which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Commerce to submit to Congress a report relating to the blockchain-based service network of the People's Republic of China, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Say No to the Silk Road Act</short-title></quote>.</text></section><section id="id8F5CD6D001F6484D87CC7FA088EB03D9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id17B29D2473814287BFA331ACB848A81B"><enum>(1)</enum><header>Digital yuan</header><text>The term <term>digital yuan</term> means the sovereign digital currency of the People’s Bank of China, or any successor sovereign digital currency of the People’s Republic of China.</text></paragraph><paragraph id="id3D66687EDB49403F909486EC84914D36"><enum>(2)</enum><header>Network</header><text>The term <term>Network</term> means the blockchain-based service network of the People's Republic of China.</text></paragraph><paragraph id="id83FBFA15571644FB8452620CD6F9D5C2"><enum>(3)</enum><header>Relevant congressional committees</header><text>The term <term>relevant congressional committees</term> means—</text><subparagraph id="idE4B8E639B5F54B4E8F5C8948B4677C82"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="id948B563FBDA746E6B8E8800D15CD8D9C"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate;</text></subparagraph><subparagraph id="idF58A384521594197A9435D55301347FA"><enum>(C)</enum><text>the Committee on Armed Services of the Senate;</text></subparagraph><subparagraph id="id314E20A1A5D4419AB808E30BEF5ABEC0"><enum>(D)</enum><text>the Committee on Finance of the Senate;</text></subparagraph><subparagraph id="id2A85B6B0E0514B199561EBC16F02394D"><enum>(E)</enum><text>the Committee on Armed Services of the House of Representatives;</text></subparagraph><subparagraph id="idC5ADECB4405B4E0BB91E398D30E36738"><enum>(F)</enum><text>the Committee on Foreign Affairs of the House of Representatives;</text></subparagraph><subparagraph id="id029062516FC244CEACB3CE36C872B218"><enum>(G)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="id30F8E08315E3491FBD7B75EDAEDB3203"><enum>(H)</enum><text>the Committee on Ways and Means of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id8387D33157E241E78F40091F8AD0C466"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></section><section id="id74AFC7D94CCC4DF8B681E84F3CBA776A"><enum>3.</enum><header>Report on the Network</header><subsection id="id65FA8698045643DC848EF315F07D1D81"><enum>(a)</enum><header>Report</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary shall submit to Congress a report—</text><paragraph id="id2AFC6A7CAE914C978527BD6EDE9579D5"><enum>(1)</enum><text>on—</text><subparagraph id="id268D6D8F4CE7487591FB133645B8E0F5"><enum>(A)</enum><text>the Network;</text></subparagraph><subparagraph id="idF2C607ED8F33496E8A1E15F42F797657"><enum>(B)</enum><text>the operations of the Network in the United States;</text></subparagraph><subparagraph id="id667EC0285EBA440BAC24B3EF7FCD800C"><enum>(C)</enum><text>the privacy implications associated with the collection of data of citizens of the United States by the Network; and</text></subparagraph><subparagraph id="id2C72A6C7FEB54AE286FC7698F8A24E4F"><enum>(D)</enum><text>the participation of companies headquartered in the United States and companies located in the United States in assisting with the operations of the Network or performing work to expand the Network, including—</text><clause id="id093BB8B55B4A4240AA32478971134F28"><enum>(i)</enum><text>with respect to the applications or technical capabilities of the Network; and</text></clause><clause id="id30FAF5CA62E442FB8102CD9E5E8774B6"><enum>(ii)</enum><text>the geographic scope of the Network, such as—</text><subclause id="idE0B2C6FF7731421CB4CF5BAD7B1FDA28"><enum>(I)</enum><text>expanding the Network to be used in the United States and countries participating in the Foreign Military Financing Program; and</text></subclause><subclause id="idC44E5B003910421D88E5E648BB5D3246"><enum>(II)</enum><text>constructing data centers of the Network in the United States and countries participating in the Foreign Military Financing Program; and </text></subclause></clause></subparagraph></paragraph><paragraph id="id1DB960AB188644DB9ADCBA7EC5121116"><enum>(2)</enum><text>that includes—</text><subparagraph id="id3DF670318D054E53810CF085A86080FB"><enum>(A)</enum><text>the goals of the Network in developing blockchain infrastructure;</text></subparagraph><subparagraph id="id5E12AE67DE1149DEA4FB7C8A81B28973"><enum>(B)</enum><text>an assessment of whether the involvement in the Network of the Government of the People's Republic of China and entities owned by the Government of the People's Republic of China may pose any risk to economic and national security interests of the United States; and</text></subparagraph><subparagraph id="idF154EBC88C5245E3AFC9D5444B166433"><enum>(C)</enum><text>the privacy and security implications associated with the collection of data of citizens of the United States by the Network.</text></subparagraph></paragraph></subsection><subsection id="id545F8946FE1D43BF9B53A7A11A30A809"><enum>(b)</enum><header>Recommendations</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to the relevant congressional committees recommendations relating to the report submitted under subsection (a).</text></subsection></section><section id="id28A45CB3CA8E49ABACCE9B97483DC5B4"><enum>4.</enum><header>Report on trade enforcement actions with respect to sovereign digital currency of People's Republic of China</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to the relevant congressional committees a report—</text><paragraph id="id70DDD458D4244589A790C5BF0DF8A0E4"><enum>(1)</enum><text display-inline="yes-display-inline">assessing how trade enforcement actions relating to the digital yuan would affect the United States; and</text></paragraph><paragraph id="idA25F4A422F394BBCB270955A5FF7CFA8"><enum>(2)</enum><text>making recommendations with respect to mitigating the effects of such actions.</text></paragraph></section><section id="id9BA33B006B2D48F4BDD4808A7BD124F9"><enum>5.</enum><header>Report on effect of sovereign digital currency of People's Republic of China on trade and investment agreements</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the United States Trade Representative shall submit to the relevant congressional committees a report—</text><paragraph id="idB8BDE319C0394D4EA692079D5193BA5A"><enum>(1)</enum><text>assessing the ways in which shifts to the use of the digital yuan by other countries as a settlement or reserve currency could affect trade and investment agreements to which the United States is a party; and</text></paragraph><paragraph id="id5ABD68226D9344AEA537D2B06DCC6FCF"><enum>(2)</enum><text>making recommendations with respect to mitigating the effects of such shifts.</text></paragraph></section><section id="id3248CDDB4D10433EBA17B36FA12F4377"><enum>6.</enum><header>Use of digital yuan by executive agencies</header><subsection id="id163e026cbf074344b46c1c963bc868ba"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id1a4ef685265e41649b56f075414278fc"><enum>(1)</enum><text>the term <term>executive agency</term> has the meaning given that term in section 133 of title 41, United States Code; and</text></paragraph><paragraph id="id2283012f5e5f4064ae11685461abbd94"><enum>(2)</enum><text>the term <term>information technology</term> has the meaning given that term in section 11101 of title 40, United States Code.</text></paragraph></subsection><subsection id="idba0588494ddc4c429d8e89c2496c0ecc"><enum>(b)</enum><header>Use of digital yuan</header><text>Not later than 60 days after the date of enactment of this Act, the Director of the Office of Management and Budget, in consultation with the Administrator of General Services, the Director of the National Institute of Standards and Technology, the Director of the Cybersecurity and Infrastructure Security Agency, the Director of National Intelligence, and the Secretary of Defense, and consistent with the information security requirements under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, shall develop strict guidance for executive agencies requiring adequate security measures for any transfer, storage, or use of digital yuan on information technology. </text></subsection></section><section id="id3F347C2AC93A437F9EA18FBF4DA3C548"><enum>7.</enum><header>Digital yuan disclosure requirement for Foreign Military Financing partner countries</header><text display-inline="no-display-inline">Any government of a country receiving assistance through the Foreign Military Financing Program shall be required, as a condition for receiving such assistance, to disclose to the Secretary of State if that government uses digital yuan as a settlement or reserve currency.</text></section><section id="id933BA344B18643AFAB8B80AD201D4C77"><enum>8.</enum><header>Department of State warning about dangers of digital yuan</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall include on a publicly available internet website of the Department of State a warning to United States citizens traveling to the People's Republic of China about the dangers of the digital yuan. </text></section></legis-body></bill>
