<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3796</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220310" legis-day="20220307">March 10 (legislative day, March 7), 2022</action-date><action-desc><sponsor name-id="S364">Mr. Murphy</sponsor> (for himself and <cosponsor name-id="S284">Ms. Stabenow</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To eliminate the opt-out for nonfederal governmental health plans. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H90128F00C8A0407B9819B8B02754E3A5"><section section-type="section-one" id="HBFCD4CBB794E4D21924061B64B70E0F6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing Health Coverage Gaps for Public Servants Act</short-title></quote>.</text></section><section id="HDB836E87589A43E294CB47E7487C4743"><enum>2.</enum><header>Eliminating the opt-out for nonfederal governmental health plans</header><text display-inline="no-display-inline">Section 2722(a)(2) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-21">42 U.S.C. 300gg–21(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB2D4EDB167EC472C9E58B3362C5D771E"><subparagraph id="H29A05C5450CA452ABA8D798EA66291C6"><enum>(F)</enum><header>Sunset of election option</header><clause id="HC4DDC54ECAC045389B395EC42BC34DFE"><enum>(i)</enum><header>In general</header><text>Notwithstanding the preceding provisions of this paragraph—</text><subclause id="HD91CC5AC8F614DC89E8DA22944FD507A"><enum>(I)</enum><text>no election described in subparagraph (A) may be made on or after the date of enactment of this subparagraph; and</text></subclause><subclause id="H3AFF2DB0620647C4BE3F056EECD850AF"><enum>(II)</enum><text>except as provided in clause (ii), no such election expiring on or after the date that is 180 days after the date of such enactment may be renewed.</text></subclause></clause><clause id="H831F1B01D3D94AA9BDBDF6B20794D079"><enum>(ii)</enum><header>Exception for certain collectively bargained plans</header><text>Notwithstanding clause (i)(II), a plan described in subparagraph (B)(ii) that is subject to multiple agreements described in such subparagraph of varying lengths and that has an election in effect under subparagraph (A) as of the date of enactment of this subparagraph that expires on or after the date that is 180 days after the date of such enactment may extend such election until the date on which the term of the last such agreement expires.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
