<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3731</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220302">March 2, 2022</action-date><action-desc><sponsor name-id="S374">Mr. Cotton</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To restart oil and gas leasing and permitting on Federal land, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0184EADA50D14F3FAB06BD44E8FC369E"><section id="idA19C9A6D9CDF4267BBEFB30100224A18" section-type="section-one"><enum>1.</enum><header>Prohibition on moratoria of new oil and gas leases on certain Federal land</header><subsection id="H9C1A59FD791A4A8CBDF480FDA17DEC28"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5798776E40634924B9473EF296F3B717"><enum>(1)</enum><header>Federal land</header><subparagraph id="id1EDAC408332E44EEA5952CCAA441AFC7"><enum>(A)</enum><header>In general</header><text>The term <term>Federal land</term> means— </text><clause id="id882B2CC96F0440B7BFE3389C15C9CFA4"><enum>(i)</enum><text>National Forest System land;</text></clause><clause id="id1287455E27D946FABB47845D578099DD"><enum>(ii)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)); and</text></clause><clause id="id4D65D40D79524455955910504F57D90C"><enum>(iii)</enum><text>the outer Continental Shelf (as defined in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>)).</text></clause></subparagraph><subparagraph id="id8F3D27FE0AFB46DDAB7405F9BD937DFD"><enum>(B)</enum><header>Inclusion</header><text>The term <term>Federal land</term> includes any interest in land described in clause (i), (ii), or (iii) of subparagraph (A) that is owned by the United States.</text></subparagraph><subparagraph id="idD6256AE026E84C40908692A258259731"><enum>(C)</enum><header>Exclusion</header><text>The term <term>Federal land</term> does not include—</text><clause id="idd6618269ec3147a9bb1dc6cbaf60677e"><enum>(i)</enum><text>a unit of the National Park System; or</text></clause><clause id="ida5f7f9db9f8f4f8db39934015a939400"><enum>(ii)</enum><text>a unit of the National Wildlife Refuge System (other than a unit of the National Wildlife Refuge System for which oil and gas drilling is allowed under law).</text></clause></subparagraph></paragraph><paragraph id="id57DA481CA7164C899BE42C1F7F654FFE"><enum>(2)</enum><header>President</header><text>The term <term>President</term> means the President or any designee. </text></paragraph></subsection><subsection id="id9FEF0888113443B48BE3D42B2B205067"><enum>(b)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the President—</text><paragraph id="idbca9d15df81044d29480e6a55e25b138"><enum>(1)</enum><text>shall immediately and without delay hold Federal onshore and offshore oil and gas lease sales; and </text></paragraph><paragraph id="id7738999A3C3444D2BC43AE2F29B9EB72"><enum>(2)</enum><text display-inline="yes-display-inline">shall not carry out any action that would prohibit or delay the issuance of oil or gas leases, permits, approvals, or authorizations on Federal land, unless such an action has been authorized by an Act of Congress.</text></paragraph></subsection></section><section id="id0ad8dfb857964c90a044caefe6df6052"><enum>2.</enum><header>Rescission of certain energy policies relating to oil and natural gas development</header><text display-inline="no-display-inline">Section 208 of Executive Order 14008 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to tackling the climate crisis at home and abroad) is rescinded and shall have no force or effect. </text></section></legis-body></bill>
