which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to make permanent certain telehealth flexibilities under the Medicare program related to the COVID–19 public health emergency.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telehealth Modernization Act</short-title></quote>.</text></section><section id="id1545589B871A4F0EBEC2DE1A367E35A0"><enum>2.</enum><header>Extending Medicare telehealth flexibilities</header><subsection id="idE2C84E586BBE4E8A927AC30CA6FA9690"><enum>(a)</enum><header>Expanding access to telehealth services</header><paragraph id="idDD57E6288FF64822A4BCB4B95330A256"><enum>(1)</enum><header>In general</header><text>Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>) is amended by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDBA3C087DCE94981B0800A0A61900219"><clause id="id75C72B2670FD479D951B371F31E8645A"><enum>(iii)</enum><header>Expanding access to telehealth services</header><text>With respect to telehealth services furnished beginning on the first day after the end of the emergency period described in section 1135(g)(1)(B) of this clause, the term <term>originating site</term> means any site at which the eligible telehealth individual is located at the time the service is furnished via a telecommunications system, including the home of an individual.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id196A1BF0C219425B9AC8C8A1E1B38BB3"><enum>(2)</enum><header>Conforming amendments</header><text>Such section is amended—</text><subparagraph id="idF092C38A2FB94C78A4A2DC740E64DDB0"><enum>(A)</enum><text>in paragraph (2)(B)—</text><clause id="id39E06E43B37F424B8C3C8DC0A748835C"><enum>(i)</enum><text>in clause (i), in the matter preceding subclause (I), by striking <quote>clause (ii)</quote> and inserting <quote>clauses (ii) and (iii)</quote>; and</text></clause><clause commented="no" id="id8E06FE5DDD384A40981A488B0511335E"><enum>(ii)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7940CA25B5B64A30852CD7BC03B72358"><clause commented="no" id="id308A96CBBD794BB983DA9B49B086269A"><enum>(iii)</enum><header>No facility fee for new sites</header><text>With respect to telehealth services furnished on or after the date of enactment of this clause, a facility fee shall only be paid under this subparagraph to an originating site that is described in paragraph (4)(C)(ii) (other than subclause (X) of such paragraph).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idEE202817E3A043AC843DE461F5E95F36"><enum>(B)</enum><text>in paragraph (4)(C)—</text><clause id="id0D4F812AD6BC4CD4ADE728A53F9AF1A1"><enum>(i)</enum><text>in clause (i), in the matter preceding subclause (I), by inserting <quote>and clause (iii)</quote> after <quote>and (7)</quote>; and</text></clause><clause id="id87ED2919F0D24E6DB47C0E94E63AE38B"><enum>(ii)</enum><text>in clause (ii)(X), by inserting <quote>prior to the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> before the period;</text></clause></subparagraph><subparagraph id="ide2dc9343a6c14928abc648b9d002527c"><enum>(C)</enum><text>in paragraph (5), by inserting <quote>and prior to the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> after <quote>January 1, 2019,</quote>;</text></subparagraph><subparagraph id="idd0a894d2dfea46caaecd7b5301207541"><enum>(D)</enum><text>in paragraph (6)(A), by inserting <quote>and prior to the first day after the end of the emergency period described in section 1135(g)(1)(B),</quote> after <quote>January 1, 2019,</quote>; and</text></subparagraph><subparagraph id="id7c1d40d2a8a84aedb508caef271bab02"><enum>(E)</enum><text>in paragraph (7), by inserting <quote>and prior to the first day after the end of the emergency period described in section 1135(g)(1)(B),</quote> after <quote>July 1, 2019,</quote>. </text></subparagraph></paragraph></subsection><subsection id="id7D3F49362F7E4A829496CAB97B711AA7"><enum>(b)</enum><header>Expanding practitioners eligible To furnish telehealth services</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="id8F80D7AFFB564343A24D68DE31D75A31"><enum>(1)</enum><text>in paragraph (1), by striking <quote>(described in section 1842(b)(18)(C))</quote> and inserting <quote>(defined in paragraph (4)(E))</quote>; and</text></paragraph><paragraph id="id2AC9C6A2D5EC4A769FFA63A031E52E89"><enum>(2)</enum><text>in paragraph (4)(E)—</text><subparagraph id="id678B8A985EF9492882ACF035B2D7984C"><enum>(A)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">practitioner</header-in-text>.—The term</quote> and inserting “<header-in-text level="subsection" style="OLC">practitioner</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8BDFD240864245ED93874DC1111BDBF6"><subparagraph id="id9E63A3AA012E485EA982243E2EA12720"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id21FCE9019D124E78BE628E5C56B00F45"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id97B0B5D2B3964FB981665C40671E2648"><subparagraph id="id95AFC0B901D14F9BBA5D5002E45F359D"><enum>(B)</enum><header>Expansion</header><text>The Secretary, after consulting with stakeholders regarding services that are clinically appropriate, may expand the types of practitioners who may furnish telehealth services to include any health care professional that is eligible to bill the program under this title for their professional services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id5475547682FD45D1999C7A383EB20C49"><enum>(c)</enum><header>Retention of additional services and subregulatory process for modifications following emergency period</header><text>Section 1834(m)(4)(F) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)</external-xref>) is amended—</text><paragraph id="id395E6FE5820B415BBE089CC7CDB467A8"><enum>(1)</enum><text>in clause (i), by inserting <quote>and clause (iii)</quote> after <quote>paragraph (8)</quote>;</text></paragraph><paragraph id="id3FB07DA3473E4384BB87821D5B046E90"><enum>(2)</enum><text>in clause (ii), by striking <quote>The Secretary</quote> and inserting <quote>Subject to clause (iii), the Secretary</quote>; and</text></paragraph><paragraph id="id7D2997FAAE824E87B6A6226AA642675B"><enum>(3)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idED9856CFD5504918B039C091B1C9767C"><clause id="id9ABF234A2E9543409057C0B3B49466CD"><enum>(iii)</enum><header>Retention of additional services and subregulatory process for modifications following emergency period</header><text>With respect to telehealth services furnished after the last day of the emergency period described in section 1135(g)(1)(B), the Secretary may—</text><subclause id="idADD82CFCF079431CA89A65B9D49FA601"><enum>(I)</enum><text>retain as appropriate the expanded list of telehealth services specified in clause (i) pursuant to the waiver authority under section 1135(b)(8) during such emergency period; and</text></subclause><subclause id="id500ED01260D541EFB130B75F0EFC2D13"><enum>(II)</enum><text>retain the subregulatory process used to modify the services included on the list of such telehealth services pursuant to clause (ii) during such emergency period.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD3DBACA4F4D942488B7FDFE2016484A0"><enum>(d)</enum><header>Enhancing telehealth services for federally qualified health centers and rural health clinics</header><text>Section 1834(m)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(8)</external-xref>) is amended—</text><paragraph id="id5C04BBEB8801404FA0CD86765681CC34"><enum>(1)</enum><text>in the paragraph heading by inserting <quote><header-in-text level="paragraph" style="OLC">and after</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">during</header-in-text></quote>;</text></paragraph><paragraph id="id9D78A6C13A9A4951B4B10C95EC178B4D"><enum>(2)</enum><text>in subparagraph (A), in the matter preceding clause (i), by inserting <quote>and after</quote> after <quote>During</quote>; and</text></paragraph><paragraph id="id2704DFE5CDDF41FF85C4749C4C3B609A"><enum>(3)</enum><text>in the first sentence of subparagraph (B)(i), by inserting <quote>and after</quote> after <quote>during</quote>.</text></paragraph></subsection><subsection id="id89DA51C5404C461A9156098D9DC79420"><enum>(e)</enum><header>Use of telehealth, as clinically appropriate, To conduct face-to-Face encounter for hospice care</header><text>Section 1814(a)(7)(D)(i)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(7)(D)(i)(II)</external-xref>) is amended by inserting <quote>and after such emergency period as clinically appropriate</quote> after <quote>1135(g)(1)(B)</quote>.</text></subsection><subsection id="idD1F360D0EB6C474786B444658FAC14F9"><enum>(f)</enum><header>Use of telehealth, as clinically appropriate, To conduct face-to-Face clinical assessments for home dialysis</header><text>Clause (iii) of section 1881(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395rr">42 U.S.C. 1395rr(b)(3)(B)</external-xref>) is amended—</text><paragraph id="id78381D37A4D64147B26B62ECE468C7D8"><enum>(1)</enum><text>by moving such clause 4 ems to the left; and</text></paragraph><paragraph id="id412433917C3B4E99B94CFC197E2C6562"><enum>(2)</enum><text>by inserting <quote>and after such emergency period as clinically appropriate</quote> before the period.</text></paragraph></subsection><subsection id="id9E26ED92CB464DD5AB7D1F7776DF8AE8"><enum>(g)</enum><header>Implementation</header><text>Notwithstanding any provision of law, the Secretary may implement the provisions of, and amendments made by, this section by interim final rule, program instruction, or otherwise. </text></subsection></section></legis-body></bill>
