which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to reauthorize the South Florida Geographic Program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>South Florida Ecosystem Enhancement Act of 2022</short-title></quote>. </text></section><section id="id7F5798908E374CCA8432848AD23B630B"><enum>2.</enum><header>South Florida program</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="idD0AB6A3915AE47B29AC122D7C945E47E" act-name=""><section section-type="subsequent-section" id="id5A1E0FF111AE49719E61B45F61DA50CF"><enum>125.</enum><header>South Florida</header><subsection id="id40D3E52170EF489F8480ACC28CF888D3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5836265A7AF64AFCAB88A14277691AA2" commented="no"><enum>(1)</enum><header>Science Coordination Group</header><text>The term <term>Science Coordination Group</term> means the South Florida Ecosystem Restoration Science Coordination Group established to support the South Florida Ecosystem Restoration Task Force. </text></paragraph><paragraph commented="no" id="id4466838975F14A2B960EF4DDC724DBEF"><enum>(2)</enum><header>Senior Advisor</header><text>The term <term>Senior Advisor</term> means the Senior Advisor of the South Florida Program.</text></paragraph><paragraph id="id5EFB5E229CDD41C8BC8BCA80FCE99E90"><enum>(3)</enum><header>South Florida</header><text>The term <term>South Florida</term> means—</text><subparagraph id="idAE50F8260C134AA29314674F500EF931"><enum>(A)</enum><text>all land and water within the administrative boundaries of the South Florida Water Management District and adjacent coastal waterbodies, including all coastal water landward of Florida's Coral Reef; and</text></subparagraph><subparagraph id="id7C92E2D643974B75B00402EED0A34329"><enum>(B)</enum><text>Florida's Coral Reef and the associated patch reef, hard-bottom, and seagrass resources.</text></subparagraph></paragraph><paragraph id="id2C9EC701AB204E8E98E32482B2BF9AEF" commented="no"><enum>(4)</enum><header>South Florida Ecosystem Restoration Task Force</header><text>The term <term>South Florida Ecosystem Task Force</term> means the South Florida Ecosystem Restoration Task Force established by section 528(f)(1) of the Water Resources Development Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/303">Public Law 104–303</external-xref>; 110 Stat. 3771).</text></paragraph><paragraph id="id3845BC029E8A4207B9C00C3F3A59DE08" commented="no"><enum>(5)</enum><header>South Florida Ecosystem Restoration Working Group</header><text>The term <term>South Florida Ecosystem Working Group</term> means the working group established by the South Florida Ecosystem Task Force pursuant to section 528(f)(2)(D) of the Water Resources Development Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/303">Public Law 104–303</external-xref>; 110 Stat 3771).</text></paragraph><paragraph id="id5F3C908AA65641F38829C7A666D4F79A"><enum>(6)</enum><header>South Florida Program</header><text>The term <term>South Florida Program</term> means the South Florida Program established within the Water Division of the Region 4 Office of the Environmental Protection Agency. </text></paragraph></subsection><subsection commented="no" id="idE1216009B4EB41E99B13C3FC1C8A221E"><enum>(b)</enum><header>South Florida Ecosystem Restoration Working Group</header><text>The Senior Advisor shall serve as the representative of the Environmental Protection Agency on the South Florida Ecosystem Restoration Working Group.</text></subsection><subsection id="idF1985678FE0B419E9C9485F7ADBC7AE4"><enum>(c)</enum><header>Grant program</header><paragraph id="id9E527D12E86C40C7B3073C6E26673F81"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>South Florida Ecosystem Enhancement Act of 2022</short-title>, the Senior Advisor shall establish a grant program (referred to in this subsection as the <quote>grant program</quote>) to carry out projects to monitor, enhance, or restore water quality, wetlands, aquatic ecosystems, or marine habitat—</text><subparagraph id="id304575F7E30C4B5ABC2E2761A34F548B" commented="no"><enum>(A)</enum><text>in South Florida; and</text></subparagraph><subparagraph id="id09647BD6F0924D3286C3456F7A64F25E" commented="no"><enum>(B)</enum><text>outside of South Florida but within the study area boundaries of—</text><clause id="id65C70596CEB14806BA171209F752BD63" commented="no"><enum>(i)</enum><text>the Indian River Lagoon National Estuary Program authorized under section 320; and</text></clause><clause id="id6EFB78BDAFED4130B065F2C7BA75C362" commented="no"><enum>(ii)</enum><text>the Coastal and Heartland National Estuary Partnership authorized under that section.</text></clause></subparagraph></paragraph><paragraph id="id436F6381199146FA8810C29AE892695C"><enum>(2)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under the grant program is—</text><subparagraph id="id066EB8163B9640B094252646BB2FB108"><enum>(A)</enum><text>a State agency;</text></subparagraph><subparagraph id="idA0460C6A4B1D47F7A484E26A67105D05"><enum>(B)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="idD47D9D6563834B60888D4493DEB3432C"><enum>(C)</enum><text>an institution of higher education;</text></subparagraph><subparagraph id="id9158802A80304A98A2AD02F5228BCBD6"><enum>(D)</enum><text>a federally recognized Indian Tribe; and</text></subparagraph><subparagraph id="id1FDAB21CA6D24A9D91D66F72AB9B71F7"><enum>(E)</enum><text>an entity that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(c) of that Code.</text></subparagraph></paragraph><paragraph id="id689C0279E30D4703B5B4131B34093DF8"><enum>(3)</enum><header>Selection</header><subparagraph commented="no" id="idF0D1C6745AE94C8B90DC84EE12EFD909"><enum>(A)</enum><header>Application</header><text>An eligible entity seeking a grant under the grant program shall submit to the Senior Advisor an application at such time, in such manner, and containing such information as the Senior Advisor may require.</text></subparagraph><subparagraph id="idFC912B1C223947B595A0F79EAB57E21D"><enum>(B)</enum><header>Limitations</header><clause id="idCCEAA71E617A4E3EA3D75A9C13A04A1A"><enum>(i)</enum><header>Location of projects</header><text>Not more than 15 percent of the amounts made available to carry out this subsection for each fiscal year may be awarded for projects that would be carried out in locations described in paragraph (1)(B).</text></clause><clause id="idF284FE229B554B0F959AD6243D59D81A"><enum>(ii)</enum><header>Other sources of funding</header><subclause id="id3CF501799CC74F88AECA01CE99DE7ECB"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), in selecting recipients of grants under the grant program, the Senior Advisor may not award a grant to carry out a water infrastructure activity that has received assistance—</text><item id="id515824B212224A9C924A8D329FB6C6BD"><enum>(aa)</enum><text>from a State water pollution control revolving fund established under title VI;</text></item><item id="id678402F23F1A4490BD55250148B4676A"><enum>(bb)</enum><text>from a State drinking water treatment revolving loan fund established under section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>); or</text></item><item id="id3E8E925C0D464D9E9A897CCAC782B871"><enum>(cc)</enum><text>pursuant to the Water Infrastructure Finance and Innovation Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3901">33 U.S.C. 3901 et seq.</external-xref>).</text></item></subclause><subclause id="id3AE1C0A419C7475D85343C0231DE2DAC"><enum>(II)</enum><header>Exception</header><text>The Senior Advisor may award a grant under the grant program to carry out a separable component of a project described in subclause (I) if grant funds would be used to construct natural features and nature-based features (as those terms are defined in section 1184(a) of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/2289a">33 U.S.C. 2289a(a)</external-xref>)), or to conduct an ecosystem restoration project, that improves habitat and other ecosystem functions.</text></subclause></clause></subparagraph></paragraph><paragraph id="id5F07BD46C54C496A8F7CA679DABF36B2"><enum>(4)</enum><header>Allocation</header><text>Of the amounts made available to carry out this section each fiscal year, not less than 33 percent shall be used to carry out this subsection.</text></paragraph></subsection><subsection id="id596ACD7AA3C648C582191D8F3F0AB05B"><enum>(d)</enum><header>Support for South Florida ecosystem restoration special projects and activities</header><paragraph id="idC374A3BF0F064A2F8989D449F0B85444"><enum>(1)</enum><header>Interagency agreement</header><text>The Senior Advisor shall, on an annual basis, develop and execute interagency agreements or cooperative agreements with appropriate Federal, State, local, or Tribal agencies to provide funding for 1 or more special projects or activities within South Florida on the recommendation of the South Florida Ecosystem Restoration Task Force.</text></paragraph><paragraph commented="no" id="idD944271551894359A3862C2089A7D3F5"><enum>(2)</enum><header>Coordination</header><text>The Senior Advisor shall coordinate with the Senior Advisor of the Office of Everglades Restoration Initiatives of the Department of the Interior to annually solicit and receive a priority list of special projects or activities that enhance the capacity of Federal, State, local, or Tribal agencies participating in the South Florida Ecosystem Restoration Task Force, the South Florida Ecosystem Restoration Working Group, and the Science Coordination Group to fulfill the mandate under section 528 of the Water Resources Development Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/303">Public Law 104–303</external-xref>; 110 Stat. 3767), title VI of the Water Resources Development Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/541">Public Law 106–541</external-xref>; 114 Stat. 2680), and other applicable law to restore the South Florida ecosystem.</text></paragraph><paragraph commented="no" id="idCFE8DA3077914C37B92F1304C7A3CD3A"><enum>(3)</enum><header>Allocation</header><text>Of the amounts made available to carry out this section each fiscal year, not less than 50 percent shall be used to carry out this subsection.</text></paragraph></subsection><subsection id="id39C262B7B0FE4E74AFFF5248AB333F21"><enum>(e)</enum><header>Education grants</header><paragraph id="idBF224E2E3EE34DE59B7CACEAD453D608"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of the <short-title>South Florida Ecosystem Enhancement Act of 2022</short-title>, the Senior Advisor shall establish an education grant program (referred to in this subsection as the <quote>grant program</quote>) to support educational and environmental literacy efforts focused on regional bodies of water in South Florida.</text></paragraph><paragraph id="id745451D2C2F54C8F9552FA9AEB3FD708"><enum>(2)</enum><header>Eligible entities</header><text>An entity eligible to receive a grant under the grant program is an entity focused on public engagement, environmental literacy, or education efforts that is—</text><subparagraph id="id7B15E0965B8C48778351B8AF9DFF16C3"><enum>(A)</enum><text>a State, local, or Tribal government entity, including a public school district;</text></subparagraph><subparagraph id="idE2ECB1059953418FA915E3945A8321C5"><enum>(B)</enum><text>an entity that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(c) of that Code; or</text></subparagraph><subparagraph id="idA08F51CA56314A0B96616ECB4610519B"><enum>(C)</enum><text>an institution of higher education.</text></subparagraph></paragraph><paragraph id="id9303E4AC71B6413AB51AD7EA37B03D3E"><enum>(3)</enum><header>Use of funds</header><text>Each fiscal year, the Senior Advisor shall award grants under the grant program for public engagement, environmental literacy, and education efforts with respect to any of the following:</text><subparagraph id="id535ae9fa939b4fa4a1675e9bfea86aa5"><enum>(A)</enum><text>Biscayne Bay.</text></subparagraph><subparagraph id="idcbab1017872043339398bbfcd2e7fa09"><enum>(B)</enum><text>Caloosahatchee River and Estuary.</text></subparagraph><subparagraph id="idd38cc9f5ceb445c5bb70f5cae5122814"><enum>(C)</enum><text>Charlotte Harbor.</text></subparagraph><subparagraph id="id13e0cba79dd549e9a3e90d0db303717e"><enum>(D)</enum><text>The Everglades.</text></subparagraph><subparagraph id="id8E5DDA2288DB46B1AB46DD5C1156CCE9"><enum>(E)</enum><text>Everglades Headwaters.</text></subparagraph><subparagraph id="ida19ed42cf2974ccd815eb9f7337ee704"><enum>(F)</enum><text>Florida Bay.</text></subparagraph><subparagraph id="id93182b5f7f64405b8d6b600f4cf0e907"><enum>(G)</enum><text>Florida’s Coral Reef.</text></subparagraph><subparagraph id="id9817D0286E8A45FBB9505119355F0D1F"><enum>(H)</enum><text>Lake Okeechobee.</text></subparagraph><subparagraph id="id763F03875F15469192A6197571822435"><enum>(I)</enum><text>Loxahatchee River and Lake Worth Lagoon.</text></subparagraph><subparagraph id="idcefa9cec322844cf923b40e922c55251"><enum>(J)</enum><text>Indian River Lagoon.</text></subparagraph><subparagraph id="id684cefc87d0843cdab41ee74dd12536a"><enum>(K)</enum><text>St. Lucie River and Estuary.</text></subparagraph></paragraph><paragraph id="idAA2F5F35B309445780CAEC6E146F7952"><enum>(4)</enum><header>Selection</header><subparagraph commented="no" id="id18313508B69042F2B43FC5E4A5733D67"><enum>(A)</enum><header>Application</header><text>An eligible entity seeking a grant under the grant program shall submit to the Senior Advisor an application at such time, in such manner, and containing such information as the Senior Advisor may require.</text></subparagraph><subparagraph commented="no" id="id6DDEE672557D40A88C4CE2BF40EDA964"><enum>(B)</enum><header>Priority consideration</header><text>In selecting entities to be awarded grants under the grant program, the Senior Advisor shall give priority to applications that seek to fund field trips for socially disadvantaged students in public elementary schools and public secondary schools to access publicly protected lands and natural resources.</text></subparagraph></paragraph><paragraph id="idB75EC86EAB5A4C919C36544C374C8671"><enum>(5)</enum><header>Cost-share</header><subparagraph id="idABD4065887A4469F8E4FD87FA27B852C"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Federal share of a project carried out using a grant under the grant program may not exceed 50 percent of the total cost of the project.</text></subparagraph><subparagraph id="id82C5962D613144CBBA1A3DD693DA7351"><enum>(B)</enum><header>Waiver</header><text>The Senior Advisor may waive the Federal share requirement under subparagraph (A) for projects carried out to support efforts described in paragraph (4)(B).</text></subparagraph></paragraph><paragraph id="idB580E91DF995413182158F98090565B7"><enum>(6)</enum><header>Allocation</header><text>Of the amounts made available to carry out this section each fiscal year, the Senior Advisor may use not more than 1 percent to carry out this subsection.</text></paragraph></subsection><subsection id="idAD0522C34FF44D0595C11BD64363C404"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="idE897DFDAC1AB47FABFD4C2F73899FDD2"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator $50,000,000 for each of fiscal years 2022 through 2026 to carry out this section.</text></paragraph><paragraph id="id65A853804A3B4922A2A12934740F9118"><enum>(2)</enum><header>Administrative costs</header><text>Of the amounts made available to carry out this section under paragraph (1) each fiscal year, the Senior Advisor may use not more than 2 percent for administrative costs.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
