which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Department of Education, in coordination with other relevant Federal agencies, to include a longitudinal component on the impact of the COVID–19 pandemic on student outcomes and well-being on an existing longitudinal educational study. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assessing Children’s Academic Development and the Emotional and Mental Health Implications of COVID–19 Act</short-title></quote> or the <quote><short-title>ACADEMIC Act</short-title></quote> .</text></section><section id="id305dde601c704d62b2eb55dadb546b91"><enum>2.</enum><header>Interagency longitudinal component on the impact of the COVID–19 pandemic on student outcomes and well-being</header><subsection id="ida5512591ef09401d87ef52e8126ee8be"><enum>(a)</enum><header>Authorization of component</header><paragraph id="id7133edbddf59477b82a936582a320c6f"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Education, in coordination with the heads of other relevant Federal agencies, shall include in a prekindergarten through grade 12 longitudinal educational study that was authorized before the date of enactment of this Act and that is active on such date of enactment, to the extent practicable and appropriate, a longitudinal component on the impact of the COVID–19 pandemic and the associated school closures, remote learning, and other factors, on student outcomes and well-being.</text></paragraph><paragraph id="idd77ccb62876c4e28994f41f69093b83a"><enum>(2)</enum><header>Impacts</header><subparagraph id="id0275CA56AEC149CFA82A3E1F4199116D"><enum>(A)</enum><header>In general</header><text>The longitudinal component authorized under paragraph (1) shall include the impact on students’— </text><clause id="id320fca3acaa143cdaab6c4655117e45e"><enum>(i)</enum><text>academic achievement, including any learning loss;</text></clause><clause id="id44848fdbedb643b68717ca8257fdf361"><enum>(ii)</enum><text>social and emotional well-being;</text></clause><clause id="ida1b2dbe13137436f8badebd56c122904"><enum>(iii)</enum><text>mental health;</text></clause><clause id="id8b97884d54b4428fba231ecd2ce2dae9"><enum>(iv)</enum><text>behavioral health; and</text></clause><clause id="id038a71e25a61431cac03331d402f0536"><enum>(v)</enum><text>physical health.</text></clause></subparagraph><subparagraph id="id0C95993221E843EDA30976751E786BB0"><enum>(B)</enum><header>HIPAA compliance</header><text>The longitudinal component authorized under paragraph (1) shall comply with the regulations promulgated under section 264(c) of the Health Insurance Portability and Accountability Act of 1996.</text></subparagraph></paragraph><paragraph id="id833091cfc35b41e6b21424c16bd3adf0"><enum>(3)</enum><header>Study on specific subgroups</header><subparagraph id="id7c944728ef7348df98795e2cc3f58d8a"><enum>(A)</enum><header>In general</header><text>The longitudinal component authorized under paragraph (1) shall examine the impact on specific subgroups of students (except as provided in subparagraph (B)), including on each of those subgroups described in section 1111(b)(2)(B)(xi) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(B)(xi)</external-xref>) and on each of the following: </text><clause id="id71b5943ecfad4e07b487242ebf8328e4"><enum>(i)</enum><text>Status as a student with a parent who is a member of the armed forces (as defined in section 101(a)(4) of title 10, United States Code) on active duty (as defined in section 101(d)(1) of title 10, United States Code) or serves on full-time National Guard duty (as defined in section 101(d)(5) of title 10, United States Code).</text></clause><clause id="idbef0a2f986484758a814dbaf511be1ae"><enum>(ii)</enum><text>Status as a homeless child or youth, as defined in section 725(2) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a(2)</external-xref>).</text></clause><clause id="idcd817400cbfb4e929ff3c1867d131f92"><enum>(iii)</enum><text>Status as a child in foster care. In this clause, the term <term>foster care</term> means 24-hour substitute care for children placed away from their parents and for whom the agency under part E of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/670">42 U.S.C. 670 et seq.</external-xref>) has placement and care responsibility. This includes, but is not limited to, placements in foster family homes, foster homes of relatives, group homes, emergency shelters, residential facilities, child care institutions, and preadoptive homes. A child is in foster care in accordance with this definition regardless of whether the foster care facility is licensed and payments are made by the State, Tribal, or local agency for the care of the child, whether adoption subsidy payments are being made prior to the finalization of an adoption, or whether there is Federal matching of any payments that are made.</text></clause><clause id="id1f324b5c4deb4ea884fe97d88717d725"><enum>(iv)</enum><text>Status as a neglected, delinquent, or at-risk student, as described in part D of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6421">20 U.S.C. 6421 et seq.</external-xref>).</text></clause><clause id="idbd9b703ac5e1456885f8ad0576b14f54"><enum>(v)</enum><text>Students from different grade levels.</text></clause></subparagraph><subparagraph id="id5BFE5413B9684809B2782BE3F55BA0F6"><enum>(B)</enum><header>Exception</header><text>The requirement under subparagraph (A) to examine the impact on a specific subgroup of students shall not be required in the case in which the number of students in a subgroup is insufficient to yield statistically reliable information or the results would reveal personally identifiable information about an individual student. </text></subparagraph></paragraph><paragraph id="id9a9e467ae61d4cb3931d5920ba42afd6"><enum>(4)</enum><header>National representation</header><text>The longitudinal component authorized under paragraph (1) shall be nationally representative and include different geographic areas, including rural and urban localities.</text></paragraph></subsection><subsection id="idef0f16d01c32499f9d394dd6a1d3710b"><enum>(b)</enum><header>Privacy laws</header><text>In carrying out this section, the Secretary of Education, in coordination with the heads of other relevant Federal agencies, shall act in accordance with section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>, commonly known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>).</text></subsection><subsection id="id82c7b6c551f84ed0be36148e35b2da51"><enum>(c)</enum><header>Release of summary of findings</header><text>Not later than 1 year after the end of the data collection under the longitudinal component authorized under subsection (a)(1), the Secretary of Education shall release a preliminary summary of findings from the longitudinal component to the public.</text></subsection></section></legis-body></bill>
