which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Office of the Special Investigator for Competition Matters within the Department of Agriculture.</official-title></form><legis-body><section id="id89867BA0C43743DE873EC8334F5B9A05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Meat and Poultry Special Investigator Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="id03C24515F7D14B7B864434299C601E34"><enum>2.</enum><header>Office of the Special Investigator for Competition Matters</header><subsection id="idb6d43cc2ca3041d9acd192f177b4de7e"><enum>(a)</enum><header>In general</header><text>The Department of Agriculture Reorganization Act of 1994 is amended by inserting after section 216 (<external-xref legal-doc="usc" parsable-cite="usc/7/6916">7 U.S.C. 6916</external-xref>) the following: </text><quoted-block id="id7FAA1614FF3C41359029262DB6224F42" display-inline="no-display-inline" style="OLC"><section id="id6C4DC5989A3F4A748129F034BF688D05"><enum>217.</enum><header>Office of the Special Investigator for Competition Matters</header><subsection id="ida1117015cf1b46fdb1baacdace94c930"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department an office, to be known as the <quote>Office of the Special Investigator for Competition Matters</quote> (referred to in this section as the <term>Office</term>).</text></subsection><subsection id="id7f01d6cb39d442238018660c067c6a25"><enum>(b)</enum><header>Special investigator for competition matters</header><text>The Office shall be headed by the Special Investigator for Competition Matters (referred to in this section as the <term>Special Investigator</term>), who shall be appointed by the Secretary. </text></subsection><subsection id="idf272d1e4408e495bbf040d5856ae1730"><enum>(c)</enum><header>Duties</header><text>The Special Investigator shall—</text><paragraph id="idbf0dc4eb38a64191a91e72f3b50de53b"><enum>(1)</enum><text>use all available tools, including subpoenas, to investigate and prosecute violations of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/181">7 U.S.C. 181 et seq.</external-xref>), by packers and live poultry dealers with respect to competition and trade practices in the food and agriculture sector;</text></paragraph><paragraph id="idd85f018c375e4b1198fef145a87c8aa9"><enum>(2)</enum><text>serve as a Department liaison to, and act in consultation with, the Department of Justice and the Federal Trade Commission with respect to competition and trade practices in the food and agricultural sector;</text></paragraph><paragraph id="idfbccc4547fa24c8e80df5f10b6878abf"><enum>(3)</enum><text>act in consultation with the Department of Homeland Security with respect to national security and critical infrastructure security in the food and agricultural sector; and</text></paragraph><paragraph id="idd52300a538bb487d97fe34ff148a03bd"><enum>(4)</enum><text>maintain a staff of attorneys and other professionals with appropriate expertise.</text></paragraph></subsection><subsection id="id22b76e718ea64668a7ce05412a9f13fa" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Prosecutorial authority</header><paragraph commented="no" display-inline="no-display-inline" id="idE898A0291E8540F88FC1B1D6CAAE924A"><enum>(1)</enum><header>In general</header><text>Notwithstanding title 28, United States Code, the Special Investigator shall have the authority to bring any civil or administrative action authorized under the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/181">7 U.S.C. 181 et seq.</external-xref>), against a packer.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id682C31A9B58E4DBA8D2606445A50CDE4"><enum>(2)</enum><header>Effect</header><text>Nothing in this section alters the authority of the Secretary to issue a subpoena pursuant to the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/181">7 U.S.C. 181 et seq.</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0FC9ABE4CACC48D88787F63D821FBECF"><enum>(b)</enum><header>Conforming amendment</header><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6b93edb7a8654f67bb9f00aee93afe92"><paragraph id="idb6443bd0ef484fa7bc6a8c11a29bc86a"><enum>(11)</enum><text>The authority of the Secretary to carry out section 217.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id476FF26D0D8848A8BC031A6E899D9B23"><enum>(c)</enum><header>Technical amendment</header><text>Subtitle A of the Department of Agriculture Reorganization Act of 1994 is amended by redesignating the first section 225 (relating to Food Access Liaison) (<external-xref legal-doc="usc" parsable-cite="usc/7/6925">7 U.S.C. 6925</external-xref>) as section 224A.</text></subsection></section></legis-body></bill>
