<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3874</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220317">March 17, 2022</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S403">Ms. Sinema</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, and <cosponsor name-id="S406">Mr. Kelly</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 7 of the Fair Labor Standards Act of 1938 to ensure appropriate compensation for certain hours of overtime work by border patrol agents.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Pay Security Act of 2022</short-title></quote>.</text></section><section id="idB91E91B23E2142CB8DB909316765584B"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="id2C11EE08F8AC4876869CFF4157EC4FE8"><enum>(1)</enum><text display-inline="yes-display-inline">to strengthen U.S. Customs and Border Protection; and</text></paragraph><paragraph id="id242BD501A00E4703ACDE26FEC76A2F51"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure that border patrol agents are compensated with premium pay for certain hours of overtime work.</text></paragraph></section><section id="idf82ba80563c743e8990cbd0388b6b675"><enum>3.</enum><header>Fair Labor Standards Act of 1938 premium pay for border patrol agents</header><text display-inline="no-display-inline">Section 7 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/207">29 U.S.C. 207</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc67221e4d8984e3488e71620c8aba725"><subsection id="id017a906efbe74efe913092645cffa36a"><enum>(s)</enum><header>Employment as a border patrol agent</header><text>No public agency shall be deemed to have violated subsection (a) with respect to the employment of any border patrol agent (as defined in section 5550(a)(2) of title 5, United States Code), if, during a work period of 14 consecutive days, the border patrol agent receives compensation at a rate not less than 150 percent of the regular rate at which the border patrol agent is employed for all hours of work between 80 hours and 100 hours. Payments required under this subsection shall be in addition to any payments made under section 5550 of title 5, United States Code, and shall be made notwithstanding any pay limitations set forth in that title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idb17e673104174ed493489e0d6b6481b5"><enum>4.</enum><header>Technical and conforming amendment</header><text display-inline="no-display-inline">Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended by striking paragraph (18).</text></section></legis-body></bill>
