<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3767</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220307">March 7, 2022</action-date><action-desc><sponsor name-id="S277">Mr. Carper</sponsor> (for himself, <cosponsor name-id="S309">Mr. Casey</cosponsor>, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S306">Mr. Menendez</cosponsor>, and <cosponsor name-id="S270">Mr. Schumer</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Water Infrastructure Improvements for the Nation Act to reauthorize Delaware River Basin conservation programs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Delaware River Basin Conservation Reauthorization Act of 2022</short-title></quote>.</text></section><section id="id43088BF724014374896EDAABC7E7D102"><enum>2.</enum><header>Delaware River Basin Conservation reauthorization</header><subsection id="idFA1F2C04C7E444DDAB45C5131853E7A7"><enum>(a)</enum><header>Cost sharing</header><text>Section 3504(c)(1) of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1775) is amended—</text><paragraph id="id9DD1D7176BA0495BBE149314274D26E1"><enum>(1)</enum><text>by striking <quote>The Federal share</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAACBED74172B445EAF876DEC036F55CB"><subparagraph id="id03EACB98ACC342589AB4478C814E3F11"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Federal share</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idFD9EBCC700A9450E9266F8D738D43234"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7A373E10EE464EB79A82600EFC011AF1"><subparagraph id="id94FA8AB82E674F8C9D6EEE7D80ABE736"><enum>(B)</enum><header>Small, rural, and disadvantaged communities</header><clause id="id7D3A9CC18FD7490CA209ABD84C1A143F"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Federal share of the cost of a project funded under the grant program that serves a small, rural, or disadvantaged community shall be 90 percent of the total cost of the project, as determined by the Secretary.</text></clause><clause id="id2A25F5D1D94E413EBDF81900609BDB2F"><enum>(ii)</enum><header>Waiver</header><text>The Secretary may increase the Federal share under clause (i) to 100 percent of the total cost of the project if the Secretary determines that the grant recipient is unable to pay, or would experience significant financial hardship if required to pay, the non-Federal share.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id0487ABF664DA4C60AC40224C66CE2FAD"><enum>(b)</enum><header>Repeal of prohibition on use of funds for federal acquisition of interests in land</header><text>Section 3506 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1775) is repealed.</text></subsection><subsection id="id73DF064113F1407693EF5ACDAB918ADB"><enum>(c)</enum><header>Sunset</header><text>Section 3507 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1775) is amended by striking <quote>2023</quote> and inserting <quote>2030</quote>.</text></subsection></section></legis-body></bill>
