which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the publication of opinions issued by the Office of Legal Counsel of the Department of Justice, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Demanding Oversight and Justification Over Legal Conclusions Transparency Act</short-title></quote> or the <quote><short-title>DOJ OLC Transparency Act</short-title></quote>.</text></section><section id="id981E0B2331E449DE985FA4BB11FFA4E5"><enum>2.</enum><header>Publication and distribution of opinions</header><text display-inline="no-display-inline">Section 521 of title 28, United States Code, is amended—</text><paragraph id="id3F4B6753969E4103A1FB56E1E63EA256"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(a) <header-in-text level="subsection" style="USC">In general</header-in-text>.—</quote> before <quote>The Attorney General</quote>; and</text></paragraph><paragraph id="id2AD77B7CF01C43A2B15CDA6605F6F21D"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90560095D4C7433EB968A3285221C7CA"><subsection id="idA95CE597A54B4360AC2B4F250F14932C"><enum>(b)</enum><header>OLC Opinions</header><paragraph id="id84D53B4E930B46A3BADF652122637ADA"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the following terms shall apply:</text><subparagraph id="idDBF270967D374684BBC4AF4A5CCED423"><enum>(A)</enum><header>Final OLC opinion</header><text>The term <term>final OLC opinion</term> means an OLC opinion that—</text><clause id="id6209d9c888b54df99870856ab2897376"><enum>(i)</enum><text>the Attorney General, Assistant Attorney General for the Office of Legal Counsel, or a Deputy Assistant General for the Office of Legal Counsel, has determined is final;</text></clause><clause id="id766012f93fee4ef68bd7e86e5326ce97"><enum>(ii)</enum><text>is relied upon by government officials or government contractors;</text></clause><clause id="idf07c10ab4ec84b5488786c2fa12de20e"><enum>(iii)</enum><text>is relied upon to formulate legal guidance; or</text></clause><clause id="id014943a9236f4664b150d4942017f3ee"><enum>(iv)</enum><text>is directly or indirectly cited in another OLC opinion. </text></clause></subparagraph><subparagraph id="id0991D3CF4A4B47B7BA63C8D9196912F6"><enum>(B)</enum><header>OLC opinion</header><text>The term <term>OLC opinion</term>—</text><clause id="id6F11E68283E24A8391D1417E689482F5"><enum>(i)</enum><text>means views on a matter of legal interpretation communicated by the Office of Legal Counsel of the Department of Justice to any other office or agency, or person in an office or agency, in the Executive Branch, including any office in the Department of Justice, the White House, or the Executive Office of the President, and rendered in accordance with sections 511 through 513; and</text></clause><clause id="id42F92E09C2E64782B5D0EAEE5915DAA9"><enum>(ii)</enum><text>includes—</text><subclause id="idB304DB441A1C4B629C890B2DA013341D"><enum>(I)</enum><text>in the case of a verbal communication of a legal interpretation, a memorialization of that communication; </text></subclause><subclause id="id616098657CC445C996423F1E88F4DCE7"><enum>(II)</enum><text> a final OLC opinion; and</text></subclause><subclause id="id57A0CD24631C4CA08915E7435BC91FF4"><enum>(III)</enum><text>a revised OLC opinion.</text></subclause></clause></subparagraph><subparagraph id="id93A22C2D38FB477ABBD3A0E3402848A1"><enum>(C)</enum><header>Revised OLC opinion</header><text>The term <term>revised OLC opinion</term> means an OLC opinion—</text><clause id="idFEB637B773454E21BA4F4D1D0C89C82F"><enum>(i)</enum><text>that is withdrawn;</text></clause><clause id="id787CF79073B246FBAB5A4C78020A7F9C"><enum>(ii)</enum><text>to which information is added; or </text></clause><clause id="id218308B4871B490986B6F5E4132D42D8"><enum>(iii)</enum><text>from which information is removed. </text></clause></subparagraph></paragraph><paragraph id="idE79D09DCC8AB40F5B24A2481743D69E6"><enum>(2)</enum><header>Requirement</header><text>Subject to paragraph (3) and in accordance with paragraph (4), the Attorney General shall publish all OLC opinions on the public website of the Department to be accessed by the public free of charge.</text></paragraph><paragraph id="idCBB514EF7FAC4C2E8C37E2FA228A53D1"><enum>(3)</enum><header>Redaction of classified information</header><subparagraph id="id5815562EDF86437B88CEE10FEB0B5CF1"><enum>(A)</enum><header>In general</header><text>In the case of an OLC opinion required to be published under paragraph (2) that contains information classified as confidential, secret, or top secret, the Attorney General shall—</text><clause id="id0CA8ED7ECA2E4EE2BECA4DAD912FA5D6"><enum>(i)</enum><text>redact the classified information from the OLC opinion before publication of the OLC opinion; and</text></clause><clause id="ide8c08c13d29d436ebca6bc90c61a40dd"><enum>(ii)</enum><text>establish and preserve an accurate record documenting each redaction from the OLC opinion, including information describing in detail why public online disclosure of the classified information would have resulted in the associated harm that pertains to each level of classification. </text></clause></subparagraph><subparagraph id="idC8775666036D45DBBB79B01AADF42541"><enum>(B)</enum><header>Limitation</header><text>The Attorney General may not redact information under this paragraph that is sensitive but unclassified.</text></subparagraph><subparagraph id="id02C563FF50DF41E697DF6D46BD49F27D"><enum>(C)</enum><header>Submission to Congress</header><text>In the case of an OLC opinion described in subparagraph (A), the Attorney General shall submit the full opinion, without redaction, to any Member of Congress and any appropriately cleared congressional staff member.</text></subparagraph><subparagraph id="idBF47862B0A2C47EFA5440FE01F217DFA"><enum>(D)</enum><header>Periodic review</header><text>To the maximum extent practicable, the Attorney General shall, on a continual basis and not less frequently than once every 90 days—</text><clause id="id6A3DAD76657A4B899C5234AAF0EDFB67"><enum>(i)</enum><text>review every OLC opinion published under this subsection that contains redactions of classified information; and</text></clause><clause id="id5A8F6C7E940B42D0903DD59450DF88B6"><enum>(ii)</enum><text>remove any redactions that no longer protect information that is classified as either sensitive, secret, or top secret. </text></clause></subparagraph></paragraph><paragraph id="idF9C4B846B1F742B69427A9C8825C2016"><enum>(4)</enum><header>Deadline for publication</header><subparagraph id="id33D7741231354DD3A82212DD399D91EB"><enum>(A)</enum><header>In general</header><text>Each OLC opinion issued by the Office of Legal Counsel of the Department after the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title> shall be published in accordance with this section as soon as practicable, but not later than 48 hours, after the date of issuance of the opinion.</text></subparagraph><subparagraph id="id5AD577235D00456B9E098801DA527709"><enum>(B)</enum><header>Previously issued opinions</header><text>In the case of OLC opinions issued before the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title>, the Attorney General shall, subject to subparagraph (C)—</text><clause id="idb7cc476b583a4fa98d3b1b8d62bbaf2a"><enum>(i)</enum><text>not later than 30 days after the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title>, publish all of the OLC opinions issued during fiscal years 2020 through 2023; </text></clause><clause id="id74AC54B8387B434182F143B5C75E2CA7"><enum>(ii)</enum><text>not later than 60 days after the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title>, publish all of the OLC opinions issued during fiscal years 2000 through 2019; </text></clause><clause id="id9F6F5DAD1FCE4D84B622BF15B3007421"><enum>(iii)</enum><text>not later than 90 days after the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title>, publish all of the OLC opinions issued during fiscal years 1980 through 1999; </text></clause><clause id="idFBF8C268D95B4718A8D5757E6AF340D5"><enum>(iv)</enum><text>not later than 120 days after the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title>, publish all of the OLC opinions issued during fiscal years 1960 through 1979; and</text></clause><clause id="idDFB0A0918EAB4922898A8323393176D4"><enum>(v)</enum><text>not later than 2 years after the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title>, publish all of the OLC opinions issued before fiscal year 1960. </text></clause></subparagraph><subparagraph id="idD5E41B9768B44035A100D2943E578D31"><enum>(C)</enum><header>Description of certain opinions</header><text>In the case of an OLC opinion issued by the Office of Legal Counsel of the Department before the date of enactment of the <short-title>DOJ OLC Transparency Act</short-title> for which the text of the OLC opinion cannot be located, the Attorney General shall—</text><clause id="idBAA42A50D18E42179BC5156DA86FE124"><enum>(i)</enum><text>publish a description of the OLC opinion; and</text></clause><clause id="idBEBB474EBE2B4969A2F96056CFBEA4C3"><enum>(ii)</enum><text>submit a written certification to Congress, under penalty of perjury, that—</text><subclause id="idD84C32500B624FCBB60C2946025CD147"><enum>(I)</enum><text>a good faith effort was made to find the text of the OLC opinion; and</text></subclause><subclause id="id6EF00B3BF70B43D988779D97F95B2CB9"><enum>(II)</enum><text>the text of the OLC opinion is unavailable.</text></subclause></clause></subparagraph></paragraph><paragraph id="id13D55AF60255468CBB32532334E1D761"><enum>(5)</enum><header>Right of action</header><subparagraph id="id453C1CF8E6EC403D85C2ECB01C643DFC"><enum>(A)</enum><header>In general</header><text>On complaint brought by a complainant who has been harmed as a result of being deprived access to an OLC opinion that is required to be made available to the public free of charge on the public website of the Department under this subsection, the district court of the United States in the district in which the complainant resides, or has his principal place of business, or in the District of Columbia, has jurisdiction to enjoin the Office of Legal Counsel from withholding information required to be made available under this subsection and to order the production of information improperly withheld from the complainant.</text></subparagraph><subparagraph id="id80B50A2ADC724A6D9869CBC06405B1D3"><enum>(B)</enum><header>Review</header><text>In a case brought under subparagraph (A)—</text><clause id="idB30DF156B14D4D4689127C01067DDA73"><enum>(i)</enum><text>the court—</text><subclause id="idE748ACE833AE4515BA4B501E4D81A3C7"><enum>(I)</enum><text>shall determine the matter de novo; and</text></subclause><subclause id="id9033494910144C6CA63BC0B1FE6C3891"><enum>(II)</enum><text>may examine the contents of the opinion issued by the Office of Legal Counsel in camera to determine whether such information or any part thereof shall be withheld under paragraph (3); and</text></subclause></clause><clause id="id3F6EE35B22E54A8DBE4CA96664993444"><enum>(ii)</enum><text>the burden is on the Office of Legal Counsel to sustain its action.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
