which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 16, 2021</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish the National Ocean Mapping, Exploration, and Characterization Council, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Ocean Exploration Act</short-title></quote>.</text></section><section id="idff6eb0494a7b451fa9907e47d6ea4fc0" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings: </text><paragraph id="idF83CFF9D4DD64057BEE0A70E3E397275"><enum>(1)</enum><text>The health and resilience of the ocean are vital to the security and economy of the United States and to the lives of the people of the United States. </text></paragraph><paragraph id="id11EBAE33B7994A6B83A05C4AD46C6245"><enum>(2)</enum><text>The United States depends on the ocean to regulate weather and climate, to sustain and protect the diversity of life, for maritime shipping, for national defense, and for food, energy, medicine, recreation, and other services essential to the people of the United States and all humankind. </text></paragraph><paragraph id="id4fbf25bd463a4837b7a19c77dccd38c6"><enum>(3)</enum><text>The prosperity, security, and well-being of the United States depend on successful understanding and stewardship of the ocean. </text></paragraph><paragraph id="id9F123BB194A94E52AFA65D98AC35E353"><enum>(4)</enum><text>Interdisciplinary cooperation and engagement among government agencies, research institutions, nongovernmental organizations, States, and the private sector are essential for successful stewardship of ocean and coastal environments, national economic growth, national security, and development of agile strategies that develop, promote, and use new technologies.</text></paragraph><paragraph id="id4a616ec6f9364eed84b4a456c76059d6"><enum>(5)</enum><text>Ocean exploration can help the people of the United States understand how to be effective stewards of the ocean and serve as catalysts and enablers for other sectors of the economy. </text></paragraph><paragraph id="idF48A63A0BA7D485E921E6C96D0687B5B"><enum>(6)</enum><text>Mapping, exploration, and characterization of the ocean provides basic, essential information to protect and restore the marine environment, stimulate economic activity, and provide security for the United States.</text></paragraph><paragraph id="ida58a719ded8b4ca2932d8ed7404f7bf5"><enum>(7)</enum><text>A robust national ocean exploration program engaging multiple Federal agencies, the private sector, nongovernmental organizations, and academia is— </text><subparagraph id="id7C1AD88E5D50463F93A33D9254CCDC7D"><enum>(A)</enum><text>essential to the interests of the United States and vital to its security and economy and the health and well-being of all people of the United States; and </text></subparagraph><subparagraph id="id8E8DABC311CA4BFE8F2F6B430F92C2A2"><enum>(B)</enum><text>critical to reestablish the United States at the forefront of global ocean exploration and stewardship.</text></subparagraph></paragraph></section><section id="id7573F732AB9B454AA240DC509DB030DC" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="idF46E8EAF05B646A5AAF079D4065C59A6"><enum>(1)</enum><header>Characterization</header><text>The term <term>characterization</term> refers to activities that provide comprehensive data and interpretations for a specific area of interest of the seafloor, sub-bottom, water column, or hydrologic features, such as water masses and currents, in direct support of specific research, environmental protection, resource management, policymaking, or applied mission objectives. </text></paragraph><paragraph id="idF647069981FF42C4AC227F056D46C165"><enum>(2)</enum><header>Exploration</header><text>The term <term>exploration</term> refers to activities that provide— </text><subparagraph id="id4E35B0375E3E4B3498774E01C9D802BE"><enum>(A)</enum><text>a multidisciplinary view of an unknown or poorly understood area of the seafloor, sub-bottom, or water column; and </text></subparagraph><subparagraph id="idB2692FCAFAFC4B3DABB2CC9259CB8408"><enum>(B)</enum><text>an initial assessment of the physical, chemical, geological, biological, archeological, or other characteristics of such an area.</text></subparagraph></paragraph><paragraph id="idECBAE2910A124E0A9C7EB2C5A18DF94D"><enum>(3)</enum><header>Mapping</header><text>The term <term>mapping</term> refers to activities that provide comprehensive data and information needed to understand seafloor characteristics, such as depth, topography, bottom type, sediment composition and distribution, underlying geologic structure, and benthic flora and fauna. </text></paragraph></section><section id="idB4886290FF4E4E5AB8CEB746C73A70EC" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>4.</enum><header>Ocean Policy Committee</header><subsection id="id8BD1008B867046D9AC01E2029D23BE0D"><enum>(a)</enum><header>Subcommittees</header><text>Section 8932(c) of title 10, United States Code, is amended to read as follows: </text><quoted-block id="id90908268CB234490B615192F002DB12E" display-inline="no-display-inline" style="USC" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subsection id="idCE08AC9BC9584B2680E51D3D5220C504"><enum>(c)</enum><header>Subcommittees</header><paragraph commented="no" display-inline="yes-display-inline" id="idABFAB20502554AD9B37A956356C4ACF4"><enum>(1)</enum><text>The Committee shall include—</text><subparagraph id="idA91F2D97F9264507AD7E09475A55BC00" indent="up1"><enum>(A)</enum><text>a subcommittee to be known as the <quote>Ocean Science and Technology Subcommittee</quote>; and</text></subparagraph><subparagraph indent="up1" id="id74A51F2E331C4490A7B967F30F234BCA"><enum>(B)</enum><text>a subcommittee to be known as the <quote>Ocean Resource Management Subcommittee</quote>.</text></subparagraph></paragraph><paragraph id="id62A786CCE32C4F2EAE480D91DA212E8C" indent="up1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>In discharging its responsibilities in support of agreed-upon scientific needs, and to assist in the execution of the responsibilities described in subsection (b), the Committee may delegate responsibilities to the Ocean Science and Technology Subcommittee, the Ocean Resource Management Subcommittee, or another subcommittee of the Committee, as the Committee determines appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAFBBAD63A6474ADA9D0D19F83143A831"><enum>(b)</enum><header>Increased access to geospatial data for more efficient and informed decision making</header><paragraph id="id0A787219FF4349BC8670F49973D00F4B"><enum>(1)</enum><header>Establishment of document system</header><text>Section 8932(b) of title 10, United States Code, is amended—</text><subparagraph id="idFDD0EEF75C7B4D6BA533A62E8A320374"><enum>(A)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end; </text></subparagraph><subparagraph id="idF7CB46C360F54962BE3A6FBAA0F18F11"><enum>(B)</enum><text>in paragraph (4)(F), by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph><subparagraph id="id9707E548A22048738BA41D7E8CC55321"><enum>(C)</enum><text>by adding at the end the following new paragraph: </text><quoted-block id="idD202D950826B4C2B8979998BA6E1746D" style="USC" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><paragraph id="id2AA337999D0145DDA5C1E2449CCAEBE3"><enum>(5)</enum><text>establish or designate one or more systems for ocean-related documents prepared under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), in accordance with subsection (h).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id5C7496D2CD0842E293396EC8AF71C8E7"><enum>(2)</enum><header>Elements</header><text>Section 8932 of such title is amended—</text><subparagraph id="id36E91124381342D387C4E3AA9F3D1B51"><enum>(A)</enum><text>by redesignating subsection (h) as subsection (i); and</text></subparagraph><subparagraph id="id8FF0B53B1DC44B708C24F6E4775B4410"><enum>(B)</enum><text>by inserting after subsection (g) the following new subsection (h): </text><quoted-block id="id36B5B33F17F9497B8AA6C418C30E9CAE" display-inline="no-display-inline" style="USC" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><subsection id="idCA075FD9ACF84C83BF28F171EC1E8B93"><enum>(h)</enum><header>Elements of document system</header><text>The systems established or designated under subsection (b)(5) shall include the following:</text><paragraph id="idC0D6C981237841A3919B4BE1A4D52B6C"><enum>(1)</enum><text>A publicly accessible, centralized digital archive of documents described in subsection (b)(5) that are finalized after the date of the enactment of the <short-title>National Ocean Exploration Act</short-title>, including—</text><subparagraph id="id48C98291D8A64D90967031DA52176AB4"><enum>(A)</enum><text>environmental impact statements; </text></subparagraph><subparagraph id="id39EC2CC5C1D2416DA2CD96EDDAF8D634"><enum>(B)</enum><text>environmental assessments; </text></subparagraph><subparagraph id="idE0E0775BFC6D44A5BE01CF4333893CE3"><enum>(C)</enum><text>categorical exclusions; </text></subparagraph><subparagraph id="id1F23DBD14D364EECA6659B1DF715D7F9"><enum>(D)</enum><text>records of decision; and </text></subparagraph><subparagraph id="id1DDE8DBD97DC412E810CA30084E4DEDB"><enum>(E)</enum><text>other relevant documents as determined by the Committee.</text></subparagraph></paragraph><paragraph id="id8FA7F69C65434BE5B3E3D10791EB94DB"><enum>(2)</enum><text>Geospatially referenced data, if any, contained in the documents under paragraph (1).</text></paragraph><paragraph id="idECB94A3B39404BAA87CDEDF28451CA32"><enum>(3)</enum><text>A mechanism to retrieve information through geo-information tools that can map and integrate relevant geospatial information, such as—</text><subparagraph id="id50D5E4CA94FC4F16BFE976FAA0192156"><enum>(A)</enum><text>Ocean Report Tools; </text></subparagraph><subparagraph id="id964484DAE75E45AB8E60301B70A2AD7E"><enum>(B)</enum><text>the Environmental Studies Program Information System; </text></subparagraph><subparagraph id="idB908183FE7BA436FA9D5293AB2ACFBBA"><enum>(C)</enum><text>Regional Ocean Partnerships; and </text></subparagraph><subparagraph id="idD631BA51A8B047C38808FB51C3B606EB" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>the Integrated Ocean Observing System.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="idfd9f59924f5a40e3a58371c57441088d" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>5.</enum><header>National Ocean Mapping, Exploration, and Characterization Council</header><subsection id="ida21b071d63fd49d98366707d3ec818cd"><enum>(a)</enum><header>Establishment</header><text>The President shall establish a council, to be known as the <quote>National Ocean Mapping, Exploration, and Characterization Council</quote> (in this section referred to as the <quote>Council</quote>).</text></subsection><subsection id="id1731d93a45fe4774b6eb801baf3abbfd"><enum>(b)</enum><header>Purpose</header><text>The Council shall— </text><paragraph id="id1F17A7266FDD414C88E6EA3EDB2F0904"><enum>(1)</enum><text>update national priorities for ocean mapping, exploration, and characterization; and </text></paragraph><paragraph id="id63DF5A43EB954E84B06B3B153A303BD6"><enum>(2)</enum><text>coordinate and facilitate activities to advance those priorities.</text></paragraph></subsection><subsection id="id28550DA85CCA4111A7C46ED7B668709D"><enum>(c)</enum><header>Reporting</header><text>The Council shall report to the Ocean Science and Technology Subcommittee of the Ocean Policy Committee established under section 8932(c) of title 10, United States Code.</text></subsection><subsection id="idadf6d81952ab4a67a16b81e0f6d98290"><enum>(d)</enum><header>Membership</header><text>The Council shall be composed of not fewer than one senior-level representative from each of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="idCFD3E6468E6A4F578180BD6DFEE16A42"><enum>(1)</enum><text>The Department of the Navy.</text></paragraph><paragraph id="idb47d9e7104ec41bbbf4ec7ba0d36dc63"><enum>(2)</enum><text>The Department of the Interior.</text></paragraph><paragraph id="ide9de34fe3fa54a8c99de88f1ff682434"><enum>(3)</enum><text>The National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="idc3bd312e342e471fb3bd0e81dc64978a"><enum>(4)</enum><text>The department in which the Coast Guard is operating.</text></paragraph><paragraph id="idadf4939d665f48b49c85dafd9cbd5081"><enum>(5)</enum><text>The Office of Management and Budget.</text></paragraph><paragraph id="idf2d39a1b21ac4219be96693c68d91f25"><enum>(6)</enum><text>The Office of Science and Technology Policy.</text></paragraph><paragraph id="id85b6a5c509924bde823c53287b4a73c0"><enum>(7)</enum><text>The National Science Foundation.</text></paragraph><paragraph id="id3329edd9491a4990a412917972a080d6"><enum>(8)</enum><text>The National Aeronautics and Space Administration.</text></paragraph><paragraph id="id6E59DDE46C274C78A6C062FB7619C858"><enum>(9)</enum><text>The Marine Mammal Commission. </text></paragraph><paragraph id="id33142EFAC17441FBA39D799FA295B6DE"><enum>(10)</enum><text>The Department of Transportation. </text></paragraph><paragraph id="id08B8A24D3CA24366AEC7B550B2D7AEA9"><enum>(11)</enum><text>The Department of Energy. </text></paragraph><paragraph id="id2709677E7B774CAFA09B986F64190974"><enum>(12)</enum><text>The Office of the Director of National Intelligence.</text></paragraph></subsection><subsection id="id7daeb17a76aa44dd8b4fcf82d2a61f4c"><enum>(e)</enum><header>Co-Chairs</header><text>The Council shall be co-chaired by—</text><paragraph id="id8E21059522534AA4A51FA20395E3E324"><enum>(1)</enum><text>two senior-level representatives from the National Oceanic and Atmospheric Administration; and </text></paragraph><paragraph id="id61D5021412194837977D953288A640DF"><enum>(2)</enum><text>one senior-level representative from the Department of the Interior. </text></paragraph></subsection><subsection id="id5f4c1580f77847c1a667b4eee3650191"><enum>(f)</enum><header>Duties</header><text>The Council shall—</text><paragraph id="id085bbd4f10e1472193d3c813a018ed3f"><enum>(1)</enum><text>set national ocean mapping, exploration, and characterization priorities and strategies;</text></paragraph><paragraph id="id94415b5802714809a991a2a9de3c35e6"><enum>(2)</enum><text>cultivate and facilitate transparent and sustained partnerships among Federal and State agencies, private industry, academia, and nongovernmental organizations to conduct ocean mapping, exploration, and characterization activities and related technology development;</text></paragraph><paragraph id="id4d2f0e4676104111a115c736d0bd9850"><enum>(3)</enum><text>coordinate improved processes for data compilation, management, access, synthesis, and visualization with respect to ocean mapping, exploration, and characterization, with a focus on building on existing ocean data management systems, as appropriate; </text></paragraph><paragraph id="id0f40d38e664f43479c77f00cf3d0a9c7"><enum>(4)</enum><text>encourage education, workforce training, and public engagement activities that— </text><subparagraph id="id2476DA62E0514A3B80A8FFDEC2764E66"><enum>(A)</enum><text>advance interdisciplinary principles that contribute to ocean mapping, exploration, research, and characterization; </text></subparagraph><subparagraph id="id6310BECA0B0445428DC817B4CE708E94"><enum>(B)</enum><text>improve public engagement with and understanding of ocean science; and </text></subparagraph><subparagraph id="idA24A688F5FF24EBCAD403DF3A13927FF"><enum>(C)</enum><text>provide opportunities for underserved populations; </text></subparagraph></paragraph><paragraph id="id3310eb19d2b54288a960b3531346b000"><enum>(5)</enum><text>coordinate activities as appropriate with domestic and international ocean mapping, exploration, and characterization initiatives or programs; and</text></paragraph><paragraph id="iddc8ba874e0aa462d96078c12c1f54f79"><enum>(6)</enum><text>establish and monitor metrics to track progress in achieving the priorities set under paragraph (1). </text></paragraph></subsection><subsection id="id1E5635A76B3B4F4293F0F231CF658F39"><enum>(g)</enum><header>Interagency Working Group on Ocean Exploration and Characterization</header><paragraph id="id8315467D5457408983EB55290EC0EEE5"><enum>(1)</enum><header>Establishment</header><text>The President shall establish a new interagency working group to be known as the <quote>Interagency Working Group on Ocean Exploration and Characterization</quote>.</text></paragraph><paragraph id="idCCF2A4D7C9674BAFB8B07AF580781E3E"><enum>(2)</enum><header>Membership</header><text>The Interagency Working Group on Ocean Exploration and Characterization shall be comprised of senior representatives from Federal agencies with ocean exploration and characterization responsibilities. </text></paragraph><paragraph id="id11F3FEBEAD464271B4F36811E52DC2F8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Functions</header><text>The Interagency Working Group on Ocean Exploration and Characterization shall support the Council and the Ocean Science and Technology Subcommittee of the Ocean Policy Committee established under section 8932(c) of title 10, United States Code, on ocean exploration and characterization activities and associated technology development across the Federal Government, State governments, private industry, nongovernmental organizations, and academia.</text></paragraph></subsection><subsection id="id3128FF212B9C4085931E1EFFDA44C611"><enum>(h)</enum><header>Oversight</header><text>The Council shall oversee—</text><paragraph id="idF3DBE53EC8BE41AFB41C20AC6BD32D15"><enum>(1)</enum><text>the Interagency Working Group on Ocean Exploration and Characterization established under subsection (g)(1); and </text></paragraph><paragraph id="id63E5585BC0724147AF9E6CD61EC8EA78" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the Interagency Working Group on Ocean and Coastal Mapping under section 12203 of the Ocean and Coastal Mapping Integration Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3502">33 U.S.C. 3502</external-xref>). </text></paragraph></subsection><subsection commented="no" id="id3D732B9B800A4CC89E01754A1565FF7B"><enum>(i)</enum><header>Plan</header><paragraph commented="no" id="id6B2D3D75747F4FCB9477486E922B23A6"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Council shall develop or update and submit to the appropriate committees of Congress a plan for an integrated cross-sectoral ocean mapping, exploration, and characterization initiative. </text></paragraph><paragraph commented="no" id="idBE7C81422CE94FB0A61673CCDA112577"><enum>(2)</enum><header>Elements</header><text>The plan required by paragraph (1) shall—</text><subparagraph commented="no" id="id7737665CA4524D6B8F5D91F61860C77B"><enum>(A)</enum><text>discuss the utility and benefits of ocean exploration and characterization; </text></subparagraph><subparagraph commented="no" id="idB7459F0A76834A2787D38A509CCDAD23"><enum>(B)</enum><text>identify and describe national ocean mapping, exploration, and characterization priorities;</text></subparagraph><subparagraph commented="no" id="id14F64AFD56764D1580545A17F1C6B077"><enum>(C)</enum><text>identify and describe Federal and federally funded ocean mapping, exploration, and characterization programs;</text></subparagraph><subparagraph commented="no" id="id06E586A374A2432FB95B4CEEEF185A7A"><enum>(D)</enum><text>facilitate and incorporate non-Federal input into national ocean mapping, exploration, and characterization priorities; </text></subparagraph><subparagraph commented="no" id="id8E024FD9708541FD875FF81C260E151F"><enum>(E)</enum><text>ensure effective coordination of ocean mapping, exploration, and characterization activities among programs described in subparagraph (C); </text></subparagraph><subparagraph commented="no" id="idAB0771143B0C45D1853D927BEB36D481"><enum>(F)</enum><text>identify opportunities for combining overlapping or complementary needs, activities, and resources of Federal agencies and non-Federal organizations relating to ocean mapping, exploration, and characterization while not reducing benefits from existing mapping, explorations, and characterization activities; </text></subparagraph><subparagraph commented="no" id="id653DD62146D849BAAA7FF4C6988C7B39"><enum>(G)</enum><text>promote new and existing partnerships among Federal and State agencies, private industry, academia, and nongovernmental organizations to conduct or support ocean mapping, exploration, and characterization activities and technology development needs, including through coordination under section 3 of the Commercial Engagement Through Ocean Technology Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/33/4102">33 U.S.C. 4102</external-xref>); </text></subparagraph><subparagraph commented="no" id="id724DF8FE5E034AF991D914645CBABAC2"><enum>(H)</enum><text>develop a transparent and sustained mechanism for non-Federal partnerships and stakeholder engagement in strategic planning and mission execution to be implemented not later than December 31, 2022;</text></subparagraph><subparagraph commented="no" id="id1304A5AB25FF4100A4672D189CD1B141"><enum>(I)</enum><text>establish standardized collection and data management protocols, such as with respect to metadata, for ocean mapping, exploration, and characterization; </text></subparagraph><subparagraph commented="no" id="idFC22F10B2281430CB281613B84C20CBD"><enum>(J)</enum><text>encourage the development, testing, demonstration, and adoption of innovative ocean mapping, exploration, and characterization technologies and applications;</text></subparagraph><subparagraph commented="no" id="idA8E10367BFD6440BBEE38CD2AD3831A7"><enum>(K)</enum><text>promote protocols for accepting data, equipment, approaches, or other resources that support national ocean mapping, exploration, and characterization priorities;</text></subparagraph><subparagraph commented="no" id="id4282A3826D35439CBB45457027F7E9C4"><enum>(L)</enum><text>identify best practices for the protection of marine life during mapping, exploration, and characterization activities;</text></subparagraph><subparagraph commented="no" id="id1B9F9D64E6B34961AC346778FC1E44DE"><enum>(M)</enum><text>identify training, technology, and other resource requirements for enabling the National Oceanic and Atmospheric Administration and other appropriate Federal agencies to support a coordinated national ocean mapping, exploration, and characterization effort;</text></subparagraph><subparagraph commented="no" id="id1F656909281C4803A4870841830109CB"><enum>(N)</enum><text>identify and facilitate a centralized mechanism or office for coordinating data collection, compilation, processing, archiving, and dissemination activities relating to ocean mapping, exploration, and characterization that meets Federal mandates for data accuracy and accessibility;</text></subparagraph><subparagraph commented="no" id="idB3322C69499743B8B3C2D5A12C42E20E"><enum>(O)</enum><text>designate repositories responsible for archiving and managing ocean mapping, exploration, and characterization data; </text></subparagraph><subparagraph id="id0F5D7D12A2824423AAF3F37EA6A91203" commented="no" display-inline="no-display-inline"><enum>(P)</enum><text>set forth a timetable and estimated costs for implementation and completion of the plan;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id96CE57AE388C431C9EC8FF9CF858CB6C"><enum>(Q)</enum><text>to the extent practicable, align ocean exploration and characterization efforts with existing programs and identify key gaps; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idA34BDF3102CA44C4B7AE45F55BE00993"><enum>(R)</enum><text>identify criteria for determining the optimal frequency of observations. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id364A14C6E62D4EB084D6E2EB19FDF17E"><enum>(j)</enum><header>Briefings</header><text>Not later than 1 year after the date of the enactment of this Act, and not less frequently than once every 2 years thereafter, the Council shall brief the appropriate committees of Congress on—</text><paragraph commented="no" display-inline="no-display-inline" id="idE49E8C4E04DF48D884AABC6A0026535B"><enum>(1)</enum><text>progress made toward meeting the national priorities described in subsection (i)(2)(B); and </text></paragraph><paragraph id="idF9F959E4327448D6B65BBA3374F54B79" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>recommendations for meeting such priorities, such as additional authorities that may be needed to develop a mechanism for non-Federal partnerships and stakeholder engagement described in subsection (i)(2)(H). </text></paragraph></subsection><subsection commented="no" id="id25039629E18F4CF8834F4DD6D9DE222D"><enum>(k)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph commented="no" id="id86164F484D1C40FDAEBD68FFC74D6F0B"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation and the Committee on Armed Services of the Senate; and</text></paragraph><paragraph id="idD40FE666ED594EB1A93B552A9F5031DD"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent possible, coordinate the efforts described in paragraph (1) with the outreach strategies of other domestic or international ocean mapping, exploration, and characterization initiatives. </text></paragraph></subsection><subsection id="idD583375EF2694C88A13EA6FB8DADD753"><enum>(b)</enum><header>Education and outreach efforts</header><text display-inline="yes-display-inline">Efforts described in subsection (a)(1) may include— </text><paragraph id="id7024CA84F2C64F4A8A3D6088C2A01A3D"><enum>(1)</enum><text display-inline="yes-display-inline">education of the general public, teachers, students, and ocean and coastal resource managers; and </text></paragraph><paragraph id="id502E18446CD54258A9C9B893DB2FD080"><enum>(2)</enum><text>workforce training, reskilling, and opportunities to encourage development of ocean related science, technology, engineering, and mathematics (STEM) technical training programs involving secondary schools, community colleges, and universities, including Historically Black Colleges or Universities (within the meaning of the term ‘<quote>part B institution</quote>’ under section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>)), Tribal Colleges or Universities (as defined in section 316(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)), and other minority-serving institutions (as described in section 371(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>))).</text></paragraph></subsection><subsection id="idC0BDC645F1D84D0499EDE2E43CAB6073"><enum>(c)</enum><header>Outreach strategy</header><text>Not later than 180 days after the date of the enactment of the <short-title>National Ocean Exploration Act</short-title>, the Administrator of the National Oceanic and Atmospheric Administration shall develop an outreach strategy to broadly disseminate information on the discoveries made by the program under section 12002.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idC42F19DDAD724B40AD28F94618BC0AD0"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; and </text></paragraph><paragraph id="idC102C28755954F338A45514734414966"><enum>(2)</enum><text>by inserting after section 12205 the following: </text><quoted-block style="OLC" id="id67C056408222494D986B5D7287A8A201" act-name="" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><section section-type="subsequent-section" id="idBC4B958B7AAE471ABC8A5596DF700C8D"><enum>12206.</enum><header>Ocean and coastal mapping Federal funding opportunity</header><subsection id="id831075B7B9CE46BEA89B1295BE8B7556"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of the <short-title>National Ocean Exploration Act</short-title>, the Administrator shall develop an integrated ocean and coastal mapping Federal funding match opportunity within the National Oceanic and Atmospheric Administration with Federal, State, Tribal, local, nonprofit, private industry, or academic partners in order to increase the coordinated acquisition, processing, stewardship, and archival of new ocean and coastal mapping data in United States waters.</text></subsection><subsection id="id3D4D99100B44401F8428ACC04CDEE76D"><enum>(b)</enum><header>Rules</header><text>The Administrator shall develop administrative and procedural rules for the ocean and coastal mapping Federal funding match opportunity developed under subsection (a), to include—</text><paragraph id="id691B8097821C4DEA9258C0BB50EA42F3"><enum>(1)</enum><text>specific and detailed criteria that must be addressed by an applicant, such as geographic overlap with pre-established priorities, number and type of project partners, benefit to the applicant, coordination with other funding opportunities, and benefit to the public;</text></paragraph><paragraph id="idEB7F42A872464A5CA6462792C6291BAF"><enum>(2)</enum><text>determination of the appropriate funding match amounts and mechanisms to use, such as grants, agreements, or contracts; and</text></paragraph><paragraph id="id94FE52EC2A374962BD82398A20EA8B5C"><enum>(3)</enum><text>other funding award criteria as are necessary or appropriate to ensure that evaluations of proposals and decisions to award funding under this section are based on objective standards applied fairly and equitably to those proposals.</text></paragraph></subsection><subsection id="id486D32E948AC4B1DB7C80C0DF13FB7F4"><enum>(c)</enum><header>Geospatial services and contract vehicles</header><text>The ocean and coastal mapping Federal funding match opportunity developed under subsection (a) shall leverage Federal expertise and capacities for geospatial services and Federal geospatial contract vehicles using the private sector for acquisition efficiencies.</text></subsection></section><section id="idA28A6F0AF8604645A1F793C54273B5FE"><enum>12207.</enum><header>Cooperative agreements, contracts, and grants</header><subsection id="id58C760FD093A43C7B0630E3D504851FD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out interagency activities under this subtitle, the heads of agencies represented on the Working Group may enter into cooperative agreements, or any other agreement with each other, and transfer, receive, and expend funds made available by any Federal agency, any State or subdivision thereof, or any public or private organization or individual, for ocean and coastal mapping investigations, surveys, studies, and other geospatial collaborations authorized by this subtitle or agreements authorized by section 5 of the Act entitled <quote>An Act to define the functions and duties of the Coast and Geodetic Survey, and for other purposes</quote>, approved August 6, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/33/883e">33 U.S.C. 883e</external-xref>).</text></subsection><subsection id="id36E225670E2D45B4B9A045E0BD15FAEC"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Administrator may make grants to any State or subdivision thereof or any public or private organization or individual to carry out the purposes of this subtitle.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idE2FA7BA98A9145D7AF741928124799B3"><enum>(f)</enum><header>Authorization of appropriations</header><text>Section 12209 of such Act, as redesignated by subsection (e)(1), is amended—</text><paragraph id="idCAC8749D4B2A448896BF497FD89CE703"><enum>(1)</enum><text>in subsection (a), by striking <quote>this subtitle</quote> and all that follows and inserting <quote>this subtitle $45,000,000 for each of fiscal years 2021 through 2030.</quote>; and</text></paragraph><paragraph id="id2A109D913212446A96F057C4168E1B80"><enum>(5)</enum><text>in paragraph (5), by striking <quote>$30,564,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$35,000,000 for each of fiscal years 2021 through 2030</quote>. </text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="ida791b92b-c36c-43d9-bbdc-59d76c988972" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Ocean Exploration Act</short-title></quote>.</text></section><section id="idcfc8b875-3d8e-4cba-a109-f679f1895db2" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings: </text><paragraph id="ided3a5260-0380-4638-8944-a5121d9e1a69"><enum>(1)</enum><text>The health and resilience of the ocean are vital to the security and economy of the United States and to the lives of the people of the United States. </text></paragraph><paragraph id="id203b2d8f-2b7f-4d1d-96d9-1dfb86124735"><enum>(2)</enum><text>The United States depends on the ocean to regulate weather and climate, to sustain and protect the diversity of life, for maritime shipping, for national defense, and for food, energy, medicine, recreation, and other services essential to the people of the United States and all humankind. </text></paragraph><paragraph id="id9de4de2f-52e8-47b7-a3f0-36c5a6e70bce"><enum>(3)</enum><text>The prosperity, security, and well-being of the United States depend on successful understanding and stewardship of the ocean. </text></paragraph><paragraph id="idb5f6f780-6978-40be-96e7-04663a3474db"><enum>(4)</enum><text>Interdisciplinary cooperation and engagement among government agencies, research institutions, nongovernmental organizations, States, Indian Tribes, and the private sector are essential for successful stewardship of ocean and coastal environments, national economic growth, national security, and development of agile strategies that develop, promote, and use new technologies.</text></paragraph><paragraph id="idd3636abd-6f0d-481e-a96d-a29d1e16608b"><enum>(5)</enum><text>Ocean exploration can help the people of the United States understand how to be effective stewards of the ocean and serve as catalysts and enablers for other sectors of the economy. </text></paragraph><paragraph id="id87e511c5-53a3-4d42-a858-782656996333"><enum>(6)</enum><text>Mapping, exploration, and characterization of the ocean provides basic, essential information to protect and restore the marine environment, stimulate economic activity, and provide security for the United States.</text></paragraph><paragraph id="idc01676d2-ebb9-4f5d-b1bf-04c427f87fa9"><enum>(7)</enum><text>A robust national ocean exploration program engaging multiple Federal agencies, Indian Tribes, the private sector, nongovernmental organizations, and academia is— </text><subparagraph id="id9a5f7d94-00e3-4767-a864-8f51a3213913"><enum>(A)</enum><text>essential to the interests of the United States and vital to its security and economy and the health and well-being of all people of the United States; and </text></subparagraph><subparagraph id="idc716cc60-1e7f-4e5c-b1cc-850b3475327f"><enum>(B)</enum><text>critical to reestablish the United States at the forefront of global ocean exploration and stewardship.</text></subparagraph></paragraph></section><section id="id8e90d9a1-f7bd-4419-89f1-542088b0832f" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="id02517b79-2035-479b-9300-d6f7a2a256cb"><enum>(1)</enum><header>Characterization</header><text>The term <term>characterization</term> refers to activities that provide comprehensive data and interpretations for a specific area of interest of the seafloor, sub-bottom, water column, or hydrologic features, such as water masses and currents, in direct support of specific research, environmental protection, resource management, policymaking, or applied mission objectives. </text></paragraph><paragraph id="idfbf3e8ea-86e2-407a-9ff8-ea54546f6c54"><enum>(2)</enum><header>Exploration</header><text>The term <term>exploration</term> refers to activities that provide— </text><subparagraph id="id3ee13dc1-ef8f-4ec0-8e19-a774184f8872"><enum>(A)</enum><text>a multidisciplinary view of an unknown or poorly understood area of the seafloor, sub-bottom, or water column; and </text></subparagraph><subparagraph id="ide703355f-9e85-4592-bc99-6c218d9041cd"><enum>(B)</enum><text>an initial assessment of the physical, chemical, geological, biological, archeological, or other characteristics of such an area.</text></subparagraph></paragraph><paragraph id="idF70993FCEA29497D80150F2E815C347A"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idafa5d7f2-54c7-442c-9ef9-f79b30b92137"><enum>(4)</enum><header>Mapping</header><text>The term <term>mapping</term> refers to activities that provide comprehensive data and information needed to understand seafloor characteristics, such as depth, topography, bottom type, sediment composition and distribution, underlying geologic structure, and benthic flora and fauna. </text></paragraph></section><section id="id5e27eafa-7afe-408c-9c4f-cb9dd56d23d0" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>4.</enum><header>Ocean Policy Committee</header><subsection id="id806a8d8a-1732-4253-910a-32fa57ddb268"><enum>(a)</enum><header>Subcommittees</header><text>Section 8932(c) of title 10, United States Code, is amended to read as follows: </text><quoted-block id="ide3c6c5bb-5f56-4533-bcd4-679123231341" display-inline="no-display-inline" style="USC" act-name="" changed="added" reported-display-style="italic" committee-id="SSCM00"><subsection id="id3f336e48-7980-4423-87ee-39f64341649e"><enum>(c)</enum><header>Subcommittees</header><paragraph commented="no" display-inline="yes-display-inline" id="id7da3edf9-5e91-47d1-9dfd-d6e82ea22d4f"><enum>(1)</enum><text>The Committee shall include—</text><subparagraph id="idadf5466b-0ba9-4939-b0f2-96c4394454af" indent="up1"><enum>(A)</enum><text>a subcommittee to be known as the <quote>Ocean Science and Technology Subcommittee</quote>; and</text></subparagraph><subparagraph indent="up1" id="ida6d58b06-953c-4f04-b0c3-2ecb356755fd"><enum>(B)</enum><text>a subcommittee to be known as the <quote>Ocean Resource Management Subcommittee</quote>.</text></subparagraph></paragraph><paragraph id="id98852b10-a8e5-4d5b-9cb5-48cb7ee3add1" indent="up1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>In discharging its responsibilities in support of agreed-upon scientific needs, and to assist in the execution of the responsibilities described in subsection (b), the Committee may delegate responsibilities to the Ocean Science and Technology Subcommittee, the Ocean Resource Management Subcommittee, or another subcommittee of the Committee, as the Committee determines appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida8c07647-28a5-4ec8-973a-10152844e25b"><enum>(b)</enum><header>Increased access to geospatial data for more efficient and informed decision making</header><paragraph id="id8329e0e0-62af-42f6-a0a2-d5bcf29429b7"><enum>(1)</enum><header>Establishment of document system</header><text>Section 8932(b) of title 10, United States Code, is amended—</text><subparagraph id="id84a3bc06-85a5-4786-aad0-72498f8ec74a"><enum>(A)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end; </text></subparagraph><subparagraph id="idc1881e67-743d-438d-b065-792f7e5893a0"><enum>(B)</enum><text>environmental assessments; </text></subparagraph><subparagraph id="idd71addd1-6462-4493-9d83-2d9d74417092"><enum>(C)</enum><text>categorical exclusions; </text></subparagraph><subparagraph id="id022a207a-b657-4760-a0e6-8f3e38e88672"><enum>(D)</enum><text>records of decision; and </text></subparagraph><subparagraph id="idd054588f-52aa-4dab-98b0-eadd25c26e36"><enum>(E)</enum><text>other relevant documents as determined by the Committee.</text></subparagraph></paragraph><paragraph id="id8fb66e34-5fb6-4bdf-afb4-cdba1e034fac"><enum>(2)</enum><text>Geospatially referenced data, if any, contained in the documents under paragraph (1).</text></paragraph><paragraph id="id5d659f4f-9a01-4fa9-b332-f6bdc6f2815b"><enum>(3)</enum><text>A mechanism to retrieve information through geo-information tools that can map and integrate relevant geospatial information, such as—</text><subparagraph id="id2bacdf99-8a69-4790-badc-8b2dfa8e683a"><enum>(A)</enum><text>Ocean Report Tools; </text></subparagraph><subparagraph id="id63d97b8b-255c-4a13-989a-4250703b624a"><enum>(B)</enum><text>the Environmental Studies Program Information System; </text></subparagraph><subparagraph id="ida242f765-3e49-4c16-bf4b-f318eb15dc8e"><enum>(C)</enum><text>Regional Ocean Partnerships; and </text></subparagraph><subparagraph id="id1e30f8d9-5afe-45a0-986e-b86cedbed5a2" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>the Integrated Ocean Observing System.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="ide1ce5c4f-4d23-424d-8107-8107ceed695d" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>5.</enum><header>National Ocean Mapping, Exploration, and Characterization Council</header><subsection id="ida950ce6e-265b-4507-ad4a-cd86efb0c15b"><enum>(a)</enum><header>Establishment</header><text>The President shall establish a council, to be known as the <quote>National Ocean Mapping, Exploration, and Characterization Council</quote> (in this section referred to as the <quote>Council</quote>).</text></subsection><subsection id="ida4329845-ea90-48be-9973-932b7753b641"><enum>(b)</enum><header>Purpose</header><text>The Council shall— </text><paragraph id="id81a2de46-60de-4d15-97c2-245b1acde919"><enum>(1)</enum><text>update national priorities for ocean mapping, exploration, and characterization; and </text></paragraph><paragraph id="id0b3e4749-0715-41c6-a7e8-66e3ad88ec50"><enum>(2)</enum><text>coordinate and facilitate activities to advance those priorities.</text></paragraph></subsection><subsection id="ida79caafb-d555-4668-b27e-82ca460288f1"><enum>(c)</enum><header>Reporting</header><text>The Council shall report to the Ocean Science and Technology Subcommittee of the Ocean Policy Committee established under section 8932(c) of title 10, United States Code.</text></subsection><subsection id="id2f525b12-7ba7-4808-b20a-a017a60e951c"><enum>(d)</enum><header>Membership</header><text>The Council shall be composed of not fewer than one senior-level representative from each of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="idcf0f1ff7-e575-4cfb-90f0-fb1fcc74708f"><enum>(1)</enum><text>The Department of the Navy.</text></paragraph><paragraph id="id63451522-a9bc-472a-930a-aca67575e0a2"><enum>(2)</enum><text>The Department of the Interior.</text></paragraph><paragraph id="id0fc7f14f-f69c-4c94-bd4e-2b8ecbc1b89d"><enum>(3)</enum><text>The National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="id783e7191-80cf-4530-b91b-a76df9e2049c"><enum>(4)</enum><text>The department in which the Coast Guard is operating.</text></paragraph><paragraph id="id7817945e-4029-4f66-939e-0ea0c61ce803"><enum>(5)</enum><text>The Office of Management and Budget.</text></paragraph><paragraph id="id3f32606d-c1f3-4346-8c6f-e14a8500c4e6"><enum>(6)</enum><text>The Office of Science and Technology Policy.</text></paragraph><paragraph id="ida5e5d3ad-d5e8-45bc-8f3b-c9a7ed55b8fc"><enum>(7)</enum><text>The National Science Foundation.</text></paragraph><paragraph id="ideb984188-75b1-4a8c-a47e-4abca017b44d"><enum>(8)</enum><text>The National Aeronautics and Space Administration.</text></paragraph><paragraph id="id26419872-320b-4f2f-99d7-eb34d7f33bad"><enum>(9)</enum><text>The Marine Mammal Commission. </text></paragraph><paragraph id="id3729367c-b85c-4468-98d6-ddaf211e1195"><enum>(10)</enum><text>The Department of Transportation. </text></paragraph><paragraph id="id0d3d5d91-9ac2-4916-8e88-381abc8a5639"><enum>(11)</enum><text>The Department of Energy. </text></paragraph><paragraph id="id3d4b31c2-c906-4aac-a635-196ce10393a5"><enum>(12)</enum><text>The Office of the Director of National Intelligence.</text></paragraph></subsection><subsection id="idfddccdfd-f4fc-4d8e-a13a-2457585628e5"><enum>(e)</enum><header>Co-Chairs</header><text>The Council shall be co-chaired by—</text><paragraph id="iddd3a4375-ce10-4c90-873f-96d0e43336a1"><enum>(1)</enum><text>two senior-level representatives from the National Oceanic and Atmospheric Administration; and </text></paragraph><paragraph id="ida6a646f0-a22c-4a94-8d43-3b48fc5e6d10"><enum>(2)</enum><text>one senior-level representative from the Department of the Interior. </text></paragraph></subsection><subsection id="idff3a7422-345f-4990-b164-6cec712ce6e5"><enum>(f)</enum><header>Duties</header><text>The Council shall—</text><paragraph id="id10508d58-3382-48e4-b285-ea1414460229"><enum>(1)</enum><text>set national ocean mapping, exploration, and characterization priorities and strategies;</text></paragraph><paragraph id="id3ba5f446-ad0d-48dc-abcb-8f21e8522f38"><enum>(2)</enum><text>cultivate and facilitate transparent and sustained partnerships among Federal and State agencies, Indian Tribes, private industry, academia, and nongovernmental organizations to conduct ocean mapping, exploration, and characterization activities and related technology development;</text></paragraph><paragraph id="id3c96e79e-5ef4-4f4b-b838-42c3e32c6c4a"><enum>(3)</enum><text>coordinate improved processes for data compilation, management, access, synthesis, and visualization with respect to ocean mapping, exploration, and characterization, with a focus on building on existing ocean data management systems, as appropriate; </text></paragraph><paragraph id="idabf026a5-7eee-436d-b9fa-e26e1a72f677"><enum>(4)</enum><text>encourage education, workforce training, and public engagement activities that— </text><subparagraph id="id878da159-e68f-4b7f-a475-9e13c7686237"><enum>(A)</enum><text>advance interdisciplinary principles that contribute to ocean mapping, exploration, research, and characterization; </text></subparagraph><subparagraph id="id6c17e1f5-a786-4f21-bca5-05512e0b5728"><enum>(B)</enum><text>improve public engagement with and understanding of ocean science; and </text></subparagraph><subparagraph id="idf87270cc-c063-4795-8f58-ec77fceab871"><enum>(C)</enum><text>provide opportunities for underserved populations; </text></subparagraph></paragraph><paragraph id="idb4773937-1552-4130-8ea2-215e14946adb"><enum>(5)</enum><text>coordinate activities as appropriate with domestic and international ocean mapping, exploration, and characterization initiatives or programs; and</text></paragraph><paragraph id="id8de6b33d-b1d1-4b07-b37e-0d3fcfcde0cd"><enum>(6)</enum><text>establish and monitor metrics to track progress in achieving the priorities set under paragraph (1). </text></paragraph></subsection><subsection id="idc85c0c1f-eb50-454e-a79e-61a908fd1425"><enum>(g)</enum><header>Interagency Working Group on Ocean Exploration and Characterization</header><paragraph id="id4e2e441a-d45b-489a-aa02-92bccc9de4bc"><enum>(1)</enum><header>Establishment</header><text>The President shall establish a new interagency working group to be known as the <quote>Interagency Working Group on Ocean Exploration and Characterization</quote>.</text></paragraph><paragraph id="id3967b877-2158-4605-b41b-6a6cb7601be7"><enum>(2)</enum><header>Membership</header><text>The Interagency Working Group on Ocean Exploration and Characterization shall be comprised of senior representatives from Federal agencies with ocean exploration and characterization responsibilities. </text></paragraph><paragraph id="idd84ef064-1e2e-4b1b-9de1-10a78908e088" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Functions</header><text>The Interagency Working Group on Ocean Exploration and Characterization shall support the Council and the Ocean Science and Technology Subcommittee of the Ocean Policy Committee established under section 8932(c) of title 10, United States Code, on ocean exploration and characterization activities and associated technology development across the Federal Government, State governments, Indian Tribes, private industry, nongovernmental organizations, and academia.</text></paragraph></subsection><subsection id="idad6d7d35-e5fd-45ce-a97a-aef2494b9760"><enum>(h)</enum><header>Oversight</header><text>The Council shall oversee—</text><paragraph id="ida6654489-d08b-4b98-96c2-fad91c32c7c0"><enum>(1)</enum><text>the Interagency Working Group on Ocean Exploration and Characterization established under subsection (g)(1); and </text></paragraph><paragraph id="idec13bab8-74d8-48be-a5ec-afd9ee76cf63" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the Interagency Working Group on Ocean and Coastal Mapping under section 12203 of the Ocean and Coastal Mapping Integration Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3502">33 U.S.C. 3502</external-xref>). </text></paragraph></subsection><subsection commented="no" id="id6479527a-817c-4967-9c85-29434431d064"><enum>(i)</enum><header>Plan</header><paragraph commented="no" id="id51876a75-e5dd-4da8-98e0-65bfca646972"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Council shall develop or update and submit to the appropriate committees of Congress a plan for an integrated cross-sectoral ocean mapping, exploration, and characterization initiative. </text></paragraph><paragraph commented="no" id="id85a137c6-c119-471e-b590-db0af1497b8e"><enum>(2)</enum><header>Elements</header><text>The plan required by paragraph (1) shall—</text><subparagraph commented="no" id="id127de15c-cb6e-4688-b15c-1a7cb2d49c75"><enum>(A)</enum><text>discuss the utility and benefits of ocean exploration and characterization; </text></subparagraph><subparagraph commented="no" id="id6e06b9b5-6278-4e3c-bbe4-80e99ce4b4f9"><enum>(B)</enum><text>identify and describe national ocean mapping, exploration, and characterization priorities;</text></subparagraph><subparagraph commented="no" id="idef952b71-37dc-4936-854c-cdf067e12e43"><enum>(C)</enum><text>identify and describe Federal and federally funded ocean mapping, exploration, and characterization programs;</text></subparagraph><subparagraph commented="no" id="idd5e618a8-c332-47c9-a10b-cfdab9989d72"><enum>(D)</enum><text>facilitate and incorporate non-Federal input into national ocean mapping, exploration, and characterization priorities; </text></subparagraph><subparagraph commented="no" id="id26db142c-c3ed-40d1-a458-4cc4d0396657"><enum>(E)</enum><text>ensure effective coordination of ocean mapping, exploration, and characterization activities among programs described in subparagraph (C); </text></subparagraph><subparagraph commented="no" id="ideb08c1c6-fc48-473a-90b5-d3c92827cd36"><enum>(F)</enum><text>identify opportunities for combining overlapping or complementary needs, activities, and resources of Federal agencies and non-Federal organizations relating to ocean mapping, exploration, and characterization while not reducing benefits from existing mapping, explorations, and characterization activities; </text></subparagraph><subparagraph commented="no" id="id1d928cc4-63e4-4da0-9443-d953c14c107c"><enum>(G)</enum><text>promote new and existing partnerships among Federal and State agencies, Indian Tribes, private industry, academia, and nongovernmental organizations to conduct or support ocean mapping, exploration, and characterization activities and technology development needs, including through coordination under section 3 of the Commercial Engagement Through Ocean Technology Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/33/4102">33 U.S.C. 4102</external-xref>) and the National Oceanographic Partnership Program under section 8931 of title 10, United States Code;</text></subparagraph><subparagraph commented="no" id="id891efa9d-125d-4b83-9d26-717f4f543851"><enum>(H)</enum><text>develop a transparent and sustained mechanism for non-Federal partnerships and stakeholder engagement in strategic planning and mission execution to be implemented not later than December 31, 2022;</text></subparagraph><subparagraph commented="no" id="idaf96057a-72fd-49ea-81d8-dc551683a5a2"><enum>(I)</enum><text>establish standardized collection and data management protocols, such as with respect to metadata, for ocean mapping, exploration, and characterization; </text></subparagraph><subparagraph commented="no" id="id07ecc0d8-df54-4d2a-acb0-c94c3154cb7d"><enum>(J)</enum><text>encourage the development, testing, demonstration, and adoption of innovative ocean mapping, exploration, and characterization technologies and applications;</text></subparagraph><subparagraph commented="no" id="id34901e02-0886-4890-a504-7a393643ab4d"><enum>(K)</enum><text>promote protocols for accepting data, equipment, approaches, or other resources that support national ocean mapping, exploration, and characterization priorities;</text></subparagraph><subparagraph commented="no" id="id1cda95f3-2f0e-4b68-b38c-08e8e4ae8f4b"><enum>(L)</enum><text>identify best practices for the protection of marine life during mapping, exploration, and characterization activities;</text></subparagraph><subparagraph commented="no" id="id9874102d-b4a2-4ab5-ba49-f858b206ee5a"><enum>(M)</enum><text>identify training, technology, and other resource requirements for enabling the National Oceanic and Atmospheric Administration and other appropriate Federal agencies to support a coordinated national ocean mapping, exploration, and characterization effort;</text></subparagraph><subparagraph commented="no" id="idbac76938-0693-4d37-abd9-a42bab44daaf"><enum>(N)</enum><text>identify and facilitate a centralized mechanism or office for coordinating data collection, compilation, processing, archiving, and dissemination activities relating to ocean mapping, exploration, and characterization that meets Federal mandates for data accuracy and accessibility;</text></subparagraph><subparagraph commented="no" id="id6ce25cd9-f714-4d8a-814c-9ad2d06d1ece"><enum>(O)</enum><text>designate repositories responsible for archiving and managing ocean mapping, exploration, and characterization data; </text></subparagraph><subparagraph id="id3d7deeb1-32ad-4860-b765-1be49463c1f7" commented="no" display-inline="no-display-inline"><enum>(P)</enum><text>set forth a timetable and estimated costs for implementation and completion of the plan;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id9d7c0e2f-960c-4ea2-affa-8ae5dae2ef0f"><enum>(Q)</enum><text>to the extent practicable, align ocean exploration and characterization efforts with existing programs and identify key gaps; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idb10bf3e7-102e-4676-a59a-f70c698eef21"><enum>(R)</enum><text>identify criteria for determining the optimal frequency of observations.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida5de0f89-48bf-44e9-b6f4-8ea5d352954f"><enum>(j)</enum><header>Briefings</header><text>Not later than 1 year after the date of the enactment of this Act, and not less frequently than once every 2 years thereafter, the Council shall brief the appropriate committees of Congress on—</text><paragraph commented="no" display-inline="no-display-inline" id="id7a768d0d-f00d-4904-9b83-d384d904203e"><enum>(1)</enum><text>progress made toward meeting the national priorities described in subsection (i)(2)(B); and </text></paragraph><paragraph id="idb883d1aa-b4ca-4685-8857-75212ccc2346" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>recommendations for meeting such priorities, such as additional authorities that may be needed to develop a mechanism for non-Federal partnerships and stakeholder engagement described in subsection (i)(2)(H). </text></paragraph></subsection><subsection commented="no" id="id97d92cb6-bb66-4c5c-a770-555b0e41a4f9"><enum>(k)</enum><header>Appropriate committees of Congress defined</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text><paragraph commented="no" id="id455be736-03c1-4b03-ab00-b5be32e8f5d1"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation and the Committee on Armed Services of the Senate; and</text></paragraph><paragraph commented="no" id="id2f300655-e371-405b-955c-b7a7d9be03ba"><enum>(2)</enum><text>the Committee on Natural Resources, the Committee on Science, Space, and Technology, and the Committee on Armed Services of the House of Representatives.</text></paragraph></subsection></section><section id="id7f3e4b76-f007-4491-8919-80cdcf2be72a" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>6.</enum><header>Modifications to the ocean exploration program of the National Oceanic and Atmospheric Administration</header><subsection commented="no" id="id1642fa8d-b81a-4e6b-84a8-7aee558148ef"><enum>(a)</enum><header>Purpose</header><text>Section 12001 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3401">33 U.S.C. 3401</external-xref>) is amended by striking <quote>and the national undersea research program</quote>. </text></subsection><subsection commented="no" id="iddd031587-6aa9-4d56-b199-ef9d8f17f24f"><enum>(b)</enum><header>Program established</header><text>Section 12002 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3402">33 U.S.C. 3402</external-xref>) is amended—</text><paragraph commented="no" id="id4cfb3ca9-af9a-411d-8ef2-2b6740fce7a6"><enum>(1)</enum><text>in the first sentence, by striking <quote>and undersea</quote>; and</text></paragraph><paragraph commented="no" id="idee899281-8750-4e3f-ad7b-4afd5e9c689a"><enum>(2)</enum><text>in the second sentence, by striking <quote>and undersea research and exploration</quote> and inserting <quote>research and ocean exploration and characterization efforts</quote>. </text></paragraph></subsection><subsection commented="no" id="ideb8e8a0e-2395-4e02-9eb4-3424766a77b0"><enum>(c)</enum><header>Powers and duties of the Administrator</header><paragraph commented="no" id="ideac4579f-42d6-4419-a805-6ff1f7839f39"><enum>(1)</enum><header>In general</header><text>Section 12003(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3403">33 U.S.C. 3403(a)</external-xref>) is amended—</text><subparagraph commented="no" id="id001c988d-2ce7-4a26-9ad5-aa8f79e67409"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>, in coordination with the Ocean Policy Committee established under section 8932 of title 10, United States Code,</quote> after <quote>Administration</quote>; and </text></paragraph><paragraph id="idb1313ced-d919-4c56-b7ce-a6bad5708070"><enum>(2)</enum><text>pay all necessary expenses in connection with the conveyance or transfer of a gift, devise, or bequest.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idfc7316fd-0cf6-47f6-b19f-3022c121acbe"><enum>(3)</enum><header>Definition of exclusive economic zone</header><text>Section 12003 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3403">33 U.S.C. 3403</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id7a022bb3-e8f1-421e-95be-dd234a0cb1a2" style="OLC" act-name="" changed="added" reported-display-style="italic" committee-id="SSCM00"><subsection id="id2018e67d-0673-4b9b-b485-498bda91fe67"><enum>(c)</enum><header>Definition of exclusive economic zone</header><text>In this section, the term <term>exclusive economic zone</term> means the zone established by Presidential Proclamation Number 5030, dated March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note; and</text></paragraph><paragraph id="id3c17ee70-4bf3-44a2-a8be-42cb0f790f74"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent possible, coordinate the efforts described in paragraph (1) with the outreach strategies of other domestic or international ocean mapping, exploration, and characterization initiatives. </text></paragraph></subsection><subsection id="idfef8e190-2781-41c1-b2a4-fc4d2615035e"><enum>(b)</enum><header>Education and outreach efforts</header><text display-inline="yes-display-inline">Efforts described in subsection (a)(1) may include— </text><paragraph id="idac273b5b-9a0d-4c1f-a6d3-841372710209"><enum>(1)</enum><text display-inline="yes-display-inline">education of the general public, teachers, students, and ocean and coastal resource managers; and </text></paragraph><paragraph id="id69292b5f-0b57-4a4e-a55e-f1694cf71ee0"><enum>(2)</enum><text>workforce training, reskilling, and opportunities to encourage development of ocean related science, technology, engineering, and mathematics (STEM) technical training programs involving secondary schools, community colleges, and universities, including Historically Black Colleges or Universities (within the meaning of the term ‘<quote>part B institution</quote>’ under section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>)), Tribal Colleges or Universities (as defined in section 316(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)), and other minority-serving institutions (as described in section 371(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>)).</text></paragraph></subsection><subsection id="id1ae72699-e76d-4d82-a6a2-5b9c58d3c5ab"><enum>(c)</enum><header>Outreach strategy</header><text>Not later than 180 days after the date of the enactment of the <short-title>National Ocean Exploration Act</short-title>, the Administrator of the National Oceanic and Atmospheric Administration shall develop an outreach strategy to broadly disseminate information on the discoveries made by the program under section 12002.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="idf7e93e07-1132-4bf4-8452-5e0290a704eb"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; and </text></paragraph><paragraph id="id5b7f32af-5bf0-454e-82d1-f4829c8d250c"><enum>(2)</enum><text>by inserting after section 12205 the following: </text><quoted-block style="OLC" id="idde4a0da3-340d-4743-9cdc-e4717c79e45a" act-name="" changed="added" reported-display-style="italic" committee-id="SSCM00"><section section-type="subsequent-section" id="id2e181cf3-1b92-4401-b7ad-20f42edd0467"><enum>12206.</enum><header>Ocean and coastal mapping Federal funding opportunity</header><subsection id="id674bec57-f243-46d0-993e-19f8790aec99"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of the enactment of the <short-title>National Ocean Exploration Act</short-title>, the Administrator shall develop an integrated ocean and coastal mapping Federal funding match opportunity within the National Oceanic and Atmospheric Administration with Federal, State, Tribal, local, nonprofit, private industry, or academic partners in order to increase the coordinated acquisition, processing, stewardship, and archival of new ocean and coastal mapping data in United States waters.</text></subsection><subsection id="id02d69fb3-3f18-436b-a9de-ebfc7e51aa26"><enum>(b)</enum><header>Rules</header><text>The Administrator shall develop administrative and procedural rules for the ocean and coastal mapping Federal funding match opportunity developed under subsection (a), to include—</text><paragraph id="idc7a90c6c-ca8e-49e6-8893-aee90277f79c"><enum>(1)</enum><text>specific and detailed criteria that must be addressed by an applicant, such as geographic overlap with pre-established priorities, number and type of project partners, benefit to the applicant, coordination with other funding opportunities, and benefit to the public;</text></paragraph><paragraph id="id2bb05aad-f906-4bd1-8d8f-93156daf5576"><enum>(2)</enum><text>determination of the appropriate funding match amounts and mechanisms to use, such as grants, agreements, or contracts; and</text></paragraph><paragraph id="id0feb9934-702f-4750-8f75-57982ce9d896"><enum>(3)</enum><text>other funding award criteria as are necessary or appropriate to ensure that evaluations of proposals and decisions to award funding under this section are based on objective standards applied fairly and equitably to those proposals.</text></paragraph></subsection><subsection id="id6856e155-df6b-448b-ad55-04c2ce7de4a9"><enum>(c)</enum><header>Geospatial services and contract vehicles</header><text>The ocean and coastal mapping Federal funding match opportunity developed under subsection (a) shall leverage Federal expertise and capacities for geospatial services and Federal geospatial contract vehicles using the private sector for acquisition efficiencies.</text></subsection></section><section id="idea532924-a00a-4b22-80d9-2194018b32c0"><enum>12207.</enum><header>Cooperative agreements, contracts, and grants</header><subsection id="ide38c493e-9190-4b24-966f-b9b0f028eee9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out interagency activities under this subtitle, the heads of agencies represented on the Working Group may enter into cooperative agreements, or any other agreement with each other, and transfer, receive, and expend funds made available by any Federal agency, any State or subdivision thereof, or any public or private organization or individual, for ocean and coastal mapping investigations, surveys, studies, and other geospatial collaborations authorized by this subtitle or agreements authorized by section 5 of the Act entitled <quote>An Act to define the functions and duties of the Coast and Geodetic Survey, and for other purposes</quote>, approved August 6, 1947 (<external-xref legal-doc="usc" parsable-cite="usc/33/883e">33 U.S.C. 883e</external-xref>).</text></subsection><subsection id="id5b4bd37f-ca3a-4403-a112-cc33e75c4f9e"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">The Administrator may make grants to any State or subdivision thereof or any public or private organization or individual to carry out the purposes of this subtitle.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id24bac484-2f20-481f-a9bf-c7c179f632a7"><enum>(f)</enum><header>Authorization of appropriations</header><text>Section 12209 of such Act, as redesignated by subsection (e)(1), is amended—</text><paragraph id="idafbaee9c-c6df-4dc9-b74c-911518ac74cf"><enum>(1)</enum><text>in subsection (a), by striking <quote>this subtitle</quote> and all that follows and inserting <quote>this subtitle $45,000,000 for each of fiscal years 2021 through 2026.</quote>; Definitions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id872ddf65-7516-4e45-ae1e-a8335040d7d7" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>9.</enum><header>Modifications to Hydrographic Services Improvement Act of 1998</header><subsection id="id3047f599-53fd-4cf4-b617-e558b62d4a59"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 302(4)(A) of the Hydrographic Services Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/892">33 U.S.C. 892(4)(A)</external-xref>) is amended by inserting <quote>hydrodynamic forecast and datum transformation models,</quote> after <quote>nautical information databases,</quote>. </text></subsection><subsection id="id0b12d111-2344-40ce-be82-4b917d5b0c30"><enum>(b)</enum><header>Functions of the Administrator</header><text>Section 303(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/892a">33 U.S.C. 892a(b)</external-xref>) is amended—</text><paragraph id="idab5ebb9f-2861-4ca7-a475-60c2b533d22f"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>precision navigation,</quote> after <quote>promote</quote>; and</text></paragraph><paragraph id="idc3845c67-b099-451b-80b8-2dacd2ce63ca"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="idd6bda4fe-1f69-4e8c-9d19-7db78b1c8e16"><enum>(A)</enum><text>by inserting <quote>and hydrodynamic forecast models</quote> after <quote>monitoring systems</quote>; </text></subparagraph><subparagraph id="id58760558-10de-43bb-9ca1-0b1fdc9957e9"><enum>(B)</enum><text>by inserting <quote>and provide foundational information and services required to support coastal resilience planning for coastal transportation and other infrastructure, coastal protection and restoration projects, and related activities</quote> after <quote>efficiency</quote>; and </text></subparagraph><subparagraph id="idfd9fed19-f35f-4553-98c6-96d6edd8ded2"><enum>(C)</enum><text>by striking <quote>; and</quote> and inserting a semicolon. </text></subparagraph></paragraph></subsection><subsection id="id7bec6320-feee-4d3f-b75f-939264c0524e"><enum>(c)</enum><header>Quality assurance program</header><text>Section 304(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/892b">33 U.S.C. 892b(a)</external-xref>) is amended by striking <quote>product produced</quote> and inserting <quote>product or service produced or disseminated</quote>.</text></subsection><subsection id="id36712aaa-1845-4d0b-9198-3a1b7d2e24b2"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 306(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/892d">33 U.S.C. 892d(a)</external-xref>) is amended—</text><paragraph id="id3310bff5-2ccd-4fc5-ae0b-d67d3821e9cf"><enum>(1)</enum><text>in paragraph (1), by striking <quote>$70,814,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$71,000,000 for each of fiscal years 2021 through 2026</quote>; </text></paragraph><paragraph id="idf793f3a6-c765-4481-9985-f329f4a20b07"><enum>(2)</enum><text>in paragraph (2), by striking <quote>$25,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$34,000,000 for each of fiscal years 2021 through 2026</quote>; </text></paragraph><paragraph id="idf618f875-7818-419e-baec-cae9989a260f"><enum>(3)</enum><text>in paragraph (3), by striking <quote>$29,932,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$38,000,000 for each of fiscal years 2021 through 2026</quote>; </text></paragraph><paragraph id="ide65d76c8-c0cc-48a6-b623-2b2d1109c04f"><enum>(4)</enum><text>in paragraph (4), by striking <quote>$26,800,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$45,000,000 for each of fiscal years 2021 through 2026</quote>; and</text></paragraph><paragraph id="idb36f447a-bfdf-406e-9a68-d87bc7ca0581" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>in paragraph (5), by striking <quote>$30,564,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$35,000,000 for each of fiscal years 2021 through 2026</quote>. </text></paragraph></subsection></section></legis-body><endorsement><action-date>December 16, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
