which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Labor to implement the industry-recognized apprenticeship program process, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Training America’s Workforce Act</short-title></quote>.</text></section><section id="idab3650f1ece54a06a621e4ce8425c8c3"><enum>2.</enum><header>Industry-recognized apprenticeship programs</header><text display-inline="no-display-inline"> The Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 63; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>), is amended—</text><paragraph id="id4F050FB18C2E4A2CBFEB9753A697A99C"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 4 as section 5; and</text></paragraph><paragraph id="id566B8062B3514D338A8FF80C5CB54762"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA920E8B092384B93A720E967929512D8"><section id="id6579d525e8cb4585bacd538277b57d5d" section-type="subsequent-section"><enum>4.</enum><header>Industry-recognized apprenticeship programs</header><subsection id="id66ECCAD16D25485F9884CDF27C4A4CCC"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id3d3b8f1ab8ad4981bbe08458be22752e"><enum>(1)</enum><header>Industry-recognized apprenticeship program</header><text>The term <term>industry-recognized apprenticeship program</term>—</text><subparagraph id="id7FB7842759ED4FAF94C8EF76B681F410"><enum>(A)</enum><text>means a high-quality, competency-based apprenticeship program that is—</text><clause id="idA7507772B7A549E3AEBD1D9443B42C22"><enum>(i)</enum><text>recognized by a standards recognition entity; and </text></clause><clause id="idCE20481D08F24577B7C5E4D087E43294"><enum>(ii)</enum><text>developed or delivered by an entity such as a trade or industry group, corporation, nonprofit organization, institution of higher education, labor organization, or labor-management organization (among other entities, as determined appropriate by the Secretary); and</text></clause></subparagraph><subparagraph id="id656F0EA63A134F7BAD36620E567AF1F4"><enum>(B)</enum><text>may include a program that meets the requirements of subparagraph (A) and trains apprentices to perform construction activities.</text></subparagraph></paragraph><paragraph id="id58bd00a354704c29b58b374cc59b2d08"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="ida5b198e516f344e5ac4f40cf4cc13afd"><enum>(3)</enum><header>Standards recognition entity</header><text>The term <term>standards recognition entity</term> means a private sector or public sector entity that—</text><subparagraph id="idEFF5102C61BB459F908BDCA577D2EE2D" commented="no"><enum>(A)</enum><text>is recognized by the Secretary (acting through the Administrator of the Office of Apprenticeship of the Department of Labor) for purposes of recognizing apprenticeship programs as industry-recognized apprenticeship programs; </text></subparagraph><subparagraph id="id0AB7726BBB564B81A633FB37C3B19562"><enum>(B)</enum><text>has a demonstrated ability to ensure an industry-recognized apprenticeship program meets the standards described in subsection (d); and</text></subparagraph><subparagraph id="id60ACDEBE0AB3479B8E7F6992AD712883"><enum>(C)</enum><text>has the capacity to perform the oversight necessary to ensure the ongoing compliance of an industry-recognized apprenticeship program with such standards.</text></subparagraph></paragraph></subsection><subsection id="idFA8A6959E90441F98DF40B31FA640895"><enum>(b)</enum><header>Recognition of industry-Recognized apprenticeship programs</header><paragraph id="id61E11C26D9BE4D079B93FA07E076E546"><enum>(1)</enum><header>In general</header><text>By not later than 1 year after the date of enactment of the <short-title>Training America’s Workforce Act</short-title>, the Secretary, after consultation with private sector industry associations, institutions of higher education, State, local, and Tribal governmental agencies, and other stakeholders the Secretary determines appropriate, shall establish a process to recognize entities as standards recognition entities for purposes of recognizing industry-recognized apprenticeship programs under this Act. </text></paragraph><paragraph id="id9C8538AE9B3A42779DDC2B6B4E562FAB"><enum>(2)</enum><header>Limited discretion</header><text>The Secretary shall not deny recognition as a standards recognition entity to a private sector or public sector entity that meets the requirements of subparagraphs (B) and (C) of subsection (a)(3) and satisfactorily completes the process established under paragraph (1).</text></paragraph><paragraph id="idE5E717A3BCF14B2BB565DCAE643435C3"><enum>(3)</enum><header>Administrative flexibility</header><text>The Secretary shall ensure that the recognition process for standards recognition entities established under paragraph (1) is a flexible process with low administrative and reporting burdens for the standards recognition entities and industry-recognized apprenticeship programs. </text></paragraph></subsection><subsection id="id1320BF9677AF45A0B6D2D1E4AFB27B0D"><enum>(c)</enum><header>Requirements</header><text>The recognition process of standards recognition entities and the activities and procedures carried out by the standards recognition entities shall, to the maximum extent practicable and except as otherwise explicitly provided in this section, be consistent with the requirements, activities, and procedures under subpart B of part 29 of title 29, Code of Federal Regulations, as such subpart was in effect on May 11, 2020. </text></subsection><subsection id="idea1b5ee2a3e14a4f8e0fbd07f65472bf"><enum>(d)</enum><header>Standards</header><text>Each standard recognition entity shall establish standards for the industry-recognized apprenticeship programs recognized by the entity that, at a minimum, ensure that each industry-recognized apprenticeship program—</text><paragraph id="id0E8D581E05E44CDFBEADD91F4B0056F2"><enum>(1)</enum><text>includes—</text><subparagraph id="id4ad9773c720b4943b2c244f34e124485"><enum>(A)</enum><text>paid work;</text></subparagraph><subparagraph id="id77e894240d034132abd68b735bc16114"><enum>(B)</enum><text>on-the-job learning;</text></subparagraph><subparagraph id="id7b4c8e9d61d34b18b21de85af679f69f"><enum>(C)</enum><text>a mentorship component;</text></subparagraph><subparagraph id="id2fe433629b504d75b8750354eb481842"><enum>(D)</enum><text>education and classroom instruction;</text></subparagraph><subparagraph id="id430be0e95d3d427ea2a99e0b66908182"><enum>(E)</enum><text>a written training plan and apprenticeship agreement; and</text></subparagraph><subparagraph id="id36e0da1e9c31481685e3c35e1227120f"><enum>(F)</enum><text>safety and supervision components; and</text></subparagraph></paragraph><paragraph id="id63139ECF52A54441BAA25388B154BF6B" commented="no"><enum>(2)</enum><text>provides, during participation in or upon completion of the apprenticeship, an industry-recognized credential.</text></paragraph></subsection><subsection id="id763e1dbbe69b4ba1aeb19b84818f0fbe"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed as affecting apprenticeship programs registered under this Act and recognized by the Secretary of Labor.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
