which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide that it is unlawful to knowingly distribute private intimate visual depictions with reckless disregard for the individual’s lack of consent to the distribution, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H800BD61C967C46AF960098D44F888173"><section section-type="section-one" id="H74D7FCD0DC434DC6B66699730F06A52F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stopping Harmful Image Exploitation and Limiting Distribution Act of 2022</short-title></quote> or the <quote><short-title>SHIELD Act of 2022</short-title></quote>.</text></section><section id="H1A6F82F74A9D48F7BC345D959739E17F"><enum>2.</enum><header>Certain activities relating to intimate visual depictions</header><subsection id="H2E9ECA2863C342848D262B2AC47F0DCF"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/88">Chapter 88</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HC1602E603389440F844BFBAFB7D4C257"><section id="H3AE0C7D748E2493B81B27BA17278053D"><enum>1802.</enum><header>Certain activities relating to intimate visual depictions</header><subsection id="HB8BE9E934C9D430DA4B3D6D939375198"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3FA63BBF4CB1408AA8BB09991FE06661"><enum>(1)</enum><header>Communications service</header><text>The term <term>communications service</term> means—</text><subparagraph id="HBF36930471AF4B19A94B68C5D06B42F8"><enum>(A)</enum><text>a service provided by a person that is a common carrier, as that term is defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>), insofar as the person is acting as a common carrier;</text></subparagraph><subparagraph id="HD10A92387EA5452A860D7DF8F3FE2C36"><enum>(B)</enum><text>an electronic communication service, as that term is defined in section 2510;</text></subparagraph><subparagraph id="H867486486C9D4C26879FFD8D1520830B"><enum>(C)</enum><text>an information service, as that term is defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>); and</text></subparagraph><subparagraph id="H2A86ECA15E13459B98F3B2500B54E92E"><enum>(D)</enum><text>an interactive computer service, as that term is defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></subparagraph></paragraph><paragraph id="HB7CF524BD0FC4A62B285BA593F3D0A73"><enum>(2)</enum><header>Information content provider</header><text>The term <term>information content provider</term> has the meaning given that term in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></paragraph><paragraph id="H707D53CB5C14434C9C33508FFD84DF40"><enum>(3)</enum><header>Intimate visual depiction</header><text>The term <term>intimate visual depiction</term> means any visual depiction (as that term is defined in section 2256(5))—</text><subparagraph id="H84F156BBE81E42DDA9C771110C6EFA37"><enum>(A)</enum><text>of an individual who is reasonably identifiable from the visual depiction itself or information displayed in connection with the visual depiction;</text></subparagraph><subparagraph id="H90650C20D17740998597F7CD21B62ACA"><enum>(B)</enum><text>in which—</text><clause id="H7B15A6BEEE944B05A4A1067A913F2C06"><enum>(i)</enum><text>the individual has obtained 18 years of age and is engaging in sexually explicit conduct; or</text></clause><clause id="HA60E31EDD2E346A3B7CFA876D6CA17A6"><enum>(ii)</enum><text>the naked genitals, anus, pubic area, or post-pubescent female nipple of the individual are visible;</text></clause></subparagraph><subparagraph id="H426EDDDCFDD34AB7A4410064A75B6743"><enum>(C)</enum><text>in which the content described in subparagraph (B) is not simulated; and</text></subparagraph><subparagraph id="H5985DC86C91D4DE8A088E492DC912D91"><enum>(D)</enum><text>in original or modified format.</text></subparagraph></paragraph><paragraph id="H2E1F2C01452343919E9B278D1C3A5586"><enum>(4)</enum><header>Sexually explicit conduct</header><text>The term <term>sexually explicit conduct</term> has the meaning given that term in section 2256(2)(A).</text></paragraph></subsection><subsection id="H7D594C37A2224284B331D96412EF69BE"><enum>(b)</enum><header>Offense</header><text>Except as provided in subsection (d), it shall be unlawful to knowingly use any means or facility of interstate or foreign commerce to distribute an intimate visual depiction of an individual—</text><paragraph id="HCAA666743B7341ADB8E6E26CB0C7F51D"><enum>(1)</enum><text>with knowledge of or reckless disregard for—</text><subparagraph id="HF76CD3905C344C04BB7EBDC24627762B"><enum>(A)</enum><text>the lack of consent of the individual to the distribution; and</text></subparagraph><subparagraph id="H7378DC3C5D254802A3763F54F6FCF2D3"><enum>(B)</enum><text>the reasonable expectation of the individual that the depiction would remain private; and</text></subparagraph></paragraph><paragraph id="HDC1701E800C747E79E1F03FD98991EDA"><enum>(2)</enum><text>without an objectively reasonable belief that such distribution touches upon a matter of public concern.</text></paragraph></subsection><subsection id="H1FCAFECADC2F4F2883B54519929BF760"><enum>(c)</enum><header>Penalty</header><text>Any person who violates subsection (b) shall be fined under this title, imprisoned not more than 5 years, or both.</text></subsection><subsection id="HA4C056C96CC14948AE9944862656AE25"><enum>(d)</enum><header>Exceptions</header><paragraph id="H90E03E14E6374C1B9CF30531A689A9E4"><enum>(1)</enum><header>Law enforcement, lawful reporting, and other legal proceedings</header><text>This section—</text><subparagraph id="H06B2EA1C41BD4AC0BC274F766DF6CCDE"><enum>(A)</enum><text>does not prohibit any lawful law enforcement, correctional, or intelligence activity;</text></subparagraph><subparagraph id="H0F0BB67981974E879014215A7667F813"><enum>(B)</enum><text>shall not apply in the case of an individual acting in good faith to report unlawful activity or in pursuance of a legal or professional or other lawful obligation; and</text></subparagraph><subparagraph id="HA7FDC8D2CD0F44D99E97F8DACC1395FF"><enum>(C)</enum><text>shall not apply in the case of a document production or filing associated with a legal proceeding.</text></subparagraph></paragraph><paragraph id="HB8AB76ECA34744C59DEA7B999518CDF7"><enum>(2)</enum><header>Service providers</header><text>This section shall not apply to any provider of a communications service with regard to content provided by another information content provider unless the provider of the communications service intentionally solicits, or knowingly and predominantly distributes, content that the provider of the communications service actually knows is in violation of this section.</text></paragraph></subsection><subsection id="H68D8349CD5D54AC2B06907808D7FC267"><enum>(e)</enum><header>Threats</header><text>Any person who intentionally threatens to commit an offense under subsection (b) shall be punished as provided in subsection (c).</text></subsection><subsection id="H2FC713A240B24CEF847D188CC686528C"><enum>(f)</enum><header>Venue and extraterritoriality</header><text>A prosecution under this section may be brought in a district where the defendant or the depicted individual resides or in a district where the intimate visual depictions are distributed or made available. There is extraterritorial Federal jurisdiction over an offense under this section if the defendant or the depicted individual is a citizen or permanent resident of the United States.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD71F29E83F4E49228A745C3C072D9F48"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/88">chapter 88</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1801">section 1801</external-xref> the following:</text><quoted-block style="USC" id="HF2AA5AF23D3F4B98A90F802B6F6060E1"><toc regeneration="no-regeneration"><toc-entry level="section">1802.
