<section id="id609EFF273A464AAAB2C6B68CCAAF5784"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id023de4bbef5c40da85a3dc34a191dcbd"><enum>(1)</enum><header>Algorithmic recommendation system</header><text>The term <term>algorithmic recommendation system</term> means a fully or partially automated system used to suggest, promote, or rank information.</text></paragraph> 
<paragraph id="idf6e11e2420aa4780b415ff315db05ebc" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Covered platform</header><text>The term <term>covered platform</term> means a commercial software application or electronic service that connects to the internet and that is used, or is reasonably likely to be used, by a minor.</text></paragraph> <paragraph id="idfaf2862f24e744589f877656140f7263"><enum>(3)</enum><header>Minor</header><text>The term <term>minor</term> means an individual who is age 16 or younger.</text></paragraph> 
<paragraph id="idb13d2eca50444ea8b2df91ad325e1e1e"><enum>(4)</enum><header>Parent</header><text>The term <term>parent</term> includes a legal guardian or an individual with legal custody over a child.</text></paragraph> <paragraph id="id2467575490664DE493579CEDDCA1AAEC"><enum>(5)</enum><header>Personal data</header><text>The term <term>personal data</term> means information that identifies or is linked or reasonably linkable to an individual, household, or consumer device.</text></paragraph></section> 
<section id="id108df14bb3184493b654ca870a6b0581"><enum>3.</enum><header>Duty of care</header> 
<subsection id="idcef425ba02cb4b909fe79ab650b7bc28"><enum>(a)</enum><header>Best interests</header><text>A covered platform has a duty to act in the best interests of a minor that uses the platform's products or services.</text></subsection> <subsection id="idd7834dbb0b5b4a0bb100291dbe7cece4"><enum>(b)</enum><header>Prevention of harm to minors</header><text>In acting in the best interests of minors, a covered platform has a duty to prevent and mitigate the heightened risks of physical, emotional, developmental, or material harms to minors posed by materials on, or engagement with, the platform, including—</text> 
<paragraph id="id16ab97dcc1104b09ae675639d8992e43"><enum>(1)</enum><text>promotion of self-harm, suicide, eating disorders, substance abuse, and other matters that pose a risk to physical and mental health of a minor;</text></paragraph> <paragraph id="id453f7482cd35405eb36d2885977d7275"><enum>(2)</enum><text>patterns of use that indicate or encourage addiction-like behaviors;</text></paragraph> 
<paragraph id="id0bfdf641316e4fa6a04935a27022da33"><enum>(3)</enum><text>physical harm, online bullying, and harassment of a minor;</text></paragraph> <paragraph id="ida008c5d5f0c2416f8c115b5ce8aa439a"><enum>(4)</enum><text>sexual exploitation, including enticement, grooming, sex trafficking, and sexual abuse of minors and trafficking of online child sexual abuse material;</text></paragraph> 
<paragraph id="id5f786385a276485ab1677410719d81db"><enum>(5)</enum><text>promotion and marketing of products or services that are unlawful for minors, such as illegal drugs, tobacco, gambling, or alcohol; and</text></paragraph> <paragraph id="id8057ebf8502c4bb2b84789891f8cdd40"><enum>(6)</enum><text>predatory, unfair, or deceptive marketing practices.</text></paragraph></subsection></section> 
<section id="id14c8f4b1b6ae435785bf37957bf1e677"><enum>4.</enum><header>Safeguards for minors</header> 
<subsection id="id987db8209cf949eaaf50fa3c71144975"><enum>(a)</enum><header>Safeguards for minors</header> 
<paragraph id="idb655e62153c44fc2a7989f6d2863736f"><enum>(1)</enum><header>In general</header><text>A covered platform shall provide a minor, or a parent acting on a minor's behalf, with readily accessible and easy-to-use safeguards to control their experience and personal data on the covered platform, including settings to—</text> <subparagraph id="id5e81e6ac672c4312a1f41888699ee626"><enum>(A)</enum><text>limit the ability of other individuals to contact or find a minor, in particular adults with no relationship to the minor;</text></subparagraph> 
<subparagraph id="id8cc8a53a579948b9adc250290e14ff66"><enum>(B)</enum><text>prevent other individuals from viewing the minor’s personal data collected by or shared on the covered platform, in particular restricting public access to personal data;</text></subparagraph> <subparagraph id="ida9feede3c2e74187ac050f45ed743ce6"><enum>(C)</enum><text>limit features that increase, sustain, or extend use of the covered platform by a minor, such as automatic playing of media, rewards for time spent on the platform, and notifications;</text></subparagraph> 
<subparagraph id="id2ca64e96ffcb4fb590debdd6817aff7c"><enum>(D)</enum><text>opt out of algorithmic recommendation systems that use a minor’s personal data;</text></subparagraph> <subparagraph id="id067122c9e781455bab575b05a38523bf"><enum>(E)</enum><text>delete the minor's account and request removal of personal data;</text></subparagraph> 
<subparagraph id="id5b146fc37cb948e19b44f2a9daf2e476"><enum>(F)</enum><text>restrict the sharing of the geolocation of a minor and to provide notice regarding the tracking of a minor’s geolocation; and</text></subparagraph> <subparagraph id="id0f4f74e7ddef4be3b98b58b2a76dd39f"><enum>(G)</enum><text>limit time spent by a minor on the covered platform.</text></subparagraph></paragraph> 
<paragraph id="idf140be658e9845dc92e002fb3e6ee4c4"><enum>(2)</enum><header>Default safeguard settings for minors</header><text>A covered platform shall provide that, in the case of a user that the platform knows or reasonably believes to be a minor, the default setting for any safeguard described under paragraph (1) shall be the strongest option available.</text></paragraph> <paragraph id="idf57382d0dde140fab0e178a0e7040f85"><enum>(3)</enum><header>Accessibility for minors</header><text>With respect to safeguards described under paragraph (1), a covered platform shall provide information and control options in a manner that is age appropriate and does not encourage minors to weaken or turn off safeguards.</text></paragraph></subsection> 
<subsection id="id18a80a9dd1474ea8843ded0c28dba7d5"><enum>(b)</enum><header>Parental tools</header> 
<paragraph id="id994148d094c5414daae7bc3b67208a7e"><enum>(1)</enum><header>Parental tools</header><text>A covered platform shall provide readily accessible and easy-to-use parental tools for parents to appropriately supervise the use of the covered platform by a minor.</text></paragraph> <paragraph id="ida2d2d0991ecc4045831b7e8f3b89a713"><enum>(2)</enum><header>Requirements</header><text>The parental tools provided by a covered platform shall include—</text> 
<subparagraph id="id963ed2f851a3460a864f610bba43de39"><enum>(A)</enum><text>the ability to control privacy and account settings, including the safeguards established under subsection (a)(1);</text></subparagraph> <subparagraph id="id0f2a83c27b9440569f04b7be8a248327"><enum>(B)</enum><text>the ability to restrict purchases and financial transactions by a minor;</text></subparagraph> 
<subparagraph id="id04AEE5E44974412FAF68BF54246088D1"><enum>(C)</enum><text>the ability to track total time spent on the platform;</text></subparagraph> <subparagraph id="id9A1A662F6AEF4626B9359AD86D05381A"><enum>(D)</enum><text>a clear and conspicuous mechanism for parents to opt out of or turn off any default parental tools put in place by the covered platform; and</text></subparagraph> 
<subparagraph id="id65B4EBACB89C44B7AD22CE77D8323610"><enum>(E)</enum><text>access to other information regarding a minor's use of a covered platform and control options necessary to a parent's ability to address the harms described in section 3(b).</text></subparagraph></paragraph> <paragraph id="id33d675aceddd4e1cb7a05ca837ab0347"><enum>(3)</enum><header>Notice to minors</header><text>A covered platform shall provide clear and conspicuous notice to a minor when parental tools are in effect.</text></paragraph> 
<paragraph id="id508B7408A58742F4A11213E882EBA2A7"><enum>(4)</enum><header>Default parental tools</header><text>A covered platform shall provide that, in the case of a user that the platform knows or reasonably believes to be a minor, parental tools shall be enabled by default.</text></paragraph></subsection> <subsection id="id433ad1a7e5fb4244aaa40973b05a0520"><enum>(c)</enum><header>Reporting mechanism</header> <paragraph id="id65b67f67ad3243d9b7cf782863e58808"><enum>(1)</enum><header>Parental reports</header><text>A covered platform shall provide minors and parents with—</text> 
<subparagraph id="id3FE901FBB8024B55896DA95A578E2C91"><enum>(A)</enum><text>a readily accessible and easy-to-use means to submit reports of harms to a minor, including harms described in section 3(b);</text></subparagraph> <subparagraph id="id6C9CB7C0792E4055B24183E5E1C5FBC0"><enum>(B)</enum><text>an electronic point of contact specific to matters involving harms to a minor; and </text></subparagraph> 
<subparagraph id="id8E51D82A63EE406CB9F2622806BACEA8"><enum>(C)</enum><text>confirmation of the receipt of such a report and a means to track a submitted report.</text></subparagraph></paragraph> <paragraph id="id6bcaac901324417b9920fa816d2d5d66"><enum>(2)</enum><header>Timing</header><text>A covered platform shall establish an internal process to receive and respond to reports in a reasonable and timely manner.</text></paragraph></subsection> 
<subsection id="id43fdd5b4801a42ddb8a75da3ecf4fbd7"><enum>(d)</enum><header>Illegal content</header><text>A covered platform shall not facilitate the advertising of products or services to minors that are illegal to sell to minors based on applicable State or Federal law.</text></subsection></section> <section id="idb91c9bd3973342598ea0c1ec9519b657"><enum>5.</enum><header>Disclosure</header> <subsection id="id0822153ecd4f4c48b9487e1ec3111aec"><enum>(a)</enum><header>Notice</header> <paragraph id="id96f3b4f40f304f74ba5698715d041e22"><enum>(1)</enum><header>Registration</header><text>Prior to registration, use, or purchase of a covered platform by a minor, the platform shall provide clear, accessible, and easy-to-understand—</text> 
<subparagraph id="id1913dc8e52ee412aafa4858044368c26"><enum>(A)</enum><text>notice of the policies and practices of the covered platform with respect to personal data and safeguards for minors;</text></subparagraph> <subparagraph id="idccd7e87013bb4295aee7fa847a395a20"><enum>(B)</enum><text>information about how to access the safeguards and parental tools required under section 4; and</text></subparagraph> 
<subparagraph id="idc57b9a824459408b9702d1ce457f1d2c"><enum>(C)</enum><text>notice about whether the covered platform, including any algorithmic recommendation systems used by the platform, pose any heightened risks of harm to a minor, including harms described in section 3(b).</text></subparagraph></paragraph> <paragraph id="ide5a74d3d25e84c8c995dcd8d778e44f5"><enum>(2)</enum><header>Parental notification</header><text>For a minor, or an individual that a covered platform reasonably believes is a minor, a covered platform shall additionally provide the notice, information, and statement described in paragraph (1) to a parent of the minor.</text></paragraph> 
<paragraph id="idecccd407d651457c84680e39c713a0b2"><enum>(3)</enum><header>Acknowledgment</header><text>After providing the notice, information, and statement described in paragraph (1), but prior to initial use of the covered platform, the covered platform shall obtain acknowledgment from a minor, or a parent of the minor, of the receipt of information related to the heightened risks of harm to minors referenced in the statement in paragraph (1)(C).</text></paragraph></subsection> <subsection id="idead68b8a36d641d0a963295b5806162e"><enum>(b)</enum><header>Algorithmic recommendation system</header><text>A covered platform that uses an algorithmic recommendation system shall set out in its terms and conditions, in a clear, accessible, and easy-to-understand manner—</text> 
<paragraph id="id607bc8f3d5124995a7c248c1c601ebf1"><enum>(1)</enum><text>an overview of how algorithmic recommendation systems are used by the covered platform to provide information to users of the platform who are minors, including how such systems use personal data belonging to minors; and</text></paragraph> <paragraph id="idba927ec6d3634d9085239fadff0058a5"><enum>(2)</enum><text>options for minors or their parents to modify the results of the algorithmic recommendation system, including the right to opt out or down-rank types or categories of recommendations.</text></paragraph></subsection> 
<subsection id="idb2bcacdd3290439a9c8fc2fa07507af7"><enum>(c)</enum><header>Advertising and marketing</header><text>A covered platform that facilitates advertising aimed at minors shall provide clear, accessible, and easy-to-understand information and labels regarding—</text> <paragraph id="id969d23d3e04a47d8a11cab2d836e0d49"><enum>(1)</enum><text>the name of the product, service, or brand and the subject matter of an advertisement or marketing material;</text></paragraph> 
<paragraph id="id1880ec2484154f39a0eb77a54b9deb09"><enum>(2)</enum><text>why the minor is being targeted for a particular advertisement or marketing material if the covered platform engages in targeted advertising, including meaningful information about how the personal data of the minor was used to target the advertisement or marketing material; and</text></paragraph> <paragraph id="id7c0873b1c4844efbad190a373eadeab5"><enum>(3)</enum><text>whether particular media displayed to a user is an advertisement or marketing material, including disclosure of endorsements of products, services, or brands made for commercial consideration by other users of the platform.</text></paragraph></subsection> 
<subsection id="id5526acb7ff2d4fe4a57fcb75ccff5f9a"><enum>(d)</enum><header>Resources for parents and minors</header><text>A covered platform shall provide to minors and parents clear, accessible, easy-to-understand, and comprehensive information in a prominent location regarding—</text> <paragraph id="idea19f80837b342a7b490948253d446c5"><enum>(1)</enum><text>its policies and practices with respect to personal data and safeguards for minors; and</text></paragraph> 
<paragraph id="id8490e8a0af8c4e03b2138afa9a6c4f4b"><enum>(2)</enum><text>how to access the safeguards and parental tools required under section 4.</text></paragraph></subsection></section> <section id="idb1f3b9f5f1244208bab92a89a552e658"><enum>6.</enum><header>Transparency</header> <subsection id="idc7c5b4e14df74539bb7c3d21d44d98cb"><enum>(a)</enum><header>Audit of systemic risks to minors</header> <paragraph id="idd5848fbbe22e4be1aea01fb3fb292c2b"><enum>(1)</enum><header>In general</header><text>Not less frequently than once a year, a covered platform shall issue a public report identifying the foreseeable risks of harm to minors based on an independent, third-party audit conducted through reasonable inspection of the covered platform and describe the prevention and mitigation measures taken to address such risks.</text></paragraph> 
<paragraph id="id24c2f49e66294f62b6376b2d2e5dd5ed"><enum>(2)</enum><header>Content</header> 
<subparagraph id="id300320BF3A5040259144A23FBB509755" commented="no"><enum>(A)</enum><header>Transparency</header><text>The public reports required of a covered platform under this section shall include—</text> <clause id="id2f3e6109d2594ab0ba32378f42b8219a"><enum>(i)</enum><text>an assessment of whether the covered platform is reasonably likely to be accessed by minors;</text></clause> 
<clause id="idcc24e31fc4cb44059f9e5013b2a956a7"><enum>(ii)</enum><text>a description of the commercial interests of the covered platform in use by minors;</text></clause> <clause id="id815e871ea47e4c67bce812c54c3443bb"><enum>(iii)</enum><text>an accounting of the number of individuals using the covered platform reasonably believed to be minors in the United States, disaggregated by the age ranges of 0–5, 6–9, 10–12, and 13–16;</text></clause> 
<clause id="id9f0878af1d5a49098609445fe5da2bfc"><enum>(iv)</enum><text>an accounting of the time spent by the median and average minor in the United States on a daily, weekly, and monthly basis, disaggregated by the age ranges of 0–5, 6–9, 10–12, and 13–16;</text></clause> <clause id="idf77018bb68cc4b39bf149dfa8bd00a00"><enum>(v)</enum><text>an accounting, disaggregated by category of harm, of—</text> 
<subclause id="idd03a04c2c32a4c46bdeae436f7cc4557"><enum>(I)</enum><text>the total number of reports of the dissemination of illegal or harmful content involving minors; and</text></subclause> <subclause id="id9368d5234f7e497ca6e0c5abb2080118"><enum>(II)</enum><text>the prevalence of content that is illegal or harmful to minors; and</text></subclause></clause> 
<clause id="id27bf5dd32e284642a0b535a0c2466cbb"><enum>(vi)</enum><text>a description of any material breaches of parental tools or assurances regarding minors, unexpected use of the personal data of minors, and other matters regarding non-compliance.</text></clause></subparagraph> <subparagraph id="id43d14a96bf2a46c2b32bab91b29ad086" commented="no"><enum>(B)</enum><header>Systemic risks assessment</header><text>The public reports required of a covered platform under this section shall include—</text> 
<clause id="id00B4B88DD18A403DB8E58F809EEA8105"><enum>(i)</enum><text>an audit of the known and emerging risks to minors posed by the covered platform, including the harms described in section 3(b);</text></clause> <clause id="id0c25ae36dcc045ff9e6826a349bcdfa4"><enum>(ii)</enum><text>an assessment of how algorithmic recommendation systems and targeted advertising systems can contribute to harms to minors;</text></clause> 
<clause id="idF7A5B5D553894689BCE2EA1C40AF192A"><enum>(iii)</enum><text>a description of whether and how the covered platform uses system design features to increase, sustain, or extend use of a product or service by a minor, such as automatic playing of media, rewards for time spent, and notifications;</text></clause> <clause id="idab6007d47afe48eaa8da46041da0201f"><enum>(iv)</enum><text>a description of whether, how, and for what purpose the platform collects or processes geolocation, contact information, health data, or other categories of personal data of heightened concern regarding minors, as determined by the Commission;</text></clause> 
<clause id="idac47f76ad3534b968e918f9f8397fb7c"><enum>(v)</enum><text>an evaluation of the efficacy and any issues in delivering safeguards to minors under section 4; and</text></clause> <clause id="id429e9185952348458c85f7c14f0e571e"><enum>(vi)</enum><text>an evaluation of any other relevant matters of public concern over risks to minors.</text></clause></subparagraph> 
<subparagraph id="id29dc426b4e604f3fb166be5ea929a4a3" commented="no"><enum>(C)</enum><header>Mitigation</header><text>The public reports required of a covered platform under this section shall include—</text> <clause id="id4237085bd9aa49a3813092ef398a1dff"><enum>(i)</enum><text>a description of the safeguards and parental tools available to minors and parents on the covered platform;</text></clause> 
<clause id="idb8d440587a854319bf3d3cc49c520776"><enum>(ii)</enum><text>a description of interventions by the covered platform when it had or has reason to believe that harm could occur to minors;</text></clause> <clause id="idf1469419637a4877b95a59b2ef155253"><enum>(iii)</enum><text>a description of the prevention and mitigation measures intended to be taken in response to the known and emerging risks identified in its audit of system risks, including steps taken to—</text> 
<subclause id="id15bddada55714eeba189937e1ed8265e"><enum>(I)</enum><text>adapt or remove system design features that expose minors to risks;</text></subclause> <subclause id="idaf9810b5e6b747cb80af0393356351ea"><enum>(II)</enum><text>set safeguards to their most safe settings by default;</text></subclause> 
<subclause id="idf3a7458b73c44380a02852fa2f28bf6f"><enum>(III)</enum><text>prevent the presence of illegal and illicit content on the covered platform; and</text></subclause> <subclause id="idcef76ae880314cefb80094eb783869f9"><enum>(IV)</enum><text>adapt algorithmic recommendation system to prioritize the best interests of users who are minors; </text></subclause></clause> 
<clause id="idbe762d275b2e470aa5620443a5314263"><enum>(iv)</enum><text>a description of internal processes for handling reports and automated detection mechanisms for harms to minors, including the rate, timeliness, and effectiveness of responses under the requirement of section 4(c);</text></clause> <clause id="ide4dcdd34a2d444958d2646682321de9d"><enum>(v)</enum><text>the status of implementing prevention and mitigation measures identified in prior assessments; and</text></clause> 
<clause id="id140ce18aefb74a459f901c11ea7a1657"><enum>(vi)</enum><text>a description of the additional measures to be taken by the covered platform to address the circumvention of safeguards and parental tools.</text></clause></subparagraph></paragraph> <paragraph id="ide0871f5d44664e46aa8cc8aa3d3f3ae3"><enum>(3)</enum><header>Reasonable inspection</header><text>In conducting an inspection of the systemic risks of harm to minors, a covered platform shall—</text> 
<subparagraph id="ideb9d17f5794f46efad9a71191f0eb052"><enum>(A)</enum><text>take into consideration the function of algorithmic recommendation systems;</text></subparagraph> <subparagraph id="id8d50a38579a0437ea032a5743534f526"><enum>(B)</enum><text>consult parents, experts, and civil society with respect to the prevention of harms to minors;</text></subparagraph> 
<subparagraph id="id65b30aec0fd7400392411f3e7ce80e82"><enum>(C)</enum><text>conduct research based on experiences of minors that use the covered platform, including harms reported under section 4(c);</text></subparagraph> <subparagraph id="id7e68cd175ecc49b8ae8b12bb5b6e9619"><enum>(D)</enum><text>take account of research, including research regarding system design features, marketing, or product integrity, industry best practices, or outside research; and</text></subparagraph> 
<subparagraph id="ideb9fee3ad3b84ced9ff069d78fad5095"><enum>(E)</enum><text>consider indicia or inferences of age of users, in addition to any self-declared information about the age of individuals.</text></subparagraph></paragraph> <paragraph id="id141df4dfef8644e9a2a90ce73d07541a"><enum>(4)</enum><header>Privacy safeguards</header><text>In issuing the public reports required under this section, a covered platform shall take steps to safeguard the privacy of its users, including ensuring that data is presented in a de-anonymized, aggregated format.</text></paragraph></subsection></section> 
<section id="id4d223a40f6784384a469680deee2d740"><enum>7.</enum><header>Independent research</header> 
<subsection id="id71a83d09101a4cf2a7deafb7ed93fa3a"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id70d2af340d154a9d8d1feb14a25bbe62"><enum>(1)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph> 
<paragraph id="id19BDF0F3C527435B8254D0A4AF732627"><enum>(2)</enum><header>Eligible researcher</header><text>The term <term>eligible researcher</term> means an individual or group of individuals affiliated with or employed by— </text> <subparagraph id="idE1668645669E43B0B8DF6DBCFAAB93AE"><enum>(A)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); or</text></subparagraph> 
<subparagraph id="idB3B94417103D43D8BB84198E98E28CD8"><enum>(B)</enum><text>a nonprofit organization, including any organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph> <paragraph id="idbd84c3b632d8489da71e8cb906609c89"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the program established under subsection (b)(1).</text></paragraph> 
<paragraph id="idB5B915C70C8C4884B939B6489E2B9F9F"><enum>(4)</enum><header>Public interest research</header><text>The term <term>public interest research</term> means the scientific or historical analysis of information that is performed for the primary purpose of advancing a broadly recognized public interest.</text></paragraph> <paragraph id="id8BB039CB884E493286F077034DFE5C53" commented="no"><enum>(5)</enum><header>Qualified researcher</header><text>The term <term>qualified researcher</term> means an eligible researcher who is approved by the Assistant Secretary to conduct public interest research regarding harms to minors under the Program.</text></paragraph></subsection> 
<subsection id="idebb6217806944b4e930d4151f9613c2f"><enum>(b)</enum><header>Access to data on harms to minors</header> 
<paragraph id="id5fba7b04a59d445697b5fc96a7f75f27"><enum>(1)</enum><header>Establishment</header><text>The Assistant Secretary shall establish a program under which an eligible researcher may apply for, and a covered platform shall provide, access to data assets from the covered platform for the sole purpose of conducting public interest research regarding harms to the safety and well-being of minors, including matters described in section 3(b).</text></paragraph> <paragraph id="id659AA498269C43119F3BA8640369E8FE"><enum>(2)</enum><header>Application requirements</header><text>In order to be approved to access data assets from a covered platform, an eligible researcher shall, in the application submitted under paragraph (1)—</text> 
<subparagraph id="id9bc265fc8a2b4f0faa367f8c2fe71b9f"><enum>(A)</enum><text>conduct the research for noncommercial purposes;</text></subparagraph> <subparagraph id="id645FA882147549A3A9866AE184BE0421"><enum>(B)</enum><text>demonstrate a proven record of expertise on the proposed research topic and related research methodologies; and</text></subparagraph> 
<subparagraph id="id5bba086ee9ca4439b72a5262001cd319"><enum>(C)</enum><text>commit to fulfill, and demonstrate a capacity to fulfill, the specific data security and confidentiality requirements corresponding to the application.</text></subparagraph></paragraph> <paragraph id="idb53c89729a254fa7846ec13f99aab131"><enum>(3)</enum><header>Duties and rights of covered platforms</header> <subparagraph id="idD153813C045547D3A87E199054C5229E"><enum>(A)</enum><header>Access to data assets</header> <clause id="idCB2FE7E67BD44E448C99E1D60A43C957"><enum>(i)</enum><header>In general</header><text>If the Assistant Secretary approves an application under paragraph (1) with respect to a covered platform, the covered platform shall, in a timely manner, provide the qualified researcher with access to data assets necessary to conduct public interest research described in that paragraph.</text></clause> 
<clause id="id6d55ac03a86e443fa0809c67b8714ccb"><enum>(ii)</enum><header>Form of access</header><text>A covered platform shall provide to a qualified researcher access to data assets under clause (i) through online databases, application programming interfaces, and data files as appropriate for the qualified researcher to undertake public interest research.</text></clause></subparagraph> <subparagraph id="id49dc9ea9d00b4b97a2f4189d1b34dc77"><enum>(B)</enum><header>Nondisclosure agreement</header><text>A covered platform may require, as a condition of access to the data assets of the covered platform, that a qualified researcher enter into a nondisclosure agreement regarding the release of data assets, provided that—</text> 
<clause id="id5F3D367389CF4C3B9113B48E5FDC1DAB"><enum>(i)</enum><text>the agreement does not restrict the publication of the qualified researcher's findings; and</text></clause> <clause id="idD81FDBB13ACE4C89AE7D16344FF7325C"><enum>(ii)</enum><text>the terms of the agreement allow the qualified researcher to provide the original agreement or a copy of the agreement to the Assistant Secretary.</text></clause></subparagraph> 
<subparagraph id="id1f9754e2167d418bab568f3f57241b19"><enum>(C)</enum><header>Appeal</header><text>A covered platform may appeal the granting of an application under paragraph (1) on the grounds that, and the Assistant Secretary shall grant such appeal if—</text> <clause id="id0B309C6245F64FD089BC72FDF67B6707"><enum>(i)</enum><text>the covered platform does not have access to the requested data assets; or</text></clause> 
<clause id="id508E8840D6DD4D08862473DB6ECEB92D"><enum>(ii)</enum><text>providing access to the data assets will lead to significant vulnerabilities in the security of the covered platform's service.</text></clause></subparagraph></paragraph> <paragraph id="id05511977ff154b02bb28dd5d8e91b53a"><enum>(4)</enum><header>Processes, procedures, and standards</header><text>Not later than 1 year after the date of enactment of this Act, the Assistant Secretary shall establish—</text> 
<subparagraph id="id3b6da550052647518fdc0821df64c687"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="id5288C76E1E8D44D3B63049F97CBE505E"><enum>(i)</enum><text>a process by which an eligible researcher may submit an application described in paragraph (1); and</text></clause> <clause id="id548FC6A721EE407C92FF9F4B4F2BE282" indent="up1"><enum>(ii)</enum><text>an appeals process for eligible researchers to appeal adverse decisions on applications described in paragraph (1) (including a decision to grant an appeal under paragraph (3)(C));</text></clause></subparagraph> 
<subparagraph id="id64480f69e89d4aa1be8dd4f75649e543"><enum>(B)</enum><text>procedures for implementation of the Program, including methods for—</text> <clause id="id614999389249405585F0E78181B92C90"><enum>(i)</enum><text>participation by covered platforms; and</text></clause> 
<clause id="idA3DE24987AA14875B66AE9FE7CD0DCBB"><enum>(ii)</enum><text>verification by the Assistant Secretary of the credentials of eligible researchers;</text></clause></subparagraph> <subparagraph id="id3efd6dd6131e4b7cbf6feb005ac437ac"><enum>(C)</enum><text>standards for privacy, security, and confidentiality required to participate in the Program; and</text></subparagraph> 
<subparagraph id="id6761c72ab8b942faae8e404ae9d6e993"><enum>(D)</enum><text>standards for transparency regarding the operation and administration of the Program.</text></subparagraph></paragraph> <paragraph id="idfaec82395658425fb7c6d671745d4b78"><enum>(5)</enum><header>Duty of confidentiality</header><text>To protect user privacy, a qualified researcher shall have a duty of confidentiality with respect to data assets provided by a covered platform, which may be defined by the Assistant Secretary.</text></paragraph> 
<paragraph id="id66F7FC167C7F411682721C44471B55A7"><enum>(6)</enum><header>Federal agencies</header><text>Nothing in this subsection shall be construed to authorize a Federal agency to seek access to the data of a covered platform through the Program.</text></paragraph></subsection> <subsection id="id813ec29872f84e2a8d51761e7807a13d"><enum>(c)</enum><header>Safe harbor for independent collection</header><text>With respect to public interest research conducted regarding harms to minors, including matters described in section 3(b), no cause of action related to terms of service violations undertaken while collecting data assets in the course of such research shall lie or be maintained in any court against the researcher conducting the research.</text></subsection> 
<subsection id="id9bdae9472bf741de8334fb4d13b44fc7"><enum>(d)</enum><header>Rulemaking</header><text>The Assistant Secretary, in consultation with the Secretary of Commerce and the Director of the National Institute of Standards and Technology, shall promulgate rules in accordance with section 553 of title 5, United States Code, as necessary to implement this section. </text></subsection></section> <section id="ida1c37723720e4b3eb6ce7f0592a915f3"><enum>8.</enum><header>Market research</header> <subsection id="id41b84ecc22164961a6a1c32fef205b8b"><enum>(a)</enum><header>Market research by covered platforms</header><text>The Federal Trade Commission, in coordination with the Secretary of Commerce, shall establish guidelines for covered platforms seeking to conduct market- and product-focused research on minors or individuals it reasonably believes to be minors. Such guidelines shall include—</text> 
<paragraph id="iddd681245869443289423a0a3c1ac9bd7"><enum>(1)</enum><text>a standard consent form that provides minors and their parents a clear and easy-to-understand explanation of the scope and purpose of the research to be conducted, and provides an opportunity for informed consent; and</text></paragraph> <paragraph id="idf019bef931be457d8973307246a1c756"><enum>(2)</enum><text>recommendations for research practices for studies that may include minors, disaggregated by the age ranges of 0–5, 6–9, 10–12, 13–15, and 16–17.</text></paragraph></subsection> 
<subsection id="id609d40c7f65443b8914a1385ea126a31"><enum>(b)</enum><header>Guidelines</header><text>The Federal Trade Commission shall promulgate such guidelines not later than 18 months after the date of enactment of this Act. In doing so, they shall seek input from members of the public and the representatives of the Kids Online Safety Council established under section 11.</text></subsection></section> <section id="iddb5f9dbd2d9c4493a38e76d2be4d8927"><enum>9.</enum><header>Age verification study and report</header> <subsection id="ide60d0f075032479e9243a038aec0de30"><enum>(a)</enum><header>Study</header><text>The Director of the National Institute of Standards and Technology, in coordination with the Federal Communications Commission, Federal Trade Commission, and the Secretary of Commerce, shall conduct a study evaluating the most technologically feasible options for developing systems to verify age at the device or operating system level.</text></subsection> 
<subsection id="id0317e51a5ce148ef9e0b84f59e9c7dbc"><enum>(b)</enum><header>Contents</header><text>Such study shall consider—</text> <paragraph id="idd15060577ef444358a17c9c6d1549f77"><enum>(1)</enum><text>the benefits of creating a device or operating system level age verification system;</text></paragraph> 
<paragraph id="idfa7dc9cfb0fa4367bdd0a3232f1afb16"><enum>(2)</enum><text>what information may need to be collected to create this type of age verification system;</text></paragraph> <paragraph id="id5057a928989b4fa8ba46fbd7f94b8f9b"><enum>(3)</enum><text>the accuracy of such systems and their impact or steps to improve accessibility, including for individuals with disabilities;</text></paragraph> 
<paragraph id="id7768a189c3e14b7494a01cfe29ae34e4"><enum>(4)</enum><text>how such a system or systems could verify age while mitigating risks to user privacy and data security and safeguarding minors' personal data; and</text></paragraph> <paragraph id="idE83DA9F2F3BF4D32B60F46B60BA4DAE4"><enum>(5)</enum><text>the technical feasibility, including the need for potential hardware and software changes, including for devices currently in commerce and owned by consumers.</text></paragraph></subsection> 
<subsection id="id38f75e061e8b44dcbd29032382727587"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the agencies described in subsection (a) shall submit a report containing the results of the study conducted under such subsection to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives.</text></subsection></section> <section id="idf5606252c6bf41e698b8bdaf587b68a8"><enum>10.</enum><header>Enforcement</header> <subsection id="id2f03791bd66a4669a331a77c88605d72"><enum>(a)</enum><header>Enforcement by Federal Trade Commission</header> <paragraph id="HA4D465F7462643D3B36E079337200DC7"><enum>(1)</enum><header>Unfair and deceptive acts or practices</header><text>A violation of this Act or a regulation promulgated under this Act by any person shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph> 
<paragraph id="H5F9A968141034E7CAFC0EEAB497350D2"><enum>(2)</enum><header>Powers of the Commission</header> 
<subparagraph id="H74F4E04C73AB4B9FAD4806B4FE6FF21D"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B) and subsection (b), the Federal Trade Commission (referred to in this section as the <term>Commission</term>) shall enforce this Act and any regulation promulgated under this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph> <subparagraph id="idb87bc6cb5ff54c6fa3a20e74b8ceb4db" commented="no"><enum>(B)</enum><header>Application to common carriers and nonprofit organizations</header><text>Notwithstanding section 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act and the regulations promulgated under this Act, in the manner provided under this subsection, with respect to—</text> 
<clause id="id23e881f914c145449f6216f031d8a1e2" commented="no"><enum>(i)</enum><text>common carriers subject to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) and all Acts amendatory thereof and supplementary thereto; and</text></clause> <clause id="ide7f8c7c5dcad40c0b8089e199754abf9" commented="no"><enum>(ii)</enum><text>organizations not organized to carry on business for their own profit or that of their members. </text></clause></subparagraph> 
<subparagraph id="HA3C7C193D41149E3BD4ACE407801DC31"><enum>(C)</enum><header>Privileges and immunities</header><text>Any person that violates this Act or a regulation promulgated under this Act shall be subject to the penalties, and entitled to the privileges and immunities, provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph id="H52884B74A9474F76BE593825C34C3BE6" commented="no"><enum>(3)</enum><header>Regulations</header><text>The Commission may promulgate regulations under section 553 of title 5, United States Code, to carry out sections 4, 5, and 6 of this Act.</text></paragraph> 
<paragraph id="H647C3F149C4043E79A1CE92360091BC8"><enum>(4)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></paragraph></subsection> <subsection id="idc345dd61f8fe4fd7b465cf77ee9168df"><enum>(b)</enum><header>Enforcement by State attorneys general</header> <paragraph id="id34d876b36fff4f9c9f43a7843a99e6f5"><enum>(1)</enum><header>In general</header> <subparagraph id="id5e9008986d2b4adf9d0e59baed4fc2ed"><enum>(A)</enum><header>Civil actions</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of that State has been or is threatened or adversely affected by the engagement of any person in a practice that violates this Act or a regulation promulgated under this Act, the State, as parens patriae, may bring a civil action on behalf of the residents of the State in a district court of the United States or a State court of appropriate jurisdiction to—</text> 
<clause id="id48214d76342c41bdb0f9bdfbdd831180"><enum>(i)</enum><text>enjoin that practice;</text></clause> <clause id="id57ffc75f910f4c4383aa84c4b8f2cc33"><enum>(ii)</enum><text>enforce compliance with this Act or such regulation;</text></clause> 
<clause id="id7f220665ee7d425f9da49618f381c461"><enum>(iii)</enum><text>on behalf of residents of the State, obtain damages, statutory damages, restitution, or other compensation, each of which shall be distributed in accordance with State law; or</text></clause> <clause id="id734ea4228bcc477183a4660bd795b9a8"><enum>(iv)</enum><text>obtain such other relief as the court may consider to be appropriate.</text></clause></subparagraph> 
<subparagraph id="id4c635cc521dd4e90b369e83697d9d98a"><enum>(B)</enum><header>Notice</header> 
<clause id="id40e036010e8743858a2805c11a32babd"><enum>(i)</enum><header>In general</header><text>Before filing an action under subparagraph (A), the attorney general of the State involved shall provide to the Commission—</text> <subclause id="id0b01ae0873084ff9a042720b66681521"><enum>(I)</enum><text>written notice of that action; and</text></subclause> 
<subclause id="id1bee520d014947dda9ef3523273d50f3"><enum>(II)</enum><text>a copy of the complaint for that action.</text></subclause></clause> <clause id="id74a9dcbcb8304a2eb60c03d220753ab3"><enum>(ii)</enum><header>Exemption</header> <subclause id="idade5aa89bacd49ebbe73d34c067f2071"><enum>(I)</enum><header>In general</header><text>Clause (i) shall not apply with respect to the filing of an action by an attorney general of a State under this paragraph if the attorney general of the State determines that it is not feasible to provide the notice described in that clause before the filing of the action.</text></subclause> 
<subclause id="idba8113df25a245cb8b061da6c095fdce"><enum>(II)</enum><header>Notification</header><text>In an action described in subclause (I), the attorney general of a State shall provide notice and a copy of the complaint to the Commission at the same time as the attorney general files the action.</text></subclause></clause></subparagraph></paragraph> <paragraph id="id406019baae7f465abff298c3365a36c4"><enum>(2)</enum><header>Intervention</header> <subparagraph id="id4c34bef7988c4f0988c9a0e7f190f727"><enum>(A)</enum><header>In general</header><text>On receiving notice under paragraph (1)(B), the Commission shall have the right to intervene in the action that is the subject of the notice.</text></subparagraph> 
<subparagraph id="idfabad1c87ffe434cb3048690343d5c3b"><enum>(B)</enum><header>Effect of intervention</header><text>If the Commission intervenes in an action under paragraph (1), it shall have the right—</text> <clause id="idf6935b1dadaa4967882510061d0b187f"><enum>(i)</enum><text>to be heard with respect to any matter that arises in that action; and</text></clause> 
<clause id="id858d0e146c374b608cc1be276dad8c77"><enum>(ii)</enum><text>to file a petition for appeal.</text></clause></subparagraph></paragraph> <paragraph id="ideb187ac6d2154361a37afd561eb6efb5"><enum>(3)</enum><header>Construction</header><text>For purposes of bringing any civil action under paragraph (1), nothing in this Act shall be construed to prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of that State to—</text> 
<subparagraph id="id6ec5e71d40fd4d1bab71f0a8b13645be"><enum>(A)</enum><text>conduct investigations;</text></subparagraph> <subparagraph id="idb8756a9667754ee9bd4978d5320f269c"><enum>(B)</enum><text>administer oaths or affirmations; or</text></subparagraph> 
<subparagraph id="id9aa94384eb86436db265cd8f3955d2b7"><enum>(C)</enum><text>compel the attendance of witnesses or the production of documentary and other evidence.</text></subparagraph></paragraph> <paragraph id="id8e8bf84b7ada4e538b09150c8d078807"><enum>(4)</enum><header>Actions by the commission</header><text>In any case in which an action is instituted by or on behalf of the Commission for violation of this Act or a regulation promulgated under this Act, no State may, during the pendency of that action, institute an action under paragraph (1) against any defendant named in the complaint in the action instituted by or on behalf of the Commission for that violation.</text></paragraph> 
<paragraph id="id01ffff2d070548e0835db2599e3f6245"><enum>(5)</enum><header>Venue; service of process</header> 
<subparagraph id="idb69c48805d1f41a1bbe258605f74717d"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in—</text> <clause id="iddd9948be89c14525940f7ffc26db5b9e"><enum>(i)</enum><text>the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause> 
<clause id="ide0d0aacb18af47208101f6a29a7ed093"><enum>(ii)</enum><text>a State court of competent jurisdiction.</text></clause></subparagraph> <subparagraph id="idffd2998a59dd4568a2661794945b38e6"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1) in a district court of the United States, process may be served wherever defendant—</text> 
<clause id="ida8ef8fb9a039471a94d29d63ed8347ca"><enum>(i)</enum><text>is an inhabitant; or</text></clause> <clause id="id5e2b34008b0841a68328ad2b395aa842"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="id5FFA801D8BD640D68E59E46A4BFED795"><enum>11.</enum><header>Kids Online Safety Council</header> 
<subsection id="id80291946986F42628CB3F9453A3A9CFA"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Commerce shall establish and convene the Kids Online Safety Council for the purpose of providing advice on the implementation of this Act.</text></subsection> <subsection id="idEB20F2A2836940DB984DCAEB3F5860CB"><enum>(b)</enum><header>Participation</header><text>The Kids Online Safety Council shall include participation from—</text> 
<paragraph id="idA7FD6CAAC54744EEA35AA362597587B8"><enum>(1)</enum><text>parents, academic experts, health professionals, and members of civil society with respect to the prevention of harms to minors;</text></paragraph> <paragraph id="id31A37D7228184229B326019203015936"><enum>(2)</enum><text>youth representation;</text></paragraph> 
<paragraph id="id1ADB1415573B4A11AE50A6F6C8F1C0FC"><enum>(3)</enum><text>representatives of covered platforms;</text></paragraph> <paragraph id="id58C4369B111E4EA283329125BC3F1B03"><enum>(4)</enum><text>representatives of the National Telecommunications and Information Administration, the National Institute of Standards and Technology, the Federal Trade Commission, and the Department of Justice; and</text></paragraph> 
<paragraph id="idC64E4333467F41F6A7C79B8D6DF1280F"><enum>(5)</enum><text>State attorneys general or their representatives. </text></paragraph></subsection></section> <section id="idb8ab9300caf141b6b787049a49c0dc75"><enum>12.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Federal Trade Commission such sums as may be necessary to carry out this Act.</text></section> 
<section id="id24ef125bc8c74d8c974b9fd3a2aa38c0"><enum>13.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided in this Act, this Act shall take effect on the date that is 18 months after the date of enactment of this Act.</text></section> <section id="ided6c7c7a5acc409ba9afcc655ab6441e"><enum>14.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or an amendment made by this Act, is determined to be unenforceable or invalid, the remaining provisions of this Act and the amendments made by this Act shall not be affected.</text></section>
