<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3843</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220315">March 15, 2022</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Environmental Protection Agency to issue analyses on the environmental and economic impacts of rules and rulemakings of the Environmental Protection Agency, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EPA Transparency Act of 2022</short-title></quote>.</text></section><section id="idDB6326232E98415280F3873756FB2E96"><enum>2.</enum><header>Report</header><subsection id="id0831CD276E274928ABCA87881BF08D3B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id19937AF8C51A4A1B8C877E8D529F2FB8"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="id91ABB510BD534A668E02F23B85EEF566"><enum>(2)</enum><header>Data of economic harm</header><text>The term <term>data of economic harm</term>, with respect to a major EPA-promulgated rule or rulemaking, means data, facts, and figures that can be measured, traced, and validated with respect to the economic harm that is anticipated to be caused by the major EPA-promulgated rule or rulemaking.</text></paragraph><paragraph id="idD7CF992EA0144462A25035F731DAC889"><enum>(3)</enum><header>Data of environmental harm</header><text>The term <term>data of environmental harm</term>, with respect to a major EPA-promulgated rule or rulemaking, means data, facts, and figures that can be measured, traced, and validated with respect to the environmental harm that would be caused without the promulgation or issuance of the major EPA-promulgated rule or rulemaking.</text></paragraph><paragraph id="id0F0DCE9605394AE189DA1A8194A7C53B"><enum>(4)</enum><header>Major EPA-promulgated rule or rulemaking</header><text>The term <term>major EPA-promulgated rule or rulemaking</term> means a final rule or policy of the Administrator—</text><subparagraph id="id15A1124511FE4205877F4E8752C5B91D"><enum>(A)</enum><text>the promulgation of which was not explicitly authorized by an Act of Congress; and</text></subparagraph><subparagraph id="idD13C71B2DAF447E9B2FA36334F5BFFB2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>that increases the control or influence of the Federal Government over the property or constitutional rights of an individual as compared to before the date of promulgation of the rule or policy, as determined by the Administrator. </text></subparagraph></paragraph><paragraph id="id1D4E23997A71451E86C7830152AFA924"><enum>(5)</enum><header>Small business</header><text>The term <term>small business</term> means a privately owned corporation, partnership, or sole proprietorship that has—</text><subparagraph id="id949EA43A677A449E9160E5659B7CE5D5"><enum>(A)</enum><text>fewer than 1,500 employees; and</text></subparagraph><subparagraph id="idDC0095DF0CA84793831F750753E3BE6C"><enum>(B)</enum><text>not more than $38,500,000 in average annual receipts.</text></subparagraph></paragraph></subsection><subsection id="id6578D1EDBA3D4529812C3342D2C25D2B"><enum>(b)</enum><header>Report required</header><text>Not later than 30 days after the date on which a major EPA-promulgated rule or rulemaking is promulgated, the Administrator shall submit to Congress and make publicly available a report that describes, with respect to the major EPA-promulgated rule or rulemaking, an analysis of—</text><paragraph id="id73B370BCC8584B5CA1B35470DC3AEC33"><enum>(1)</enum><text>the data of environmental harm; and</text></paragraph><paragraph id="id17AD4409A7424AC7931FBB84CCC2A6B6"><enum>(2)</enum><text>the data of economic harm with respect to small businesses.</text></paragraph></subsection></section></legis-body></bill>
