which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To correct the inequitable denial of enhanced retirement and annuity benefits to certain U.S. Customs and Border Protection Officers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>U.S. Customs and Border Protection Officer Retirement Technical Corrections Act</short-title></quote>.</text></section><section id="idde0f61415cd84861a6035e21d1cab315"><enum>2.</enum><header>Adjustment related to transition rules</header><subsection id="id4a654bab33ad499f9cf8f474d32932d7"><enum>(a)</enum><header>Defined term</header><text>In this section the term <term>Eligible Individual</term> means any individual who—</text><paragraph id="id72b4c3a2b13f4652b09539a736242023"><enum>(1)</enum><text>received and accepted an offer of employment as a U.S. Customs and Border Protection Officer before July 6, 2008; and</text></paragraph><paragraph id="ida81397701b7d4f30891fedb29c271f1e"><enum>(2)</enum><text>entered into duty as a U.S. Customs and Border Protection officer on or after July 6, 2008, as a result of an offer described in paragraph (1).</text></paragraph></subsection><subsection id="idfce347836c47435280786827a852bbd9"><enum>(b)</enum><header>Treatment of Eligible Individuals</header><text>Eligible Individuals—</text><paragraph id="ida048791aa4d74dfab156715a45ab5130"><enum>(1)</enum><text>are considered to be individuals serving as U.S. Customs and Border Protection Officers on July 6, 2008, for purposes of section 535(e) of the Department of Homeland Security Appropriations Act, 2008 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>; 121 Stat. 1844); and </text></paragraph><paragraph id="id2EB56F51EF4146149C4688834E26B2D4"><enum>(2)</enum><text>are entitled to—</text><subparagraph id="id9FD557E994734576912037941D47195F"><enum>(A)</enum><text>the minimum annuity amount required under section 535(e)(2)(C) of such Act; and </text></subparagraph><subparagraph commented="no" id="id95fcf921672c4b61be702ae50bc21cd1"><enum>(B)</enum><text>an exemption from mandatory retirement otherwise required under section 8425(b)(1) of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idC744E9C44E394B4191953A672B5B6CF4"><enum>(c)</enum><header>Implementation</header><paragraph commented="no" id="id7B752404FE8B4354B3866CCC8DBCFF50"><enum>(1)</enum><header>Submission of information</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall—</text><subparagraph id="id512d6be1b06446c99f0988734ababad5"><enum>(A)</enum><text>create a list of all Eligible Individuals;</text></subparagraph><subparagraph id="idf644a90ead254eeb99e8b3275930b825"><enum>(B)</enum><text>notify each Eligible Individual of the annuity correction described in subsection (b); and</text></subparagraph><subparagraph id="idc7368a7f43e74a118248e1539abc48ab"><enum>(C)</enum><text>provide the Director of the Office of Personnel Management with all of the information that is necessary for making annuity corrections with respect to Eligible Individuals. </text></subparagraph></paragraph><paragraph id="idB37FCB963C344EFCADEFCF51F2119E99"><enum>(2)</enum><header>Completion of annuity correction</header><text>After receiving the information described in paragraph (1)(C), the Director of the Office of Personnel Management shall make the annuity correction described in subsection (b) with respect to each Eligible Individual, including a retroactive annuity adjustment for Eligible Individuals who retired before the date of the enactment of this Act.</text></paragraph></subsection><subsection commented="no" id="id258BE48410B1404DB4C4140B7AA941B6"><enum>(d)</enum><header>Waivers and guidance</header><paragraph commented="no" id="ide8a5e9679c5e41cc92f149a940cb0bd8"><enum>(1)</enum><header>Waivers</header><text>The Secretary of Homeland Security may retroactively waive the maximum entry age requirement under 3307(g) of title 5, United States Code, to the extent necessary, to ensure that each Eligible Individual is eligible for immediate retirement with the annuity correction described in subsection (b).</text></paragraph><paragraph commented="no" id="idf9351369b3c84f0da128dfc0af717f4b"><enum>(2)</enum><header>Guidance</header><text>The Director of the Office of Personnel Management, in consultation with the Secretary of Homeland Security, shall issue appropriate guidance to assist in the implementation of the annuity correction described in subsection (b). </text></paragraph></subsection></section></legis-body></bill>
