<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3860</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To establish a grant program to provide assistance to local governments with fewer than 200 law enforcement officers, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="id35fc20bd60ee411faddfc515d352a2eb" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Invest to Protect Act of 2022</short-title></quote>.</text></section><section id="idee38f3f309ef49588d7ea7ae07c5803e" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Grant program</header><subsection id="id5efef7d859aa446881537f421b881af3" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="idcf92ab9b066549a39b864de27074795f" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">De-escalation training</header><text display-inline="yes-display-inline">The term <term>de-escalation training</term> means training relating to taking action or communicating verbally or non-verbally during a potential force encounter in an attempt to stabilize the situation and reduce the immediacy of the threat so that more time, options, and resources can be called upon to resolve the situation without the use of force or with a reduction in the force necessary.</text></paragraph><paragraph id="ida0b56e36e82f49539d5d73d3da557bb7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office.</text></paragraph><paragraph id="id2feaa59bdb74429e98f69d88f13c189b" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible local government</header><text display-inline="yes-display-inline">The term <term>eligible local government</term> means—</text><subparagraph id="ide8744843126d4156a1d82ecb8e091bc8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a county, municipality, town, township, village, parish, borough, or other unit of general government below the State level that employs fewer than 200 law enforcement officers; and</text></subparagraph><subparagraph id="idcd080c55846d4923905da23105d12515" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a Tribal government that employs fewer than 200 law enforcement officers.</text></subparagraph></paragraph><paragraph id="idbac060de215d499697018e559f85cd74" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Law enforcement officer</header><text display-inline="yes-display-inline">The term <term>law enforcement officer</term> has the meaning given the term <term>career law enforcement officer</term> in section 1709 of title I the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10389">34 U.S.C. 10389</external-xref>).</text></paragraph><paragraph id="ide3e919c7e56c4529b652ce7353fc93a4" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the Office of Community Oriented Policing Services of the Department of Justice.</text></paragraph></subsection><subsection id="id8511141bf8cb4da582ab57fd7ea6786c" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established within the Office a grant program to—</text><paragraph id="idee259a8978d342b49409c3667d975de2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">provide training and access to mental health resources to local law enforcement officers; and</text></paragraph><paragraph id="id326750019f9a42f9b8e34c94584e1318" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">improve the recruitment and retention of local law enforcement officers.</text></paragraph></subsection><subsection id="id8c4f303331a543109641664a4ca68224" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Director shall award grants to eligible local governments as a part of the grant program established under subsection (b).</text></subsection><subsection id="idfde270ded9ae4a13a181c451b86440b3" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Applications</header><paragraph id="idce8f2ce902384584baab00b978d3d0fe" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Barriers</header><text display-inline="yes-display-inline">The Attorney General shall determine what barriers exist to establishing a streamlined application process for grants under this section.</text></paragraph><paragraph id="id03a062deddf842fa94d5131b33de6dd0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><subparagraph id="ide4ac6136c51e4b94a1df77e3f588f4ec" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Attorney General shall submit to Congress a report that includes a plan to execute a streamlined application process for grants under this section under which an eligible local government seeking a grant under this section can reasonably complete the application in not more than 2 hours.</text></subparagraph><subparagraph id="id49ac96c32bc84400abfbea68c606945b" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Contents of plan</header><text display-inline="yes-display-inline">The plan required under subparagraph (A) may include a plan for—</text><clause id="ida427497c1e474996bdaad4f98392d6fc" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">proactively providing eligible local governments seeking a grant under this section with information on the data such eligible local governments will need to prepare before beginning the grant application; and</text></clause><clause id="id95e197ef5d164698a4c08b78bdc1d873" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">ensuring technical assistance is available for eligible local governments seeking a grant under this section before and during the grant application process, including through dedicated liaisons within the Office.</text></clause></subparagraph></paragraph><paragraph id="ide51ae7fa79f24609be07e133e3447346" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Applications</header><text display-inline="yes-display-inline">In selecting eligible local governments to receive grants under this section, the Director shall use the streamlined application process described in paragraph (2)(A).</text></paragraph></subsection><subsection id="id34f35f4159fe457ebca4d1e05948c726" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Eligible activities</header><text display-inline="yes-display-inline">An eligible local government that receives a grant under this section may use amounts from the grant only for—</text><paragraph id="id77316a0852454534a3c0bd0880199c06" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">de-escalation training for law enforcement officers;</text></paragraph><paragraph id="iddb56542e6c8c47d1a19c8049568096ab" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">victim-centered training for law enforcement officers in handling situations of domestic violence;</text></paragraph><paragraph id="id7482a6262fd24c02994a9893602f1700" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">evidence-based law enforcement safety training, including training for—</text><subparagraph id="id89018F1C5E624F44B3735FC6E1C2FC4A" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">active shooter situations;</text></subparagraph><subparagraph id="id99FD85A2CDE147178F2101791EB337CA" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the safe handling of illicit drugs and precursor chemicals;</text></subparagraph><subparagraph id="idC30B2D096D88479394F204927EA32BBD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">rescue situations;</text></subparagraph><subparagraph id="idD7E083E8B52149D7A44D6E1FEED21123" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">high speed or pursuit driving;</text></subparagraph><subparagraph id="id3EDC4D0743794DFEA65BCDBED218555E" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">recognizing and countering ambush attacks;</text></subparagraph><subparagraph id="id2EE083D722094BADA9E1FBD7297A38FC" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">contact with individuals with mental health needs;</text></subparagraph><subparagraph id="id9F9C2B4F51C7417EB61B4311C8CB3E8B" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">contact with individuals with substance use disorders;</text></subparagraph><subparagraph id="idD9F4C7983F2B40CF9FB4D9692E7B1785" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">contact with veterans; </text></subparagraph><subparagraph id="id210EB5A192C44B79A97B0805368ED233" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">contact with individuals with disabilities;</text></subparagraph><subparagraph id="id20A215E16B5246A68CFF70F6505B8ADC" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">contact with vulnerable youth;</text></subparagraph><subparagraph id="id059766B05EA64BD395CCC2962A4327A2" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">contact with individuals who are victims of domestic violence, sexual assault, or trafficking; or</text></subparagraph><subparagraph id="idE80D02EA40334725980484C66E53B930" commented="no" display-inline="no-display-inline"><enum>(L)</enum><text display-inline="yes-display-inline">contact with individuals experiencing homelessness or living in poverty;</text></subparagraph></paragraph><paragraph id="id97a68262667e49e3a77adfcebf2e9f00" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the offsetting of overtime costs associated with scheduling issues relating to the participation of a law enforcement officer in the training described in paragraphs (1) through (3);</text></paragraph><paragraph id="id9498642485934ac99e7618fd7c73328b" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">a signing bonus for a law enforcement officer in an amount determined by the eligible local government;</text></paragraph><paragraph id="idb6822e07ec7043699e944aea2146e79c" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">a retention bonus for a law enforcement officer—</text><subparagraph id="id5081309ca0d94fa09ed6c51cf84574c2" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in an amount determined by the eligible local government that does not exceed 20 percent of the salary of the law enforcement officer; and</text></subparagraph><subparagraph id="id5a10963349114a0793c0f27b06dfc646" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">who—</text><clause id="idbea7bc4f0ed743b4b4e4a1de2b489e67" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">has been employed at the law enforcement agency for not fewer than 5 years; and</text></clause><clause id="id7c23e11605c849199e4020f003ac2cba" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">has not been found by an internal investigation to have engaged in serious misconduct;</text></clause></subparagraph></paragraph><paragraph id="idb1de652a461f4a7e80e240af6621abc9" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">a stipend for the graduate education of law enforcement officers in the area of mental health, public health, or social work, which shall not exceed the lesser of—</text><subparagraph id="idd720166d72ac4a909b0ef8bd158c75a7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">$10,000; or</text></subparagraph><subparagraph id="id49781c297fc241679e812523ee0c9d19" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the amount the law enforcement officer pays towards such graduate education; and</text></subparagraph></paragraph><paragraph id="id180fa3d838bc436e8b5affaa2a62ae4b" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">providing access to patient-centered behavioral health services for law enforcement officers, which may include resources for risk assessments, evidence-based, trauma-informed care to treat post-traumatic stress disorder or acute stress disorder, peer support and counselor services and family supports, and the promotion of improved access to high quality mental health care through telehealth.</text></paragraph></subsection><subsection id="idc1decefc024f4ac78ce450450da4c0ab" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Disclosure of officer recruitment and retention bonuses</header><paragraph id="ida1d8c840af284105bbd2d89482f0f8d9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which an eligible local government that receives a grant under this section awards a signing or retention bonus described in paragraph (5) or (6) of subsection (e), the eligible local government shall disclose to the Director and make publicly available on a website of the eligible local government the amount of such bonus.</text></paragraph><paragraph id="id7497f40995ea4d20ab22ddb4dc82d301" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Attorney General shall submit to the appropriate congressional committees an annual report that includes each signing or retention bonus disclosed under paragraph (1) during the preceding year.</text></paragraph></subsection><subsection id="idee133106dd064dcd9b45827bf521608e" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Grant accountability</header><text display-inline="yes-display-inline">All grants awarded by the Director under this section shall be subject to the following accountability provisions:</text><paragraph id="idcab284020abe420597ab200077635c16" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Audit requirement</header><subparagraph id="id8d4ef0f516694085a523f78712926170" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <term>unresolved audit finding</term> means a finding in the final audit report of the Inspector General of the Department of Justice that the audited grantee has used grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</text></subparagraph><subparagraph id="id93384ec6d05c4ef8b7bc148f67e69565" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">Beginning in the first fiscal year beginning after the date of enactment of this subsection, and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of grants under this section to prevent waste, fraud, and abuse of funds by grantees. The Inspector General of the Department of Justice shall determine the appropriate number of grantees to be audited each year.</text></subparagraph><subparagraph id="ide9073867e81d43f6a438b0efcb225c2f" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Mandatory exclusion</header><text display-inline="yes-display-inline">A recipient of grant funds under this section that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this section during the first 2 fiscal years beginning after the end of the 12-month period described in subparagraph (A).</text></subparagraph><subparagraph id="id3e0bb9e32bcb4f5c820ad304713baba5" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In awarding grants under this section, the Director shall give priority to eligible local governments that did not have an unresolved audit finding during the 3 fiscal years before submitting an application for a grant under this section.</text></subparagraph><subparagraph id="id451591f8791e498ead3325f9062b3a27" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">If an eligible local government is awarded grant funds under this section during the 2-fiscal-year period during which the eligible local government is barred from receiving grants under subparagraph (C), the Attorney General shall—</text><clause id="id86090ab13a164a4a886166dd0fa6bbc4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">deposit an amount equal to the amount of the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</text></clause><clause id="id3fe7171111784ed6822ffeebf7ee77d6" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</text></clause></subparagraph></paragraph><paragraph id="id519e9c283abf44fd9f06b8e06c554ebb" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Annual certification</header><text display-inline="yes-display-inline">Beginning in the fiscal year during which audits commence under paragraph (1)(B), the Attorney General shall submit to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives an annual certification—</text><subparagraph id="id1f17ab8f39b34c788b685cba0553f724" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">indicating whether—</text><clause id="id8d791c83229a45dcbdf1ebfd88a36788" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">all audits issued by the Office of the Inspector General of the Department of Justice under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</text></clause><clause id="id9a979e929d194742ab7fe300e256c42a" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">all mandatory exclusions required under paragraph (1)(C) have been issued; and</text></clause><clause id="idccf786dac77a451298c8ea51ad1affae" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">all reimbursements required under paragraph (1)(E) have been made; and</text></clause></subparagraph><subparagraph id="id020ef53bd01e45bea63b2519796a6884" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">that includes a list of any grant recipients excluded under paragraph (1) from the previous year.</text></subparagraph></paragraph></subsection><subsection id="id346898173e224c2bb4cadf0f877f1f24" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Preventing duplicative grants</header><paragraph id="id88c9124c7cce4a8c8d9fe1b819dd304e" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Before the Director awards a grant to an eligible local government under this section, the Attorney General shall compare potential grant awards with other grants awarded by the Attorney General to determine if grant awards are or have been awarded for a similar purpose.</text></paragraph><paragraph id="id01fdaba4d9b347fe96009c7245f9dae1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">If the Attorney General awards grants to the same applicant for a similar purpose, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report that includes—</text><subparagraph id="ide98ab878abb44bffabaabf1d902558dc" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a list of all such grants awarded, including the total dollar amount of any such grants awarded; and</text></subparagraph><subparagraph id="id624e85b1531e458fbae6fc924fd7ad7f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the reason the Attorney General awarded multiple grants to the same applicant for a similar purpose.</text></subparagraph></paragraph></subsection><subsection id="id5f37252b269042449714b44acfc92f72" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">In carrying out this section, the Director—</text><paragraph id="id0f08c707b40f451a8248283c3e41d588" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">shall use amounts otherwise made available to the Office; and</text></paragraph><paragraph id="iddd97afc2319f4135a67835ff9289b5c5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">may use not more than $50,000,000 of such amounts for each of fiscal years 2023 through 2027.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220801" chamber="Senate">Passed the Senate August 1, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
