which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To address research on, and improve access to, supportive services for individuals with long COVID.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8B39515918D84426BF2BC752F7D566C8"><section section-type="section-one" id="H87249AB25FCE4076B4037905754A0A0E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Access to Resources and Education for Long COVID Act</short-title></quote> or the <quote><short-title>CARE for Long COVID Act</short-title></quote>.</text></section><section id="H7AC7FE21B8CF4201B6F05FA32816518F"><enum>2.</enum><header>Authorization to fund research of the long-term symptoms of COVID–19 by the Patient-Centered Outcomes Research Trust Fund</header><subsection id="idb9b5ff8953294a26b1f7aa3dc1f97dcd"><enum>(a)</enum><header>In general</header><text>The Patient-Centered Outcomes Research Trust Fund under section 1181 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320e">42 U.S.C. 1320e(b)</external-xref>) shall fund activities described in subsection (b) to improve treatment and outcomes for individuals with PASC.</text></subsection><subsection id="H238CDD3D3FAA4B6AB2D865CC50835363"><enum>(b)</enum><header>Activities described</header><text>For purposes of subsection (a), activities described in this subsection shall include—</text><paragraph id="H2BE63528A3834E41A7D2723D78EC8279"><enum>(1)</enum><text display-inline="yes-display-inline">prior to creating a patient registry described in paragraph (2)—</text><subparagraph id="idB63487C20CCA4DF4AC632678EDFA6760"><enum>(A)</enum><text display-inline="yes-display-inline">surveying existing patient registries that include individuals experiencing PASC and other relevant chronic disease or health registries; and</text></subparagraph><subparagraph id="id651D9EE6DCDB4EE3AB418E79E4A5BFEC"><enum>(B)</enum><text>identifying common data elements and definitions for use, in order to promote appropriate data sharing for ongoing and future research;</text></subparagraph></paragraph><paragraph id="HDE17A0D2CF6E4EB483BCF316A103A017"><enum>(2)</enum><text display-inline="yes-display-inline">creating a patient registry, informed by the survey described in paragraph (1), for individuals with suspected or confirmed PASC and related post-viral illnesses or conditions—</text><subparagraph id="id0DE705453E7D411DBB7E1244F18A06BF"><enum>(A)</enum><text display-inline="yes-display-inline">with information that is culturally and linguistically appropriate and easily accessible to people with disabilities, and which may include—</text><clause id="id66767597F8A64F20B270E5C9A2C7A390"><enum>(i)</enum><text display-inline="yes-display-inline">symptoms that arise while an individual is initially infected with COVID–19 and that may resolve over time or extend beyond the resolution of the initial symptoms;</text></clause><clause id="HD56138AFA9B343BE98BBF8DF549FB563"><enum>(ii)</enum><text display-inline="yes-display-inline">persistent symptoms that arise after an individual is initially infected with COVID–19 and that the clinician of such individual has reason to suspect were related to the COVID–19 diagnosis;</text></clause><clause id="H5EACEDC57B1D4805A701BDB924A8D2D2"><enum>(iii)</enum><text display-inline="yes-display-inline">symptoms that arise in an individual that may be related to COVID–19 but a diagnosis of COVID–19 was not obtained and cannot be identified due to a lack of antibodies, false negative test results, or lack of access to timely testing; </text></clause><clause id="HB5170870E03842FB8B57726C49C8BCB1"><enum>(iv)</enum><text display-inline="yes-display-inline">treatments of individuals after primary diagnosis of COVID–19 and the effectiveness of such treatments; and</text></clause><clause id="HE610439A0AD14781BC455936F951EADC"><enum>(v)</enum><text display-inline="yes-display-inline">any other relevant questions or issues related to individuals who experience a diagnosis of, treatment for, and management of care with COVID–19, PASC, or related post-viral illnesses; </text></clause></subparagraph><subparagraph id="H706E2D22EDAD4A93A154DAEBB1163E84"><enum>(B)</enum><text display-inline="yes-display-inline">that collects information regarding co-morbidities, vaccination status, and demographics, including age, gender, race and ethnicity, geographic location, disability, and occupation of registry participants; </text></subparagraph><subparagraph id="id40CDE8969121429999105B4BD69B9F2B"><enum>(C)</enum><text display-inline="yes-display-inline">that synthesizes information relating to individuals experiencing PASC or related post-viral illnesses or conditions from the survey described in paragraph (1) and other information available through the patient registry; and</text></subparagraph><subparagraph id="idC3D2B55226C149C7ADF7364B5510CC78"><enum>(D)</enum><text>that disseminates information to relevant Federal departments and agencies and patients participating in the registry to inform treatment and policy related to COVID–19, PASC, or related post-viral illnesses and conditions; and</text></subparagraph></paragraph><paragraph id="H92F5DC6AADEF4948B7FD047AAE1E47E8"><enum>(3)</enum><text display-inline="yes-display-inline">outreach to, and inclusion (as appropriate) of, individuals, including children and older adults, from communities impacted by high COVID–19 rates, communities affected by health disparities and inequities, including Indian Tribes and Tribal organizations, urban Indian organizations, people with disabilities, individuals with related post-viral illnesses or conditions, health care providers, first responders, and frontline workers who may be impacted by high COVID–19 rates, and health care providers from diverse disciplines that may treat individuals with COVID–19, PASC, or related post-viral illnesses and conditions.</text></paragraph></subsection><subsection id="id220a981ba57d4b74b866b57cf1694539"><enum>(c)</enum><header>Privacy protections</header><text>Participation in the registry described in subsection (b)(2) shall be voluntary and personal and health information of participants, including information voluntarily submitted through the registry, shall be subject to all applicable privacy protections under Federal or State law.</text></subsection><subsection id="HFA942AEBDDD84818A1323002BECFF852"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the establishment of the synthesized patient registry under subsection (b)(2), and annually thereafter, the Patient-Centered Outcomes Research Institute shall submit data, findings, and information with respect to the status of the patient registry (including progress, barriers, and issues) to Congress and the President.</text></subsection><subsection id="HE22E824CA8634A7DB4207790E24EDE10"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there is authorized to be appropriated $30,000,000 for fiscal year 2023, which shall remain available until expended.</text></subsection></section><section id="H82C3385E9ED64FF0AAFCA7FE6901EAA5"><enum>3.</enum><header>Research on United States health care system’s response to PASC</header><subsection id="idb1f014fa4de94825a5f1bfd8dcd7f7dd"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services (referred to in this Act as the <quote>Secretary</quote>), in coordination with the Director of the Agency for Healthcare Research and Quality, the Director of the National Institutes of Health, and the Director of the Centers for Disease Control and Prevention, shall conduct or support research related to the United States health care system’s response to PASC, including with respect to—</text><paragraph id="H4E7733C597204DD5A172C1154B4DC717"><enum>(1)</enum><text>the expansion and efficacy of post-infectious disease treatment, including—</text><subparagraph id="id834b382d45d24bd38f2f1383b6021e89"><enum>(A)</enum><text>identifying obstacles to access for treatment of COVID–19, PASC, or related post-viral illnesses and conditions for veterans, older adults, people with disabilities, children and young adults, communities of color, underserved and rural communities, and other groups impacted by high rates of COVID–19, as determined by the Secretary;</text></subparagraph><subparagraph id="H22D811B8578E4B81B068D8183D8ECA95"><enum>(B)</enum><text>evaluating and identifying potential gaps or other weaknesses that contribute to age, gender, geographic location, disability, occupation, and racial and ethnic disparities with respect to COVID–19 infection rates, severity and length of symptoms, and outcomes; and</text></subparagraph><subparagraph id="H8F4CB67AD43E41E2AE04917F77BC7FF8"><enum>(C)</enum><text>identifying trends associated with differences in diagnosis and treatment of PASC and related post-viral illnesses and conditions by demographic factors such as age, gender, geographic location, disability, occupation, race, ethnicity, or other factors identified by the Secretary to promote health equity; and </text></subparagraph></paragraph><paragraph id="HD6A4C70319E846D3AC003AD9466DC41A"><enum>(2)</enum><text>conducting and supporting research to—</text><subparagraph id="HC11A7384A53C443D9A180E75B19F5AEB"><enum>(A)</enum><text>identify health care strategies that help mitigate age, gender, geographic location, disability, occupation, and racial and ethnic disparities in COVID–19 infection rates, hospitalizations, severity and length of symptoms, secondary illnesses, and outcomes;</text></subparagraph><subparagraph id="H45E31B10C0894A6E902EFBEC6D00DC7D"><enum>(B)</enum><text>identify health care-related factors contributing to such disparities in COVID–19 infection rates, hospitalizations, severity and length of symptoms, secondary illnesses, and outcomes; and</text></subparagraph><subparagraph id="H1F3BDC7D33C843F2BD595D57EAFA3D95"><enum>(C)</enum><text>provide recommendations on ensuring equity in diagnosis and access to quality post-infectious treatments that may be advanced to mitigate such disparities, going forward.</text></subparagraph></paragraph></subsection><subsection id="H00FC36358BDE43E6BE6C86B47DE4EDA4"><enum>(b)</enum><header>Authorization of Appropriations</header><text>To carry out this section, there is authorized to be appropriated $15,000,000 for fiscal year 2023, which shall remain available until expended.</text></subsection></section><section id="H40286715540D40BA8D9F5CE65CF599A3"><enum>4.</enum><header>Education and dissemination of information on PASC</header><subsection id="H7850D9E45F2D4250A21FF74FB0C27A34"><enum>(a)</enum><header>Post-Acute sequelae of COVID–19 (PASC) public education program</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall develop and disseminate to the public information regarding PASC, in plain language and in a manner that is culturally and linguistically appropriate and easily accessible to people with disabilities and people with limited English proficiency, including information on—</text><paragraph id="H866D5B100E0A468099797F66834B9898"><enum>(1)</enum><text>the awareness, incidence, and short- and long-term health effects associated with COVID–19 infection;</text></paragraph><paragraph id="HDF3D04AA4FE34276B6DB313C644B98A6"><enum>(2)</enum><text>illnesses related and often comorbid with PASC, which may include—</text><subparagraph id="H0BC99C0DD22A4BEB936049D96A77201A"><enum>(A)</enum><text>myalgic encephalomyelitis/chronic fatigue syndrome and fibromyalgia;</text></subparagraph><subparagraph id="H7DD02CA09265467BB9A267232E25840A"><enum>(B)</enum><text>postural orthostatic tachycardia syndrome and other forms of dysautonomia;</text></subparagraph><subparagraph id="H09031C1E52B64B5E938D5D0E0EE5BE7C"><enum>(C)</enum><text>autoimmune diseases associated with viral triggers;</text></subparagraph><subparagraph id="HD98C4281E8DB44BD9184C4760A44D19E"><enum>(D)</enum><text>connective tissue diseases exacerbated or triggered by infections; </text></subparagraph><subparagraph id="HBAD858690C9C4213A953FD9BEED81D27"><enum>(E)</enum><text>mast cell activation syndrome;</text></subparagraph><subparagraph id="id39fdfcef7f7c4728af3da6dd7dac09c4"><enum>(F)</enum><text>related conditions and illnesses that may affect adults, young adults, or children; and</text></subparagraph><subparagraph id="idB3533842A1B74D198631E1EE972EF968"><enum>(G)</enum><text>other conditions, as the Secretary determines appropriate; and</text></subparagraph></paragraph><paragraph id="HB04B788A109F4040A27E18811925EFE6"><enum>(3)</enum><text>the availability, as medically appropriate, of treatment options for PASC and related post-viral illnesses and conditions overlapping with PASC identified under paragraph (2).</text></paragraph></subsection><subsection id="idc4e9a568eba4453eb85cb06c7d58d8ae"><enum>(b)</enum><header>Post-Acute sequelae of COVID–19 (PASC) provider education program</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall, in consultation with representatives from impacted communities and health care providers who treat these communities or individuals, develop and disseminate to health care providers information on PASC, recommended assessment tools, and management of PASC and related conditions for the purpose of ensuring that health care providers remain informed about current information on such emerging illness and related post-infectious illnesses, which have been shown to be closely related to PASC, including information on—</text><paragraph id="H6E8D0F1C691142BE92123ED4D56BEB7D"><enum>(1)</enum><text>PASC symptoms such as cognitive, neurological, psychiatric, gastrointestinal, respiratory, and cardiovascular symptoms;</text></paragraph><paragraph id="id910C7E25471044EA90A678DAFA4571E4"><enum>(2)</enum><text>myalgic encephalomyelitis/chronic fatigue syndrome and fibromyalgia;</text></paragraph><paragraph id="HCC8DBD958007401AB7F61EA95C31E487"><enum>(3)</enum><text>postural orthostatic tachycardia syndrome and other forms of dysautonomia;</text></paragraph><paragraph id="H676FB18E3D5040A28012376DCC54F985"><enum>(4)</enum><text>autoimmune diseases associated with viral triggers;</text></paragraph><paragraph id="HE4FC4387335C43B0B3C047D4827E0B84"><enum>(5)</enum><text>connective tissue diseases exacerbated or triggered by infections; </text></paragraph><paragraph id="H9DECE7A942584D528884E70DD0FA7588"><enum>(6)</enum><text>mast cell activation syndrome;</text></paragraph><paragraph id="ide3f303ebd444462893e0ad5face98541"><enum>(7)</enum><text>related conditions and illnesses that may affect adults, young adults, or children; and</text></paragraph><paragraph id="id82683baf514e4479870baef536e34619"><enum>(8)</enum><text>other conditions as the Secretary determines appropriate. </text></paragraph></subsection><subsection id="id99f2b9ecf70e48d193de638c233a1952"><enum>(c)</enum><header>Considerations</header><text>In developing and disseminating information in subsections (a) and (b), the Secretary shall ensure that—</text><paragraph id="iddeaec5f225ee44b6820f62c7f687957a"><enum>(1)</enum><text>guidance on PASC diagnostics, treatments, and care include demographic factors such as age, gender, geographic location, disability, occupation, race and ethnicity, and other factors identified by the Secretary to promote health equity; and</text></paragraph><paragraph id="idda95730d38aa4627adca1e38adc0fa56"><enum>(2)</enum><text>individuals with PASC or related post-viral illnesses and conditions, and entities representing such individuals, are empowered to participate in protocol development and outreach and education strategies. </text></paragraph></subsection><subsection id="HCAD56F4A75B54310A35B4AD9F7809B4B"><enum>(d)</enum><header>Dissemination of information</header><text>The Secretary shall disseminate, in plain language and in a manner that is culturally and linguistically appropriate and easily accessible to people with disabilities and individuals with limited English proficiency, information under subsections (a) and (b), directly or through arrangements with intra-agency initiatives, nonprofit organizations, consumer groups, institutions of higher learning (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), local educational agencies or State educational agencies (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), or Federal, State, Tribal, or local public private partnerships.</text></subsection><subsection id="H28FE93B3DC5242918D1BEB571C0837F3"><enum>(e)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $30,000,000 for each of fiscal years 2023 through 2025, which shall remain available until expended.</text></subsection></section><section id="id27beb11fd6854c36bf17ecb38aca08eb"><enum>5.</enum><header>Interagency coordination on public engagement and information dissemination on PASC</header><subsection id="id99df6c5fbd4640d2a4bb10bbed636f5d"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services shall convene relevant agencies to develop information and resources to make available to the public and for dissemination to individuals and communities impacted by PASC and related post-viral illness and conditions to raise awareness and provide education on the impact PASC or related post-viral illness and conditions may have on rights associated with employment, disability status, and education afforded under Federal and State law.</text></subsection><subsection id="id8b9266b086c5457fb9e94d1d72a9e2e0"><enum>(b)</enum><header>Collaboration and consultation</header><text>In developing the information and resources under subsection (a), the Secretary of Health and Human Services—</text><paragraph id="id659183D0989F4875840BE254C4A67453"><enum>(1)</enum><text>shall collaborate with—</text><subparagraph id="idb9918de7edb144d2ab6293e3f57e29cf"><enum>(A)</enum><text>the Department of Labor, including the Office of Disability Employment Policy of the Department of Labor;</text></subparagraph><subparagraph id="ide5419ad954d94952b68989ea60454b2b"><enum>(B)</enum><text>the Department of Education;</text></subparagraph><subparagraph id="id2adb80e6d58842ecb0f05cc0c5dbc635"><enum>(C)</enum><text>the Social Security Administration;</text></subparagraph><subparagraph id="idbb66efc322974fafa90d300337b16da7"><enum>(D)</enum><text>relevant agencies within the Department of Health and Human Services, including—</text><clause id="idf5f3ed71f22e4ba8b950bdf2ed579b52"><enum>(i)</enum><text>the Centers for Disease Control and Prevention;</text></clause><clause id="id1EEA10A0F50B4A2D8CCA75B57D2EBFB3"><enum>(ii)</enum><text>the National Institutes of Health;</text></clause><clause id="idDD57FD4C0F5148DEAEAE5BD7FCCD91B3"><enum>(iii)</enum><text>the Centers for Medicare &amp; Medicaid Services;</text></clause><clause id="id5f8e040011eb444a8a9cc87ca2e4f757"><enum>(iv)</enum><text>the Administration for Children and Families; and</text></clause><clause id="id4d5ea243cebe4a29b1e602cb1643d155"><enum>(v)</enum><text>the Administration on Community Living; and</text></clause></subparagraph><subparagraph id="id65a219fab83b475aa05d40749f73dc60"><enum>(E)</enum><text>other Federal departments, agencies, or offices, as the Secretary determines appropriate to carry out the activities described in this section; and</text></subparagraph></paragraph><paragraph id="id96D5B8AE3FC647E5AA47191070DA9F5D"><enum>(2)</enum><text>may consult with—</text><subparagraph id="id73ea685c2e0042e9966b672cc0756c5e"><enum>(A)</enum><text>communities and professions impacted by high COVID–19 rates;</text></subparagraph><subparagraph id="id60953e930d294c98abf2db47fa387c16"><enum>(B)</enum><text>individuals with PASC or related post-viral illnesses and conditions; and</text></subparagraph><subparagraph id="id075825155b8a4dc79b4f658d43ab1871"><enum>(C)</enum><text>organizations and experts that represent the rights and interests of the groups described in subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection><subsection id="id964a5e93ca9445178a6fb74425c82c30"><enum>(c)</enum><header>Information and resources developed</header><text>Not later than 1 year after the date of enactment of this Act, the entities described in subsection (b) shall develop information and resources to include—</text><paragraph id="id5e1a6f7119d843a19701dfbcb5991f9f"><enum>(1)</enum><text>educational materials to school administrators, counselors, educators, parents, coaches, school nurses, and other school staff about PASC and related post-viral illnesses and conditions with clear guidance on appropriate academic, social, and emotional supports and services, and the rights of students with disabilities, available to students and families;</text></paragraph><paragraph id="id9cc2d22fd381463f80c73ee2ae89b0e1"><enum>(2)</enum><text>guidance for employers on the rights of people with disabilities related to PASC and related post-viral illnesses and conditions; and</text></paragraph><paragraph id="id4a6cd549906742a2ad7503812b36938c"><enum>(3)</enum><text>guidance on PASC and related post-viral illnesses and conditions as a disability, including recommendations to streamline the process of applying for benefits through the Social Security Administration, including guidance on evaluating PASC and related post-viral illnesses and conditions for individuals under the age of 18, continuing disability reviews, and the payment of benefits under part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281 et seq.</external-xref>). </text></paragraph></subsection><subsection id="idf16ca7f1245e4694aff5060a26bd6bdd"><enum>(d)</enum><header>Appropriations</header><text>To carry out this section, there is authorized to be appropriated $30,000,000 for each of fiscal years 2023 through 2025, which shall remain available until expended.</text></subsection></section><section id="HA690A4D2F58E4E399E7616C5F25F05A0"><enum>6.</enum><header>Research with respect to Medicaid coverage of long-term symptoms of COVID–19</header><subsection id="H979E762655664DE99A3F433F2F2B9181"><enum>(a)</enum><header>Research</header><text>The Secretary of Health and Human Services shall expand the Chronic Conditions Data Warehouse research database of the Centers for Medicare &amp; Medicaid Services to collect data on items and services furnished to individuals under a State plan (or a waiver of such a plan) under the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) or under a State child health plan (or a waiver of such a plan) under the Children’s Health Insurance Program under title XXI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>) for the treatment of PASC, for purposes of assessing the frequency at which COVID–19 survivors are furnished such items and services.</text></subsection><subsection id="H607F5ABB473C4F4F824052EF802149FF"><enum>(b)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $3,000,000 for fiscal year 2022, which shall remain available until expended.</text></subsection></section><section id="id222f0ba654f04c3e84aeeedf64a8cc53"><enum>7.</enum><header>Program to support legal and social service assistance for individuals with PASC</header><subsection id="ide3ee7e1f03634854b48ebf33057dfe4f"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services, acting through the Administrator of the Administration for Community Living, shall award grants or contracts to eligible entities for purposes of establishing or expanding medical-legal partnerships, or increasing the availability of legal assistance or social supports necessary, to provide effective aid or support to individuals with PASC or related post-viral illnesses and conditions who are seeking assistance in obtaining or maintaining access to, or in legal matters relating to, any of the following services, at minimal or no cost to the individuals:</text><paragraph id="idF57BC8D75450419CA210597FBE205EEC"><enum>(1)</enum><text>The Social Security Disability Insurance program under section 223 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423</external-xref>).</text></paragraph><paragraph id="idD5D665572B8840A9A2863E8DDDD5E75B"><enum>(2)</enum><text>The supplemental security income program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>).</text></paragraph><paragraph id="idDBB0FD068EF94E0C99B4AA3885D9A958"><enum>(3)</enum><text>Survivors benefits under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>).</text></paragraph><paragraph id="idD3BD78A718D14332B2C66859AD416DE0"><enum>(4)</enum><text>Housing matters.</text></paragraph><paragraph id="id65CF4B524EA544AE99F0C52FE40AF0E9"><enum>(5)</enum><text>Access to medical care.</text></paragraph><paragraph id="id37b8844cec6d420faddfe91c44ffe36e"><enum>(6)</enum><text>Access to vocational rehabilitation services under title I of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/720">29 U.S.C. 720 et seq.</external-xref>).</text></paragraph><paragraph id="id9a9d227e8259434e9498d65f7447941d"><enum>(7)</enum><text>Access to assistive technology under the Assistive Technology Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/3001">29 U.S.C. 3001 et seq.</external-xref>).</text></paragraph><paragraph id="id18EBF3E6E16649889409B49556507722"><enum>(8)</enum><text>Early intervention, specialized instruction, and related services and accommodations for children provided under parts B and C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1411">20 U.S.C. 1411 et seq.</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431 et seq.</external-xref>) and section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>).</text></paragraph><paragraph id="id052AABBAAA24447BB8FC2DDFEC634F8A"><enum>(9)</enum><text>The low-income home energy assistance program established under the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8621">42 U.S.C. 8621 et seq.</external-xref>).</text></paragraph><paragraph id="id6C28382CD43541AEACA1F9F9681070B6"><enum>(10)</enum><text>Employment supports.</text></paragraph><paragraph id="id549C580C5887439C903ECCD8CA08495A"><enum>(11)</enum><text>Nutrition assistance.</text></paragraph><paragraph id="id780AAD151FB242D79145BB0343D5EBE7"><enum>(12)</enum><text>Other support services for low-income individuals and people with disabilities (as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>)).</text></paragraph></subsection><subsection id="id1b85184bb7824fddabe598cadba91638"><enum>(b)</enum><header>Eligibility for awards</header><paragraph id="id98DF5E4A5E754182A4AD9BC0969C2B18"><enum>(1)</enum><header>In general</header><text>To be eligible to receive an award under this section, an entity shall—</text><subparagraph id="id914ccf8b20544d988bdc03846972a144"><enum>(A)</enum><text>be—</text><clause id="id102def4c84a5484496f462dc9d20ac20"><enum>(i)</enum><text>a State, or an agency implementing the State protection and advocacy system (as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>));</text></clause><clause id="id966ed8a6bb1247779a401aac23514bcd"><enum>(ii)</enum><text>a nonprofit entity or a publicly funded organization not acting in a governmental capacity, such as a law school;</text></clause><clause id="id90261a8deb0848bda12f4810c6cfdf9d"><enum>(iii)</enum><text>an Indian Tribe or Tribal organization;</text></clause><clause id="id32587AC248024C799C0CE273C3584C4C"><enum>(iv)</enum><text>an urban Indian organization;</text></clause><clause id="id32f8b96faf514f83b2d457fa81b6766c"><enum>(v)</enum><text>a territory;</text></clause><clause id="id1b6671f3d67841039d25f7d11102aa8c"><enum>(vi)</enum><text>a health care provider with an existing multi-disciplinary clinic or other specialized program focused on serving individuals with PASC, underserved communities, or low-income patients, or with a demonstrated intent to create such a program;</text></clause><clause id="idfec6c2ce161a4f80b6272436b1b0d068"><enum>(vii)</enum><text>an entity providing legal services; or</text></clause><clause id="id0ed83bdd698d4505ba67ee2880758eb9"><enum>(viii)</enum><text>a consortium of entities described in clauses (i) through (vii); </text></clause></subparagraph><subparagraph id="id836de9e1437e410d83ba38d248dff737"><enum>(B)</enum><text>agree to use the award for the purposes described in subsection (c); and</text></subparagraph><subparagraph id="id321e3b0e293e4eacb8bfc3f78d033b99"><enum>(C)</enum><text>partner with at least one community-based organization with a demonstrated history of serving people with disabilities, including helping people with disabilities access supportive services, or a demonstrated history of serving impacted communities, including limited-English proficient communities.</text></subparagraph></paragraph><paragraph id="id5E669E4A2FCB4E3893643D8B2ADA8C60"><enum>(2)</enum><header>Priority</header><text>In making awards under subsection (a), the Secretary shall give priority to entities described in paragraph that certify in writing that any person providing legal assistance through a program supported by the award—</text><subparagraph id="id3dc9acb0b8664d4983ca143cd1724fdc" commented="no"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idA8D73B0D99B14E9B9DDD52D04A003579"><enum>(i)</enum><text>has demonstrated expertise in providing legal assistance to people with disabilities; or</text></clause><clause id="id0742946531cc4a25b4cf931d96f02613" indent="up1" commented="no"><enum>(ii)</enum><text>is partnered with a person that has demonstrated expertise described in clause (i); and</text></clause></subparagraph><subparagraph id="id30a6496b74654b6498af1ff6d9e5ae3b" commented="no"><enum>(B)</enum><text>has completed, or will complete, training in connection with disability-related legal issues. </text></subparagraph></paragraph></subsection><subsection id="id39B2FCF362AD452693D70B7AAA04ED3F"><enum>(c)</enum><header>Use of funds</header><text>An eligible entity receiving an award under this section may use such award to—</text><paragraph id="idade3a2af7fae4ed9ae89d60754d57b4b"><enum>(1)</enum><text>establish or expand medical-legal partnerships or other cooperative efforts between community-based organizations, medical and social service providers, and legal assistance providers to provide legal assistance and help accessing or maintaining social services for individuals with PASC;</text></paragraph><paragraph id="idf96a5ab0aade446bab94c1cb138fd841"><enum>(2)</enum><text>establish or expand efforts and projects to provide legal assistance for individuals with PASC by organizations with a demonstrated history of providing direct legal or advocacy services on behalf of people with disabilities;</text></paragraph><paragraph id="id69b73b5fa775426fa91664ed23bba646"><enum>(3)</enum><text>provide technical assistance to organizations or agencies for educating individuals with PASC or parents, including foster parents, caring for children with PASC about rights related to accommodations in employment, education, or other matters as determined by the Secretary; and</text></paragraph><paragraph id="id06058454e36d43c48761368c6ab6e821"><enum>(4)</enum><text>employ staff or educate current staff on assisting individuals with PASC in obtaining health care, social services, or legal services.</text></paragraph></subsection><subsection id="idf7b31994ab804aeebeba1c73a523c813"><enum>(d)</enum><header>Reporting</header><text>Eligible entities receiving an award under this section shall collect data and report information to the Secretary of Health and Human Services in a manner prescribed by such Secretary.</text></subsection><subsection id="idd7e92ef2ac644f67849a541a20ab48a8"><enum>(e)</enum><header>Evaluation</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary of Health and Human Services shall submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, which shall also be made publicly available, outlining the number of individuals who sought services offered by recipients of awards under this section and the services provided. Such report shall include a summary of activities conducted under the program under this section, and information broken down by award recipient.</text></subsection><subsection id="idf5d728fd5fb044219510609f8331775b"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="id92735a7be4f34d35928e8abf1473db35"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2023 through 2027.</text></paragraph><paragraph id="idf1f19c639e2546018c5618204a5e2069"><enum>(2)</enum><header>Nonsupplantation</header><text>Amounts made available under this section shall be used to supplement and not supplant other Federal, State, and local funds expended to further the purpose of this section.</text></paragraph></subsection></section><section id="id01fda406a62347f3af140efc58225b4f"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="id314342ab0cc0472fb8805b4f0fca0c1b"><enum>(1)</enum><header>Indian Tribe; Tribal organization</header><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given the terms <quote>Indian tribe</quote> and <quote>tribal organization</quote> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idD94ABC807AE848ABAA73BB920A850C0F"><enum>(2)</enum><header>PASC</header><text>The term <term>PASC</term> means post-acute sequelae of COVID–19, commonly referred to as <quote>long COVID</quote>.</text></paragraph><paragraph id="idDD94CFE94D3F413A9DF714CC17AB25AC"><enum>(3)</enum><header>Urban Indian organization</header><text>The term <term>urban Indian organization</term> has the meaning given such term in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text></paragraph></section></legis-body></bill>
