<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3793</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220310" legis-day="20220307">March 10 (legislative day, March 7), 2022</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> (for himself and <cosponsor name-id="S415">Mr. Warnock</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XI of the Social Security Act to recommend that the Center for Medicare and Medicaid Innovation test the effect of technology-enabled care interventions in the home to coordinate care over time and across settings, improve quality, and lower costs for certain Medicare Advantage beneficiaries, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Technology-Enabled Care in the Home (TECH) Act</short-title></quote>.</text></section><section id="idC8185BDAE93247FCA4B8AEB68476DBBB"><enum>2.</enum><header>Center for Medicare and Medicaid innovation testing of Medicare Advantage telehealth, remote patient monitoring, and other technology-enabled care interventions in the home demonstration project</header><text display-inline="no-display-inline">Section 1115A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a</external-xref>) is amended—</text><paragraph id="id0fea036d35cc4e4b92f5872d95527d70"><enum>(1)</enum><text>in subsection (b)(2)(B), by adding at the end the following new clause: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F4B167AB8A14B3FB90F5BB5A420A3A5"><clause id="id3AD39F2FA89345EA9FAB8B22B670A62D"><enum>(xxviii)</enum><text>Furnishing telehealth, remote patient monitoring, and other technology-enabled care interventions in the home to eligible individuals as described in subsection (h).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id119bef10fab5448792aea707c0ebc84a"><enum>(2)</enum><text>by adding at the end the following new subsection: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A158B45B5F04690B5856D788D0F34BC"><subsection id="id116a079e837147c68ed0b717ba1cdac9"><enum>(h)</enum><header>Medicare Advantage telehealth, remote patient monitoring, and other technology-Enabled care interventions in the home demonstration project (TECH demonstration project)</header><paragraph id="idb7646da036e54ec6abf0459ab9c68b87"><enum>(1)</enum><header>Description of demonstration project and requirements</header><subparagraph id="id2e61c86a945940208572e64b3e8a61ae"><enum>(A)</enum><header>In general</header><text>The demonstration project described in this subsection (referred to in this subsection as the <quote>TECH demonstration project)</quote> is a demonstration project to test the use of telehealth services, remote patient monitoring, and other technology-enabled care interventions in the home for eligible enrollees authorized under Medicare Advantage organizations under part C of title XVIII and restricted to such organizations that are participating in the CMI’s Value-Based Insurance Design model in 2023. The demonstration project will test the effectiveness of these technology-enabled interventions on—</text><clause id="id723A613D6EC842E1A297F54C9CA32A61"><enum>(i)</enum><text>the provision of care in homes and congregate care settings for the management of disease progression, patient health, care quality, patient care experience, and caregiver well-being; and</text></clause><clause id="idD8469125BE9244E0A66984F8262444AE"><enum>(ii)</enum><text>reducing spending under part C of title XVIII without reducing quality of care.</text></clause></subparagraph><subparagraph id="id8434181fef6b4b89be876e8a385d14b9"><enum>(B)</enum><header>Voluntary participation</header><text>Participation under the TECH demonstration project shall be voluntary with respect to both eligible enrollees and Medicare Advantage organizations.</text></subparagraph></paragraph><paragraph id="idbcc4c362c9c44d97bc87ca528c4634c8"><enum>(2)</enum><header>Duration</header><text> The TECH demonstration project shall be implemented for a 3-year period, beginning not later than 18 months after the date of the enactment of this subsection.</text></paragraph><paragraph id="id545a2533d8624ed29c35c683653fedcc"><enum>(3)</enum><header>Enrollment</header><text>The TECH demonstration project shall establish a comparison group and enroll sufficient numbers of eligible enrollees to achieve statistically significant findings on quality and cost for the demonstration project and for specific sub-populations, including those based on geography, socioeconomic status, age, race, and ethnicity.</text></paragraph><paragraph id="idfd95df5d41484e6c86005d751af9d883"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idd3fed1225085424ebf7acd7d35affbf8"><enum>(A)</enum><header>Eligible enrollee</header><text>The term <term>eligible enrollee</term> means a chronically ill enrollee (as defined in section 1852(a)(3)(D)(iii)).</text></subparagraph><subparagraph id="ida432f44c86f54c40aead119c7c66a72c"><enum>(B)</enum><header>Remote patient monitoring</header><text>The term <term>remote patient monitoring</term> means connected digital technologies and mobile medical devices that collect clinical grade, patient-generated health data from individuals in one location and electronically transmit that information securely to a care team in a different location for assessment and intervention.</text></subparagraph><subparagraph id="id6FA4E523BE7B4613B7BADFC8D45B6535"><enum>(C)</enum><header>Telehealth services</header><text>The term <term>telehealth services</term> means telehealth services (as defined in subparagraph (F) of section 1834(m)(4), but without regard to geographic or other originating site requirements described in subparagraph (C) of such section).</text></subparagraph><subparagraph id="id6BD5709517BD4098A2B372A0EA549BAB"><enum>(D)</enum><header>Other technology-enabled care interventions</header><text> The term <term>technology-enabled care interventions</term> means mobile, digital, or electronic health services and systems that enable the remote, secure exchange of information primarily between a health or care provider and a patient in a home or congregate care setting for the purpose of diagnosing or managing a health condition. </text></subparagraph></paragraph><paragraph id="id39EB6E92D16949FFA40C915BE73B6E00"><enum>(5)</enum><header>Funding</header><text>Out of amounts appropriated under subsection (f)(1)(C) for the 10-year fiscal period beginning with fiscal year 2020, $25,000,000 shall be made available to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id9013865963B04596A3A60087B1C40E36"><enum>3.</enum><header>Changes to the administrative finality policy of the Social Security Administration</header><subsection id="idD1376AB10074416699238DADB30221FB"><enum>(a)</enum><header>In general</header><text>Section 205(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401(c)</external-xref>) is amended—</text><paragraph id="id63F4269EC52B4A5D9C2D26D7C969925C"><enum>(1)</enum><text>by striking paragraphs (4) and (5) and inserting the following:</text><quoted-block id="idF5AB4AC396E847738D906E125154D107" style="OLC" act-name=""><paragraph id="id09AB39595BA74DBFBDC123FC7981BEB4"><enum>(4)</enum><text>The Commissioner of Social Security may, if it is brought to the Commissioner's attention that any entry of wages or self-employment income in the Commissioner's records for a year is erroneous or that any item of wages or self-employment income for such year has been omitted from such records, correct such entry or include such omitted item in the individual's records, as the case may be. After the expiration of the time limitation following any year—</text><subparagraph id="IDB89B606A911447E6B34FA8F50FA74EA3" indent="up1"><enum>(A)</enum><text>the Commissioner's records (with changes, if any, made pursuant to such regulations as the Commissioner shall establish) of the amounts of wages paid to, and self-employment income derived by, an individual during any period in such year shall be conclusive for the purposes of this title;</text></subparagraph><subparagraph id="ID9E1DFBB0ED344CB49C942A3EB9A857C7" indent="up1"><enum>(B)</enum><text>the absence of an entry in the Commissioner's records as to the wages alleged to have been paid by an employer to an individual during any period in such year shall be presumptive evidence for the purposes of this title that no such alleged wages were paid to such individual in such period; and</text></subparagraph><subparagraph id="ID62171E8A9A40481E8EDEE23BFF856384" indent="up1"><enum>(C)</enum><text>the absence of an entry in the Commissioner's records as to the self-employment income alleged to have been derived by an individual in such year shall be conclusive for the purposes of this title that no such alleged self-employment income was derived by such individual in such year unless it is shown that the individual filed a tax return of the individual's self-employment income for such year before the expiration of the time limitation following such year, in which case the Commissioner of Social Security shall include in the Commissioner's records the self-employment income of such individual for such year.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idBF6931F0F7054BD5A4B8338958D30DF4"><enum>(2)</enum><text>by redesignating paragraphs (6) through (9) as paragraphs (5) through (8), respectively; and</text></paragraph><paragraph id="idF0ED245AE8384B19BC5B455D6810118D"><enum>(3)</enum><text>in paragraph (5), as so redesignated, by striking <quote>under paragraph (4) or (5)</quote> and inserting <quote>made by the Commissioner of Social Security in accordance with such regulations as the Commissioner shall establish</quote>.</text></paragraph></subsection><subsection id="idB16F658BCCE3449EA4D4F0A382C40474" commented="no"><enum>(b)</enum><header>Requiring SSA To adjust administrative finality policy</header><text>Not later than 6 months after the date of enactment, the Commissioner of Social Security shall promulgate regulations establishing processes and criteria for correcting the Commissioner's records of the wages and self-employment income of individuals for purposes of title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) in accordance with section 205(c)(4) of such Act, as amended by subsection (a).</text></subsection></section></legis-body></bill>
