enum>(B)</enum><header>Participation</header><text>The Commission may invite to participate in a technical conference convened under paragraph (1) representatives of residential ratepayers, transmission providers, environmental justice and equity groups, Tribal communities, Independent System Operators, Regional Transmission Organizations, consumer protection groups, renewable energy advocates, State utility commission and energy offices, and such other entities as the Commission determines appropriate. </text></subparagraph><subparagraph id="idDBE9C2BB3C73445F80C83744AC4DD5FA"><enum>(C)</enum><header>Timeline</header><text>The Commission may establish and enforce a timeline for a technical conference convened under paragraph (1) that discourages actions by participants that may unnecessarily delay the conference.</text></subparagraph></paragraph><paragraph id="id760dcc6d6e474898bebe641f54681bd3"><enum>(3)</enum><header>Public comment</header><text>The Commission may provide an opportunity for public comment on the topics considered by a technical conference convened under paragraph (1).</text></paragraph></subsection><subsection id="id58f17a8cb5d84e89b8ea078d136f706d"><enum>(c)</enum><header>Office of Public Participation</header><text>The Commission shall consult the Office of Public Participation during the rulemaking process under subsection (a), including with respect to—</text><paragraph id="id454a4692f06546989db9c1293686c461"><enum>(1)</enum><text>guidance on public participation requirements;</text></paragraph><paragraph id="id14d1ac1b24724b12943be97c37da6f4b"><enum>(2)</enum><text>communications with the public concerning transmission planning that may impact local communities and land owners, including Tribal, indigenous, and environmental justice communities; and</text></paragraph><paragraph id="id0d7f46999e8342dda64bb7062beae4a3"><enum>(3)</enum><text>minimum data transparency and access requirements. </text></paragraph></subsection><subsection id="id80a60ce5c4654e719a58d204048e99b2"><enum>(d)</enum><header>Joint Federal-State Task Force on Electric Transmission</header><text>The Commission may consult the Joint Federal-State Task Force on Electric Transmission in any actions that—</text><paragraph id="ide3bcf414e5ed41c0adaac2d9ac6752a3"><enum>(1)</enum><text>involve shared Federal and State regulatory authority and processes; or</text></paragraph><paragraph id="idfbc2a0b245064dde81dd8f688eb33cbb"><enum>(2)</enum><text>would benefit from a combined Federal and State perspective. </text></paragraph></subsection></section><section id="id922b8b1071a34add843ad7d2dc848fb4"><enum>5.</enum><header>Interregional minimum transfer requirements</header><subsection id="id6826af40987f426e87fa70af3e1d0a15"><enum>(a)</enum><header>Electric reliability</header><text>Section 215(i)(2) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(i)(2)</external-xref>) is amended by striking <quote>or transmission</quote>.</text></subsection><subsection id="id2abf1c5f69f34015ad790e6af7d39bb7"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall promulgate a final rule that establishes a minimum transfer capability that—</text><paragraph id="id13b884f925a44d3da65c2f6e838238bf"><enum>(1)</enum><text>shall govern minimum transfer requirements between transmission planning regions;</text></paragraph><paragraph id="id8e48f37fac824e9d896251b08227a7ef"><enum>(2)</enum><text>achieves reliability and resilience standards during plausible extreme weather scenarios;</text></paragraph><paragraph id="id343f824eeac844b18b90922155f78c58"><enum>(3)</enum><text>optimizes efficiency of delivering renewable energy to demand centers; and</text></paragraph><paragraph id="ide4915605f70245a2b5cdfb44af9082d3"><enum>(4)</enum><text>incorporates the best available science relating to energy transmission, climatological patterns, climate change causes and impacts, grid reliability, and grid resiliency, including study results from the Department of Energy or National Laboratories (as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>)).</text></paragraph></subsection></section><section id="id4cf91a8b320f422d9eec8147f0d30827"><enum>6.</enum><header>Data transparency</header><text display-inline="no-display-inline">Part II of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="idA388F6991FBF448697DFD02B9650ED68" display-inline="no-display-inline" style="OLC"><section id="idDE30E91937754A6DB2F7B72966ECF1D5"><enum>224.</enum><header>Data transparency</header><subsection id="idea3cb33e7bb74420b9b6d75709767bc8"><enum>(a)</enum><header>In general</header><text>The Commission shall require all public utilities and other entities subject to the jurisdiction of the Commission to make hourly operating data transparent and accessible to the public, including—</text><paragraph id="id924FD893D78440FE862431CAC49D2DE2"><enum>(1)</enum><text>as original source data posted in a timely manner; and </text></paragraph><paragraph id="idE084A2AE0B464B46B6539A52C651D16D"><enum>(2)</enum><text>through coordination with an online database operated by the Administrator of the Energy Information Administration. </text></paragraph></subsection><subsection id="id8BCCFAC8C8394F51B481C1FD095DABC6"><enum>(b)</enum><header>Data</header><text>Data made publicly available under subsection (a) shall—</text><paragraph id="ide6ab5501dde24a069a2cafd376eef294"><enum>(1)</enum><text>be organized and easy to understand;</text></paragraph><paragraph id="id2dfa7f1fe63f475f8661e419eac59aba"><enum>(2)</enum><text>be centralized and provided in usable formats, including an application programming interface;</text></paragraph><paragraph id="id037633a7cf2343a997247f7a90f10d49"><enum>(3)</enum><text>be available free of charge or at-cost;</text></paragraph><paragraph id="id114f6cbe6f2443a499b1bc4b54c57313"><enum>(4)</enum><text>be published in a timely manner; </text></paragraph><paragraph id="id21156D522E504228A1C10395569F4B9F"><enum>(5)</enum><text>include generation by fuel type; and</text></paragraph><paragraph id="idcfaa0a12331842aaaa09599115899a21"><enum>(6)</enum><text>include average and hourly, or more frequent if technologically feasible, marginal greenhouse gas emissions per megawatt hour of electricity generated within the metered boundaries of each entity and for each pricing node.</text></paragraph></subsection><subsection id="idDE1D7F5FBD7348FB97D9DCBF1A9188B1"><enum>(c)</enum><header>Commercial products</header><text>The Commission may identify and reduce regulatory barriers to the development of commercial products that use the data made publicly available under subsection (a) in order to provide verifiable emissions reductions, including short- and long-term nodal congestion products.</text></subsection><subsection id="id476c6837c8684dba8de1b5498c365415" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Appropriation</header><text>In addition to amounts otherwise made available to the Administrator of the Energy Information Administration, there is appropriated to the Administrator of the Energy Information Administration for fiscal year 2023, out of any funds in the Treasury not otherwise appropriated, $10,000,000 to develop and operate the database described in subsection (a)(2), to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ide49383388e5e438fa456a527f38a474a"><enum>7.</enum><header>Promoting competition for generation</header><text display-inline="no-display-inline">Part II of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824 et seq.</external-xref>) (as amended by section 6) is amended by adding at the end the following:</text><quoted-block id="id92193803412B44E3BF5A5B461E46611B" display-inline="no-display-inline" style="OLC"><section id="id13fe29605f934bf09b0372d8d90c6d62"><enum>225.</enum><header>Due regard for fair competition</header><subsection id="idbfe544852a69409aa656bbdd8703513b"><enum>(a)</enum><header>In general</header><text>In order to effectively protect against the exercise of market power through affiliate abuse, the Commission shall require that any new generation described in subsection (b) is procured through a competitive process and without any right of first refusal for an incumbent utility, subject to subsection (c).</text></subsection><subsection id="id2FC4705BB6244763A084596DA7907659"><enum>(b)</enum><header>New generation described</header><text>The new generation referred to in subsection (a) is new generation that is—</text><paragraph id="idA794B725345B4798B246C0221780F9EF"><enum>(1)</enum><text>above a Commission-determined size threshold;</text></paragraph><paragraph id="id4874DF40FFA94C849A5CC9FED177CCE7"><enum>(2)</enum><text>above a Commission-determined cost materiality threshold; and</text></paragraph><paragraph id="idC09D16EC517F4089A188A6C420351817"><enum>(3)</enum><text>ultimately used to sell power in interstate commerce.</text></paragraph></subsection><subsection id="idacf052e770114fe994ea6c9c9c6c8af7" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Exemption</header><text>New generation that is procured through a process administered by a Regional Transmission Organization or an Independent System Operator is exempted from the requirements of subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id240B3B04C3D64211B478671445D9F63E"><enum>8.</enum><header>State subsidies</header><text display-inline="no-display-inline">Part II of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824">16 U.S.C. 824 et seq.</external-xref>) (as amended by section 7) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F24DFED6AB0473EB9F86EE46C664984"><section id="idC7CC4278BF774F47B3ABBEAB81C38BC1"><enum>226.</enum><header>State subsidies</header><text display-inline="no-display-inline">In order to promote competition in wholesale markets, reliability, and affordability, the Commission shall not use price mitigation methods to counteract the effects of State subsidies for renewable energy resources.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idd3e61e5b272c414eb37e51b67088671e"><enum>9.</enum><header>Office of Transmission</header><text display-inline="no-display-inline">Part III of the Federal Power Act is amended by inserting after section 317 (<external-xref legal-doc="usc" parsable-cite="usc/16/825p">16 U.S.C. 825p</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idca36ce4a91c14300b79f27cd53c13866"><section id="id2b8d4ad3d2cc432094200a76384b764a"><enum>318.</enum><header>Office of Transmission</header><subsection id="id5fef88b86857464b88ac0354f0d46f4f"><enum>(a)</enum><header>Establishment</header><text>There shall be established in the Commission an office, to be known as the <quote>Office of Transmission</quote> (referred to in this section as the <quote>Office</quote>).</text></subsection><subsection id="id23b62f82978e49d59724da681ba4e679"><enum>(b)</enum><header>Director</header><text>The Office shall be administered by a Director, who shall be appointed by the Chairman of the Commission.</text></subsection><subsection id="id60a53a35be374a838c830d60bcbb827c"><enum>(c)</enum><header>Duties</header><text>The Director of the Office shall—</text><paragraph id="idd413117b61764d449347543d9134bebf"><enum>(1)</enum><text>review transmission plans submitted by public utilities in accordance with the regional and interregional transmission planning processes, including the processes established pursuant to section 206;</text></paragraph><paragraph id="ida29a747612864194a4b9edc995b72055"><enum>(2)</enum><text>coordinate transmission-related matters of the Commission, as the Commission determines appropriate;</text></paragraph><paragraph id="id5884baf9d27e4f208cd4e9853acc61ff"><enum>(3)</enum><text>carry out the responsibilities of the Commission under section 216, in coordination with the Office of Energy Projects of the Commission;</text></paragraph><paragraph id="id77ddf69589684775a8e0e80683a54b3f"><enum>(4)</enum><text>review opportunities for innovation in transmission planning and operation, including deployment of grid-enhancing technologies, advanced conductors, and other approaches; and</text></paragraph><paragraph id="idB539E096557449949212DA1338061DB6"><enum>(5)</enum><text>provide oversight of interregional transmission planning activities. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id98debb83b9fa4c76af4f81217e8c37cc"><enum>10.</enum><header>Interconnection</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate regulations, or revise existing regulations—</text><paragraph id="id79e745d3ee8f4f548fa66cdd1bbafde7"><enum>(1)</enum><text>to prohibit a public utility from requiring an interconnection customer to exclusively or disproportionately fund, without reimbursement, the costs of any network upgrade identified as necessary for the interconnect request of the interconnection customer;</text></paragraph><paragraph id="idCC690BB3FF1C4EA2B58B6192BA3EFA6F"><enum>(2)</enum><text>to encourage cost-sharing models that reflect the broad set of benefits and beneficiaries for any network upgrades identified as needed in an interconnection or affected system study, subject to the requirement that the model adheres to any requirements established under paragraph (1); and</text></paragraph><paragraph id="id87C3F7C65D764F2BAB416A6417BEBED3"><enum>(3)</enum><text>to alleviate interconnection backlogs and reduce informational and procedural barriers in interconnection, which may include—</text><subparagraph id="id5E8C76F11CD44F729BB26B7EF93A165C"><enum>(A)</enum><text>the establishment of an interconnection analysis center within the Office of Transmission established under section 318 of the Federal Power Act; and</text></subparagraph><subparagraph id="idF8684D77C308419BB239715F5905B004"><enum>(B)</enum><text>consultation with staff and the use of other resources of the Department of Energy.</text></subparagraph></paragraph></section><section id="idac8f3579aebd4540acba4a199f9a0cb6"><enum>11.</enum><header>Independent transmission monitor</header><subsection id="idc7addaeb9dc146038674715b49617f9b"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, for the purpose of monitoring the planning and operation of transmission facilities in transmission planning regions, the Commission shall—</text><paragraph id="id795940f23ecd42969513eb5f58df6a54"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id31F3F3BD8CCD4979995A9710D1E2333B"><enum>(A)</enum><text>require each transmission planning region to establish an independent entity to monitor the planning and operation of transmission facilities in the transmission planning region; and</text></subparagraph><subparagraph id="id8CE8255424AE40018FC56A202013F8EC" indent="up1"><enum>(B)</enum><text>establish a council, to be known as the <quote>Council of Transmission Monitors</quote>—</text><clause id="idF32F7F43A5964E7A8F131AFFCD9E0969"><enum>(i)</enum><text>to provide oversight of each independent entity established pursuant to subparagraph (A); and</text></clause><clause id="idB56B2BB2D8DF4671A9F19B6EDFAEE2CD"><enum>(ii)</enum><text>to ensure interregional collaboration and consistency; or</text></clause></subparagraph></paragraph><paragraph id="idb27a99ecfb0a42efbf7f2e3a99a945f0"><enum>(2)</enum><text>establish an independent entity to monitor the planning and operation of transmission facilities in all transmission planning regions.</text></paragraph></subsection><subsection id="id6c8f4b79e8c64e87aec44abfbfeaffc8"><enum>(b)</enum><header>Role of transmission monitor</header><text>An independent entity described in paragraph (1)(A) or (2) of subsection (a) shall, as applicable—</text><paragraph id="id9b01379896634001a7bbe9bafd6b241f"><enum>(1)</enum><text>review the operation of applicable transmission planning regions for inefficiency and practices that may lead to unjust and unreasonable rates;</text></paragraph><paragraph id="id0ce71740ed7a4f32ba19a5efeafb22d0"><enum>(2)</enum><text>review transmission planning processes;</text></paragraph><paragraph id="idc95b33de208b47f09250f50028e0f69e"><enum>(3)</enum><text>review costs of transmission facilities, including identifying inefficiencies among local, regional, and interregional planning;</text></paragraph><paragraph id="id9c5d38fffa1d4c7cb8d4daf5df1882f6"><enum>(4)</enum><text>provide examples and advice to transmission providers on appropriate regional transmission operations, planning, and cost-allocation processes; and</text></paragraph><paragraph id="idbd9aa7a93dfd4919a445fbd4e54de533"><enum>(5)</enum><text>identify situations in which, with respect to a transmission planning process—</text><subparagraph id="id09D2C15FAA334303B69D846B9BE08429"><enum>(A)</enum><text>nonwire alternatives may be more cost-effective than transmission;</text></subparagraph><subparagraph id="id7E4FF33A9B62402BBD9297222D422FD0"><enum>(B)</enum><text>grid-enhancing technologies may be appropriate; or</text></subparagraph><subparagraph id="id27E7DD57BB6A45909AC0AD8A3D08AA82"><enum>(C)</enum><text>high-capacity, interregional lines may be—</text><clause id="id2423AB6039BB49E182F60A2AF7950164"><enum>(i)</enum><text>more cost-effective; or </text></clause><clause id="id19FB42898984452481047A64F766C42E"><enum>(ii)</enum><text>a more appropriate reliability and resilience alternative.</text></clause></subparagraph></paragraph></subsection></section><section id="id47cca6e6536847c08e39679c455fa5bf"><enum>12.</enum><header>Advisory committee</header><subsection id="id6c9e0c2af96342beb60a5b1463315ece"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall establish an advisory committee (referred to in this section as the <quote>committee</quote>) to make recommendations on—</text><paragraph id="idf716f0ac66f641eaad009c48af18e3ab"><enum>(1)</enum><text>oversight and governance of Independent System Operators or Regional Transmission Organizations;</text></paragraph><paragraph id="ida0ba1f6a185f4eb0aa9dd1394fe10a26"><enum>(2)</enum><text>stakeholder participation best practices—</text><subparagraph id="id74FD624C66774821B8BC678CC23B4641"><enum>(A)</enum><text>that ensure transparency, accountability, independence, oversight, and fair representation; and</text></subparagraph><subparagraph id="id6E21D01F29374D94A597DE2F782649EB"><enum>(B)</enum><text>the purpose of which are to promote competition, reliability, and affordability in all transmission planning regions;</text></subparagraph></paragraph><paragraph id="id9f5dda10cc8b4767a1e2149439918b9f"><enum>(3)</enum><text>enhancing transparency and open decisionmaking in regions not classified as Independent System Operators or Regional Transmission Organizations; and</text></paragraph><paragraph id="iddd942d5133104d1cbef856b3b9cfbfc7"><enum>(4)</enum><text>the requirements of governing boards within Independent System Operators or Regional Transmission Organizations.</text></paragraph></subsection><subsection id="id1E41686CC03941B1AA48D34AD191777A"><enum>(b)</enum><header>Representation</header><text>The committee shall be composed of not more than 30 members, including—</text><paragraph id="idBDFEE73D4E1D45CFA69F9B3E776645F6"><enum>(1)</enum><text>at least 2 representatives of end-use customers;</text></paragraph><paragraph id="id6532F681CCE443E79A8FF4CD36FB9475"><enum>(2)</enum><text>at least 1 representative of transmission providers;</text></paragraph><paragraph id="idD7FB1A5EAC86432E8845E4524EDFEE56"><enum>(3)</enum><text>at least 2 representatives of environmental justice and equity groups;</text></paragraph><paragraph id="id8BC219D2AA5B4EA98065A8EA0F701858"><enum>(4)</enum><text>at least 1 representative of Tribal communities;</text></paragraph><paragraph id="id9CBF0200D28C487F892E1CB78C467A73"><enum>(5)</enum><text>at least 1 representative of Independent System Operators;</text></paragraph><paragraph id="id152845F135884D229B7F4903FA4A09B5"><enum>(6)</enum><text>at least 1 representative of Regional Transmission Organizations;</text></paragraph><paragraph id="idA26BD563C8A34134B78BDDF8E153920E"><enum>(7)</enum><text>at least 1 representative of consumer protection groups;</text></paragraph><paragraph id="idDADE508CF2FF4CBDABE453DFB102F9F8"><enum>(8)</enum><text>at least 2 representatives of renewable energy advocates;</text></paragraph><paragraph id="idE8FAD1DA922C4A87825724E0A7DB0A11"><enum>(9)</enum><text>at least 1 representative of State commissions; </text></paragraph><paragraph id="id24B1A181ED4D4819A1A9994CC2C0FB2F"><enum>(10)</enum><text>at least 1 representative of public power entities;</text></paragraph><paragraph id="id86C4A19A7F7A46CE9F34E51C0FFC3EF1"><enum>(11)</enum><text>at least 1 representative of marketers; and</text></paragraph><paragraph id="idAD9D11E8CE534F919765A23C58AA3FD1"><enum>(12)</enum><text>at least 1 representative of generators. </text></paragraph></subsection><subsection id="idA2FD3DE18F744C20A6D4FC60B8EBC057"><enum>(c)</enum><header>FACA applicability</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the committee.</text></subsection></section><section id="id1C4A08E05E40484DAB90285BD883E796"><enum>13.</enum><header>Appropriations</header><text display-inline="no-display-inline">In addition to amounts otherwise available, there is appropriated to the Commission for fiscal year 2023, out of any funds in the Treasury not otherwise appropriated, $200,000,000, to remain available until expended, to carry out—</text><paragraph id="id8FE4A12FE9244636B213FE46869EE786"><enum>(1)</enum><text display-inline="yes-display-inline">sections 4, 5, and 10; and</text></paragraph><paragraph id="id01AEDB9D49634D888010B9086AE19C36"><enum>(2)</enum><text display-inline="yes-display-inline">the amendment made by section 9.</text></paragraph></section></legis-body></bill>
