<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3729</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220302">March 2, 2022</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S323">Mr. Risch</cosponsor>, and <cosponsor name-id="S376">Ms. Ernst</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 203 of <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law 94–305</external-xref> to ensure proper authority for the Office of Advocacy of the Small Business Administration, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advocacy Empowerment Act of 2022</short-title></quote>.</text></section><section id="idcd6aa1a4bfc04386a9dbb42af22836ca"><enum>2.</enum><header>Additional powers of the Chief Counsel for Advocacy</header><subsection id="idfa2983fefe7f48deaaa7739532bb332b"><enum>(a)</enum><header>Chief counsel authority</header><text>Section 203(a) of <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law 94–305</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/634c">15 U.S.C. 634c(a)</external-xref>) is amended—</text><paragraph id="id19ec29a3e2474613bcc6e8ffd662c663"><enum>(1)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id55A786494BAC41F2ADEC45F055C047C5"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="idFE677931070A440CA545D0E84B25680D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id678cebc104be49c29c215849a270de5d"><paragraph id="id3f8ef2a023ac4012a401aea92b8d7cfa"><enum>(7)</enum><text>issue, modify, or amend rules governing compliance by agencies with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code, after opportunity for notice and comment under section 553 of title 5, United States Code; and</text></paragraph><paragraph id="iddd0d0f20f7574c5d8d6f3ae1baf094f0"><enum>(8)</enum><text>authorize an agency to issue such supplemental rules governing compliance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code, as the Chief Counsel may approve, and ensure that the supplemental rules comply with such chapter 6 and with the notice and comment process under section 553 of title 5, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6511dd702ba84f728b9844d25548e22f"><enum>(b)</enum><header>Implementation</header><text>On and after the date that is 270 days after the date of enactment of this Act, the Chief Counsel for Advocacy of the Small Business Administration may exercise the authority under paragraphs (7) and (8) of section 203(a) of <external-xref legal-doc="public-law" parsable-cite="pl/94/305">Public Law 94–305</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/634c">15 U.S.C. 634c(a)</external-xref>), as added by subsection (a).</text></subsection></section></legis-body></bill>
