which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand employees eligible for leave and employers subject to leave requirements.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H29C39E02171C4E5CA79398D37A429FFF"><section section-type="section-one" id="H934F253C35F04031BA99474A39D00E31"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Job Protection Act</short-title></quote>.</text></section><section id="HF3689E8C42954B2CA262F9829EE20985"><enum>2.</enum><header>Expansion of employees eligible for leave</header><subsection id="H81DBDAAF9D644AD0BB52EEBCC2210B5C"><enum>(a)</enum><header>In general</header><text>Section 101(2) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)</external-xref>) is amended—</text><paragraph id="HF31A990E605844759E2F99EBE666F978"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>employed—</quote> and all that follows through the end of the subparagraph and inserting <quote>employed for not less than 90 days by the employer with respect to whom leave is requested under section 102.</quote>;</text></paragraph><paragraph id="HF950D4590D0544E794E71B8BEBDA0B6A"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>does not include—</quote> and all that follows through the end of the subparagraph and inserting <quote>does not include any Federal officer or employee covered under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code (as added by title II of this Act).</quote>;</text></paragraph><paragraph id="H2E758E0B5BC94F2980BE23BC1259FA44"><enum>(3)</enum><text>by striking subparagraphs (C) and (D); and</text></paragraph><paragraph id="H0713E781C3CC4276B9A3D67A27AA4DD1"><enum>(4)</enum><text>by redesignating subparagraph (E) as subparagraph (C).</text></paragraph></subsection><subsection id="id495265DF886541148A2406618C7C1322"><enum>(b)</enum><header>Federal employees</header><paragraph id="idFFB8BE5186794FBAB7C1B7DD84F7B971"><enum>(1)</enum><header>Title 5</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended—</text><subparagraph id="id1B91A47DC1E944238ACC8AABF86BE6C2"><enum>(A)</enum><text>in section 6381(1)(B), by striking <quote>12 months</quote> and inserting <quote>90 days</quote>; and</text></subparagraph><subparagraph id="idD584E82C2779418185EC8E9C63D43521"><enum>(B)</enum><text>in section 6382(d)(2)(E), by striking <quote>12 months</quote> and inserting <quote>90 days</quote>.</text></subparagraph></paragraph><paragraph id="ida3ebf4cf4d194845a93d2bd847092ac6"><enum>(2)</enum><header>Presidential employees</header><text>Section 412(a)(2)(B) of title 3, United States Code, is amended by striking <quote>12 months and for at least 1,250 hours of employment during the previous 12 months</quote> and inserting <quote>90 days</quote>.</text></paragraph><paragraph id="idBA4FA8E3F0CA4780BE2904D230ED295D"><enum>(3)</enum><header>Congressional employees</header><text>Section 202(a)(2)(B) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1312">2 U.S.C. 1312(a)(2)(B)</external-xref>) is amended by striking <quote>12 months and for at least 1,250 hours of employment during the previous 12 months</quote> and inserting <quote>90 days</quote>.</text></paragraph></subsection></section><section id="HB62062A4C96F429992EF28E237EED83D"><enum>3.</enum><header>Expansion of employers subject to leave requirements</header><text display-inline="no-display-inline">Section 101(4)(A)(i) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(4)(A)(i)</external-xref>) is amended by striking <quote>50 or more employees</quote> and all that follows through the end of the clause and inserting <quote>1 or more employees</quote>.</text></section><section id="idE60B5D59EA864B7D892C2AB5E00AD137"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall apply with respect to leave taken on or after the date of enactment of this Act. </text></section></legis-body></bill>
