which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to enhance compliance with hospital price transparency requirements, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hospital Transparency Compliance Enforcement Act</short-title></quote>.</text></section><section id="id3E02D5318C9742A3AA2924AD2548292F"><enum>2.</enum><header>Hospital price transparency requirements</header><text display-inline="no-display-inline">Section 2718(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-18">42 U.S.C. 300gg–18(e)</external-xref>) is amended—</text><paragraph id="idC08969F07F8C457BA03C766D57DB67DA"><enum>(1)</enum><text>by striking <quote>Each hospital</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAB4133E86A2743F8A10DB8DC6EEA80D6"><paragraph id="idE07214C22BC342DD8F230DF397FDB7B7"><enum>(1)</enum><header>In general</header><text>Each hospital</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id4BC84BAFB6934C7694CD50120AFEC86E"><enum>(2)</enum><text>by inserting <quote>, in accordance with paragraph (2)</quote>, after <quote>for each year</quote>; and</text></paragraph><paragraph id="id958E444F817C4D63A6C7F1BC0F329A4D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFD055CA97148449CAC893D1CA66325F8"><paragraph id="id8AB1FD0CA06845A4B3130D38B168486C"><enum>(2)</enum><header>Timing requirements</header><subparagraph id="id1582A0422C7F47388A78C9D9614B63E3"><enum>(A)</enum><header>In general</header><text>Each hospital operating within the United States on the date on which the COVID–19 public health emergency terminates shall, not later than 100 days after such date and every year thereafter, establish (and update) and make public the list under paragraph (1).</text></subparagraph><subparagraph id="id1E873AA1B0D244108ACEB15E091E5245"><enum>(B)</enum><header>Newly operating hospitals</header><text>In the case of a hospital that begins operating in the United States after the date on which the COVID–19 public health emergency terminates, the hospital shall comply with the requirements described in subparagraph (A) not later than 100 days after the date on which the hospital begins such operation and every year thereafter.</text></subparagraph></paragraph><paragraph id="id3D5D3E46984A4BAB842D711590C5D6BB"><enum>(3)</enum><header>Prohibition on shielding information</header><text>No hospital may shield the information required under paragraph (1) from online search results through webpage coding. </text></paragraph><paragraph id="idDCB5718648CF4A4FB9A3E818BB52486E" commented="no"><enum>(4)</enum><header>Civil monetary penalties</header><subparagraph id="id91F0A5F7EE364CB390B4178A425EA5CD" commented="no"><enum>(A)</enum><header>In general</header><text>A hospital that fails to comply with the requirements of this subsection for a year shall be subject to a civil monetary penalty of an amount not to exceed—</text><clause commented="no" id="id89986EDD7B5946E1BACFAC6D3437E6C2"><enum>(i)</enum><text>in the case of a hospital with a bed count of 30 or fewer, $600 for each day in which the hospital fails to comply with such requirements;</text></clause><clause commented="no" id="id344A8D91FCDC4BC38480EC131C3A8B84"><enum>(ii)</enum><text>in the case of a hospital with a bed count that is greater than 30 and equal to or fewer than 550, $20 per bed for each day in which the hospital fails to comply with such requirements; or</text></clause><clause commented="no" id="id5A8ACEAFC79A4E979970D3C9EC9985FC"><enum>(iii)</enum><text>in the case of a hospital with a bed count that is greater than 550, $11,000 for each day in which the hospital fails to comply with such requirements. </text></clause></subparagraph><subparagraph id="id0418450477F5473D97D00481690962E3" commented="no"><enum>(B)</enum><header>Procedures</header><clause commented="no" id="idD8BEBD067FA24D7F9C0FE39764C8F976"><enum>(i)</enum><header>In general</header><text>Except as otherwise provided in this subsection, a civil monetary penalty under subparagraph (A) shall be imposed and collected in accordance with part 180 of title 45, Code of Federal Regulations (or successor regulations).</text></clause><clause commented="no" id="idDB778B9490CA4299A45CAB251FB72C83"><enum>(ii)</enum><header>Timing</header><text>A hospital shall pay in full a civil monetary penalty imposed on the hospital under subparagraph (A) not later than—</text><subclause commented="no" id="id8DCA097C3F014CD0B37005AD1C65DFF3"><enum>(I)</enum><text>60 calendar days after the date on which the Secretary issues a notice of the imposition of such penalty; or</text></subclause><subclause commented="no" id="id2192E5E7546B4312A8A6BA42D443E466"><enum>(II)</enum><text>in the event the hospital requests a hearing pursuant to subpart D of part 180 of title 45, Code of Federal Regulations (or successor regulations), 60 calendar days after the date of a final and binding decision in accordance with such subpart, to uphold, in whole or in part, the civil monetary penalty.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="id86614F3C419044CB8A4CB8B1296F24D2"><enum>(5)</enum><header>List of hospitals not in compliance</header><text>The Secretary shall publish a list of the name of each hospital that is not in compliance with the requirements under this subsection. Such list shall be published 280 days after the COVID–19 public health emergency terminates and every 180 days thereafter.</text></paragraph><paragraph commented="no" id="id86774FE6D9504F6CA46E7AF9A42AD923"><enum>(6)</enum><header>Definition of COVID–19 public health emergency</header><text>In this subsection, the term <term>COVID–19 public health emergency</term> means the public health emergency declared by the Secretary under section 319 with respect to COVID–19.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
