which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Southwestern Power Administration Fund, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Southwestern Power Administration Fund Establishment Act</short-title></quote>.</text></section><section id="idEDBA33468FBE4C539DAA5CC99814C1CF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idD03B70BA4E7E4B96A58A2897467347C5"><enum>(1)</enum><header>Administrator</header><text>The term <quote>Administrator</quote> means the Administrator of the Southwestern Power Administration. </text></paragraph><paragraph id="idE64E0AFCE71C496A9AC1278C3A020B67"><enum>(2)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Southwestern Power Administration Fund established by section 3(a).</text></paragraph><paragraph id="id6422751EE8814D0595235EA8BC836BEE"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph></section><section id="idC8C87BDCBE854603BE5641B62C40A6FF"><enum>3.</enum><header>Southwestern Power Administration Fund</header><subsection id="idccc257383caf4455bd97f1172942e31b"><enum>(a)</enum><header>Establishment of Fund</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Southwestern Power Administration Fund</quote>, consisting of—</text><paragraph id="idDC2038F7A9C54ACA89F716FF740EF4D0"><enum>(1)</enum><text>all receipts, collections, and recoveries of the Southwestern Power Administration, including trust funds;</text></paragraph><paragraph id="idE12BA430C9134CA4A54891ED48F8E7FE"><enum>(2)</enum><text>appropriations to the Fund; </text></paragraph><paragraph id="id2B243F3EBF154013AEBBCBEA4264B41A"><enum>(3)</enum><text>amounts transferred to the Fund under subsection (b); and</text></paragraph><paragraph id="id781E46DCA67345928DE6CD3171D3E51B"><enum>(4)</enum><text>amounts deposited in the Fund under the first proviso in the matter under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Operation and Maintenance, Southwestern Power Administration</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Power Marketing Administrations</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Department of Energy</header-in-text></quote> in title III of the Energy and Water Development Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/825s-4">16 U.S.C. 825s–4</external-xref>).</text></paragraph></subsection><subsection id="id81032D41E45045E6BCB6D0B152B5A7FA"><enum>(b)</enum><header>Transfers to Fund</header><text>There are transferred to the Fund—</text><paragraph id="idE382A4B75FDA45909B9B8AFDA194A0D3"><enum>(1)</enum><text>unexpended balances in the continuing fund pursuant to the 11th paragraph under the heading <quote><header-in-text style="OLC" level="appropriations-major">OFFICE OF THE SECRETARY</header-in-text></quote> in title I of the Act of October 12, 1949 (<external-xref legal-doc="usc" parsable-cite="usc/16/825s-1">16 U.S.C. 825s–1</external-xref>);</text></paragraph><paragraph id="id83860897ABCE4652A1CF20723BA72128"><enum>(2)</enum><text>unexpended balances in the advanced payment fund pursuant to the first proviso in the matter under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Operation and Maintenance, Southwestern Power Administration</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Power Marketing Administrations</header-in-text></quote> under the heading <quote>Department of Energy</quote> in title III of the Energy and Water Development Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/825s-4">16 U.S.C. 825s–4</external-xref>); and </text></paragraph><paragraph id="idE8E7A3FDDC5041A2A7E3E1A7BD90C239"><enum>(3)</enum><text>unexpended balances in the offsetting collections fund pursuant to the fourth and fifth provisos in the matter under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Operation and Maintenance, Southwestern Power Administration</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Power Marketing Administrations</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Department of Energy</header-in-text></quote> in title III of the Energy and Water Development and Related Agencies Appropriations Act, 2010 (<external-xref legal-doc="usc" parsable-cite="usc/16/825s-7">16 U.S.C. 825s–7</external-xref>) (as in effect on the day before the date of enactment of this Act).</text></paragraph></subsection><subsection id="idB21C4F7904974D14B3AD56F34087963A"><enum>(c)</enum><header>Availability</header><text>Amounts in the Fund shall remain available until expended.</text></subsection><subsection id="idbc132c70c0614cf5a7a81d0939774228"><enum>(d)</enum><header>Use</header><text>Amounts in the Fund shall be used by the Secretary, acting through the Administrator, for expenses necessary for—</text><paragraph id="idB236E1CCCE274CFABCC6A551AAA7E320"><enum>(1)</enum><text>operation and maintenance of power transmission facilities; </text></paragraph><paragraph id="id1E3FBD7754D3464E97E4274C0A660DE8"><enum>(2)</enum><text> marketing electric power and energy;</text></paragraph><paragraph id="idCAFA7525C49C449186BFFCFE6A32713C"><enum>(3)</enum><text>construction and acquisition of transmission lines, substations, and appurtenant facilities; and</text></paragraph><paragraph id="id4AFF162FBC764E2E8D661359322645A1"><enum>(4)</enum><text>administrative expenses in carrying out the duties of the Secretary under—</text><subparagraph id="id0EBFBC7944554457BEF4EB5C3D6E4A9C"><enum>(A)</enum><text>section 5 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/825s">16 U.S.C. 825s</external-xref>); and</text></subparagraph><subparagraph id="id03530C6560F94AED9B64AA1F05CB43DC"><enum>(B)</enum><text>section 1232 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16431">42 U.S.C. 16431</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="idcfba66aeb0384ebdbf970503d61be19e"><enum>(e)</enum><header>Obligations</header><text>The Secretary, acting through the Administrator, may incur obligations for authorized purposes in advance of appropriations to be liquidated by the Fund.</text></subsection><subsection id="id91dfef3950d24d23a5c28eaa53ab2b1e"><enum>(f)</enum><header>Excess funds</header><text>Annually, the Secretary, acting through the Administrator, shall transfer excess amounts in the Fund to the Treasury of the United States as miscellaneous receipts.</text></subsection><subsection id="id5889469a434c4ea2af8a5b68c694001b"><enum>(g)</enum><header>Applicable law</header><text>The provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/91">chapter 91</external-xref> of title 31, United States Code, shall apply to the Administrator in carrying out this section in the same manner as the provisions apply to a wholly owned Government corporation (as defined in section 9101 of that title).</text></subsection><subsection id="id9AD50C09C387424CA18839CD990CDCF5"><enum>(h)</enum><header>Conforming amendments</header><paragraph id="idBC3C4AA3120446ACAA5AD1728544F7B0"><enum>(1)</enum><text>The proviso in the matter under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Operation and Maintenance, Southwestern Power Administration</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Power Marketing Administrations</header-in-text></quote> under the heading <quote>Department of Energy</quote> in title III of the Energy and Water Development Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/16/825s-4">16 U.S.C. 825s–4</external-xref>), is amended—</text><subparagraph id="id16060F9C47C747C4A625B4D8FCFB3F07"><enum>(A)</enum><text>by striking <quote>in fiscal year 2005</quote> and inserting <quote>on the date of enactment of the <short-title>Southwestern Power Administration Fund Establishment Act</short-title></quote>; and</text></subparagraph><subparagraph id="idD9441915AD79474C8F7005EB8AFD59BC"><enum>(B)</enum><text>by striking <quote>credited to this account</quote> and inserting <quote>deposited in the Southwestern Power Administration Fund established by section 3(a) of the <short-title>Southwestern Power Administration Fund Establishment Act</short-title></quote>.</text></subparagraph></paragraph><paragraph id="id46976C6E4F3A45E79CE06C6347055A7D"><enum>(2)</enum><text> The fourth and fifth provisos in the matter under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">Operation and Maintenance, Southwestern Power Administration</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">Power Marketing Administrations</header-in-text></quote> under the heading <quote>Department of Energy</quote> in title III of the Energy and Water Development and Related Agencies Appropriations Act, 2010 (<external-xref legal-doc="usc" parsable-cite="usc/16/825s-7">16 U.S.C. 825s–7</external-xref>), are repealed. </text></paragraph></subsection></section></legis-body></bill>
