Wade (410 U.S. 113 (1973)) and Planned Parenthood of Southeastern Pennsylvania v. Casey (505 U.S. 833 (1992)).</official-title></form><legis-body><section id="id639D6FF280E7443CAC4D70A7D821D49F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reproductive Choice Act</short-title></quote>.</text></section><section id="idd9e5084f973f405989295b736ec531f1"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to codify the essential holdings of Roe v. Wade (410 U.S. 113 (1973)) and Planned Parenthood of Southeastern Pennsylvania v. Casey (505 U.S. 833 (1992)).</text></section><section id="id3e248f5935f44d3a9c93460871fa90cc"><enum>3.</enum><header>Clarification of allowable State requirements</header><subsection id="id28e5c4a8e9694834bce49fafa79e6a12"><enum>(a)</enum><header>In general</header><text>A State—</text><paragraph id="id92e829f135d14722b2e66f997ec00856"><enum>(1)</enum><text>may not impose an undue burden on the ability of a woman to choose whether or not to terminate a pregnancy before fetal viability;</text></paragraph><paragraph id="ida81bb76026f7483591ceffb358d5b24e"><enum>(2)</enum><text>may restrict the ability of a woman to choose whether or not to terminate a pregnancy after fetal viability, unless such a termination is necessary to preserve the life or health of the woman; and</text></paragraph><paragraph id="id038aae6dcc4346da8fdf7e62880ba4c9"><enum>(3)</enum><text>may enact regulations to further the health or safety of a woman seeking to terminate a pregnancy.</text></paragraph></subsection><subsection id="idCD90494CC5AF4167864AC42E9C7FE619"><enum>(b)</enum><header>Clarification</header><text>For purposes of this Act, unnecessary health regulations that have the purpose or effect of presenting a substantial obstacle to a woman seeking to terminate a pregnancy impose an undue burden.</text></subsection><subsection id="id2b8d49e1f6ef420991a5bac521854e6c"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed to have any effect on laws regarding conscience protection.</text></subsection></section><section id="id330374069e394682b81da4c80e8e3e0c"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id67e4fd366230410095a346842eb6ad98"><enum>(1)</enum><header>State</header><text>The term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, and each other territory or possession of the United States, and any subdivision of any of the foregoing.</text></paragraph><paragraph id="idbdea1fda356f4e06b138dca4f01de48f"><enum>(2)</enum><header>Undue burden</header><text>The term <term>undue burden</term> means any burden that places a substantial obstacle in the path of a woman seeking to terminate a pregnancy prior to fetal viability. </text></paragraph></section></legis-body></bill>
