<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 370</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210223">February 23, 2021</action-date><action-desc><sponsor name-id="S303">Mr. Thune</sponsor> (for himself, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S252">Ms. Collins</cosponsor>, <cosponsor name-id="S363">Mr. King</cosponsor>, <cosponsor name-id="S381">Mr. Rounds</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, and <cosponsor name-id="S309">Mr. Casey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Poultry Products Inspection Act and the Federal Meat Inspection Act to support small and very small meat and poultry processing establishments, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HCCAE1828D84D4163A0C417659EA98C73"><section section-type="section-one" id="HE1AD1BF9BADA4332856E9BDA08F7647D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Local Processing Act of 2021</short-title></quote>.</text></section><section id="HF51D2BB38347436DB4AAAB836DE52DDB"><enum>2.</enum><header>HACCP guidance and resources for smaller and very small poultry and meat establishments</header><subsection id="HD3E6DC1542EF40BBBAC890CD48F35119"><enum>(a)</enum><header>Poultry establishments</header><text>The Poultry Products Inspection Act is amended by inserting after section 14 (<external-xref legal-doc="usc" parsable-cite="usc/21/463">21 U.S.C. 463</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF8E0A3C0F3BE44EE90684309C008AC97"><section id="id2181AEF187384551AB287CD36716FE54"><enum>14A.</enum><header>Smaller and very small establishment guidance and resources</header><subsection id="id8C48BCE93ED24B54BFA73BE2E019CFA1"><enum>(a)</enum><header>Definitions of smaller establishment and very small establishment</header><text>In this section, the terms <quote>smaller establishment</quote> and <quote>very small establishment</quote> have the meanings given those terms in the final rule entitled ‘Pathogen Reduction; Hazard Analysis and Critical Control Point (HACCP) Systems’ (61 Fed. Reg. 38806 (July 25, 1996)).</text></subsection><subsection id="idC22F86BE97444D018B7B788E58424381"><enum>(b)</enum><header>Database of studies; model plans</header><text>Not later than 18 months after the date of enactment of this section, the Secretary shall—</text><paragraph id="H10BEC51A3720454193983F421D907418"><enum>(1)</enum><text display-inline="yes-display-inline">establish a free, searchable database of approved peer-reviewed validation studies accessible to smaller establishments and very small establishments subject to inspection under this Act for use in developing a Hazard Analysis and Critical Control Points plan; and</text></paragraph><paragraph id="HCF66C64F918F47A0931CDBED900B60DE"><enum>(2)</enum><text>publish online scale-appropriate model Hazard Analysis and Critical Control Points plans for smaller establishments and very small establishments, including model plans for—</text><subparagraph id="H39B5D667D4BF4530BB141B0DE171FFFC"><enum>(A)</enum><text display-inline="yes-display-inline">slaughter-only establishments; </text></subparagraph><subparagraph id="H2750FC68A68D492BB3265558E79FA0CA"><enum>(B)</enum><text display-inline="yes-display-inline">processing-only establishments; and</text></subparagraph><subparagraph id="H3FE58E12ED0B45D497108C1D0A96CADA"><enum>(C)</enum><text>slaughter and processing establishments. </text></subparagraph></paragraph></subsection><subsection id="H4097802343D04D7A9AC7A2C1A188BC50"><enum>(c)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Secretary shall publish a guidance document, after notice and an opportunity for public comment, providing information on the requirements that need to be met for smaller establishments and very small establishments to receive approval for a Hazard Analysis and Critical Control Points Plan pursuant to this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1BC391A113274297952B4669F0DE87BC"><enum>(b)</enum><header>Meat establishments</header><text>The Federal Meat Inspection Act is amended by inserting after section 25 (<external-xref legal-doc="usc" parsable-cite="usc/21/625">21 U.S.C. 625</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCEA05AA64EA640F8A16A9632E3806AC8"><section id="idB6633EF6B77D4D2EAFD8BBF50674C32A"><enum>26.</enum><header>Smaller and very small establishment guidance and resources</header><subsection id="idF7AE6C98F3A044668D95EEDE7F2D6952"><enum>(a)</enum><header>Definitions of smaller establishment and very small establishment</header><text>In this section, the terms <quote>smaller establishment</quote> and <quote>very small establishment</quote> have the meanings given those terms in the final rule entitled ‘Pathogen Reduction; Hazard Analysis and Critical Control Point (HACCP) Systems’ (61 Fed. </text></subparagraph><subparagraph id="idDB0CEEBA982947C4A02348FC9C70A25D"><enum>(B)</enum><text display-inline="yes-display-inline">processing-only establishments; and</text></subparagraph><subparagraph id="id3F19281A56F148C19AC112FE9B9382BB"><enum>(C)</enum><text>slaughter and processing establishments. </text></subparagraph></paragraph></subsection><subsection id="id07B162931C8B4F95943052B097292761"><enum>(c)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Secretary shall publish a guidance document, after notice and an opportunity for public comment, providing information on the requirements that need to be met for smaller establishments and very small establishments to receive approval for a Hazard Analysis and Critical Control Points Plan pursuant to this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H68C6708C17444D5186B853FD44529094"><enum>3.</enum><header>Increasing maximum Federal share for expenses of State inspection</header><subsection id="id633683414a4d494ab36a72a67a82a616"><enum>(a)</enum><header>Poultry products</header><text>Section 5(a)(3) of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/454">21 U.S.C. 454(a)(3)</external-xref>) is amended in the second sentence by striking <quote>50 per centum</quote> and inserting <quote>65 percent</quote>.</text></subsection><subsection id="id822d505f3a9e40f18ffc8370624fa621"><enum>(b)</enum><header>Meat and meat food products</header><text>Section 301(a)(3) of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/661">21 U.S.C. 661(a)(3)</external-xref>) is amended in the second sentence by striking <quote>50 per centum</quote> and inserting <quote>65 percent</quote>.</text></subsection></section><section id="H3BC41F5124EC4AD699FDCAA6EDCD354D"><enum>4.</enum><header>Cooperative interstate shipment of poultry and meat</header><subsection id="H38349316E483406BBFCB1F4885A92EF9"><enum>(a)</enum><header>Poultry products</header><text>Section 31 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/472">21 U.S.C. 472</external-xref>) is amended—</text><paragraph id="HEB5561D652764E098AC6265A2BE45B32"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HEE5DBA77D77B4E3BB8A98531D8E20940"><enum>(A)</enum><text>in paragraph (2), by striking <quote>25 employees</quote> each place it appears and inserting <quote>50 employees</quote>; and</text></subparagraph><subparagraph id="H824B64C8488F4480878B3F0B29B962BA"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="H737149A108034EC48CD65F36B5A8BA25"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">25</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">50</header-in-text></quote>;</text></clause><clause id="H1B800E25712B4B288A92A3D715D6A221"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>25</quote> and inserting <quote>50</quote>; and </text></clause><clause id="HB25D88F0B4C6446D9B0E18A2A29C8DF8"><enum>(iii)</enum><text>in subparagraph (B)—</text><subclause id="id7E4E2C95EA9F418CB757439E948070B1"><enum>(I)</enum><text>in clause (i), by striking <quote>more than 25 employees but less than 35 employees</quote> and inserting <quote>more than 50 employees but less than 70 employees</quote>; and</text></subclause><subclause id="idFDD05EC42649461A92C4B7DF40B1B012"><enum>(II)</enum><text>in clause (ii), by striking <quote>subsection (i)</quote> and inserting <quote>subsection (j)</quote>;</text></subclause></clause></subparagraph></paragraph><paragraph id="H9FB29873C07B41EC8E44E43B6CC5A591"><enum>(2)</enum><text>in subsection (c), by striking <quote>60 percent</quote> and inserting <quote>80 percent</quote>; </text></paragraph><paragraph id="idE1F4225D1259489CAB66A3C680D5EEB0"><enum>(3)</enum><text>in subsection (e)(1), by striking <quote>subsection (i)</quote> and inserting <quote>subsection (j)</quote>;</text></paragraph><paragraph id="H313B9DC6BE1B4172BD1F82CBC4800979"><enum>(4)</enum><text>by redesignating subsections (f) through (i) as subsections (g) through (j), respectively; and</text></paragraph><paragraph id="HAA9DEDD3B82D4EC2B664E0F339F348E0"><enum>(5)</enum><text>by inserting after subsection (e) the following: </text><quoted-block style="OLC" id="H7FB922D3313D434AAA27E8559CFA5751"><subsection id="H018D9EABAA8E4791842800935E2D4854"><enum>(f)</enum><header>Federal outreach</header><paragraph id="H1F99E59886AE4F10BE4FF72F5BA09B19"><enum>(1)</enum><header>In general</header><text>In each of fiscal years 2021 through 2024, for the purpose of State participation in the Cooperative Interstate Shipment program, the Secretary shall conduct outreach to, and, as appropriate, subsequent negotiation with, not fewer than 25 percent of the States that—</text><subparagraph id="idD71B1EB1D43B4806A196DF151DFDF9A7"><enum>(A)</enum><text>have a State poultry product inspection program pursuant to section 5; but</text></subparagraph><subparagraph id="idEB2BD442ED5941CC8B0693A13394F0CC"><enum>(B)</enum><text>do not have a selected establishment.</text></subparagraph></paragraph><paragraph id="HEB14AF8B170949CC822CCDFC54EDA0D5"><enum>(2)</enum><header>Report</header><text>At the conclusion of each of fiscal years 2021 through 2024, the Secretary shall submit a report detailing the activities and results of the outreach conducted during that fiscal year under paragraph (1) to—</text><subparagraph id="H275A0E1D0D844F8B8B898A46C0EA4847"><enum>(A)</enum><text>the Committee on Agriculture of the House of Representatives;</text></subparagraph><subparagraph id="H06950B1C64AF4911AF56F4659B79EC99"><enum>(B)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></subparagraph><subparagraph id="HB8B4EC06C54F445FB21C17FF51D51CE5"><enum>(C)</enum><text>the Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies of the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="H67FE70F31AAD47D187E88CA055C246B3"><enum>(D)</enum><text>the Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies of the Committee on Appropriations of the Senate.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE189DB551539484993D073485A657900"><enum>(b)</enum><header>Meat and meat food products</header><text>Section 501 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/683">21 U.S.C. 683</external-xref>) is amended—</text><paragraph id="HD588217AC9314E9D828259ED9E9817EF"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HC4387D958875493CA097019C3BEC622B"><enum>(A)</enum><text>in paragraph (2), by striking <quote>25 employees</quote> each place it appears and inserting <quote>50 employees</quote>; and</text></subparagraph><subparagraph id="H5F38B056AEB84DC19BA2E7D7DD329A71"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="idE51CAA4B4EFD4EE48CB35DD076826063"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">25</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">50</header-in-text></quote>;</text></clause><clause id="H9F4F184D1DB84AA896AE795E1F743002"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>25</quote> and inserting <quote>50</quote>; and </text></clause><clause id="HAEB7861C7376474FAC19DFE302D755AE"><enum>(iii)</enum><text>in subparagraph (B)(i), by striking <quote>more than 25 employees but less than 35 employees</quote> and inserting <quote>more than 50 employees but less than 70 employees</quote>; </text></clause></subparagraph></paragraph><paragraph id="HEB2A87EB838B4537B736E93911F50971"><enum>(2)</enum><text>in subsection (c), by striking <quote>60 percent</quote> and inserting <quote>80 percent</quote>; and</text></paragraph><paragraph id="H2EC49FE791154B2B999B33BD4D310D40"><enum>(3)</enum><text>in subsection (f), by adding at the end the following:</text><quoted-block style="OLC" id="id7FA4E6E99D03413989BA7AD81A7131F0"><paragraph id="id4FCB16C53B5E41CD837FD769ED2396AD"><enum>(3)</enum><header>Federal outreach</header><subparagraph id="id341309F88BDF4ED6B1EC25EB638FDE8B"><enum>(A)</enum><header>In general</header><text>In each of fiscal years 2021 through 2024, for the purpose of State participation in the Cooperative Interstate Shipment program, the Secretary shall conduct outreach to, and, as appropriate, subsequent negotiation with, not fewer than 25 percent of the States that—</text><clause id="idEC34B56A6EE144498E035E7B3F0370EF"><enum>(i)</enum><text>have a State meat inspection program pursuant to section 301; and</text></clause><clause id="idA3DB02B889014E0E9433F962788EBE6F"><enum>(iv)</enum><text>the Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies of the Committee on Appropriations of the Senate.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HF4425BC8E06C4A4FA29CF558B56FC2A8"><enum>5.</enum><header>Processing resilience grant program</header><text display-inline="no-display-inline">Subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H77250C0F33F04D46A38B3B5C7BE86F30"><section id="H01ACCB31179A48369ED5BA40BB85A83B"><enum>210B.</enum><header>Processing resilience grant program</header><subsection id="H3D92DA904C2443F9B6D46EE435AC2BB5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id6B1BDADA8E1E4FF4B90D6CC15A1D26B8"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HBFCF913663754F1E9E420372BFA02CA1"><enum>(A)</enum><text display-inline="yes-display-inline">a smaller establishment or very small establishment (as those terms are defined in the final rule entitled ‘Pathogen Reduction; Hazard Analysis and Critical Control Point (HACCP) Systems’ (61 Fed. Reg. 33806 (July 25, 1996))); </text></subparagraph><subparagraph id="HCCBB446E5B72494CA598D5E30245F33A"><enum>(B)</enum><text>a slaughtering or processing establishment subject to—</text><clause id="id1F8B6A80D6F74B3DA5974042AD01CC5C"><enum>(i)</enum><text>a State meat inspection program pursuant to section 301 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/661">21 U.S.C. 661</external-xref>); or </text></clause><clause id="id0E8F65271AD84047B0FB2EAFCAD090D7"><enum>(ii)</enum><text>a State poultry product inspection program pursuant to section 5 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/454">21 U.S.C. 454</external-xref>);</text></clause></subparagraph><subparagraph commented="no" id="id955018869C67417581645D4A8F38D9E1"><enum>(C)</enum><text>a person engaging in custom operations that is exempt from inspection under—</text><clause commented="no" id="id921DBA7569F64FD2885B1F13C1C46C3A"><enum>(i)</enum><text>section 23 of the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/623">21 U.S.C. 623</external-xref>); or</text></clause><clause commented="no" id="idB64D08C698E841F18683F48EB17FDE90"><enum>(ii)</enum><text>section 15 of the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/464">21 U.S.C. 464</external-xref>); and</text></clause></subparagraph><subparagraph commented="no" id="id2111F7A267114281B7446FD26B3BBA27"><enum>(D)</enum><text>a person seeking—</text><clause commented="no" id="id331ABA6C07064721BFE518AFB46B936A"><enum>(i)</enum><text>to establish and operate an establishment described in subparagraph (A) or (B); or</text></clause><clause commented="no" id="idD97B24057B424392AC9F5F6872F61DBE"><enum>(ii)</enum><text>to engage in custom operations described in subparagraph (C). </text></clause></subparagraph></paragraph><paragraph commented="no" id="idE11F64215DE040CC93DF721F30C5F084"><enum>(2)</enum><header>Minority-owned business</header><text>The term <quote>minority-owned business</quote> means a for-profit business not less than 51 percent of which is owned by 1 or more Black American, Native American, Hispanic American, or Asian American individuals. </text></paragraph><paragraph id="idd5579b669ebe4ee78634f40002ae320e"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service. </text></paragraph></subsection><subsection id="HDC8AD60CEEAE4100A19BD1195686621C"><enum>(b)</enum><header>Grants</header><paragraph id="id5BDF05E913AC4109A398A2F64B7CAA03"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this section, the Secretary shall award competitive grants to eligible entities for activities to adapt production, processing, distribution, and sales systems to respond to and recover from the effects of the Coronavirus Disease 2019 (referred to in this section as <quote>COVID–19</quote>) pandemic, including activities that—</text><subparagraph id="H66629EC2312748A98B5024E5E97889A1"><enum>(A)</enum><text>support the health and safety of meat and poultry plant employees, suppliers, and customers;</text></subparagraph><subparagraph id="HC9E47AFBA75848F6A06F027FDB7AC83F"><enum>(B)</enum><text>support increased processing capacity; and</text></subparagraph><subparagraph id="H9795FED104DF4767B9F2C5D432A13E4D"><enum>(C)</enum><text>otherwise support the resilience of the small meat and poultry processing sector.</text></subparagraph></paragraph><paragraph id="HFF8DE250DE8544F1BE83C2145E0408C8"><enum>(2)</enum><header>Maximum amount</header><text>The maximum amount of a grant awarded under this section shall not exceed $500,000. </text></paragraph><paragraph id="idC8096A2592944EA6A29FB03066785445"><enum>(3)</enum><header>Duration</header><text>The term of a grant awarded under this section shall not exceed 3 years. </text></paragraph></subsection><subsection id="H164D6D0AAD2B4999B9581530CE9EB6A6"><enum>(c)</enum><header>Applications</header><paragraph id="HF287C735D0A4472FA7FF487531E44C66"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity desiring a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="H21994E8FE4454CF0883655168E6F0B73"><enum>(2)</enum><header>Applications for small grants</header><text display-inline="yes-display-inline">The Secretary shall establish a separate, simplified application process for eligible entities applying for a grant under this section of not more than $100,000.</text></paragraph><paragraph id="H7FB11D5A99D444968A6574711E99385E"><enum>(3)</enum><header>Requirements</header><text>The Secretary shall ensure that any application for a grant under this section is—</text><subparagraph id="HDFBED33464B54BE486CFAC07CA1CC297"><enum>(A)</enum><text>simple and practicable;</text></subparagraph><subparagraph id="HB8B44C1C0E6347C2A07781A18D9BCF3E"><enum>(B)</enum><text>accessible online; and</text></subparagraph><subparagraph id="HB263582041DB41B3BB92E934AD016FC0"><enum>(C)</enum><text>available through local staff of the Department of Agriculture.</text></subparagraph></paragraph><paragraph id="H5E06424B2A664074BB949FE5B39F7CA9"><enum>(4)</enum><header>Notice</header><text>Not later than 14 days before the date on which the Secretary begins to accept applications under paragraph (1), the Secretary shall publish a notice of funding opportunity with respect to the grants available under this section.</text></paragraph><paragraph id="HBAC7EAB0441D4D148DBB59AA8F027900"><enum>(5)</enum><header>Reapplication</header><text>If an application of an eligible entity under this subsection is denied by the Secretary, the eligible entity may submit a revised application.</text></paragraph><paragraph id="HDCD7A35618AC4AD38476B8E5FC6EB8E7"><enum>(6)</enum><header>Priority</header><text>In reviewing applications submitted under this subsection, the Secretary shall give priority to proposals that will—</text><subparagraph id="H8CD6BD8F6015421491E52F1E500DD770"><enum>(A)</enum><text>increase farmer and rancher access to animal slaughter options within a 200-mile radius of the location of the farmer or rancher;</text></subparagraph><subparagraph id="H1D77C105E7C94EA086911F4861FF02C7"><enum>(B)</enum><text>support an eligible entity described in subsection (a)(1)(A); or</text></subparagraph><subparagraph id="H094F11707D904057B6415FAFD6EB14EC"><enum>(C)</enum><text>support an eligible entity that is a minority-owned business.</text></subparagraph></paragraph></subsection><subsection id="HFD17D4A33CA8448784FD96053040CD37"><enum>(d)</enum><header>Use of grant</header><text>An eligible entity that receives a grant under this section shall use the grant funds to carry out activities in support of the purposes described in subsection (b)(1), including through—</text><paragraph id="HE356BC21FF004B7B801D8C44B7EB1487"><enum>(1)</enum><text>the development and issuance of a Hazard Analysis and Critical Control Points plan for the eligible entity, which may be developed by a consultant;</text></paragraph><paragraph id="H2D1C46ACBAD6479790A1F499BF6240C6"><enum>(2)</enum><text>the purchase or establishment, as applicable, of facilities, equipment, processes, and operations necessary for the eligible entity to comply with applicable requirements under the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601</external-xref> et seq.) or the Poultry Products Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/451">21 U.S.C. 451</external-xref> et seq.);</text></paragraph><paragraph id="H278EBC7B21AC4989B5A161DF9AACB7D1"><enum>(3)</enum><text>the purchase of cold storage, equipment, or transportation services or equipment needed to respond to COVID–19 demand;</text></paragraph><paragraph id="HCA582D486DD24A79B25CF02CEDD676D3"><enum>(4)</enum><text>the purchase of test kits for COVID–19, temperature screening supplies, disinfectant, sanitation systems, hand washing stations, and other sanitizing supplies;</text></paragraph><paragraph id="HB4AC10EF065946BD948E015368DF8290"><enum>(5)</enum><text>the purchase and decontamination of personal protective equipment;</text></paragraph><paragraph id="HDCC1BBD9BC2F4B03AA2F1200AD74176C"><enum>(6)</enum><text>the construction or purchase of humane handling infrastructure, including holding space for livestock prior to slaughter, shade structures, and knock box structures;</text></paragraph><paragraph id="idf498c2d49a974627a2d6032deceb624b"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFC103B5710A742148883AC94F5038B76"><enum>(A)</enum><text>the purchase of software and computer equipment for record keeping, production data, Hazard Analysis and Critical Control Points record review, and facilitation of marketing and sales of products in a manner consistent with the social distancing guidelines of the Centers for Disease Control and Prevention; and </text></subparagraph><subparagraph id="id24E05F9BB30544E49DB084A2EAA68B67" indent="up1"><enum>(B)</enum><text>the provision of guidelines and training relating to that software and computer equipment;</text></subparagraph></paragraph><paragraph id="HE5D7D23442764C4487E6BA6AD778ADAB"><enum>(8)</enum><text>the provision of staff time and training for implementing and monitoring health and safety procedures; </text></paragraph><paragraph id="H064AC50131F24C35B90CB3E92AE07AF7"><enum>(9)</enum><text>the development of a feasibility study or business plan for, or the carrying out of any other activity associated with, establishing or expanding a small meat or poultry processing facility; and</text></paragraph><paragraph id="id2879bb701a71402ba1e203d68f114d97"><enum>(10)</enum><text>other activities associated with expanding or establishing an eligible entity described in subsection (a)(1)(A), as determined by the Secretary. </text></paragraph></subsection><subsection id="H7FB90E76BFC243FFA7056102214273CF"><enum>(e)</enum><header>Outreach</header><text>During the period beginning on the date on which the Secretary publishes the notice under subsection (c)(4) and ending on the date on which the Secretary begins to accept applications under subsection (c)(1), the Secretary shall perform outreach to States and eligible entities relating to grants under this section.</text></subsection><subsection id="H76103DA92959421C81343C1F1ADC5D0D"><enum>(f)</enum><header>Federal share</header><paragraph commented="no" id="id98128BA3E6834F158B365DA8D82263A5"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Federal share of the activities carried out using a grant awarded under this section shall not exceed—</text><subparagraph commented="no" id="id0264C996A7E0459D8E37FC73C843CB79"><enum>(A)</enum><text>90 percent in the case of a grant in the amount of $100,000 or less; or</text></subparagraph><subparagraph commented="no" id="id59FA25AAB3034C338B72ED6825DFF18C"><enum>(B)</enum><text>75 percent in the case of a grant in an amount greater than $100,000.</text></subparagraph></paragraph><paragraph id="H38BF2A1430B54591B61B0DF0A6075A56"><enum>(2)</enum><header>Fiscal years 2021 and 2022</header><text>An eligible entity awarded a grant under this section during fiscal year 2021 or 2022 shall not be required to provide non-Federal matching funds with respect to the grant.</text></paragraph></subsection><subsection id="idfb972ec99d3a4cc5a904ed9734fd85fd"><enum>(g)</enum><header>Administration</header><text>The promulgation of regulations under, and administration of, this section shall be made without regard to—</text><paragraph id="idd873277c2f7d4c8aa2c3170ae9f1ce16"><enum>(1)</enum><text>the notice and comment provisions of section 553 of title 5, United States Code; and</text></paragraph><paragraph id="idde5ce5d3a470459e9794838d8e5735cc"><enum>(2)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>). </text></paragraph></subsection><subsection id="HB60B9218048F4CB0BF1690ECB152628E"><enum>(h)</enum><header>Funding</header><paragraph id="HCB96E58B11DE46E1A7DF47077BE9D4A2"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary of Agriculture shall use to carry out this section $10,000,000 for each of fiscal years 2021 through 2030.</text></paragraph><paragraph id="H6E2F82C711F441449D70F348E9D69967"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to amounts made available under paragraph (1), there is authorized to be appropriated to the Secretary of Agriculture to carry out this section $15,000,000 for each of fiscal years 2021 through 2030.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1E5AB0FD07FC4A3EB656A9BDC0F66AAB"><enum>6.</enum><header>Local meat and poultry processing training programs</header><text display-inline="no-display-inline">Title IV of the Agricultural Research, Extension, and Education Reform Act of 1998 is amended by inserting before section 404 (<external-xref legal-doc="usc" parsable-cite="usc/7/7624">7 U.S.C. 7624</external-xref>) the following:</text><quoted-block style="OLC" id="H22E4F43EF5C64FC6B2A4807B8376BC65"><section id="H4C374742153E480BA017408B7A2AA107"><enum>403.</enum><header>Local meat and poultry processing training programs</header><subsection id="H941C4F1FC2D2448F848A06C3E4D392E8"><enum>(a)</enum><header>Higher education career training programs</header><paragraph id="H2670B0353B174E80BF0C7404531BBB40"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide competitive grants to junior or community colleges, technical or vocational schools, and land-grant colleges and universities (as defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)) to establish or expand career training programs relating to meat and poultry processing.</text></paragraph><paragraph id="H0896D49E049748D989AC1BA7D419FAB5"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $10,000,000 for fiscal year 2021 and each fiscal year thereafter, to remain available until expended.</text></paragraph></subsection><subsection id="H1DE1E049F15744B1B6299006DD13016B"><enum>(b)</enum><header>Processor career training programs</header><paragraph id="HF8A6DF973AAB4EDD9BCB0080D1BE4212"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide grants to smaller establishments and very small establishments (as those terms are defined in the final rule entitled <quote>Pathogen Reduction; Hazard Analysis and Critical Control Point (HACCP) Systems</quote> (61 Fed. Reg. 38806 (July 25, 1996))) and nongovernmental organizations to offset the cost of training new meat and poultry processors.</text></paragraph><paragraph id="H7FF3C42F72BE472BB4E795EBEB03BCF4"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $10,000,000 for fiscal year 2021 and each fiscal year thereafter, to remain available until expended.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
