which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the confiscation of property of certain Russian persons subject to sanctions imposed by the United States and the use of that property for the benefit of the people of Ukraine, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H35D96DA0C1EF4218B1BFA7D93EAC3636"><section section-type="section-one" id="H38EBCBD9C08B454F929CAB1D5A541A55"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Asset Seizure for Ukraine Reconstruction Act</short-title></quote>.</text></section><section id="H70511B964CC847C3A73D3D01A58E5A8D"><enum>2.</enum><header>Use of property of sanctioned Russian persons for the benefit of the people of Ukraine</header><subsection id="idC0A834526747450F9418E5492ADDBD28"><enum>(a)</enum><header>Authorization of confiscation of property</header><paragraph id="H7FC2765DCFB7425189F5A51881A3E2DD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Upon declaring a national emergency under section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621</external-xref>) with respect to the engagement of the Russian Federation in a conflict of territorial conquest in Ukraine, the President may—</text><subparagraph id="id53D79D90FB564BCAB1391148BEB4B4E8"><enum>(A)</enum><text display-inline="yes-display-inline">by means of such instructions, licenses, or other regulations as the President determines appropriate, confiscate any funds or other property of any foreign person described in subsection (b)—</text><clause id="id04DA2F531FF44877A2563BC4516855AA"><enum>(i)</enum><text display-inline="yes-display-inline">subject to the jurisdiction of the United States; and </text></clause><clause id="idFA71BF03563F44888985703D1D4BDB5E"><enum>(ii)</enum><text display-inline="yes-display-inline">valued in excess of $2,000,000;</text></clause></subparagraph><subparagraph id="id91466c310a7b4b98a7724de3244ef6a6"><enum>(B)</enum><text>liquidate or sell any of such property; and</text></subparagraph><subparagraph id="idBDED687E56104375A1FA8756F6F6F459"><enum>(C)</enum><text>transfer funds confiscated under subparagraph (A) and the proceeds of property liquidated or sold under subparagraph (B) to such agencies or other persons as the President determines appropriate to be used for the purposes described in subsection (c).</text></subparagraph></paragraph><paragraph id="id92792e0b54d245809b52fb7c61d3ee1f"><enum>(2)</enum><header>Vesting</header><text>All right, title, and interest in funds and other property confiscated under paragraph (1) shall vest in the Government of the United States. </text></paragraph></subsection><subsection id="H83C3E38EBDE44687BAC3158E1E3D52E0"><enum>(b)</enum><header>Foreign person described</header><text>A foreign person described in this subsection is a foreign person—</text><paragraph id="H528CEB01A62D41CD9B5FC1FAAD548D65"><enum>(1)</enum><text display-inline="yes-display-inline">the wealth of which, according to credible information, is derived in part through corruption linked to or political support for the regime of the President of the Russian Federation, Vladimir Putin; and </text></paragraph><paragraph id="H48E6A69184B349129E5284BC6D3BE35C"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to which the United States has imposed sanctions relating to corruption, human rights violations, the malign influence of the Russian Federation, or conflicts in Ukraine.</text></paragraph></subsection><subsection id="H932405A301B04CDEB2B98FF92561E873"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds confiscated under subparagraph (A) of subsection (a)(1) and the proceeds of property liquidated or sold under subparagraph (B) of that subsection may be used only for the benefit of the people of Ukraine, for the following purposes:</text><paragraph id="HADAF2F8A84D64C77A9D258A9886D04F6"><enum>(1)</enum><text display-inline="yes-display-inline">Post-conflict reconstruction in Ukraine.</text></paragraph><paragraph id="H3A1E3138CA4F40628ECFAFDD30C4EEFE"><enum>(2)</enum><text>Humanitarian assistance.</text></paragraph><paragraph id="HEDEC61330DDB4EEBBE223FA975EC0076"><enum>(3)</enum><text>Weapons for the military forces of the elected Government of Ukraine.</text></paragraph><paragraph id="H6C821A066E3E4E9B93971A4E62B1EA52"><enum>(4)</enum><text>Provisions to support refugees and refugee resettlement in neighboring countries and in the United States.</text></paragraph><paragraph id="H6FC1C2B15EC94500B51019DDFB614BB9"><enum>(5)</enum><text>The provision of technology items and services to ensure the free flow of information to the Ukrainian people in Ukraine, including items—</text><subparagraph id="id65A9D15FC16C438DBE324B02B8F035EE"><enum>(A)</enum><text>to counter internet censorship by the Government of the Russian Federation; </text></subparagraph><subparagraph id="id9573BDCE1C8C4630B757FA070275FD79"><enum>(B)</enum><text>to circumvent efforts to shut down internet or communication services by that Government; or</text></subparagraph><subparagraph id="idC6E4402308504E8DA6C310EA845782A7"><enum>(C)</enum><text>to bolster cybersecurity capabilities of the elected Government of Ukraine or nongovernmental organizations in Ukraine.</text></subparagraph></paragraph><paragraph id="HE583D0B2D7D54510AF5E3772F97F12AC"><enum>(6)</enum><text>Humanitarian and development assistance for the people of the Russian Federation, including democracy and human rights programming and monitoring.</text></paragraph></subsection><subsection id="id138adcd9cfc74ae2b43868d496c686fd" commented="no"><enum>(d)</enum><header>Terms and conditions</header><text>The President may impose such additional terms and conditions as the President determines appropriate with respect to the confiscation, liquidation, sale, or transfer of funds and other property under subsection (a) and with respect to the use of funds under subsection (c). </text></subsection><subsection id="id760dd9c39ed142729002e468dc445f08"><enum>(e)</enum><header>Authorization of rewards</header><paragraph id="id0407692C789A43A5BEE5E3E64C31070C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the sole discretion of the Secretary of the Treasury and in consultation, as appropriate, with the heads of other relevant Federal agencies, the Secretary may pay a reward to—</text><subparagraph id="id0983AC71C956419E8F12F06E103EB5A1"><enum>(A)</enum><text display-inline="yes-display-inline">any individual that furnishes information leading to the confiscation of funds or other property of a foreign person described in subsection (b) that are subject to the jurisdiction of the United States; or</text></subparagraph><subparagraph id="idC36550E0012D412FAB04B587DAF138E3"><enum>(B)</enum><text>any nonprofit humanitarian organization designated by an individual described in subparagraph (A) to receive the reward.</text></subparagraph></paragraph><paragraph id="id1d1a2b053b944aee9b4319ef9d6e140e"><enum>(2)</enum><header>Nonprofit humanitarian organization defined</header><text>In this subsection, the term <term>nonprofit humanitarian organization</term> means an organization that—</text><subparagraph id="id0F0DE5139E58407FBBDCBE2D20FE4478"><enum>(A)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code; and</text></subparagraph><subparagraph id="idEFBD98B749D545B6B15C4E0FB7F34924" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>engages in humanitarian work. </text></subparagraph></paragraph></subsection><subsection id="H591E76528A714248BF070355AE3F63EF"><enum>(f)</enum><header>Sunset</header><text>The authority provided by subsection (a) shall terminate on the date that is 2 years after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
