which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consumer Financial Protection Act of 2010 with respect to arbitration.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Arbitration Fairness for Consumers Act</short-title></quote>.</text></section><section id="idf3b864c57177486ca1c710636cbb7763"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="id2c451dc565c4464e8c34f475bb570b0e"><enum>(1)</enum><text>prohibit predispute arbitration agreements that force arbitration of a future consumer financial product or service dispute; and</text></paragraph><paragraph id="id6d1c80534ac74504a17bb7fa9e4633df"><enum>(2)</enum><text>prohibit agreements and practices that interfere with the right of consumers to participate in a joint, class, or collective action related to a consumer financial product or service dispute.</text></paragraph></section><section id="ida7094959fe834f5e9eb2150eea5bc979"><enum>3.</enum><header>No validity or enforceability of predispute arbitration agreements or joint-action waivers</header><subsection id="ide0a9985647504bbfa01802e68b08c106"><enum>(a)</enum><header>In general</header><text>Subtitle C of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5531">12 U.S.C. 5531 et seq.</external-xref>) is amended by inserting after section 1036 (<external-xref legal-doc="usc" parsable-cite="usc/12/5536">12 U.S.C. 5536</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96cec8d633c4463b826ba35090b90325"><section id="idabad5d5e822148ea8f3d78cd64b40b99"><enum>1036A.</enum><header>No validity or enforceability of predispute arbitration agreements or joint-action waivers</header><subsection id="id06aceaec1bd34167bf345707fc6079dc"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida2ac6f46baba4112ae0a3b4e89ebae42"><enum>(1)</enum><header>Class action</header><text>The term <term>class action</term> means a lawsuit in which 1 or more parties seek or obtain class treatment pursuant to rule 23 of the Federal Rules of Civil Procedure or a comparable rule or provision of State law.</text></paragraph><paragraph id="id9ed5909a088447d2a0d76d0028b3408e"><enum>(2)</enum><header>Consumer dispute</header><text>The term <term>consumer dispute</term> means a dispute relating to a consumer financial product or service between—</text><subparagraph id="id3f200beb8b884d4cba7c31c8fa1b1066"><enum>(A)</enum><text>a consumer, including a consumer who seeks certification as a class under rule 23 of the Federal Rules of Civil Procedure or a comparable rule or provision of State law; and</text></subparagraph><subparagraph id="id4107f2ec60c940b39007e04edcae71a3"><enum>(B)</enum><text>a covered person.</text></subparagraph></paragraph><paragraph id="ide0ba1ef6398c4d619bca61a507b3ac0a"><enum>(3)</enum><header>Predispute arbitration agreement</header><text>The term <term>predispute arbitration agreement</term> means an agreement to arbitrate a consumer dispute that has not yet arisen at the time of the making of the agreement.</text></paragraph><paragraph id="id90a0433a56e04bccbbf044fceedd064e"><enum>(4)</enum><header>Predispute joint-action waiver</header><text>The term <term>predispute joint-action waiver</term> means an agreement, whether or not part of a predispute arbitration agreement, that would prohibit, or waive the right of, one of the parties to the agreement to participate in a joint, class, or collective action in a judicial, arbitral, administrative, or other forum, concerning a consumer dispute that has not yet arisen at the time of the making of the agreement.</text></paragraph></subsection><subsection id="id8bd848ac879349c7ba997ebd8f7cce91"><enum>(b)</enum><header>No validity or enforceability of predispute arbitration agreements or joint-Action waivers</header><paragraph id="id6b36d902042e4c6499713c047c5d5a42"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to a consumer dispute.</text></paragraph><paragraph id="id3fdbe1d7642743619556c37f6aa33d67"><enum>(2)</enum><header>Applicability</header><subparagraph id="id46760A1A0A2B40058147B211C2617319"><enum>(A)</enum><header>In general</header><text>An issue as to whether this section applies with respect to a consumer dispute shall be determined under Federal law. </text></subparagraph><subparagraph id="id03A9554E27DA4FAAA67C47A87D8FA2C7"><enum>(B)</enum><header>Determination</header><text>The applicability of this section to an agreement to arbitrate and the validity and enforceability of an agreement to which this section applies shall be determined by a court, rather than an arbitrator, irrespective of—</text><clause id="idACA7F3B775E24075B7FABB8A10BDCA54"><enum>(i)</enum><text>whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing the agreement; and</text></clause><clause id="id482C1AF9B1834AF59F80963F671F31A9"><enum>(ii)</enum><text>whether the agreement purports to delegate such determinations to an arbitrator.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id97e4b73b7c7348b7a54c3f594f96bafa"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The table of contents for the Dodd-Frank Wall Street Reform and Consumer Protection Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/203">Public Law 111–203</external-xref>; 124 Stat. 1376) is amended by inserting after the item relating to section 1036 the following: </text><quoted-block style="OLC" id="idc87bfda8-7d09-4daf-b518-1c82f2279cd0"><toc><toc-entry level="section">Sec. 1036A. No validity or enforceability of predispute arbitration agreements or joint-action waivers.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idb887c20a72be40e6bc4663897ddcd096"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall apply with respect to any consumer dispute or claim that arises or accrues on or after the date of enactment of this Act.</text></section></legis-body></bill>
