<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>The Watchdog Act</short-title></quote>.</text></section> <section id="id73A8075518DB404D92D97601FD272458"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="id8C1888C03FF44EC8B82219138F7FA8BE"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> means—</text> <subparagraph id="idab3b2e566bf3430bab8363944ba94202"><enum>(A)</enum><text>an Executive agency, as defined in section 105 of title 5, United States Code; and</text></subparagraph>
<subparagraph id="idd2eeeb9f291040bebb6393ca5c530f0d"><enum>(B)</enum><text>an independent regulatory agency, as defined in section 3502 of title 44, United States Code. </text></subparagraph></paragraph> <paragraph id="id9DCF6F9E91C74B0DA5A686E0C09815B0"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of Openness in Government appointed under section 3(b).</text></paragraph>
<paragraph id="idF2042888B876424C84CF1A0200DEC9E5"><enum>(3)</enum><header>Federal transparency laws</header><text>The term <term>Federal transparency laws</term> means transparency laws of the Federal Government, including—</text> <subparagraph id="id9080c96c2f2e4df89235404885a0aa61"><enum>(A)</enum><text>section 552 of title 5, United States Code; </text></subparagraph>
<subparagraph id="id4a9847d835db4d79811c14a702386dee"><enum>(B)</enum><text>section 552b of title 5, United States Code; </text></subparagraph> <subparagraph id="id48fef6d010054c74a8b0bc151bd6ca52"><enum>(C)</enum><text>the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note); </text></subparagraph>
<subparagraph id="id80652807a220484ba94ad52600ea4866"><enum>(D)</enum><text>the program inventory of each Federal agency required under section 1122(a) of title 31, United States Code; </text></subparagraph> <subparagraph id="id1963C9D575AA4D829D414FCFC0E7551E"><enum>(E)</enum><text>section 2374b of title 10, United States Code;</text></subparagraph>
<subparagraph id="id4b1399be389c4754a6d2d2f39e660780"><enum>(F)</enum><text>section 11319 of title I of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>); and </text></subparagraph> <subparagraph id="id427eef00d60040bb96eaa9651980133f"><enum>(G)</enum><text>any requirement included in an annual appropriations Act for a grant recipient of Federal funds to include in statements, press releases, requests for proposals, bid solicitations, or other documents describing projects or programs funded in whole or in part with Federal money—</text>
<clause id="idAD4A6C9AE9424E8EA77B2E16FD9C8F55"><enum>(i)</enum><text>the percentage of the total costs of the program or project which will be financed with Federal money; </text></clause> <clause id="id4DE27D660A0441DFA120CB3A9878599E"><enum>(ii)</enum><text>the dollar amount of Federal funds for the project or program; or</text></clause>
<clause id="id7E4882C18C9F4D2F8BBABDE27D07B188" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>the percentage and dollar amount of the total costs of the project or program that will be financed by non-governmental sources. </text></clause></subparagraph></paragraph> <paragraph id="id35DE615753194BFD83085CC43D5F6052"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Taxpayer Watchdog Office established under section 3(a).</text></paragraph></section>
<section id="idF58277851D4245ADB18399912227BEF9"><enum>3.</enum><header>Establishment of Taxpayer Watchdog Office</header>
<subsection id="idEC26D0DE730C43F99F6366C9258CDA64"><enum>(a)</enum><header>Establishment</header><text>There is established within the Executive Office of the President the Taxpayer Watchdog Office.</text></subsection> <subsection id="idA816A542D7574C1899F73BD15AEB2ED2"><enum>(b)</enum><header>Director</header><text>The Director shall be the head of the Office and shall be appointed by the President.</text></subsection>
<subsection id="id514641B1691141A6BCAE3E4FDC526CC9"><enum>(c)</enum><header>Staff resources</header><text>The Director of the Office of Management and Budget shall ensure that the Office has sufficient staff resources to enable the Director to fulfill the duties described in section 4.</text></subsection></section> <section id="idFA65B224B2B44599B110A04E19490EB8"><enum>4.</enum><header>Duties of the Office</header> <subsection id="idE7713177952E46CA8167BB79B8780FBF"><enum>(a)</enum><header>Oversight</header> <paragraph id="id1f5677427daf4ecba51507812ebc38e3"><enum>(1)</enum><header>Implementation of Government Transparency Laws</header><text>The Director shall oversee the implementation of Federal transparency laws.</text></paragraph>
<paragraph id="idE2A974E84FB044088D0ED55AF7952BC2"><enum>(2)</enum><header>Complaints</header><text>The Director shall accept and review complaints about a failure of an agency to comply with a Federal transparency law.</text></paragraph> <paragraph id="id726A7CC9DA764CBAA78EBC856F5E1807"><enum>(3)</enum><header>Evaluation</header><text>The Director shall develop a standard compliance and performance scoring methodology using a 100-point scale and shall evaluate and grade each agency according to the scale by considering— </text>
<subparagraph id="id96729D4AC685405C90EAB197AE40F834"><enum>(A)</enum><text>the compliance of the agency with Federal transparency laws, including the accuracy, thoroughness, and timeliness of the agency in providing the public the information required by those laws; and </text></subparagraph> <subparagraph id="id9EAE2408ED0C4331838D39803FE9BA6C"><enum>(B)</enum><text>any other action taken by the agency to increase openness in the Federal Government. </text></subparagraph></paragraph>
<paragraph id="idABCE4CF7092645208EB2E3BA975DF82E"><enum>(4)</enum><header>Cooperation</header>
<subparagraph id="idE98FECFA863A411997D403EEEE74C05D"><enum>(A)</enum><header>In general</header><text>The Director may collect necessary information from agencies to determine whether an agency is in compliance with Federal transparency laws.</text></subparagraph> <subparagraph id="id1F6778D05E65491593F62C891099637D"><enum>(B)</enum><header>Agency cooperation</header><text>Each agency shall cooperate with the Office to provide information necessary to complete the evaluation required under paragraph (3).</text></subparagraph></paragraph></subsection>
<subsection id="id532C1AD42F1444CBBCC80512BFEBC1FA"><enum>(b)</enum><header>Information to the Public</header><text>The Director shall—</text> <paragraph id="id564865D344A7482AA79B25A381D5F85A"><enum>(1)</enum><text>with respect to information to which the public is required to be provided access under Federal transparency laws—</text>
<subparagraph id="idF8B15CF8BC4745149AAF24AC8862C9A8"><enum>(A)</enum><text>compile and maintain on a searchable public website an up-to-date summary of the information and the manner in which the information may be accessed; and</text></subparagraph> <subparagraph id="idF1DFC92977154A659A100F3F14B6DEEF"><enum>(B)</enum><text>compile a summary of the legal limitations to accessing the information, including limitations relating to personal privacy, national security, law enforcement, and privileged communications; and</text></subparagraph></paragraph>
<paragraph id="id6AA0D66763E7416FA51E3D0EFE50C6B1"><enum>(2)</enum><text>compile case law on the interpretation of Federal transparency laws.</text></paragraph></subsection> <subsection id="id6D425D99518B4687B86A5DBFB21B760C"><enum>(c)</enum><header>Report and Recommendations</header> <paragraph id="id81415a545a794f25a3db26b158060be5"><enum>(1)</enum><header>Annual report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Director shall make available to the public a report—</text>
<subparagraph id="id938AA40B81E346CCA608CF0883A9D851"><enum>(A)</enum><text>listing—</text> <clause id="id065586BFF866411C8468B26ED2E22266"><enum>(i)</enum><text>each Federal transparency law; and</text></clause>
<clause id="id34E473F1C5EC4A4BBB77FE1F9350BBA2"><enum>(ii)</enum><text>the compilation of information relating to Federal transparency laws required under subsection (b)(1); </text></clause></subparagraph> <subparagraph id="id28F71821CDFD4F0BB57FA8E505F8DEE8"><enum>(B)</enum><text>summarizing the evaluations required under subsection (a)(3); </text></subparagraph>
<subparagraph id="id7892D0F4FF9845E28FA1155DD9F4C152"><enum>(C)</enum><text>detailing how the Federal transparency laws apply to— </text> <clause id="id7000034B13EB49D4A405EC8BE2C6ECDF"><enum>(i)</enum><text>each agency; and</text></clause>
<clause id="id26BDC67AE93B479088715E50FD745F5B"><enum>(ii)</enum><text>each entity receiving Federal financial assistance, including grants, subgrants, loans, contracts, and tax expenditures;</text></clause></subparagraph> <subparagraph id="id5D916276EFEC49269D2F972CF3D80A37"><enum>(D)</enum><text>providing statistics on the timeliness and completeness of agency reporting and disclosure of information required to be provided or disclosed under Federal transparency laws; and</text></subparagraph>
<subparagraph id="id46F1C232CBAF4BDB99BED3205A274E4C"><enum>(E)</enum><text>including any agency response to the evaluation in the report.</text></subparagraph></paragraph> <paragraph id="idFEE26855045C4FD9A1674E42F7EF931E"><enum>(2)</enum><header>Recommendations</header><text>Not later than 2 years after the date of enactment of this Act, and not less frequently than every 2 years thereafter, the Director shall submit to the President, the heads of agencies, and Congress recommendations for improvements to increase transparency in the activities and missions of, and supported by, the Federal Government. </text></paragraph></subsection></section>
<section id="id61CB5673F614452B84EC21B068C57B2E"><enum>5.</enum><header>Officers and Employees</header><text display-inline="no-display-inline">The Director may appoint and terminate such officers and employees as may be necessary to enable the Office to perform the duties of the Office. </text></section> <section id="id72858B4F9DDD4DA3A4210192D4C244A2" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Funding</header><text display-inline="no-display-inline">The Office shall be funded through the Office of Management and Budget.</text></section>
