<official-title>To authorize the Secretary of Health and Human Services, acting through the Director of the Center for Mental Health Services of the Substance Abuse and Mental Health Services Administration, to award grants, contracts, or cooperative agreements to facilitate the funding of community-based mental health and substance use disorder services and peer support programs, and for other purposes. </official-title>

<section section-type="section-one" id="HD2B220701EB54CE9BAD68759484E68A3"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Tele-Behavioral Health Services Act</short-title></quote>. </text></section> <section id="H9A67CB9EC314429BA090CFA52FA5B80A"><enum>2.</enum><header>Awards for community-based mental health and substance use disorder services and peer support programs</header> <subsection id="HAB3C0D3125C34A96990A35E50AECBFE9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), acting through the Director of the Center for Mental Health Services of the Substance Abuse and Mental Health Services Administration, shall establish a program (in this Act referred to as the <quote>Program</quote>) to facilitate the funding of community-based mental health and substance use disorder services and peer support programs, including services provided virtually. </text></subsection>
<subsection id="H6996CBFAADDA43A1876D2DD94AB3368C"><enum>(b)</enum><header>Award authority</header><text>In carrying out the Program, the Secretary shall award grants, contracts, or cooperative agreements in accordance with this section. </text></subsection> <subsection id="HEB2551707C5A49D9B342BA2DB6962B81"><enum>(c)</enum><header>Eligible recipients</header><text>The Secretary may make an award under the Program to an eligible recipient determined by the Secretary to be authorized and capable of carrying out a project described in subsection (d). </text></subsection>
<subsection id="id71916c8d62f14aa7b28c50d46170f8bb"><enum>(d)</enum><header>Use of funds</header><text>Funds awarded under the Program may be used to—</text> <paragraph id="H143AC1911FD841DF96CD5B808488FDD8"><enum>(1)</enum><text display-inline="yes-display-inline">identify and coordinate care between programs that provide access to community-based mental health and substance use disorder services for juveniles and assist in the coordination of such services; </text></paragraph>
<paragraph id="H6DAD46896D8D4AAD960AFCC8E6B599CC"><enum>(2)</enum><text display-inline="yes-display-inline">identify and coordinate care between programs that provide access to community-based mental health and substance use disorder services for adults and assist in the coordination of such services; </text></paragraph> <paragraph id="H46C6DA96B6FE4BDDA5A30C97F3EE1C5D"><enum>(3)</enum><text>obtain technology required to provide community-based mental health and substance use disorder services virtually, through audio or video telehealth services; </text></paragraph>
<paragraph id="HBC685487C84B4D3C8DEEDA6B7C4FBA98"><enum>(4)</enum><text display-inline="yes-display-inline">compensate a health care provider or a peer specialist for the provision of community-based mental health and substance use disorder services, including services provided virtually;</text></paragraph> <paragraph id="HADA852CB47BF4F97965869585CA5597A"><enum>(5)</enum><text display-inline="yes-display-inline">provide education assistance to an individual seeking certification as a peer specialist; </text></paragraph>
<paragraph id="HC999A01D1B714F2EAA07582B4BE0155F"><enum>(6)</enum><text display-inline="yes-display-inline">provide for workforce development, recruitment, and retention activities, to train, recruit, and retain peer specialists; </text></paragraph> <paragraph id="id465cbdee8ee54cc8a566cbc5a71c85a6"><enum>(7)</enum><text>support the provision of peer specialist-facilitated mental health and substance use disorder support services on a virtual platform by an entity that, prior to the award, was providing such services in-person; or</text></paragraph>
<paragraph id="idfea9e82085ad44a9896e01a4c10b76ec"><enum>(8)</enum><text>expand or improve virtual, peer specialist-facilitated mental health and substance use disorder support services carried out by the entity prior to the date of enactment of this Act.</text></paragraph></subsection> <subsection id="H487547636E7C4FA6A23FD04AC484CDE2"><enum>(e)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible for an award under the Program, an eligible recipient shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines to be appropriate. </text></subsection>
<subsection id="H9452E30012FC402CA41E7DC35F134FC6"><enum>(f)</enum><header>Guidance</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary shall issue guidance on the requirements an eligible recipient shall take to provide community-based mental health and substance use disorder services.</text></subsection> <subsection id="HDDDE965F370D4F19A17DED45BF18230E"><enum>(g)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">Federal funds awarded to an eligible recipient pursuant to the Program shall be used to supplement, but not supplant, any other Federal, State, or local funds available to such eligible recipient. </text></subsection>
<subsection id="H1D5782762F0F4894B9828EB3D94464F9"><enum>(h)</enum><header>Report</header>
<paragraph id="HFD7F31C502D54F9199B97935BD514EB2"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which funds are distributed under the Program, and annually thereafter, the Secretary shall submit to Congress a report on the Program that includes—</text> <subparagraph id="H88D4D10D2DE641F0B71C001F82E5B3F8"><enum>(A)</enum><text>the number of awards made under the Program;</text></subparagraph>
<subparagraph id="idf9ffe5f734884ee99cf1e2130bfe371b"><enum>(B)</enum><text>the physical location of each awardee selected under the Program;</text></subparagraph> <subparagraph id="HEB90C4CB148F4CF68B2759714674E4C4"><enum>(C)</enum><text>the amount requested and amount awarded for each award under the Program; and</text></subparagraph>
<subparagraph id="id3fde80b8548646d78621cd7897206861"><enum>(D)</enum><text>whether funds were used during the COVID–19 public health emergency.</text></subparagraph></paragraph> <paragraph id="H7F9A646EE7154DCAB1602F3918FE1C7D"><enum>(2)</enum><header>Publication requirement</header><text>On the date on which a report is submitted under paragraph (1) or (2), the Secretary shall publish such report on the website of the Department of Health and Human Services. </text></paragraph></subsection>
<subsection id="H01E2EA2004314BDF9A06EAF5770D3A0B"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the Program $5,000,000 for each of fiscal years 2023 through 2027.</text></subsection> <subsection id="HD83C4AEA72D64B64AEDDEE4E1EB08571"><enum>(j)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HFC49ABBD442945BC85F4007F4F058556"><enum>(1)</enum><header>COVID–19 public health emergency</header><text display-inline="yes-display-inline">The term <term>COVID–19 public health emergency</term> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 27, 2020, with respect to COVID–19. </text></paragraph> <paragraph id="H696AA8227C7F4A44987E36F1591CA4BC"><enum>(2)</enum><header>Eligible recipient</header><text display-inline="yes-display-inline">The term <term>eligible recipient</term> means—</text>
<subparagraph id="H6255FA2910B94441B5F820E35FADF618"><enum>(A)</enum><text>a department of health or a department of public health, in coordination with a State; </text></subparagraph> <subparagraph id="HC40DAF928BBF4AE3BF48B9F275B6E11A"><enum>(B)</enum><text>a nonprofit health program that primarily serves individuals with mental health or substance abuse disorders; </text></subparagraph>
<subparagraph id="H0F822B54738845EB96AA3A32A09E6779"><enum>(C)</enum><text display-inline="yes-display-inline">community-based nonprofit entity, that is a consumer-controlled and is certified in accordance with applicable State law to deliver peer specialist support services at a State or local level; </text></subparagraph> <subparagraph id="H6C44A51B50B44C4B840C4DCF0BDB9CEB"><enum>(D)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), providing service learning and civic-engagement courses for peer specialist training; </text></subparagraph>
<subparagraph id="id807B269929B84A9C91DAC5DF28D9A1F0"><enum>(E)</enum><text>a State or local law enforcement agency or other State first responder agency; or </text></subparagraph> <subparagraph id="idAAA1F50A50534AC7823A0E95CFAC3C3C"><enum>(F)</enum><text>an Indian Tribe or Tribal organization. </text></subparagraph></paragraph>
<paragraph id="H74CBF367AA544B4DB4AA903E7CE29DE5"><enum>(3)</enum><header>Health care provider</header><text display-inline="yes-display-inline">The term <term>health care provider</term> means a certified provider who provides mental health and substance use disorder services.</text></paragraph> <paragraph id="idCF078C90A8354F91A6EE86FF9C00FE49"><enum>(4)</enum><header>Indian Tribe; Tribal organization</header><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given the terms <term>Indian tribe</term> and <term>tribal organization</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph>
<paragraph id="HA77F6B8D6B6F47C3AAE04311D0260C50"><enum>(5)</enum><header>Peer specialist</header><text>The term <term>peer specialist</term> includes—</text> <subparagraph id="HC590CF561F61402692A41BD1E8F40DA5"><enum>(A)</enum><text>a certified peer specialist;</text></subparagraph>
<subparagraph id="HC92441ADA20D4EBE9B5BDF170AD28702"><enum>(B)</enum><text>a peer recovery specialist; and</text></subparagraph> <subparagraph id="HBC3A3A12D81A4E5A8BF249818D1597F5"><enum>(C)</enum><text>a recovery coach.</text></subparagraph></paragraph>
<paragraph id="HBFD7D835F4A34BF6AD2E52635A525C99"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means a State of the United States, the District of Columbia, or any commonwealth, territory, or possession of the United States, or an Indian Tribe. </text></paragraph></subsection></section> </legis-body> </bill>
