<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3670</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220216">February 16, 2022</action-date><action-desc><sponsor name-id="S345">Mr. Johnson</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify that agencies of the Department of Health and Human Services do not have the authority to regulate the practice of medicine.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Right to Treat Act</short-title></quote>.</text></section><section id="id8EF3D6568A9644D18EBA9C2CD8AA77EC"><enum>2.</enum><header>Scope of authorities</header><text display-inline="no-display-inline">Notwithstanding any other provision of law—</text><paragraph id="idF51C119844734CE9B8044EC2E19B4E91"><enum>(1)</enum><text display-inline="yes-display-inline">no Federal agency, including the Food and Drug Administration, the National Institutes of Health, and the Centers for Disease Control and Prevention, shall have the authority to regulate the practice of medicine; and</text></paragraph><paragraph id="id9890419BC66D4AE2ACCCD97535F64817"><enum>(2)</enum><text>no Federal law, rule, regulation, or policy shall prohibit or restrict the lawful prescribing or disbursing of any drug that is approved by the Food and Drug Administration, or that is available pursuant to section 561B of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360bbb-0a">21 U.S.C. 360bbb–0a</external-xref>).</text></paragraph></section></legis-body></bill>
