<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 3665</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220216">February 16, 2022</action-date><action-desc><sponsor name-id="S252">Ms. Collins</sponsor> (for herself, <cosponsor name-id="S403">Ms. Sinema</cosponsor>, and <cosponsor name-id="S363">Mr. King</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize certain aliens seeking asylum to be employed in the United States while their applications are being adjudicated.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6EEC771847EB491AA2672F4B4365FB57"><section section-type="section-one" id="H906187F08E5F4EE489CE8D8992D80896"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Asylum Seeker Work Authorization Act of 2022</short-title></quote>.</text></section><section id="H5954A4800DAA467B90F2B054E03E5017"><enum>2.</enum><header>Employment authorization for aliens seeking asylum</header><text display-inline="no-display-inline">Section 208(d)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(d)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCB3E5B8ABDFC4DA6BEBE0A1AC9F5C759"><paragraph id="H8F465DBD4CBC422B9653A3D6255E1CD4"><enum>(2)</enum><header>Employment authorization</header><subparagraph id="HF890523B6F1E4B25B2766496346C261F"><enum>(A)</enum><header>Eligibility</header><text>The Secretary of Homeland Security shall authorize employment for an applicant for asylum—</text><clause id="id7BDE72873EC344D3BB9DAB11331AEB25"><enum>(i)</enum><text>who is not in detention;</text></clause><clause id="id8390A0AE52B74A4FBFE59656247A93D3"><enum>(ii)</enum><text>whose application for asylum has not been determined frivolous; and</text></clause><clause id="id1D6D6BF4158B496597F9EB13EB86CD09"><enum>(iii)</enum><text>with respect to whom the procedures required under paragraph (5)(A)(i) have been completed.</text></clause></subparagraph><subparagraph id="HB69C54B744034921B9FE2F7E75D007B3"><enum>(B)</enum><header>Application</header><text>The Secretary may not grant employment authorization under this paragraph to an applicant for asylum who is not otherwise eligible for employment authorization until 30 days after the date on which the applicant filed an application for asylum.</text></subparagraph><subparagraph id="H0A124E50213F4F9E9E1E48DD860B5EB2"><enum>(C)</enum><header>Term</header><text>Employment authorization under this paragraph—</text><clause id="H60CD575F6C5D47A9A3E69448C321A601"><enum>(i)</enum><text>shall be for a period of 1 year; and</text></clause><clause id="H03EB929195C5496295030D006D25B337"><enum>(ii)</enum><text>shall be renewable for additional 1-year periods while the applicant’s asylum claim is being adjudicated, including administrative or judicial review.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
