<official-title>To amend title 54, United States Code, to establish within the National Park Service the United States African-American Burial Grounds Preservation Program, and for other purposes.</official-title>

<section section-type="section-one" id="HABAAF1BED67B427AA34F367F6FBAEB6C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>African-American Burial Grounds Preservation Act</short-title></quote>.</text></section> <section commented="no" section-type="subsequent-section" id="HDF1AB70984A34010A894A5186A23B218"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph commented="no" id="H6FB42959ED9C42BEB9BF0D4FA8D82F18"><enum>(1)</enum><text>during the period beginning in 1619 and ending in 1865, millions of African Americans throughout the United States were enslaved;</text></paragraph> <paragraph commented="no" id="H928DCA69AA1949CFB34937BDE4192C3F"><enum>(2)</enum><text>slaveholders often—</text>
<subparagraph commented="no" id="id566BCFD1A7894D018F6C4CA6AD6A72C3"><enum>(A)</enum><text>controlled where and how deceased slaves were buried; and </text></subparagraph> <subparagraph commented="no" id="idC2794C720B97437683A8CEE891C463D9"><enum>(B)</enum><text>prohibited the burial of slaves on valuable land;</text></subparagraph></paragraph>
<paragraph commented="no" id="id4753737EBEAE446D800622E24F523490"><enum>(3)</enum><text>as a result of the practices described in paragraph (2), slave burial grounds were often confined to remote areas or marginal property;</text></paragraph> <paragraph commented="no" id="H35F2F72BE739478B9BD600BD58861FFC"><enum>(4)</enum><text>slave burial grounds—</text>
<subparagraph commented="no" id="idFF64026C99954CB99E26D7FA1778F9B3"><enum>(A)</enum><text>were rarely documented; and </text></subparagraph> <subparagraph commented="no" id="id93A0490AF5614186A77BC16F314849C7"><enum>(B)</enum><text>infrequently appear on historical maps;</text></subparagraph></paragraph>
<paragraph commented="no" id="id20CA351BE1F844C9B307FD84CD18F2F1"><enum>(5)</enum><text>a lack of accurate information is typical of African-American cemeteries originating before the Civil War;</text></paragraph> <paragraph commented="no" id="HED2A1A4037574ED697DC6752E391CA84"><enum>(6)</enum><text>following the end of slavery, many African-American families continued to face restrictions on where the deceased could be buried; </text></paragraph>
<paragraph commented="no" id="id83727DC684F542B08122CFEA4464AF60"><enum>(7)</enum><text>across many areas of the United States, local laws segregated burial sites by race;</text></paragraph> <paragraph commented="no" id="id2F57E44B91B94607B8FBF0E1D1FA3E00"><enum>(8)</enum><text>African-American burial grounds often failed to receive the type of maintenance and recordkeeping that predominantly White burial grounds enjoyed;</text></paragraph>
<paragraph commented="no" id="H5C38D37D36904E72B04163088E867FE4"><enum>(9)</enum><text>many African-American burial grounds from before and after the Civil War are in a state of disrepair or inaccessibility due to overgrowth of vegetation, crumbling physical structures, and other challenges;</text></paragraph> <paragraph commented="no" id="H5B855575028743D3A70CFB74C375C6BD"><enum>(10)</enum><text>there is no official national record or database for African-American burial ground locations;</text></paragraph>
<paragraph commented="no" id="idF94AB851275947D3A9CBBC694C4D79EC"><enum>(11)</enum><text>the location of many African-American burial sites is unknown;</text></paragraph> <paragraph commented="no" id="id07322353909D47ECBB24BA1F6791B5B8"><enum>(12)</enum><text>as a result of the issues described in paragraphs (10) and (11), the family members and descendants of the individuals interred are unable to visit the burial sites to honor and remember their ancestors;</text></paragraph>
<paragraph commented="no" id="H1D60F488C93E4109A06EEBE1BA11BEC8"><enum>(13)</enum><text>abandoned African-American burial grounds are often discovered when construction projects inadvertently disturb human remains, which slows or halts completion of the projects;</text></paragraph> <paragraph commented="no" id="HCFB6C3B5725F469D838CBC29A8D858B8"><enum>(14)</enum><text>the presence and location of historic African-American burial grounds should be recorded; </text></paragraph>
<paragraph commented="no" id="id0CEE816684BE42A0BE1FA0B0AE2DA8FB"><enum>(15)</enum><text>there should be coordinated national, State, local, and Tribal efforts to preserve and restore African-American burial grounds;</text></paragraph> <paragraph commented="no" id="H032ACE98D64B497FB03A35B45EB3A75F"><enum>(16)</enum><text>African-American burial grounds are an integral component of the heritage of the United States; and</text></paragraph>
<paragraph commented="no" id="HEB88B2BB77ED4F218DFF2E1DBD014919"><enum>(17)</enum><text display-inline="yes-display-inline">establishing a program to preserve previously abandoned, underserved, and other African-American burial grounds would help communities identify and record burial grounds and preserve local history, while better informing development decisions and community planning.</text></paragraph></section> <section id="H6F45BAD6506742D29DBDEF155890053F"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to authorize the National Park Service to coordinate and facilitate Federal activities and non-Federal activities to identify, interpret, research, preserve, and record unmarked, previously abandoned, underserved, and other African-American burial grounds.</text></section>
<section id="H6B030F95495F4D51A192F8D780D5AE04"><enum>4.</enum><header>United States African-American Burial Grounds Preservation Program</header>
<subsection id="H5AD83131791D41F685777F2916909875"><enum>(a)</enum><header>In general</header><text>Subdivision 1 of division B of subtitle III of title 54, United States Code, is amended by inserting after chapter 3085 the following:</text> <quoted-block style="USC" id="H48117887A9474D6B8B183E7BCB6105C5"> <chapter id="H661D35428A7841A8888CF46E21451BBB"><enum>3086</enum><header>United States African-American Burial Grounds Preservation Program</header> <toc> <toc-entry level="section">Sec. </toc-entry> <toc-entry level="section" idref="HF1DF1444C1DC4D15B5220D045111B4E2">308601. Definitions. </toc-entry> <toc-entry level="section" idref="HF45BC8042CCC43B6A07CC2DDB9E108FB">308602. United States African-American Burial Grounds Preservation Program. </toc-entry> <toc-entry level="section" idref="H24390EDCBBA6429D900624D03DBD09BE">308603. Authority to make grants. </toc-entry> <toc-entry level="section" idref="H00DD6B76284646A1A4D4C46FEAB79D9B">308604. Cooperative agreements and memoranda of understanding. </toc-entry> <toc-entry level="section" idref="H7D379C8B93D841AD9D3064A8047F5ACB">308605. Private property protection. </toc-entry></toc> <section id="HF1DF1444C1DC4D15B5220D045111B4E2"><enum>308601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
<paragraph id="H4BFB8EF4BF4D448981EF3CEED648E256"><enum>(1)</enum><header>Burial ground</header><text display-inline="yes-display-inline">The term <term>burial ground</term> means any natural or prepared physical location, whether originally below, on, or above the surface of the earth, into which human remains are deposited as a part of the death rite or ceremony of a culture.</text></paragraph> <paragraph id="H8393BED412F344AEA4F43E72176FA283"><enum>(2)</enum><header>Historic</header><text display-inline="yes-display-inline">The term <term>historic</term>, with respect to a property, means a property that can reasonably be considered to date back at least 50 years.</text></paragraph>
<paragraph id="H36ED1FA5D73E45A0BFEB0C8B242E3C7C"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the United States African-American Burial Grounds Preservation Program established under section 308602(a). </text></paragraph></section> <section id="HF45BC8042CCC43B6A07CC2DDB9E108FB"><enum>308602.</enum><header>United States African-American Burial Grounds Preservation Program</header> <subsection id="HD0BCFF31CB7246D1AB7367C979E09E81"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish within the Service, in accordance with this chapter, a program to be known as the <quote>United States African-American Burial Grounds Preservation Program</quote>. </text></subsection>
<subsection id="HCE92DC2FB85D4751B1EAA12EA1058017" commented="no"><enum>(b)</enum><header>Duties of Secretary</header><text>In carrying out the Program, the Secretary, in consultation with the National Trust for Historic Preservation and members of the African-American heritage community, shall develop a program for the provision of grants in accordance with section 308603(a).</text></subsection> <subsection id="H87C27D43401B4E29904164398B1A747F"><enum>(c)</enum><header>Donations</header><text display-inline="yes-display-inline">The Secretary may accept monetary donations to further the purposes of this chapter.</text></subsection>
<subsection id="HEBE8D50DA8B340E990BA6BB14F0D3073"><enum>(d)</enum><header>Consent of private property owner required</header><text display-inline="yes-display-inline">Burial grounds shall only be considered for a grant under the Program—</text> <paragraph id="H2880E2F6220C4A0DB9FDDFC2918D3CFB"><enum>(1)</enum><text>with the consent of the property owner; and</text></paragraph>
<paragraph id="HD968A7C8CE4B41929976184C88E79C55"><enum>(2)</enum><text>at the request of an individual, landowner, private or nonprofit organization, State, Tribal, or local government, or other entity.</text></paragraph></subsection></section> <section id="H24390EDCBBA6429D900624D03DBD09BE"><enum>308603.</enum><header>Authority to make grants</header> <subsection id="id65FEA6AF00FC44FD9D07BD68DCB427B4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may make grants to other Federal agencies, State, local, and Tribal governments, other public entities, educational institutions, historic preservation groups, and private nonprofit organizations in accordance with this chapter for—</text>
<paragraph id="HF18E63467F5A4CCFBF45023DEE8895D4"><enum>(1)</enum><text display-inline="yes-display-inline">the identification of historic African-American burial grounds that may qualify for the Program;</text></paragraph> <paragraph id="HC56F7162D59944488C8C22D14E9FD524"><enum>(2)</enum><text display-inline="yes-display-inline">the preservation and restoration of African-American burial grounds;</text></paragraph>
<paragraph id="HB4EA47D30C074ECAA3FF24E93EB3E68E"><enum>(3)</enum><text display-inline="yes-display-inline">the interpretation of African-American burial grounds; and</text></paragraph> <paragraph id="H105D7CB4569D42368C4E8ADC344DA378"><enum>(4)</enum><text display-inline="yes-display-inline">related research and documentation for historic African-American burial grounds.</text></paragraph></subsection>
<subsection id="id6ccdcf3747c04228beb232d98fcd706e"><enum>(b)</enum><header>Funding</header>
<paragraph id="id5CC85BA4F174469DA43198CF371EAC91"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this section $3,000,000 for each of fiscal years 2023 through 2027.</text></paragraph> <paragraph id="idAC1C4BE34B8345B8A4A0D7253821BD5E"><enum>(2)</enum><header>Availability</header><text>Any amounts made available for a fiscal year under paragraph (1) that are not used during that fiscal year shall be available for use under this section during any subsequent fiscal year. </text></paragraph></subsection></section>
<section id="H00DD6B76284646A1A4D4C46FEAB79D9B"><enum>308604.</enum><header>Cooperative agreements and memoranda of understanding</header><text display-inline="no-display-inline">The Secretary may enter into cooperative agreements and memoranda of understanding with, and provide technical assistance to, the heads of other Federal agencies, States, units of local government, Tribal governments, regional governmental bodies, nonprofit organizations, educational institutions, and private entities—</text> <paragraph id="idB9338DD8FAFC4A9CB4E5DEA5E2DF2D7C"><enum>(1)</enum><text display-inline="yes-display-inline">to achieve the purposes of this chapter; and </text></paragraph>
<paragraph id="idF88D0D2D86CB4F2688CCD2EE185B559B"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure effective coordination of the Federal elements and non-Federal elements provided a grant or other assistance under the Program with System units and programs of the Service.</text></paragraph></section> <section id="H7D379C8B93D841AD9D3064A8047F5ACB"><enum>308605.</enum><header>Private property protection</header><text display-inline="no-display-inline">Nothing in this chapter—</text>
<paragraph id="H0CDE43029AC4427AAD2296CBDFE3B314"><enum>(1)</enum><text>authorizes the Secretary to require or affect the management or use of private property without the written consent of the owner of the private property; or</text></paragraph> <paragraph id="H26B185DE901E413CA432F67F4E3CE600"><enum>(2)</enum><text>prohibits the Secretary from providing land management guidance or requirements relating to private property as a condition of a grant provided to the owner of the private property under this chapter.</text></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
