which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 35, United States Code, to limit foreign interference with respect to the right to file and maintain a patent infringement claim, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending American Courts Act</short-title></quote>.</text></section><section id="id7d951c80b76e433aa78186bce5497e66"><enum>2.</enum><header>Limiting foreign interference</header><subsection id="id3455f60723244f62b1fa3f56e1c6da1f"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/28">Chapter 28</external-xref> of title 35, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idfb744c9c87674515a2eb06dfec206950"><section id="id497c535b741545928c73d781ef9d5740" section-type="subsequent-section"><enum>274.</enum><header>Foreign interference</header><subsection id="idf613be9b1f564cedad72c2b86c303c7f"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>anti-suit injunction</term> means an injunction issued by a foreign tribunal that purports to restrict the rights of a person to file or maintain—</text><paragraph id="id91aa2ef198db428eb26f50d75d5f0cdc"><enum>(1)</enum><text>a claim of infringement of any claim of a United States patent in a tribunal of the United States, including—</text><subparagraph id="idcbf263f18e7740f18806ddc7e7e2f426"><enum>(A)</enum><text>in a civil action arising in whole or in part under section 1338 of title 28; or</text></subparagraph><subparagraph id="id828f46570fa84b21a4b5785b4a2c5f80"><enum>(B)</enum><text>in a proceeding before the United States International Trade Commission pursuant to section 337 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1337">19 U.S.C. 1337</external-xref>); or</text></subparagraph></paragraph><paragraph id="id3c4494fc789b427a86f0cef14f899078"><enum>(2)</enum><text>any appeal from a civil action or proceeding described in paragraph (1), including any appeal arising under paragraph (1) or (6) of section 1295(a) of title 28.</text></paragraph></subsection><subsection id="idd1850f632e894970a49859adc5928715"><enum>(b)</enum><header>Civil action presumptions</header><text>Upon a finding of infringement of a patent under section 271 in a civil action against any person that has asserted an anti-suit injunction in any tribunal of the United States seeking to restrict the claim of infringement of the patent on the basis of the anti-suit injunction, the court shall presume that—</text><paragraph id="id3a88eaf4d5064937b7447dfc9fcf127b"><enum>(1)</enum><text>the infringement is willful when determining whether to increase damages under section 284; and</text></paragraph><paragraph id="id8bc44326f52845b2b26c71ef97cadbea"><enum>(2)</enum><text>the action is exceptional when determining whether to award attorney fees under section 285.</text></paragraph></subsection><subsection id="id07a00835889449ac9d814c7ead5bdde6"><enum>(c)</enum><header>Patent trial and appeal board</header><text>In determining whether to institute a review under chapter 31 or 32 with respect to a patent, the Director shall decline to institute such a review if the petitioner, real party in interest, or privy of the petitioner has asserted an anti-suit injunction in any tribunal of the United States seeking to restrict a claim for infringement of the patent on the basis of the anti-suit injunction.</text></subsection><subsection id="id705057bf32994b9aacdddf4d5870ced3"><enum>(d)</enum><header>Consent or prior agreement</header><text>Neither subsection (b) nor (c) shall apply if—</text><paragraph id="idB6D4493A9CDB46D190F6197AB2BBDE49" commented="no"><enum>(1)</enum><text>the person subject to the applicable anti-suit injunction consents to be bound by the anti-suit injunction; or</text></paragraph><paragraph id="idF14C83AF0C454CF7B6FB18CE05869DB9" commented="no"><enum>(2)</enum><text>the applicable anti-suit injunction was issued to enforce a contractual agreement between the parties to submit disputes concerning the patent that is the subject of the anti-suit injunction to resolution by a specified court or arbitral tribunal.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2986fd6166794cefaab5e4dc8c3b3efc"><enum>(b)</enum><header>Table of sections amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/28">chapter 28</external-xref> of title 35, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/35/273">section 273</external-xref> the following:</text><quoted-block style="OLC" id="idd50c781c-4d12-4ee3-bd0c-424786708cb8"><toc><toc-entry level="section" idref="id497c535b741545928c73d781ef9d5740">274. Foreign interference.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idc8284ed72a814fe787673ba37e7cc41c"><enum>3.</enum><header>Study on patents and anti-suit injunctions</header><subsection id="id2bdd2a60df0743d68cfab2d53a069945"><enum>(a)</enum><header>Study required</header><text>The Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office (referred to in this section as the <quote>Director</quote>), in consultation with the head of any other appropriate agency, shall conduct a study that examines— </text><paragraph id="idEA5DD3CA16524F3FA21EAA1C7DCE2654"><enum>(1)</enum><text>the importance of patents to the technological leadership of the United States in critical and emerging technologies, including by incentivizing research and development in innovation and standards development in the United States; and </text></paragraph><paragraph id="id49DB1FE57C634B54A5DCCF8E6A262009"><enum>(2)</enum><text>the harms resulting from anti-suit injunctions, as that term is defined in section 274(a) of title 35, United States Code, as added by section 2 of this Act.</text></paragraph></subsection><subsection id="idccca82f670e647cb99036948e2cceb36"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on the results of the study conducted under subsection (a). </text></subsection></section></legis-body></bill>
